(ii) पलव जमलेट (बाजरा) पेजिसेटम ग्लायूकम, पेजिसेटम अमेरीकानम, पेजिसेटम टाइफ़ाइजडयम; (iii) फफगर जमलेट (रागी) एल्यूसाइन कोराकाना; (iv) फॉक्सटेल जमलेट (काँगनी) सेटाररया इटाजलका; (v) कोदो जमलेट (कोदो) पास्ट्पालुम स्ट्क्रोजबकुलाटम; (vi) जलटल जमलेट (कुटकी) पैजनकम सुमारेनसे; (vii) ब्राउनटॉप जमलेट (कोराले) यूरोक्लोया रामोसा; (viii) बानवयाडव जमलेट (सामक के चावल) एककनोक्लोया क्रुस-गल्ली, एककनोक्लोया कोलोना, एककनोक्लोया फ्रुमेंटेजसया; (ix) प्रोसो जमलेट (चीना) पैजनकम जमजलएकम; (x) अमराद्थस बीज (रामदाना या राजगीरा) अमराद्थस कौडाटस, अमराद्थस क्रुएद्टस, अमराद्थस हाइपोकोंजियाकस और (xi) बक्‍हीट (कुट्टू) फैगोपाएरम एस्ट्कयुलेंटम (3) ये भारत के आजधकाररक राजपत्र में उनके अंजतम प्रकािन की तारीख को प्रवृत्त होंगे। 2. पररभािाएं :- (1) इन जनयमों में जब तक संदभव में अद्यथा अपेजक्षत न हो,- (क) ‘’अजधजनयम’’ से कृजि उपज (श्रेणीकरण और जचहनांकन) अजधजनयम, 1937 (1937 का 1) अजभप्रेत ह;ै (ख) ‘’कृजि जवपणन सलाहकार’’ से भारत सरकार का कृजि जवपणन सलाहकार अजभप्रेत ह;ै (ग) ‘’प्राजधकृत पैकर’’ से ऐसा ्‍य जि या ्‍य जियों का जनकाय अजभप्रेत ह ै जजसे इन जनयमों एवं साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 के अधीन जवजहत श्रेणी मानकों और प्रकक्रया के अनुसार जमलेट्स का श्रेणीकरण करने और उद्ह ें जचहनांककत करने के जलए प्राजधकार प्रमाण-पत्र अनुदत् त ककया गया हो; (घ) ‘’प्राजधकार प्रमाण पत्र’’ से साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 के उपबंधों के अधीन जारी प्रमाण पत्र अजभप्रेत ह,ै जो ककसी व्यजि या व्यजियों के जनकाय को श्रेणी अजभधान जचहन द्वारा जमलेट्स के श्रेणीकरण और जचहनांकन का प्राजधकार दते ा ह;ै (ङ) “साधारण श्रेणीकरण और जचहनांकन जनयम” से कृजि उपज (श्रेणीकरण और जचहनांकन) अजधजनयम, 1937 (1937 का 1) की धारा 3 के अधीन बनाए गए साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 अजभप्रेत है; (च) “श्रेणी अजभधान जचहन’’ से जनयम 3 में जन्दष्ट “एगमाकव प्रतीक जचहन” अजभप्रेत ह;ै (छ) “जवजधक माप जवज्ञान (पैकेज में रखी वस्ट्तुएं) जनयम” से जवजधक माप जवज्ञान अजधजनयम, 2009 (2010 का 1) के अंतगवत बनाए गए जवजधक माप जवज्ञान (पैकेज में रखी वस्ट्तुएं) जनयम, 2011 अजभप्रेत ह ैएवं; (ज) “अनुसूची” से इन जनयमों के साथ संलग्न अनुसूजचयााँ अजभप्रेत ह।ै (2) इन जनयमों में प्रयुक् त िब् द और पद, जो पररभाजित नहीं ह ैं लेककन जजद्ह ें कृजि उपज (श्रेणीकरण और जचहनांकन) अजधजनयम, 1937 या साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 में पररभाजित ककया गया ह,ै के वही अथव होंगे जो उक् त अजधजनयम या जनयम में ह।ैं 3. श्रेणी अजभधान जचहन :- श्रेणी अजभधान जचहन में “एगमाकव प्रतीक जचहन” का जडज़ाइन होगा जो अनुसूची-। म ें जनधावररत जडजाइन के सदश्ृ य होगा जजसमें प्राजधकार प्रमाण-पत्र संखयांक, िब्द ‘एगमाकव’, वस्ट्तु का नाम और श्रेणी िाजमल होंगे।[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 4. श्रेणी अजभधान :- जमलेट्स की गुणवत्ता उपदर्वित करने के जलए श्रेणी अजभधान वह होगा जैसा कक अनुसूची-II से अनुसूची-XII के श्रेणी अजभधान हते ु मापदडं में वर्वणत ककया गया ह।ै 5. गुणवत्ता:- इन जनयमों के प्रयोजन के जलए जमलेट्स की गुणवत्ता अनुसूची-II से अनुसूची-XII में जन्दष्ट के अनुसार होगी। 6. पैफकग करन े की जवजध : -(1) जमलेट्स को खाद्य सुरक्षा और मानक (पैकेजजग) जवजनयम, 2018 और जवजधक माप जवज्ञान (पैकेज में रखी वस्ट्तुएं) जनयम, 2011 के प्रावधानों के अनुसार समुजचत पैकेजजग सामग्री में पैक ककया जाएगा। (2) समान लॉट या बैच और ग्रेड के छोटे पैक आकारों की श्रेणीकृत सामग्री की पैफकग एक मास्ट्टर कंटेनर में की जाएगी और उस पर श्रेणी अजभधान जचहन सजहत पूरा ब्यौरा अंककत ककया जाएगा; (3) प्रत् येक पैकेज में समान प्रकार का और समान श्रेणी अजभधान का जमलेट होगा; (4) प्रत् येक पैकेज उजचत और सुरजक्षत रूप,प से बंद और मुहरबंद ककया जाएगा, ताकक उसकी सामग्री बाहर न फैल सके तथा उस पर सक्षम प्राजधकारी द्वारा जारी प्रजतकृजत संखया अंककत की जाएगी। 