Karnataka Government Secretariat, Vikasa Soudha, Bengaluru, dated: 07-07-2022 NOTIFICATION Whereas the draft of the Karnataka Municipal Administrative Service (Cadre and Recruitment) Rules, 2022, was published as required by sub section (1) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) is hereby published as required by Clause (a) of sub-section (2) section 3 of the said Act in Notification No.UDD 82 EMC 2016, dated 03.06.2022 in part IV-A of the Karnataka Gazette Extra ordinary, Number 322, dated, 03.06.2022 inviting objections and suggestions from all persons likely to be affected thereby within fifteen days from the date of its publications in the official Gazette. And whereas, the said Gazette was made available to the public on 03.06.2022 And whereas, objections and suggestions have been received and considered by the State Government. Now, therefore, in exercise of the powers conferred by sub section (1) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), the Government of Karnataka hereby makes the following rules, namely:- RULES 1. Title, Commencement and Application.- (1) These rules may be called the Karnataka Municipal Administrative Service (Cadre and Recruitment) Rules, 2022. (2) They shall come into force from the date of their final publication in the Official Gazette. 2. Definitions.-In these rules unless context otherwise requires,- (a) “Act” means the Karnataka Municipalities Act, 1964 (Karnataka Act 22 of 1964); (b) “Chief Officer” means the Chief Officer of a Town municipal Council or Town Panchayath; (1)2 (c) "City Corporations" means City Corporations established under the Karnataka Municipal Corporations Act, 1976 (Karnataka Act 14 of 1977); (d) “City Municipal Council” means the municipal area established under the Act; (e) “Commission” means the Karnataka Public Service Commission; (f) “Directorate of Municipal Administration” means the office of the Director of Municipal Administration, functioning as Head of the Department; (g) “District” means a Revenue District; (h) “Government” means the Government of Karnataka; (i) “Municipal Commissioner” means Municipal Commissioner of a City Municipal Council; (j) "Notified Area" means an area notified by the Government, which is covered with industries and factories and with the population of less than ten thousand; (k) “Region” means revenue region as specified in Schedule-I; (l)“Project Director” means the Karnataka Municipal Administrative Service officer or the Karnataka Administrative Service officer of the respective cadre who is the Head of the District Urban Development Cell in each Revenue District; (m)“Regional Commissioner” means the Regional Commissioner of a revenue region; (n) “Schedule” means the schedule appended to these rules; (o) “Section” means section of the Act; (p) “Town Municipal council” means a town municipal council established under the Act; (q) “Town Panchayath” means a town panchayath established under the Act; and (r) “Urban Local body” means city corporations, city municipal councils, Town municipal councils, Town panchayaths and notified areas; 3. Method of recruitment, minimum qualification and cadre strength.- (1) The establishment of the Karnataka Municipal Administrative Service shall consist of the category of posts with scales of pay as specified in column (2) of schedule III and the number of posts, the method of recruitment and minimum qualifications shall be as specified in the corresponding entries in columns (3), (4) and (5) thereof. (2) The cadre strength sanctioned to each urban local body and various Government organizations shall be as specified in schedule II. (3) The details of City Corporations, City Municipal Council Grade-I, City Municipal Council Grade-II, Town Municipal Council, Town Panchayaths and Notified Area Committees shall be as specified in Schedule II-A, Schedule II-B, Schedule II-C, Schedule II-D, Schedule II-E and Schedule II-F respectively and subject to the Government order for the up gradation of Urban Local Bodies from time to time. (4) The method of recruitment and minimum qualification shall be as specified in Schedule III. (5) The officers and employees of the Karnataka Administrative Service shall pass the service examinations specified in Schedule-IV. (6) The details of authorities competent to sanction leave to the KMAS officers are specified in Schedule V.3 (7) The details of authorities competent to impose penalties and other details are specified in Schedule VI. 4. Repeal and Savings.