Representation from Sri G.Susheel Kumar, Deputy Executive Engineer, Q.C. & Q.A.Circle, Nuzvid, Krishna District, dated 06-04-2011. 9. Govt. Letter No.1511/Ser.VI(1)/2009-13, dated 11-07-2011. 10. From the Principal Secretary, A.P.Public Service Commission, Hyderabad, Letter No.1005/RT-I/1/2011, dated 24-08-2011. * * * O R D E R: In reference 1st read above, the Director General, Anti-Corruption Bureau, Hyderabad, in his Preliminary Report dated 27-01-2009, informed that a Trap Case was registered by the Anti-Corruption Bureau authorities against Sri G.Susheel Kumar, formerly Dy.Executive Engineer and additional incharge Executive Engineer, Division No.2, Sriram Sagar Project, Pochampad (V), Balkonda (M), Nizamabad District, as the said official demanded and accepted the bribe amount from the complainant and requested to place the accused officer Sri G.Susheel Kumar, Deputy Executive Engineer under deemed suspension from the date of his detention i.e., on 02-01-2009 under Rule 8(2)(a) and Rule 8(5) of A.P.Civil Services (Classification, Control & Appeal) Rules, 1991. 2. I n reference 2nd read above, orders were issued placing the accused officer Sri G.Susheel Kumar, In-charge Executive Engineer under deemed suspension from the date of his detention i.e., on 02-01-2009 under Rule 8(2) (a) and Rule 8(5) of A.P.Civil Services (Classification, Control & Appeal) Rules, 1991 until further orders. (P.T.O.)::2:: 3. In reference 3rd read above, departmental action was initiated against the accused officer Sri G.Susheel Kumar, formerly Deputy Executive Engineer and Articles of Charges were issued against him under Rule 20 of A.P.Civil Services (Classification, Control & Appeal) Rules, 1991. 4. In reference 4th read above, orders were issued reinstating the accused officer Sri G.Susheel Kumar, Deputy Executive Engineer (U/s) into service. 5. The charged officer Sri G.Susheel Kumar, formerly Deputy Executive Engineer did not submit his written statement of self defence vis-a-vis the Articles of Charges served upon him, even after the stipulated period had elapsed. Government consequently decided to conduct a detailed departmental inquiry in respect of the charges framed against the charged officer, and in reference 5th read above, orders were issued appointing Sri Ch.Siva Prasad, Chief Engineer, Quality Control, Dowlaiswaram as the Inquiring Authority, to conduct departmental inquiry into the charges framed against the accused officer Sri G.Susheel Kumar, formerly Deputy Executive Engineer, Office of the Y.R.C.Sub-Division No.3, Yeleshwaram of Y.R.C.Division, Yeleshwaram under Irrigation Circle, Dowlaiswaram. 6. In reference 6th read above, the Chief Engineer & Inquiring Authority, Q.C.Wing, Coastal Region, Dowlaiswaram, East Godavari District, in his Inquiry Report dated 14-03-2011held that the charges framed against Sri Gurudwar Susheel Kumar, Deputy Executive Engineer vide G.O.Rt.No.1640, Irrigation & CAD (IW:Services-VI(1) Department, dated 20-10-2009 were proved. 7. While enclosing a copy of the Report of the Inquiring Authority under Rule 21(2) of A.P.Civil Services (Classification, Control & Appeal) Rules, 1991, the charged officer Sri G.Susheel Kumar, Deputy Executive Engineer was directed to submit his representation if any, as to why a major penalty should not be imposed against him within 15 days for taking necessary action vide reference 7th read above. 8. In reference 8th read above, the charged officer Sri G.Susheel Kumar, Deputy Executive Engineer, Q.C. & Q.A. Circle, Nuzvid, Krishna District in his representation dated 06-04-2011, amongst other things, requested to take lenient view in his case and drop all further proceedings in pursuance of the enquiry report submitted by the Inquiry Officer and provide him justice. 9. After careful examination of the matter, Government have observed that the charged officer Sri G.Susheel Kumar, Deputy Executive Engineer did not submit his Annual Property Returns from the date of joining into Govt. Service i.e, from 06-11-1993 to 02-01-2009 except for the years 2005 and 2006. Therefore, Government have decided to confirm the provisional decision of the department i.e., to impose a major penalty of cut in two (2) increments with cumulative effect against the charged officer Sri G.Susheel Kumar, Deputy Executive Engineer, Q.C. & Q.A.Circle, Nuzvid, Krishna District, subject to review on the outcome of the ACB Trap case pending against the charged officer in C.C.No.65/2009 before the Hon’ble Court of Principal Special Judge for SPE & ACB Cases, Hyderabad and in reference 9th read above, the Principal Secretary, A.P.Public Service Commission, Hyderabad was requested to obtain the concurrence of the Commission on the proposed major penalty i.e., cut in two (2) increments with cumulative effect against the charged officer Sri G.Susheel Kumar, Deputy Executive Engineer, Q.C. & Q.A.Circle, Nuzvid, Krishna District, subject to review on the outcome of the ACB Trap case pending against the charged officer in C.C.No.65/2009 before the Hon’ble Court of Principal Special Judge for SPE & ACB Cases, Hyderabad. Contnd..3.::3:: 10. In reference 10th read above, the Secretary, A.P.Public Service Commission, Hyderabad in his letter dated 24-08-2011 has agreed with the proposal of the Government i..e, to impose a punishment of cut in two (2) increments with cumulative effect against the charged officer Sri G.Susheel Kumar, Deputy Executive Engineer, Q.C. & Q.A.Circle, Nuzvid, Krishna District, subject to review on the outcome of the ACB Trap case pending against the charged officer in C.C.No.65/2009 before the Hon’ble Court of Principal Special Judge for SPE & ACB Cases, Hyderabad. 11. Government have examined the entire matter carefully and decided to impose a major penalty of cut in two (2) increments with cumulative effect against the charged officer Sri G.Susheel Kumar, Deputy Executive Engineer, Q.C. & Q.A.Circle, Nuzvid, Krishna District, subject to review on the outcome of the A.C.B. Trap case pending against the charged officer in C.C.No.65/2009 before the Hon’ble Court of Principal Special Judge for SPE & ACB Cases, Hyderabad. Accordingly, it is hereby order to impose a major penalty of cut in two (2) increments with cumulative effect against the charged officer Sri G.Susheel Kumar, Deputy Executive Engineer, Q.C. & Q.A.Circle, Nuzvid, Krishna District, subject to review on the outcome of the A.C.B. Trap case pending against the charged officer in C.C.No.65/2009 before the Hon’ble Court of Principal Special Judge for SPE & ACB Cases, Hyderabad. 12.