7. जचहनाकं न की जवजध : - (1) श्रेणी अजभधान जचहन प्रत्य ेक पैकेज पर कृजि जवपणन सलाहकार या उनके द्वारा अजधकृत ककसी अजधकारी द्वारा साधारण श्रेणीकरण और जचहनांकन जनयम के जनयम 11 के अनुसार अनुमोकदत रीजत से सुरजक्षत रूप,प से जचपकाया या मुकरत ककया जाएगा। खाद्य सुरक्षा और मानक (लेबजलग और प्रदिवन) जवजनयम, 2020 के प्रावधानों के अनुसार पैकेजजग पर उपयुि रूप,प से जमलेट को जचहनांककत ककया जाएगा। (2) श्रेणी अजभधान जचहन के अजतररक् त, प्रत्येक पैकेज पर जनम् नजलजखत जववरण स्ट्पष्ट रूप,प से और अजमट रूप,प से अंककत ककया जाएगा:- (क) वस्ट्तु का नाम; (ख) श्रेणी; (ग) ककस्ट्म या रेड का नाम (वैकजल्पक); (घ) लॉट अथवा बैच संखया; (ड़) पैकेजजग की तारीख; (च) पोिण संबंधी जानकारी; (छ) फसल विव (वैकजल्पक); (ज) िुद्ध भार; (झ) प्राजधकृत पैकर का नाम और पता; (ञ) अजधकतम खुदरा मूल्य (सभी कर सजहत); (ट)....माह....विव के पूवव उपयोग हते ु सववोतत्तम; (ठ) भंडारण की जस्ट्थजत, यकद कोई हो; और (ड) जवजधक माप जवज्ञान (पैकेज में रखी वस्ट्तुएं) जनयम, 2011 या खाद्य सुरक्षा और मानक (पैकेजजग) जवजनयम, 2018 तथा खाद्य सुरक्षा और मानक (लेबजलग और प्रदिवन) जवजनयम, 2020 के तहत जन्दष्ट अथवा तत्समय लागू ककसी अद्य कानून के तहत जारी अजधसूचना अथवा इस अजधजनयम के प्रावधानों के तहत जारी ककद्हीं अनुदिे ों के तहत कोई अद्य अनुदिे , बिते कक पैकेजों पर अंकन के जलए सही गुणवत्ता की स्ट्याही का उपयोग ककया जाए। (3) प्राजधकृत पैकर कृजि जवपणन सलाहकार अथवा उनके द्वारा अजधकृत ककसी अजधकारी का पूवव अनुमोदन प्राप् त करने के पश्च ात साधारण श्रेणीकरण और जचहनांकन जनयम के जनयम 11 के अंतगवत श्रेणीकृत पैकेजों पर अपना प्राइवेट ्‍य ापार जचहन या ्‍य ापार ब्रांड जचहनांककत कर सकता है, परंतु वह इन जनयमों के अनुसार श्रेणीकृत पैकेजों पर लगाए गए श्रेणी अजभधान जचहन द्वारा उपदर्वित गुणवत्ता से जभद् न गुणवत्ता उपदर्वित नहीं करेगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 8. प्राजधकार प्रमाण पत्र प्रदान करन े की जविेि ित:ें - साधारण श्रेणीकरण और जचहनांकन जनयम के जनयम 3 के उप- जनयम (8) में जवजन्दष्ट ितों के अजतररि प्रत्येक प्राजधकृत पैकर इन जनयमों के अंतगवत जन्दष्ट ितों का पालन करेगा। (1) जमलेट्स की गुणवत्ता का परीक्षण करने के जलए प्राजधकृत पैकर साधारण श्रेणीकरण और जचहनांकन जनयम के जनयम 8 के तहत जारी मापदडं ों के अनुसार या तो अपनी स्ट्वयं की प्रयोगिाला स्ट्थाजपत करेगा या ककसी अनुमोकदत राज्य श्रेणीकरण प्रयोगिाला या सहकारी अथवा एसोजसएिन प्रयोगिाला या ऐसी प्राइवेट वाजणजज्यक प्रयोगिाला के साथ संपकव करेगा जजसका प्रबंधन साधारण श्रेणीकरण और जचहनांकन जनयम के जनयम 9 के अंतगवत कृजि जवपणन सलाहकार या उनके द्वारा अजधकृत ककसी अजधकारी द्वारा अनुमोकदत योग्य रसायनज्ञ द्वारा ककया जा रहा हो। (2) प्राजधकृत पैकर के पररसर को समुजचत संवातन और प्रकाि व्यवस्ट्था सजहत स्ट्वास्ट््यप्रद और स्ट्वच्छता की दिा में रखा जाएगा। इन कायों में लगे हुए कार्वमकों का अच्छा स्ट्वास्ट््य होगा और वे ककसी संचारी, संसगी या संक्रामक रोग से मुि होंगे। (3) प्राजधकृत पैकर के पररसर में पक्क े फिव सजहत पयावप् त भंडारण सुजवधाएं होंगी और वह नमी, ककसी तरह की दरारों, कृंतकों और कीटों से मुक् त होगा। (4) प्राजधकृत पैकर और अनुमोकदत रसायनज्ञ परीक्षण, श्रेणीकरण, पैफकग, जचहनांकन, सीजलग और अजभलेखों के अनुरक्षण से संबंजधत ऐसे सभी अनुदिे ों का पालन करेंगे जो समय-समय पर साधारण श्रेणीकरण और जचहनांकन जनयम के अंतगवत कृजि जवपणन सलाहकार या इस जनजमत्त उनके द्वारा अजधकृत ककसी अजधकारी द्वारा जारी ककए गए हो। 