-(1) The Karnataka Municipal Administrative Services Rules, 1970 and the provisions made in column 2 of the table published by the Government in notification No. HUD/28/EMC/91(1), dated:24.08.1992 and the provisions specified in column 2 of the table notified by the Government in Notification No.HUD/102/EMC/95, dated:04.03.1996 are hereby repealed: Provided that, such repeal shall not affect;- (a) The previous operation of the said rules and notification or anything duly done or suffered there under; or (b) Any right, privilege, obligation or liability acquired, accrued or incurred under the said rules. (2) Any reference in any rule or order to the rules repealed by this rule shall be constructed as a reference to these rules. (3) All proceedings commenced under the rules repealed by sub-rule (1) and pending on the date of commencement of these rules shall be continued and disposed off in accordance with the provisions of these rules. As per Schedule-IIIA of the Karnataka Municipal Corporations (Common Recruitment of Officers and Employees) Rules, 2011, Number of Council Secretary posts specified at Sl.No.I(5) are 75% of the sanctioned strength as per Karnataka Municipal Corporations (Common Recruitment of Officers and Employees) Rules, 2011. 5. As per Schedule-IIIA of the Karnataka Municipal Corporations (Common Recruitment of Officers and Employees) Rules, 2011, Number of post of Zonal Commissioner specified at Sl.No.I(6) are 75% of the sanctioned strength as per Karnataka Municipal Corporations (Common Recruitment of Officers and Employees) Rules, 2011. 6. As per Schedule IIIA of the Karnataka Municipal Corporations (Common Recruitment of Officers and Employees) Rules, 2011, Number of post of Public Relation Officer specified at Sl.No.I(7) are 75% of the sanctioned strength as per Karnataka Municipal Corporations (Common Recruitment of Officers and Employees) Rules, 2011.7 7. As per Schedule-IIIA of the Karnataka Municipal Corporations (Common Recruitment of Officers and Employees) Rules, 2011, Number of post of Estate Officer specified at Sl.No.I(8) are 30% of the sanctioned strength as per Karnataka Municipal Corporations (Common Recruitment of Officers and Employees) Rules, 2011. 8. As per Schedule-IIIA of the Karnataka Municipal Corporations (Common Recruitment of Officers and Employees) Rules, 2011, Number of post of Administrative Officer (Office Assistant)(Admin) and Administrative Officer (Office Assistant) (Revenue) specified at Sl.No.I(9) and I(10) are 30% of the sanctioned strength as per Karnataka Municipal Corporations (Common Recruitment of Officers and Employees) Rules, 2011. 9. As per Schedule-IIIA of the Karnataka Municipal Corporations (Common Recruitment of Officers and Employees) Rules, 2011, Number of post of Revenue Officer specified at Sl.No.I(11) are 30% of the sanctioned strength as per Karnataka Municipal Corporations (Common Recruitment of Officers and Employees) Rules, 2011. 10. As per Schedule-IIIA of the Karnataka Municipal Corporations (Common Recruitment of Officers and Employees) Rules, 2011, Number of Committee Secretary posts indicated at Sl.No. I (12) are 100% of the sanctioned strength as per Karnataka Municipal Corporations (Common Recruitment of Officers and Employees) Rules, 2011 only after retirement of all the existing Corporation officials who have been given fitment as Committee Secretary. 11. Number of posts of Project Directors specified at Schedule-II Sl.No.III (1) (District Urban Development Cell) is depending upon the number of districts which are having City Corporations -10 Posts, number of districts which are having City Municipal Councils with population from 1 lakh to 3 lakhs - 13 posts and other - 8 posts. 12. As per the Government Order No. UDD 99 EMC 1999, Dated: 08.08.2001, out of 16 posts, Commissioner of Urban Development Authorities specified at Sl.No.IV(1), Column No.3, 08 posts are Urban Development Authorities with City Corporations and at Column No.4 are remaining Urban Development Authorities (UDAs). 13. Number of post of Project Coordinator specified in Sl.No.V(7) at K.M.D.S. are temporary posts designated for Chief Officer Grade-I.
