(1) इन जनयमों का नाम कीटनािी (चौथा संिोधन) जनयम, 2024 ह।ै (2) यह रािपत्र में इनके अंजतम प्रकािन की तारीख को प्रवत्तृ होंगे। 2. कीटनािी जनयम, 1971 (जिसे इसके पश्चात उि जनयम कहा गया ह)ै के जनयम 10 म:ें- (1) उप-जनयम (1ख) म,ें “या वतवमान लाइसेंस का नवीकरण” िब्ि को हटा किया िाएगा। (2) उप-जनयम (1ग) म,ें "नब्बे" िब्ि के स्ट्थान पर "तीस" िब्ि प्रजतस्ट्थाजपत ककया िाएगा। (3) उप-जनयम 4 के खडं (iii) म ेंजनम्नजलजखत परंतुक अंतःस्ट्थाजपत ककया िाएगा, अथावत:् - "परन्द्तु यह कक जतलचट्टे, मच्छर, घरेल ू मक्खी और खटमलों के जनयंत्रण के जलए घरेल ू उपयोग म ें सामान्द्यतः उपयोग ककए िान े वाले कीटनािकों को बेचने, भडं ारण करने या जबक्री के जलए प्रिर्ितव करन े के जलए लाइसेंस म ें ककसी अजतररि कीटनािक के जलए इस प्रकार के अनुमोिन की आवश्यकता नहीं ह।ै " (4) उपजनयम (4 क) में खडं (iv) के पश्चात जनम्नजलजखत खडं अंतःस्ट्थाजपत ककया िाएगा, अथावत:् - “(v) मुख्य प्रमाणपत्र िोकक खंड (i) स े (iv) में उजल्लजखत ह,ै केवल जतलचट्टे, मच्छरों, घरेलू मजक्खयों और खटमलों के जनयंत्रण के जलए घरेलू प्रयोिन हते ु सामान्द्यतः उपयोग ककए िाने वाले कीटनािकों की जबक्री, भंडारण या जबक्री के जलए प्रििवन हते ु लाइसेंस के जलए लाग ूनहीं ह ै ” 3. जनयम 18 के उपजनयम (1) में खंड (प) के पश्चात जनम्नजलजखत परंतुक अंतःस्ट्थाजपत ककया िाएगा, अथावत:् - परन्द्तु यह कक क्यआू र कोड को सामान्द्यतः घरेलू प्रयोिन (जतलचट्टे, मच्छर, मक्खी और खटमल के जनयंत्रण के जलए) में उपयोग ककए िान े वाल े कीटनािकों के खुिरा पैक (प्राथजमक या जद्वतीयक पैक, िैसा भी मामला हो) पर उपयिु स्ट्थान पर लगाया िा सकता ह,ै िहां मोबाइल फोन िैसे उपकरणों से क्यआू र कोड को स्ट्कैन करन े पर जवजनमावण कंपनी का एक वेब ललंक या यूआरएल खोलन े के जलए एक ललंक किखाई िगे ा, जिसे िबाने या जक्लक करन े पर उपयोगकताव को लेबल और पत्रक की पूरी जवजिष्ट िानकारी जमल िाएगी तथा क्यआू र कोड में जनयम 18 के उपजनयम (1) की समस्ट्त जविय-वस्ट्तु िाजमल होगी। 4. उि जनयमों म,ें "प्रथम अनुसचू ी" म ें"प्रपत्र II, केवल जतलचट्टे, मच्छरों, घरेलू मजक्खयों और खटमल के जनयंत्रण के जलए घरेलू प्रयोिन हते ु सामान्द्यतः उपयोग ककए िान े वाले कीटनािकों को बेचने, भडं ारण करने या जबक्री के जलए प्रििवन करने हते ु लाइसेंस प्रिान करन े के जलए आवेिन " को अतं ःस्ट्थाजपत ककया िाएगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 फॉम व II (4) केवल जतलचट्टे, मच्छर, घरेल ूमक्खी और खटमलों के जनयत्रं ण के जलए घरेल ूप्रयोिन म ेंउपयोग ककए िाने वाल े कीटनािकों को बचे न,े स्ट्टॉक करन ेया जबक्री के जलए प्रिर्ितव करन ेका लाइससें [जनयम 10 का उपजनयम (1) का संिभव ल]ें सेवा म ें लाइसेंलसंग प्राजधकरण, -------------------- -------------------- 1. आवेिक का नाम, पता और ईमेल: 2. उस पररसर का पूरा पता (जिसमें गली का नाम, जपन कोड आकि िाजमल ह)ै िहां यह कीटनािक ह।ै (क) भण्डाररत/स्ट्टॉक ककया गया ह:ै (ख) बेचा गया या जबक्री के जलए प्रिर्िवत ककया गया है: 3. लाइसेंस(ओं) का पूण व जववरण, यकि आवेिक के नाम पर ककसी अन्द्य राज्य द्वारा उनके अजधकार क्षेत्र म ेंिारी ककया गया हो: 4. आवेिक द्वारा भुगतान ककये गये आवेिन िुल्क का जववरण: 5. कोई अन्द्य प्रासंजगक िानकारी: आवेिक के हस्ट्ताक्षर एवं मुहर4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] घोिणा (िो लागू न हो उस ेकाट िें) (क) म ैं...............पुत्र/पुत्री सत्यजनष्ठा से सत्याजपत करता ह ूँकक आवेिन में िी गई िानकारी तथा इसके साथ संलग्न अनलु ग्नक और जववरण मेरे सवोत्तम ज्ञान और जवश्वास के अनुसार सही और पणू व ह ैंतथा इसम ेंकुछ भी जछपाया नहीं गया ह।ै म ैंस्ट्पष्ट रूप स ेसमझता ह ूँकक यकि कोई िानकारी या उसका कोई भाग ककसी भी स्ट्तर पर गलत, नकली या जमथ्या पाया िाता ह ैया लाइसेंस की ककसी ितव का उल्लघं न ककया िाता ह ैतो यह लाइसेंस रद्द ककया िा सकता ह।ै (ख) म ैंघोिणा करता ह ूँकक हमारे पास कीटनािकों के भण्डारण के जलए पयावि स्ट्थान और सुजवधाएं हैं, ताकक उनकी गुणवत्ता बनी रह।े (ग) म ैंयह भी घोिणा करता ह ूँकक मैं ककसी भी स्ट्टॉक को उसकी गुणवत्ता से संतष्टु हुए जबना अपन ेकब्िे म ेंनहीं लूंगा। (घ) मैं यह भी घोिणा करता ह ूँकक मैं यह आवेिन अपनी क्षमता से कर रहा ह ूँऔर म ैंयह आवेिन करने तथा इस े सत्याजपत करने के जलए सक्षम ह,ूँ जिसकी सत्याजपत प्रजत इसके साथ संलग्न है। म ैंयह भी घोिणा करता ह ूँकक म ैं लाइसेंस में िी गई ितों का पालन करूूँगा और ऐसा न करने पर लाइसेंस रद्द ककया िा सकता ह।