Written Statement of Self Defence submitted by Sri M.Bullaiah, Deputy Executive Engineer, dated 23-04-2010. 5. Govt. Memo.No.6841/Ser.VI(1)/2009-10, dated 21-09-2010 of Irrigation & CAD (Ser.VI(1) Department. 6. Proceedings No.Rc/ENC/S1(2)/5245/2009, dated 13-10-2010 of the Engineer-in-Chief (AW), Irrigation & CAD Department, Hyderabad. 7. Govt. Memo.No.6841/Ser.VI(1)/2009-14, dated 23-04-2011 of Irrigation & CAD (Ser.VI(1) Department. 9. Representation received from Sri M.Bullaiah, Deputy Executive Engineer, dated 23-05-2011. 10. Govt. Letter No.6841/Ser.VI(1)/2009-17, dated 20-12-2011. 11. From the Secretary, A.P.Public Service Commission, Hyderabad, Letter No.1919/RT-I/3/2011, dated 03-01-2012. * * * O R D E R: In the reference 1st read above, a Trap Case was registered by the Anti-Corruption Bureau authorities against Sri Medidi Bullaiah, Deputy Executive Engineer, Office of the Special Minor Irrigation Sub-Division, Polavaram, West Godavari District, as he demanded and accepted the bribe amount from the complainant. The accused officer Sri M.Bullaiah, Deputy Executive Engineer was arrested on 23-03-2009 and he was produced before the Hon’ble Court of Special Judge for SPE & ACB Cases, Vijayawada on 24-03-2009. Accordingly, the said accused officer was placed under deemed suspension from the date of his detention i.e., on 23-03-2009 under Rule 8(2)(a) of A.P.Civil Services (Classification, Control & Appeal) Rules, 1991 vide reference 2nd read above. 2. In the reference 3rd read above, Government have initiated departmental proceedings against Sri M.Bullaiah, Deputy Executive Engineer and Articles of Charges were issued against him. (P.T.O.)::2:: 3. In the reference 4th read above, the accused officer Sri M.Bullaiah, Deputy Executive Engineer in his written statement of self defence dated 23-04-2010 has stated among other things and requested to consider his case sympathetically and further action may be dropped against him in the interest of justice. 4. I n the reference 5th read above, the Engineer-in-Chief (AW), Irrigation & CAD Department, Hyderabad was requested to institute an inquiry into the charges framed against the accused officer Sri M.Bullaiah, Deputy Executive Engineer, Office of the Special Minor Irrigation Sub-Division, Polavaram, West Godavari District and presently working in the Office of the Chief Engineer (Projects), Irrigation Department, L.M.D.Colony, Karimnagar District under the provisions of A.P.Civil Services (CC&A) Rules, 1991 duly appointing a competent Enquiry Officer of proven integrity, and also a Presenting Officer, with the directions that the enquiry as per the C.C.A. Rules should be completed within three months and furnish the Enquiry Report to Government, for taking further action in the matter. 5. In the reference 6th read above, the Engineer-in-Chief (AW), Irrigation & CAD Department, Hyderabad has issued orders, appointing the Superintending Engineer, Flood Flow Canal Circle No.II, L.M.D.Colony, Karimnagar District as the Enquiry Officer, to inquire into the charges framed against the said Sri M.Bullaiah, Deputy Executive Engineer. 6. In the reference 7th read above, the Superintending Engineer & Inquiring Authority, I.F.F.C.Circle-II, L.M.D.Colony, Karimnagar District in his Inquiry Report dated 17-03-2011 held that the charge No.1 i.e., submission of annual property returns by the accused officer during the period of his incumbency, is proved. In respect of Charge No.2 i.e., the accused officer failed to sign in the attendance register for 3 months from January to March, 2009 except 12, 16, 20 to 24 of January, 2009, the Inquiring Authority held that the charge is not proved. 7. In the reference 8th read above, while enclosing a copy of the Inquiry Report of the Inquiring Authority under Rule 21(2) of A.P.Civil Services (Classification, Control & Appeal) Rules, 1991, the charged officer Sri M.Bullaiah, formerly Deputy Executive Engineer, Office of the Special Minor Irrigation Sub-Division, Polavaram, West Godavari District and presently working in the Office of Chief Engineer (Projects), Irrigation & CAD Department, L.M.D.Colony, Karimnagar District was directed to submit his representation if any, why a major penalty should not be imposed against him, within 15 days for taking necessary action. 8. In the reference 9th read above, the charged officer Sri M.Bullaiah, Deputy Executive Engineer in his representation dated 23-05-2011 has stated among other things and requested to drop the charge framed against him. 9. As no new grounds put-forth by the charged officer in his representation, the Secretary, A.P.Public Service Commission, Hyderabad was requested to obtain the concurrence of the Commission on the proposed major penalty of cut of two increments with cumulative effect against the charged officer Sri M.Bullaiah, formerly Deputy Executive Engineer, Office of the Special Minor Irrigation Sub-Division, Polavaram, West Godavari District and presently working in the Office of Chief Engineer (Projects), Irrigation & CAD Department, L.M.D.Colony, Karimnagar District, subject to review on the outcome of the criminal proceedings on account of the A.C.B. trap case against the charged officer Sri M.Bullaiah, Deputy Executive Engineer, which is pending before the Hon’ble Court of III Additional District & Sessions Judge-cum-Special Judge for SPE & ACB Cases, Vijayawada vide reference 10th read above. Contnd…3. ::3::10. In the reference 11th read above, the Secretary, A.P.Public Service Commission, Hyderabad has informed that after careful examination of the disciplinary case in the light of the records made available, Commission agreed with the proposal of the Government, to impose punishment of stoppage of two increments with cumulative effect against Sri M.Bullaiah, Dy.E.E., subject to review on the outcome of the Criminal proceedings on account of the A.C.B. Trap case against him. 11. Government have examined the entire matter carefully and decided to impose a major penalty of stoppage of two (2) increments with cumulative effect against the charged Officer Sri M.Bullaiah, formerly Dy.E.E., subject to review on the outcome of the criminal proceedings on account of the A.C.B. trap case against the charged officer Sri M.Bullaiah, Deputy Executive Engineer, which is pending before the Hon’ble Court of III Additional District & Sessions Judge-cum-Special Judge for SPE & ACB Cases, Vijayawada. Accordingly, it is hereby order to impose a major penalty of stoppage of two (2) increments with cumulative effect against the charged officer Sri M.Bullaiah, formerly Deputy Executive Engineer, Office of the Special Minor Irrigation Sub- Division, Polavaram, West Godavari District and presently working in the Office of Chief Engineer (Projects), Irrigation & CAD Department, L.M.D.Colony, Karimnagar District, subject to review on the outcome of the criminal proceedings on account of the A.C.B. trap case against the charged officer Sri M.Bullaiah, Deputy Executive Engineer, which is pending before the Hon’ble Court of III Additional District & Sessions Judge-cum-Special Judge for SPE & ACB Cases, Vijayawada. 12.
