Short title and commencement. – (1) These rules may be called the Mental Healthcare (Central Mental Health Authority and Mental Health Review Boards) (Amendment) Rules, 2021. (2) They shall come to force on the date of their publication in the Official Gazette. 2. Note:- The Mental Healthcare (State Mental Health Authority) Rules, 2018 were published in the Gazette of India, Extraordinary, Part II, section 3, sub-section (i), dated the 29th May, 2018 vide notification number G.S.R.508(E), dated the 29th May, 2018. अजधसचू ना नई दिल्ली, 12 अगस्ट् त, 2021 सा.का.जन. 569(अ).—मानजसक स्ट्वास्ट््य िेखरेख अजधजनयम, 2017 (2017 का 10) की धारा 121 की उप-धारा (1) और उप-धारा (3) द्वारा प्रित्त िजियों का प्रयोग करके केंद्रीय सरकार मानजसक स्ट्वास्ट््य िेखरेख (मानजसक रुग् णता से ्रसस्ट् त ्‍ यजियों के अजधकार) जनयम, 2018 का संिोधन करने के जलए जनम्नजलजखत जनयम बनाती ह,ै अर्ाित:् - 1. सजं िप्त नाम और प्रारंभ - (1) इन जनयमों का संजिप् त नाम मानजसक स्ट्वास्ट््य िेखरेख (मानजसक रुग्ण ता से ्रसस्ट्त ्‍ यजियों के अजधकार) (संिोधन) जनयम, 2021 ह।ै (2) ये रािपत्र में उनके प्रकािन की तारीख को प्रवृत् त होंगे। 2. मानजसक स्ट्वास्ट््य िेखरेख (मानजसक रुग् णता से ्रसस्ट् त ्‍ यजियों के अजधकार) जनयम, 2018 म,ें जनयम 5 के उप-जनयम (2) को जनम्नवत ् रूप से प्रजतस्ट्र्ाजपत दकया िा सकेगा,- "(2) मुख्य जचदकत्सा अजधकारी, उप जनयम (1) म ें जनर्िष्टि व्यजि से उपचार के खच ि की प्रजतपूर्त ि सबं ंधी आवेिन के प्राप्त होन े पर, आवेिन की िाचं करेगा और िहा ं कहीं प्रजतपर्ू ति का िावा स्ट्वीकायि पाया िाता ह ै वहां मुख्य जचदकत्सा अजधकारी आवेिन की प्राजप्त के तीस दिन के भीतर उपचार की ऐसे खचि की प्रजतपर्ू ति के जलए उस राज्य सरकार के स्ट्वास्ट््य सेवा जनिेिालय के भारसाधक अजधकारी को एक आिेि िारी करेगा। स्ट्वास्ट््य सेवा जनिेिालय का भारसाधक अजधकारी आिेि के िारी होन े की तारीख से पैंतालीस दिन के भीतर ऐसे खच ि की प्रजतपूर्ति को सुजनजित करेगा। परन् त ु प्रजतपूर्त िके खच िको समय- समय पर केंद्रीय सरकार द्वारा जवजनर्िष्टि िरों तक सीजमत रखा िाएगा।“ 3. मानजसक स्ट्वास्ट््य िेखरेख (मानजसक रुग् णता स े ्रसस्ट् त ्‍ यजियों के अजधकार) जनयम, 2018 म,ें जनयम 6 के उप-जनयम (3) को जनम्नवत ् रूप से प्रजतस्ट्र्ाजपत दकया िाएगा,-6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] "(3) उप-जनयम (2) के अधीन अनरु ोध की प्राजप्त की तारीख से पद्रं ह दिनों के भीतर आवेिक को भत रोगी का मूल जचदकत्सा अजभलेख प्रारूप-ख प्रिान दकया िाएगा। यदि आवेिक को भत रोगी का मूल जचदकत्सा अजभलेख जनधािररत समय- सीमा के भीतर उपलब्ध नही कराया िाता ह ै तो आवेिक इस प्रकार की सूचना िारी करन े के आिेि के जलए सबं ंजधत बोडि से संपकि कर सकता ह।ै “ [फा. सं. वी-15016/115/2020-पीएच-I] रेखा िुक्ला, संयुि सजचव रटप्पण: मानजसक स्ट्वास्ट््य िेखरेख (मानजसक रुग्ण ता स े ्रसस्ट् त ्‍ यजियों के अजधकार) जनयम, 2018 को तारीख 29 मई 2018 की अजधसूचना संख्या सा.का.जन. 509 (अ) के द्वारा तारीख 29 मई 2018 के भारत के रािपत्र, असाधारण, भाग 2, खंड 3, उप-खंड (i) में प्रकाजित दकया गया र्ा। NOTIFICATION New Delhi, the 12th August, 2021 G.S.R. 569(E).—In exercise of the powers conferred by sub-sections (1) and (3) of section 121 of the Mental Healthcare Act, 2017 (10 of 2017), the Central Government hereby makes the following rules to amend the Mental Healthcare (Rights of Persons with Mental Illness) Rules, 2018, namely:- 1. Short title and commencement. – (1) These rules may be called the Mental Healthcare (Rights of Persons with Mental Illness) (Amendment) Rules, 2021. (2) They shall come to force on the date of their publication in the Official Gazette. 2. In the Mental Healthcare (Rights of Persons with Mental Illness) Rules, 2018, sub-rule (2) of rule 5 shall be substituted as under, - “(2). The Chief Medical Officer, on receipt of the application for reimbursement of the costs of treatment from the person referred to in sub-rule (1), shall examine the application, and wherever the claim of reimbursement is found admissible, the Chief Medical Officer shall within thirty days of receipt of the application, issue an order to the officer in-charge of the Directorate of Health Services of that State Government for reimbursement of such costs of treatment. The officer in-charge of the Directorate of Health Services shall ensure reimbursement of such costs within forty five days from the date of issue of order. Provided that the cost of reimbursement shall be limited to the rates specified by the Central Government from time to time.”. 3. In the Mental Healthcare (Rights of Persons with Mental Illness) Rules, 2018, sub-rule (3) of rule 6 shall be substituted as under, - “(3). Within fifteen days from the date of receipt of the request under sub-rule (2), basic inpatient medical records shall be provided to the applicant in Form-B. If the basic inpatient medical records are not provided to the applicant in the prescribed time limit, the applicant may approach the concerned Board for an order to release such information.”. [F.
