(1) इन जनयमों का संजक्षप्त नाम कीटनािी (पहला संिोधन) जनयम, 2023 ह ै। (2) य ेरािपत्र म ेंइनके प्रकािन की तारीख को प्रवृत्त होंगे । 2. कीटनािी जनयम, 1971 म,ें जनयम 9 के उपजनयम (4ख) के स्ट्थान पर जनम्नजलजखत रखा िाएगा, अथाात् :-- ‘‘(4ख) कोई व्यजक्त, िो जवजनमााण लाइसेंस के जलए आवेिन करता है, उसके पास जनम्नजलजखत िैजक्षक अहता ा होनी चाजहए या जनम्नजलजखत िैजक्षक अहता ा रखन े वाल ेव्यजक्त को जनयोजित ककया िाएगा, अथाात:् -- (i) तकनीकी ग्रडे कीटनािकों को बनान े के जलए रसायन जवज्ञान या कृजि रसायन जवज्ञान या कृजि रसायन म ें डॉक्टरेट या केजमकल इंिीजनयररंग में मास्ट्टर आफ टेक्नोलॉिी या मास्ट्टर आफ साइंस या समकक्ष हो ; (ii) कीटनािक जवनर्माजत के जवजनमााण के जलए कृजि जवज्ञान में स्नातक जडग्री या एक जविय के रूप में रसायन जवज्ञान के साथ जवज्ञान में स्नातक जडग्री हो : परंत ु कीटनािी (पहला संिोधन) जनयम, 2023 के आरंभ की तारीख को जवजनमााण लाइसेंस रखन े वाल े व्यजक्त को जवजहत िैजक्षक अहता ा का अनुपालन करन े के जलए चार विा की अवजध या उक्त अहता ा रखन े वाल े व्यजक्त को जनयोजित करन े के जलए एक विा की अवजध, िो भी पहले हो, अनुज्ञात की िाएगी ।’’ [फा. सं. 13035/28/2014-पीपी-। (खंड-IV)] आिीि कुमार श्रीवास्ट्तव, संयक्तु सजचव (पीपी) टटप्पण : मलू जनयम, भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखडं (i) में संखयांक सा.का.जन. 1650(अ), तारीख 19 अक्तूबर, 1971 द्वारा प्रकाजित ककए गए और सा.का.जन. संखयांक 846(अ), तारीख 25 नवंबर, 2022 द्वारा संिोजधत ककए गए । MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture and Farmers Welfare) NOTIFICATION New Delhi, the 24th February, 2023 G.S.R. 140(E).—Whereas the draft rules further to amend the Insecticides Rules, 1971, was published, as required by section 36 of the Insecticides Act, 1968 (46 of 1968) vide notification of the Government of India in the Ministry of Agriculture and Farmers Welfare (Department of Agriculture and Farmers Welfare) number G.S.R. 790(E), dated the 25th October, 2022, in the Gazette of India, Extraordinary, Part-II, Section-3, Sub-section (i), inviting objections or suggestions from all persons likely to be affected thereby, before the expiry of a period of thirty days from the date on which the copies of the Gazette of India in which the said notification was published were made available to the public; And whereas, copies of the said notification were made available to the public on 25th October 2022; And whereas, objections or suggestions received from the public in respect of the said draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 36 of the Insecticides Act, 1968 (46 of 1968), the Central Government hereby makes the following rules further to amend the Insecticides Rules, 1971, namely :- 1. (1) These rules may be called the Insecticides (First Amendment) Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Insecticides Rules, 1971, in rule 9, for sub-rule (4B), the following shall be substituted namely:—[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 “(4B) A person who applies for manufacturing license shall possess or shall employ a person possessing the following educational qualifications, namely:- (i) Doctorate in Chemistry or Agriculture Chemistry or Agriculture Chemicals or Master of Technology or Master of Science in Chemical Engineering or equivalent for manufacture of technical grade insecticides. (ii) Graduate degree in Agriculture or Science with Chemistry as one of the subject for manufacture of insecticides formulations; Provided that a person possessing a manufacturing license on the date of commencement of the Insecticides (First Amendment) Rules, 2023 shall be allowed a period of four years to comply with the prescribed educational qualifications or a period of one year to employ a person possessing the said qualification, whichever is earlier.” [F.