ै स्ट्थान…………… तारीख…………….. …………..……………………. आवेिक के हस्ट्ताक्षर एवं मुहर 5. उि जनयमों म,ें "प्रथम अनुसचू ी" म,ें "प्रपत्र ।।।, केवल जतलचट्टे, मच्छर, घरेल ूमक्खी और खटमल के जनयंत्रण के जलए घरेलू प्रयोिन के जलए सामान्द्यतः उपयोग ककए िान े वाले कीटनािकों को बेचने, भंडारण करने या जबक्री के जलए प्रििवन करने का लाइसेंस" अंत:स्ट्थाजपत ककया िाएगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 फॉम व III (लाइसेंलसंग अजधकारी के पत्र पर) केवल जतलचट्टे, मच्छर, घरेल ूमक्खी और खटमलों के जनयत्रं ण के जलए घरेल ूप्रयोिन में उपयोग ककए िान े वाल े कीटनािकों को बचे न,े स्ट्टॉक करन ेया जबक्री के जलए प्रिर्ितव करन ेका लाइससें । [जनयम 10 का उपजनयम (4) का संिभव ल]ें 1. लाइसेंस संख्या.......................... सामान्द्यतः घरेलू उपयोग म ेंआने वाल ेकीटनािकों को बेचने, भण्डाररत करन े या जबक्री हते ु प्रिर्िवत करने का लाइसेंस, पररसर म ेंजस्ट्थत........................................ (परू ा पता जपन कोड सजहत) मेससव (नाम, पूरा पता, ई-मले आकि) ....................................................................... को प्रिान ककया िाता ह।ै 2. लाइसेंस ऐसी ितों के अधीन होगा िो कीटनािक अजधजनयम, 1968 के तहत वतवमान में लाग ूजनयमों में जनर्िष्टव की िा सकती ह ैंऔर साथ ही पंिीकरण प्रमाणपत्र और अन्द्य ितों पर भी लागू होगा िैसा कक नीचे बताया गया ह।ै लाइसेंलसंग अजधकारी के हस्ट्ताक्षर व मुहर ित ें 1. यह लाइसेंस उस पररसर म ेंमहत्वपूणव स्ट्थान पर प्रिर्िवत ककया िाएगा जिसके जलए लाइससें िारी ककया िा रहा ह ै और इसे कीटनािक जनरीक्षक, लाइसेंलसंग अजधकारी या इस सबं ंध में सरकार द्वारा अजधकृत ककसी अन्द्य अजधकारी द्वारा अपेजक्षत होने पर जनरीक्षण के जलए प्रस्ट्तुत ककया िाएगा। 2. लाइसेंसधारी को कीटनािक के पंिीकरण की प्रत्येक ित वका ईमानिारी से पालन करना होगा अन्द्यथा लाइसेंस रद्द कर किया िाएगा। 3. लाइसेंसधारी को कीटनािक अजधजनयम, 1968 तथा उसके अधीन बनाए गए वतवमान जनयमों के प्रावधानों का अनुपालन करना होगा। 4. लाइसेंसधारी को पररजिष्ट 'क' के अनुसार प्रारूप में 'समाि जतजथ वाल ेकीटनािकों' का ररकाडव अलग से रखना होगा। 5. लाइसेंलसंग अजधकारी द्वारा जनर्िवष्ट कोई अन्द्य िते। लाइसेंलसंग अजधकारी के हस्ट्ताक्षर [जम. स.ं 13035/08/2023-पीपी-I] फैज़ अहमि ककिवई,अपर सजचव (पीपी) रटप्पणी: मूल जनयम भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखडं (i) म ेंसंख्या सा.का.जन. 1650 (ई) किनांक 19 अिूबर, 1971 द्वारा प्रकाजित ककए गए तथा इसमें सा.का.जन. 228 (ई) किनांक 22 माच,व 2024 द्वारा अंजतम बार संिोधन ककया गया।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture and Farmers Welfare) NOTIFICATION New Delhi, the 16th August, 2024 G.S.R. 507(E).—The following draft rules further to amend the Insecticides Rules, 1971, which the Central Government proposes to make in exercise of the powers conferred by section 36 of the Insecticides Act, 1968 (46 of 1968), is hereby published, as required by the said section, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rule shall be taken into consideration after the expiry of thirty days from the date on which copies of this notification as published in the Gazette of India are made available to the public; Objections or suggestions which may be received from any person in respect of the said draft rule before the expiry of the aforesaid period of thirty days will be considered by the Central Government; Objections and suggestions in respect to the said draft rule may be forwarded to the Additional Secretary (Plant Protection), Ministry of Agriculture and Farmers Welfare, Department of Agriculture and Farmers Welfare, Krishi Bhawan, New Delhi-110 001 or through email at fa.kidwai@nic.in Draft Rules 1. (1) These rules may be called the Insecticides (Fourth Amendment) Rules, 2024. