Read the following:-
1. Automex Message received from the Inspector of Police,
Anti-Corruption Bureau, Sangareddy, Nizamabad Range, dated
30-04-2003.
2. From the Director General, Anti-Corruption Bureau,
Hyderabad, Letter C.No.122/RCO-NMD/2003-S4, dated
01-12-2004.
3. G.O.Ms.No.37, Irrigation & CAD (Ser.VI(1) Department, dated
22-03-2005.
4. From the Hon’ble II Additional Special Judge for SPE & ACB
Cases, Hyderabad, Judgement dated 30-07-2011 in
C.C.No.9/2010.

O R D E R:
In the reference 1st read above, It has been brought to the notice of the
Government that Sri K.V.V. Satyanarayana Raju, formerly Asst. Engineer,
Irrigation Branch, Shivampet, Mandal, Narsapur Division collected illegal
gratification from the Presidents of Water Users Association of Pothulbuguda
and Parikibanda Villages on 29-04-2003, a Surprise check was conducted in
the presence of mediators on Sri K.V.V.Satyanarayana Raju formerly Asst.
Engineer, Irrigation Branch Shivampet Mandal, Narsapur Sub-Division at the
office of the Deputy Executive Engineer, Irrigation, Narsapur and found
Rs.18,000/- in his possession. On verification it is revealed that the Assistant
Engineer, Irrigation Branch, Sri K.V.V.Satyanarayana Raju, has deducted
Rs.6, 000/- and Rs.12, 000/- from the final payment of the Presidents of Water
Users Association of Pothulabuguda and Parikibanda Villages and paid the
remaining amount Rs.17, 710/- and Rs.33, 890/- to them. The Presidents of
Water Users Association of Pothulabuguda and Parikibanda stated that the
Asst. Engineer Sri K.V.V.Satyanarayana Raju, was deducted Rs.6,000/- and
Rs.12, 000/- respectively from their final payment bills. The accused officer
had collected the percentage for an amount of Rs.18,000/- and the same was
seized from the possession of Sri K.V.V.Satyanarayana Raju, formerly
Assistant Engineer, Irrigation Branch, Shivampet Mandal, Narsapur Division.
2. In the reference 2nd read above, the Director General,
Anti-Corruption Bureau, Hyderabad in his Final Report has recommended to
prosecute the accused officer Sri K.V.V.Satyanarayana Raju, formerly Assistant
Engineer in a competent Court of Law for the offences punishable under
Sections 7 & 13(2) read with 13(1)(d) of the Prevention of Corruption Act, 1988.
3. In the reference 3rd read above, Government have accorded sanction for
prosecuting the accused officer Sri K.V.V.Satyanarayana Raju, formerly
Assistant Engineer, Irrigation Branch, Shivampet Mandal, Medak District in a
competent Court of Law for the offences punishable under sections 7 and sub-
section (2) of section 13 read with clause (d) of sub-section (1) of section 13 of
the Prevention of Corruption Act, 1988.

4. In the reference 4th read above, the Hon’ble II Additional Special Judge
for SPE & ACB Cases, Hyderabad in its Judgement dated
30-07-2011 in C.C.No.9/2010 held that “in the result, accused officer is found
guilty for the offences under Sections 7, 13(1) (d) read with 13(2) of the
Prevention of Corruption Act, and he is convicted under Section 248(2) Cr.P.C.
Accused Officer is heard on the quantum of sentence to be imposed on him.
Accused Officer submitted that he is having large family and there are number
of dependents upon him and prayed for a lenient view. Having regard to the
facts and circumstances, and nature of the offence, the court is of the
considered opinion that ends of justice could be met by sentencing the Accused
Officer to undergo Rigorous Imprisonment for a period of six (6) months and to
pay fine of Rs.500/- (Rupees Five hundred only) indefault of payment of fine, he
shall suffer Simple Imprisonment for a period of One (1) month for the offence
under Section 7 of the Prevention of Corruption Act, 1988. Further the
Accused Officer is sentenced to undergo Rigorous Imprisonment for a period of
One (1) year and to pay fine of Rs.500/- (Rupees Five hundred only) indefault
of payment of fine he shall suffer Simple Imprisonment for a period of One (1)
month for the offence under Section 13(1)(d) read with 13(2) of the Prevention
of Corruption Act, 1988. Both the substantive sentences shall run
concurrently”.
5. Government have examined the entire matter carefully and decided to
impose a punishment of dismissal from service against Sri K.V.V.
Satyanarayana Raju, formerly Assistant Engineer, Irrigation Branch, Shivampet
Mandal, Medak District, as he was found guilty of the charges and convicted in
a Trial Court Judgement dated 30-07-2011 in C.C.No.9/2010 under clause (x)
of rule 9 read with sub-rule (i) of rule 25 of A.P.Civil Services (Classification,
Control & Appeal) Rules, 1991 read with G.O.Ms.No.2, General Administration
(Ser.C) Department, dated 04-01-1999. As per the amendment of Rule 25(i)
to the A.P.Civil Services (Classification, Control & Appeal) Rules, 1991 issued
through G.O.Ms.No.240, General Administration (Ser.C) Department, dated
14-08-2003, it is not necessary to consult the A.P.Public Service Commission
for taking any such action.
6. Now, therefore, in exercise of the powers conferred under
clause (x) of rule 9 read with sub-rule (i) of rule 25 of A.P.Civil Services
(Classification, Control & Appeal) Rules, 1991 read with G.O.Ms.No.2,
General Administration (Ser.C) Department, dated 04-01-1999, Government
hereby order to impose a punishment of dismissal from service against
Sri K.V.V.Satyanarayana Raju, formerly Assistant Engineer, Irrigation Branch,
Shivampet Mandal, Medak District, as he was found guilty of the charges and
convicted in a Trial Court Judgement dated 30-07-2011 in C.C.No.9/2010.
7. The Engineer-in-Chief (AW), Irrigation & CAD Department, Hyderabad
shall take necessary action in the matter accordingly and acknowledge the
receipt of the order.
