## Report on the Drugs (3rd Amendment) Rules, 2022
**1. Executive Summary:**
This report analyzes the Drugs (3rd Amendment) Rules, 2022, as published in the Gazette of India on February 24, 2022. This amendment to the Drugs Rules, 1945, introduces a new permitted Coal Tar Colour – Allura Red – for use in drugs. The core purpose is to update and expand the list of approved colorants, likely to ensure product safety and quality while potentially providing manufacturers with more formulation options. The key finding is the addition of Allura Red, including its Colour Index Number and Chemical Name, to the list of approved Coal Tar Colours.
**2. Introduction:**
This report aims to provide a comprehensive overview of the Drugs (3rd Amendment) Rules, 2022, based solely on the information presented in the provided policy text. The report will outline the amendment's purpose, key provisions, affected stakeholders, and likely impact, providing insights for affected industry.
**3. Policy Overview:**
* **Original Policy:** Drugs Rules, 1945
* **Core Objective(s):** Based on the text, the core objective of this *amendment* is to update the list of permitted Coal Tar Colours used in drugs. The broader objective of the original Drugs Rules, inferred from this amendment, is likely to regulate the composition, manufacturing, and safety of drugs.
**4. Background and Rationale:**
This is an amendment to the Drugs Rules, 1945. The likely reason for this specific amendment is to update the regulations pertaining to permitted colorants in drugs. This might be driven by factors such as:
* Industry requests for new or alternative colorants.
* New scientific data on the safety and efficacy of existing or new colorants.
* Harmonization with international standards for drug manufacturing.
The addition of Allura Red suggests a need to expand the options available to drug manufacturers for coloring their products, potentially improving product appeal, identification, or patient adherence, while also adhering to safety standards.
**5. Key Provisions / Changes:**
This amendment specifically alters Rule 127 of the Drugs Rules, 1945, which deals with Coal Tar Colours.
* **Specific Part of Original Policy Changed:** Rule 127, subrule 1, under the heading relating to Coal Tar Colours.
* **New Rule/Provision:** The amendment inserts the following entry *after* the entry "Carmoisine" and *before* the entry "BLUE Indigo Carmine":
| Common Name of Colour | Index Number | Chemical Name |
| :---------------------- | :------------- | :-------------------------------------------------------------------------------------------------------------------------------------------- |
| Allura Red | 16035 | Disodium 6-hydroxy-5-[(2-methoxy-5-methyl-4- sulfophenyl)azo]-2-Naphthalenesulfonic acid |
* **Difference/Effect of the Change:** This change adds Allura Red to the list of approved Coal Tar Colours that can be used in the manufacturing of drugs within India. This expands the palette of available colorants for pharmaceutical companies.
**6. Target Audience and Stakeholders:**
The primary target audience and stakeholders are:
* **Pharmaceutical manufacturers:** Companies involved in the production of drugs that utilize Coal Tar Colours. They can now use Allura Red in their formulations.
* **Drug regulatory agencies:** The Central Government (Ministry of Health and Family Welfare), specifically the Department of Health and Family Welfare, which is responsible for enforcing the Drugs Rules, 1945.
* **Consumers:** Indirectly affected, as the amendment ensures the safety and quality of drugs by regulating the colorants used.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Central Government, specifically the Ministry of Health and Family Welfare, is responsible for implementing and enforcing the amended rule. The Drugs Technical Advisory Board was consulted in the process.
* **Timelines/Procedures:** The amendment comes into force on the date of its publication in the Official Gazette (February 24, 2022). Pharmaceutical manufacturers can immediately begin incorporating Allura Red into their drug formulations, subject to compliance with other relevant regulations.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcome of this amendment is to:
* **Provide manufacturers with more colorant options:** This allows for greater flexibility in drug formulation and presentation.
* **Potentially enhance product differentiation:** Allura Red may offer a specific shade or characteristic that was previously unavailable, allowing manufacturers to distinguish their products.
* **Maintain drug safety standards:** The amendment implies that Allura Red has been assessed and deemed safe for use in drugs under the prescribed conditions.
**9. Conclusion:**
The Drugs (3rd Amendment) Rules, 2022, represent a targeted update to the Drugs Rules, 1945, by adding Allura Red to the list of approved Coal Tar Colours. This change broadens the range of permitted colorants available to the pharmaceutical industry, potentially impacting product development and consumer appeal while adhering to established safety guidelines. The amendment highlights the ongoing efforts to maintain and refine drug regulations in India.