9. अद्य अपेक्षाएाँ: (1) घरेलू व्यापार के मामले में यह धातु संदिू क, कीटनािक अविेि, सूक्ष्मजीव अपेक्षाओं, फसल संदिू कों, प्राकृजतक रूप,प से पाए जाने वाले जविैले पदाथों के अवजिष्ट स्ट्तर से संबंजधत प्रजतबंधों तथा खाद्य सुरक्षा और मानक (संदिू क, आजवि और अवजिष्ट) जवजनयम, 2011 और खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) जवजनयम, 2011 में यथा जवजन्दष्ट अद्य खाद्य सुरक्षा अपेक्षाओं तथा घरेलू व्यापार के जलए खाद्य सुरक्षा और मानक अजधजनयम, 2006 (2006 का 34) के अधीन ककसी भी अद्य जवजनयम का अनुपालन करेगा। (2) जनयावत के मामले में यह कोडेक्स एजलमेंटेररयस आयोग द्वारा जनधावररत भारी धातुओं और कीटनािकों की अवजिष्ट सीमाओं तथा अद्य खाद्य सुरक्षा मापदडं ों अथवा आयातकताव दिे की अपेक्षाओं का अनुपालन करेगा। (3) (i) जमलेट्स की जस्ट्थजत ऐसी होगी कक वह - (क) यातायात और हडैं जलग की जस्ट्थजत का सामना कर सके और (ख) जजसे अपने गंतव्य स्ट्थान पर संतोिजनक ढंग से पहुचं ाया जा सके। (ii) जमलेट्स का भंडारण सामाद्य तापमान पर िुष्क एवं स्ट्वच्छ स्ट्थान पर ककया जाएगा। अनुसूची-I (जनयम 3 दखे ें) (एगमाकव प्रतीक का जडजाइन) वस्ट्त ु का नाम………………………………………… श्रेणी………………………………………………………………[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 5 अनुसूची –II (जनयम 4 व 5 दखे ें) ज्वार का श्रेणी अजभधान और उसकी गुणवत्ता 1. ज्वार, सोरघम बाईकलर पौधे के सूखे पररपक्व दाने होंगे। 2. द्य ूनतम अपेक्षाएं:- ज्वार में जनम्नजलजखत जविेिताएाँ होंगी– (क) सूखा, स्ट्वच्छ, स्ट्वास्ट््यकर तथा एक समान माप, आकार और रंग का होगा; Definitions. -(1) In these rules, unless the context otherwise requires,- (a) “Act” means the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937); (b) "Agricultural Marketing Adviser" means the Agricultural Marketing Adviser to the Government of India; (c) "authorised packer" means a person or a body of persons who has been granted a certificate of authorisation to grade and mark millets in accordance with the grade standards and procedure provided under these rules and the General Grading and Marking Rules, 1988; (d) "certificate of authorisation" means a certificate issued under the provisions of the General Grading and Marking Rules, 1988 authorising a person or a body of persons to grade and mark millets with the grade designation mark; (e) "General Grading and Marking Rules" means the General Grading and Marking Rules, 1988, made under section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937); (f) "grade designation mark" means „‟AGMARK Insignia‟‟ referred to in rule 3; (g) “Legal Metrology (Packaged Commodities) Rules" means the Legal Metrology (Packaged Commodities) Rules, 2011, made under the Legal Metrology Act, 2009 (1 of 2010); and (h) "Schedules" means the schedules appended to these rules. (2) The words and expressions used and not defined in these rules but defined in the Agricultural Produce (Grading and Marking) Act, 1937 or the General Grading and Marking Rules, 1988, shall have the same meaning as are assigned to them under the said Act or the rules. 3. Grade designation mark. - The grade designation mark shall be consisting of the design of "AGMARK Insignia", as set out in Schedule-I, incorporating the certificate of authorisation number, the word “AGMARK", the name of commodity and its grade. 