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. In the Insecticides Rules, 1971 (hereinafter referred to as the said rules), In Rule 10 :- (1) In sub-rule (1B), the word “or renewal of existing license” shall be omitted. (2) In sub-rule (1C), for the word “ninety”, the word “thirty” shall be substituted. (3) In sub-rule 4, clause (iii) the following proviso shall be inserted namely:- “Provided no such endorsement for any additional insecticide is required in the license to sell, stock or exhibit for sale of insecticides commonly used for house hold purpose for the control of cockroaches, mosquitoes, housefly and bed bugs” (4) In sub-rule (4A) after clause (iv) the following clause shall be inserted namely:- “(v) The principal certificate as stated in clause (i) to (iv) is not applicable for the license to sell, stock or exhibit for sale of insecticides commonly used for house hold purpose for the control of cockroaches, mosquitoes, housefly and bed bugs only” 3. In rule 18, sub rule (1), after clause (u), the following proviso shall be inserted, namely:- Provided that QR Code may be placed on retail pack (Primary or Secondary pack as the case may be) of insecticides commonly used for house hold purpose (for the control of cockroaches, mosquitoes, housefly and bed bugs) at suitable place where on scanning the QR code by scanning equipment like mobile phone, a web link or link for opening the URL of the Manufacturing company will appear, which on pressing or clicking, will take the user to the entire unique information of leaflet and the QR code shall contain all the contents of sub rule (1) of rule 18. 4. In the said rules, in the “FIRST SCHEDULE” the “FORM II, Application for Grant of License to Sell, Stock or Exhibit for sale Insecticides commonly used for House hold purpose for the control of cockroaches, mosquitoes, housefly and bed bugs only” shall be inserted.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 FORM II (4) License to Sell, Stock or Exhibit for sale Insecticides commonly used for Household purpose for the control of cockroaches, mosquitoes, housefly and bed bugs only [See Sub-rule (1) of rule 10] To The Licensing Authority, -------------------- -------------------- 1. I clearly understand that this license is liable to be cancelled, if any information, or part thereof, is found to be wrong, fake or false at any stage or any condition of license is violated. (b) I declare that we have adequate space and facilities to stock insecticides, so as to maintain their quality on shelf. (c) I also declare that I shall not take possession of any stock without satisfying myself with the quality thereof. (d) I further declare that I am making this application in my capacity as...............and that I am competent to make this application and verify it by virtue of................., an attested copy of which is enclosed herewith. This licence shall be displayed in the prominent place in the premises for which the licence is being issued and shall be produced for inspection as and when required by an Insecticide Inspector, licensing officer or any other officer authorised by the Government in this regard. 2. The licensee shall scrupulously comply with each and every condition of registration of the insecticide(s), failing which the license is liable to be cancelled. 3. The licensee shall comply with the provisions of the Insecticides Act, 1968, and the rules made there under for the time being in force. 4. The licensee shall maintain the record of 'date expired insecticides' separately in the format as per Appendix A. 5. Any other condition(s) as specified by the licensing officer.
