L.-33004/99 xxxGIDHxxx सी.जी.-डी.एल.-अ.-01062023-246216 xxxGIDExxx CG-DL-E-01062023-246216 असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 332] नई किल्ली, बृहस्ट्प जतवार, िनू 1, 2023/ज्य ष्े ठ 11, 1945 No. 332] NEW DELHI, THURSDAY, JUNE 1, 2023/JYAISHTHA 11, 1945 कृजि एव ंककसान कल्याण मत्रं ालय (कृजि एवं ककसान कल्याण जवभाग) अजधसचू ना नई किल्ली, 31 मई, 2023 सा.का.जन. 406(अ).—केन्द्रीय सरकार कीटनािी अजधजनयम, 1968 (1968 का 46) की धारा 36 द्वारा प्रित्त िजियों का प्रयोग करते हुए कीटनािी जनयम, 1971 का और संिोधन करन े के जलए जनम्नजलजखत प्रारूप जनयम का प्रस्ट्ताव करती ह,ै उि धारा की अपेक्षानुसार उन सभी व्यजियों जिनकी उससे प्रभाजवत होने की संभावना है, की िानकारी के जलए प्रकाजित ककए िाते ह ैं और सूचना िी िाती ह ै कक उि प्रारूप जनयमों पर उस तारीख से, जिसको भारत के रािपत्र में यथाप्रकाजित, इस अजधसूचना की प्रजतयां िनता को उपलब्ध करा िी िाती ह,ै तीस किनों की समाजि के पश्चात् जवचार ककया िाएगा ; ऐसे आक्षेपों और सुझावों पर, िो तीस किनों की पूवोि अवजध के समाि होने स े पहले उि प्रारूप जनयमों के संबंध म,ें ककसी व्यजि से प्राि हो सकेंग,े केन्द्रीय सरकार द्वारा जवचार ककया िाएगा ; उि प्रारूप जनयमों के संबंध में आक्षेपों और सुझावों को संयुि सजचव (वनस्ट्पजत संरक्षण) कृजि और ककसान कल्याण मंत्रालय, कृजि और ककसान कल्याण जवभाग, कृजि भवन, नई किल्ली-110001 अथवा jspp-dac@gov.in पर ईमेल के माध्यम से भेिे िा सकत े ह।ैं 3472 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] प्रारूप जनयम 1. सजं क्षि नाम और प्रारंभ:- (i) इन जनयमों का संजक्षि नाम कीटनािी (पााँचवा संिोधन) जनयम, 2023 ह।ै (ii) यह रािपत्र में इनके अंजतम प्रकािन की तारीख को प्रवृत्त होंगे। 2. कीटनािी जनयम, 1971 के जनयम 14 के उपजनयम (1) में पहले परंतुक के बाि जनम्नजलजखत प्रावधान िोडे िा िाएगं े । परन्द्त ु यह कक मौिूिा खुिरा जवक्रेता या डीलर की मृत्य ु के मामले म,ें मृतक खुिरा जवक्रेता या डीलर के पररवार के सिस्ट्य, अनुज्ञाप त्र की अवजध के िौरान, उत्तराजधकार कानूनों की प्रयोज्यता और संबंजधत अनुज्ञापन अजधकारी के समक्ष मृत खुिरा जवक्रेता या डीलर के मृत्यु प्रमाण पत्र को प्रस्ट्तुत करन े पर अनज्ञु ाप त्र को अपन े नाम पर स्ट्थानांतररत करने की अनुमजत के जलए आवेिन कर सकत े ह।ैं परन्द्त ु यह भी कक मृतक खुिरा जवक्रेता या डीलर के पररवार के सिस्ट्य िो जनधााररत योग्यता के जबना ह,ैं उन्द्ह ें अनज्ञु ाप त्र के हस्ट्तांतरण के जलए कीटनािक प्रबंधन म ें प्रमाण पत्र कोसा करना होगा। अनुज्ञापत्र अस्ट्थायी रूप से पररवार के सिस्ट्य को एक विा की अवजध के जलए या पररवार के सिस्ट्य द्वारा कीटनािक प्रबंधन म ें प्रमाण पत्र कोसा पूरा करने तक, िो भी पहल े हो, हस्ट्तांतररत ककया िा सकता ह।ै इस अवजध के िौरान आविे क जनधााररत िैजक्षक योग्यता वाले व्यजि को जनयोजित कर सकता ह।ै [फा. सं. 13035/28/2014-पी.पी-I (खंड–vii)] आिीि कुमार श्रीवास्ट्तव, संयक्ु त सजचव (पीपी) रटप्प ण : मूल जनयम, भारत के रािपत्र असाधारण, भाग II, खंड 3, उपखंड (i) में सा.का.जन. सं. 1650(अ), तारीख 19 अक्त ूबर, 1971 द्वारा प्रकाजित ककए गए थ े और सा.का.जन. सं. 315(अ) किनांक 26 अप्रैल, 2023 द्वारा अंजतम बार संिोधन ककए गए। MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture and Farmers Welfare) NOTIFICATION New Delhi, the 31st May, 2023 G.S.R 406(E).—The following draft rules further to amend the Insecticides Rules, 1971, which the Central Government proposes to make in exercise of the powers conferred by section 36 of the Insecticides Act, 1968 (46 of 1968), is hereby published, as required by the said section, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Gazette of India are made available to the public; The Objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period of thirty days will be considered by the Central Government; Objections and suggestions in respect to the said draft rules may be forwarded to the Joint Secretary (Plant Protection), Ministry of Agriculture and Farmers Welfare, Department of Agriculture and Farmers Welfare, Krishi Bhawan, New Delhi-110 001 or through email at jspp-dac@gov.in. DRAFT RULES 1. Short title and commencement.—(i) These rules may be called the Insecticides (Fifth Amendment) Rules, 2023. (ii) They shall come into force on the date of their final publication in the Official Gazette. 2. In the Insecticides Rules, 1971, in rule 14, sub rule(1), after the first proviso, following provision may be inserted: Provided that in case of death of the existing retailer or dealer, the family member of the deceased retailer or dealer, during the currency of the license, may apply for permission to transfer the license in his name subject to the[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 applicability of succession laws and submission of the death certificate of the deceased dealer or retailer before the concerned licensing officer. Provided also that the family member of the deceased retailer or dealer who is without the prescribed qualification shall undergo the certificate course in insecticides management for transfer of license. The license can be provisionally transferred to the family member for a period of one year or till the family member completes the certificate course in insecticides management, whichever is earlier.