4. Grade designations. - The grade designations to indicate the quality of millets including the criteria for grade designation shall be as set out in Schedule-II to XII. 5. Quality. -For the purpose of these rules, the quality of millets shall be as provided in Schedule-II to XII. 6. Method of packing. - (1) Millets shall be packed in suitable packaging material in accordance with the provisions of the Food Safety and Standards (Packaging) Regulations, 2018 and Legal Metrology (Packaged Commodities) Rules, 2011. (2) The graded material of small pack sizes of the same lot or batch and grade may be packed in a master container with complete details thereon along with the grade designation mark. (3) Each package shall contain millets of the same type and of the same grade designation. (4) Each package shall be properly and securely closed and sealed so as to disallow spilling and marked with replica numbers issued by the competent authority.[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 15 7. Method of marking.- (1) The grade designation mark shall be securely affixed to or printed on each package in the manner approved by the Agricultural Marketing Adviser or an officer authorised by him under rule 11 of the General Grading and Marking Rules. Millets shall be marked suitably on packaging in accordance with the provisions of the Food Safety and Standards (Labeling and Display) Regulations, 2020. (2) In addition to the grade designation mark, following particulars shall be clearly and indelibly marked on each package, namely:- (a) name of the commodity; (b) grade; (c) variety or trade name(optional); (d) lot or batch number; (e) date of packaging; (f) nutritional information; (g) crop year (optional); (h) net weight; (i) name and address of the authorised packer; (j) maximum retail price (inclusive of all taxes); (k) BEST BEFORE ___________MONTH ______YEAR; (l) Storage condition, if any; and (m) any other particulars as provided under the Legal Metrology (Packaged Commodities) Rules, 2011 or specified under the Food Safety and Standards (Packaging) Regulations, 2018 and the Food Safety and Standards (Labeling and Display) Regulations, 2020 or any notification issued under any other law for the time being in force or any instructions issued under the provisions of the Act, provided that right quality of ink is used for marking on packages. (3) The authorised packer may after obtaining prior approval of the Agricultural Marketing Adviser or an officer authorised by him under rule 11 of the General Grading and Marking Rules, mark his private trade mark or trade brand on the graded packages provided the same do not indicate quality other than that indicated by the grade designation mark affixed to the graded packages in accordance with these rules. 8. The special conditions for grant of certificate of authorisation– In addition to the conditions specified in sub-rule (8) of rule 3 of the General Grading and Marking Rules, every authorised packer shall comply the conditions specified under these rules. (1) The authorised packer shall either set up his own laboratory as per norms issued under rule 8 of the General Grading and Marking Rules, or have access to an approved State grading laboratory or cooperative or association laboratory or a private commercial laboratory manned by a qualified chemist approved by the Agricultural Marketing Adviser or an officer authorized by him under rule 9 of the General Grading and Marking Rules, for testing the quality of millets. (2) The premises of the authorised packer shall be maintained in hygienic and sanitary conditions with proper