उपयोग से स्ट्वास्ट््य के जलए खतरा और मनुष्यों और िानवरों के जलए िोजखम िाजमल है ;
अतः, अब, केन्द्द्रीय सरकार, कीटनािक अजधजनयम, 1968 (1968 का 46) की धारा 27 की उप-धारा (2) द्वारा
प्रित्त िजियों का प्रयोग करत ेहुए जनम्नजलजखत आिेि बनाती ह,ै अथाटत ् :-

1. संजक्षप्त नाम और प्रारंभ- (1) इस आििे का संजक्षप्त नाम ग्लाइफोसेट के उपयोग पर जनबंधन आिेि, 2022 ह;ै
(2) यह रािपत्र में इसके अंजतम प्रकािन की तारीख से लाग ूहोगा।
2. ग्लाइफोसेट के उपयोग को जनबंजधत ककया िाता ह ै और नािीिीव जनयंत्रण प्रचालकों के जसवाय कोई व्यजि
ग्लाइफोसेट का उपयोग नहीं करेगा।
3. सभी पंिीकरण प्रमाणपत्र धारक, पंिीकरण प्रमाणपत्र िो की ग्लाइफोसेट और उसके संिातों के जलए किय े गए ह,ै
पंिीकरण सजमजत को लेबल ओर लीफलेट पर मोटे अक्षरों में “ग्लाइफोसेट के उपयोग की अनुमजत नािीिीव जनयंत्रण
आपरेटरों (पीसीओ) के माध्यम से िी िाए” की चेतावनी िाजमल ककए िान े हते ु वाजपस करेंगे।
4. यकि कोई व्यजि जिसके पास पंिीकरण का प्रमाण पत्र ह,ै खंड(3) में जनर्िष्टट तीन महीन े की अवजध के भीतर पंिीकरण
सजमजत को प्रमाण पत्र वापस करने में जवफल रहता है, तो उि अजधजनयम म ें अंतर्वटष्ट उपबंधों के अधीन कारटवाई की
िाएगी।
5. प्रत्येक राज्य सरकार उि अजधजनयम के उपबंधों तथा उसके अधीन बनाये गय े जनयमों के अधीन ऐसे सभी किम
उठाएगी, िो राज्य म ेंइस आििे के कक्रयान्द्वयन के जलए आवश्यक समझे।

NOTIFICATION
New Delhi, the 21st October, 2022
S.O. 5010(E).—Whereas the Central Government had received a report from the Government of
Kerala for prohibiting the distribution, sale and use of Glyphosate and its derivatives;
And whereas, the Central Government, in exercise of the powers conferred by sub-section (2) of
section 27 of the Insecticides Act, 1968 (46 of 1968) published a draft Order for declaring its intention to
restrict the use of Glyphosate and its derivatives through pest control operators vide notification number
S.O. 2268(E), dated 6th July, 2020, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-
section (ii), dated 7th July, 2020, and invited objections and suggestions from all persons likely to be
affected thereby, before the expiry of the period of ninety days from the date on which the copies of the
Official Gazette in which the said notification was published were made available to the public;
And whereas, copies of the said Gazette notification were made available to the public on the
7th July, 2020;
And whereas, the objections or suggestions received in respect of the said draft Order were duly
considered by an Expert Committee;
And whereas, the Central Government, after considering the report of the Expert Committee and
after consultation with the Registration Committee, set up under the Insecticides Act, 1968 (46 of 1968), is
satisfied that the use of Glyphosate involves health hazards and risk to human beings and animals ;
Now, therefore, in exercise of the powers conferred by sub-section (2) of section 27 of the
Insecticides Act, 1968 (46 of 1968), the Central Government hereby makes the following Order, namely:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3
ORDER
1. Short title and commencement. - (1) This Order may be called the Restriction on use of Glyphosate
Order, 2022.
(2) It shall come into force on the date of its final publication in the Official Gazette.
2. The use of Glyphosate is hereby restricted and no person shall use Glyphosate except Pest Control
Operators.
3. All holders of the certificate of registration granted for Glyphosate and its derivatives shall return
the certificate of registration to the Registration Committee for incorporation of the warning in bold
letters “THE USE OF GLYPHOSATE FORMULATION TO BE ALLOWED THROUGH PEST
CONTROL OPERATORS” on the label and leaflets.
4. If any person who holds the certificate of registration fails to return the certificate to the
Registration Committee, referred to in clause (3), within a period of three months, action shall be
taken under the provisions contained in the said Act.
5. Every State Government shall take all such steps under the provisions of the said Act and the rules
framed thereunder, as it considers necessary, for the execution of this order in the State.
