Executive Summary & Key Takeaways

Executive Summary: This notification from the Ministry of Labour and Employment amends the Second Schedule of the Factories Act of 1948. The amendment, effective December 22, 2015, introduces permissible activity concentration levels for radionuclides commonly found in metal recycling industries. It also mandates specific measurement and notification protocols related to radiation levels. Key Points / Main Content: * **Amendment to Factories Act, 1948:** * The Second Schedule of the Factories Act, 1948 is amended. * **Radionuclide Concentration Levels:** * Sets permissible activity concentration levels for radionuclides in metal recycling industries: * Cobalt-60 (Co60): 0.1 Bq/g * Cesium-137 (Cs137): 0.1 Bq/g * Americium-241 (Am241): 0.1 Bq/g * Iridium-192 (Ir192): 1.0 Bq/g * (Bq/g stands for Becquerel per gram, the SI unit of radioactivity). * **Measurement and Notification:** * Requires measurement of external radiation levels on metal scrap, semi-finished, and finished products, as well as background levels. * Mandates record-keeping of radiation level measurements. * Requires immediate notification to the Atomic Energy Regulatory Board (AERB) if radiation levels on the material exceed background levels by 20 micro Rad per hour. Impact Analysis: * **Metal Recycling Industries:** * Impact: Must adhere to the specified permissible activity concentration levels for radionuclides. * Action Required: Implement measurement protocols for radiation levels, maintain records, and notify AERB of any exceedances. * **Regulatory Bodies (e.g., AERB):** * Impact: Responsible for overseeing and enforcing the new regulations regarding radionuclide concentration levels and radiation levels. * Action Required: Be prepared to receive and act upon notifications of radiation level exceedances from metal recycling industries. * **Ministry of Labour and Employment:** * Impact: Responsible for ensuring the amendments to the Factories act are followed. * Action Required: Oversee the implementation and effectiveness of these amendments in ensuring worker safety and environmental protection.