ventilation and well lighted arrangement and the personnel engaged in these operations shall be in sound health and free from any infectious, contagious or communicable diseases. (3) The premises of the authorised packer shall have adequate storage facilities with pucca floor and free from dampness, any kind of cracks and crevices, rodent and insect infestation.16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (4) The authorised packer and the approved chemist shall observe all instructions regarding testing, grading, packing, marking, sealing and maintenance of records which may be issued by the Agricultural Marketing Adviser or an officer authorised by him in this behalf in accordance with the General Grading and Marking Rules, from time to time. 9. Other requirements: (1) For domestic trade, it shall comply with the restrictions in regard to residual levels of metal contaminants, pesticides residues, microbial requirements, crop contaminants, naturally occurring toxic substances and other food safety requirements as specified under the Food Safety and Standards (Contaminants, Toxins and Residues) Regulations, 2011, the Food Safety and Standards (Food Product Standards and Food Additives) Regulations, 2011 and other regulations made for domestic trade under the Food Safety and Standards Act, 2006 (34 of 2006). (2) For export trade, it shall comply with the residual limits of heavy metals, pesticides and other food safety requirements as laid down by the Codex Alimentarius Commission or importing countries requirement for exports. (3) (i) The condition of the millets shall be so as to enable it to - (a) withstand transport and handling; and (b) arrive in satisfactory condition at the place of destination. (ii) Millets shall be stored in a dry and hygienic place at normal room temperature. The inorganic matter shall include sand, gravel, dirt, pebbles, stones, glass and metallic pieces, lumps of earth, clay and mud. Organic matter shall include husk, chaff, straw, weed seeds, fragments of bran and other inedible grains. (ii) Other edible grains are any edible grains other than the one under consideration. (iii) Grains with serious defects are grains in which the cotyledon has been affected or attacked by pests; grains with very slight traces of mould or decay. (iv) Grains with slight defects are grains with extensive seed coat staining, without the cotyledon being affected; grains in which the seed coat is wrinkled, with pronounced folding or broken grains. (v) Immature and shrivelled grains are kernels or pieces of grain kernels that are not fully developed. (vi) Grains with husk are kernels or pieces of kernels carrying husk on one sixteenth or larger portion. (vii) Weevilled grains are grain kernels that are partially or wholly bored by insects injurious to grain but do not include germ-eaten grains and egg-spotted grains. (viii) Poisonous, toxic and/or obnoxious seeds means any seed which may have damaging or dangerous effect on health, organoleptic properties or technological performance such as dhatura (D. fastuosa linn. and D. stramonium linn.), corncockle (Agrostemma githago L.), Akra (Vicia species). Note : The Schedules II, III, IV and VII of the Cereals Grading and Marking Rules, 2001 have been amended and now incorporated as Schedule II, III and IV under these rules. [F.
