अत: अब, केंद्रीय सरकार, कीटनािक अजधजनयम, 1968 (1968 का 46) की धारा 36 द्वारा प्रित्त िजियों का
प्रयोग करते हुए, कीटनािक जनयम, 1971 का और संिोधन करने के जलए जनम्नजलजखत जनयम बनाती ह,ै अथावत:्-

1. (1) इन जनयमों का संजक्षि नाम कीटनािी (संिोधन) जनयम, 2021 ह ै।
(2) ये रािपत्र म ेंउनके प्रकािन की तारीख को प्रिृत्त होंग े।
2. कीटनािी जनयम, 1971 (जिसे इसम ें इसके पश्चात ् उि जनयम कहा िाएगा) म,ें जनयम 10 के उपजनयम 1(क) के
पश्चात जनम्नजलजखत उप जनयम अंतःस्ट्थाजपत ककए िाएगं ,े अथातव ् :-
“(1ख) कोई व्यजि िो केिल घरेलू प्रयोिन के जलए सामान्यतः उपयोग ककए िाने िाल े कीटनािकों का जिक्रय या
जितरण करने के जलए जिक्रय, स्ट्टाक या प्रििवन करने के जलए अनुज्ञजि या जिद्यमान अनज्ञु जि के पुनर्िवलोकन ककए िाने के
जलए आिेिन करता ह ै और इस तरह रजिस्ट्रीकृत ह ै उन्ह ें उपजनयम (1क) म ें जिजनर्िष्टव जिजहत िैजक्षक अहतव ा की अपेक्षा स े
छूट िी िाएगी ।
(1ग) कोई व्यजि िो केिल घरेलू प्रयोिन के जलए सामान्यतः उपयोग ककए िाने िाले कीटनािकों का जिक्रय या
जितरण करन े के जलए जिक्रय, स्ट्टाक या प्रििवन करन े के जलए अनुज्ञजि के पुनर्िवलोकन ककए िाने के जलए आिेिन करता ह ै
और इस तरह रजिस्ट्रीकृत ह,ै यकि अनज्ञु जि अजधकारी न े उसके आिेिन के प्रस्ट्तुत करन े की तारीख स े नब्बे किनों की अिजध
की समाजि के पश्चात ् उस े अनज्ञु जि अनुित्त नहीं की ह ैतब अनज्ञु जि िी गई समझी िाएगी” ।
3. उि जनयमों के जनयम 10 क के खंड (क) म ें “प्ररुप 3” िब्ि और अंक के पश्चात ् “या तो भौजतक प्ररुप या अंकीय प्ररुप” म ें
िब्ि अंतःस्ट्थाजपत ककए िाएंगे ;
4. उि जनयमों के जनयम 15 में,-
(क) उपजनयम (2) में, “रजिस्ट्रर” िब्ि के पश्चात ् “या तो भौजतक प्ररुप या अंकीय प्ररुप म”ें िब्ि अतं ःस्ट्थाजपत
ककए िाएंगे ;
(ख) उपजनयम (3) में, “रजिस्ट्रर” िब्ि के पश्चात ् “या तो भौजतक प्ररुप या अंकीय प्ररुप म”ें िब्ि अतं ःस्ट्थाजपत
ककए िाएंगे ;
(ग) उपजनयम (4) में, “रजिस्ट्रर” िब्ि के पश्चात ् “या तो भौजतक प्ररुप या अंकीय प्ररुप म”ें िब्ि अतं ःस्ट्थाजपत
ककए िाएंगे।

NOTIFICATION
New Delhi, the 3rd September, 2021
G.S.R. 620(E) —Whereas the draft rules further to amend the Insecticides Rules, 1971, was published, as
required by section 36 of the Insecticides Act, 1968 (46 of 1968) vide notification of the Government of India in the
Ministry of Agriculture and Farmers Welfare (Department of Agriculture, Co-operation and Farmers Welfare) number
G.S.R. 484 (E), dated the 9th July, 2021, in the Gazette of India, Extraordinary, Part-II, Section-3, Sub-section (i),
inviting objections or suggestions from all persons likely to be affected thereby, before the expiry of a period of
fifteen days from the date on which the copies of the Gazette of India in which the said notification was published
were made available to the public;
And whereas, copies of the said notification were made available to the public on 9th July, 2021;
And whereas, no objections or suggestions received from the public on the said draft rules;
Now, therefore, in exercise of the powers conferred by section 36 of the Insecticides Act, 1968 (46 of 1968),
the Central Government hereby makes the following rules further to amend the Insecticides Rules, 1971, namely:-
1. (1) These rule may be called the Insecticides (Amendment) Rules, 2021.
(2) They shall come into force on the date of their publication in the Official Gazette.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
2. In the Insecticides Rules, 1971 (hereinafter referred to as the said rules), in rule 10, after sub-rule (1A), the
following Sub-rules shall be inserted, namely:-
“ (1B) A person who applies for the grant of licence or renewal of existing licencee to sell, stock or exhibit
for sale or distribute insecticides commonly used for household purpose only and registered as such, shall be
exempted from the requirement of educational qualification specified in sub-rule (1A).
(1C) A person who applies for the grant of licence to sell, stock or exhibit for sale or distribute insecticides
commonly used for household purpose only and registered as such shall be deemed to have granted a licence if the
licensing officer did not grant him licence after expiry of a period of ninety days from the date of submission of his
application”.
3. In rule 10A of the said rules, in clause (a), after the word and figure “Form III”, the words “either in physical form
or digital form” shall be inserted.
4. In rule 15 of the said rules, -
(a) in sub-rule (2), after the word “register”, the words “either in physical form or digital form” shall be
inserted;
(b) in sub-rule (3), after the word “register”, the words “either in physical form or digital form” shall be
inserted;
(c) in sub-rule (4), after the word “register”, the words “either in physical form or digital form” shall be
inserted.
5. In rule 37 of the said rules, in sub rule (1), after the word “register”, the words “either in physical form or digital
form” shall be inserted.
