(Ser.C) Department, dated: 04.01.1999. ****** ORDER : In the reference 1st read above the Director General, Anti Corruption Bureau, has brought to the notice of the Government that Sri P.Somaraju, former Assistant Commissioner of Labour, Hyderabad was trapped by Anti Corruption Bureau on 26.09.1997 when he demanded and accepted a bribe of Rs.6,000/- from the complainant and recommended to prosecute him in a court of law u/sec 7 ,11,13 (2) read with 13 (1) (d) of prevention of Corruption Act, . 2. Accordingly, after examining the matter and based on the recommendations of the Director General, Anti Corruption Bureau vide reference 2nd read above, orders were issued to prosecute of Sri P.Somaraju, former Assistant Commissioner of Labour, Hyderabad in a court of law vide reference 3rd read above. 3. In the reference 4th read above the Director General, Anti Corruption Bureau, has informed that the Special Judge for SPE and ACB cases, Hyderabad pronounced Judgment on 28.11.2003 acquitting the Accused Officer, Sri. P.Somaraju, former Assistant Commissioner of Labour, Hyderabad of the charges framed against him and the requested necessary permission to file an appeal in the High Court of Andhra Pradesh against judgment dated 28.11.2003 of the trial court. Permission was accorded vide memo dated fifth read above to the Director General, Anti Corruption Bureau to prefer appeal before the High Court of Andhra Pradesh, Hyderabad and the Director General, Anti Corruption Bureau has filed criminal appeal No. 1540 of 2004 against the orders of the acquittal of the lower court, before the High Court of Andhra Pradesh. In the reference 6th read above the Director General, Anti Corruption Bureau, has informed that the High Court of Andhra Pradesh, Hyderabad allowed the Criminal Appeal No. 140 of 2004 filed by Bureau by setting aside the acquittal judgment dated 28.11.2003 of the Principal Special Judge for APE & ACB Cases, Hyderabad in CC. No.13 of 1999. The AO Sri P.Somaraju, former Assistant Commissioner of Labour, Circle-I, Hyderabad was convicted and sentenced to Contd…2-2- undergo rigorous imprisonment for one year and fine of Rs.10,000/- under each counts i.e., for the offences under section 7 & 13(1)(d) r/w 13(2) of the PC Act, 1988. In default of payment of fine of Rs.10,000/- (total Rs.20,000/-) the A.O. shall undergo simple imprisonment for two months under each count. Substantive sentences of imprisonment on both the counts shall run concurrently. Government, after careful examination of the matter, have decided to impose the punishment of dismissal from service against Sri P.Somaraju, former Assistant Commissioner of Labour, Circle-I, Hyderabad Under Rule 9 (x) read with Rule 25 (i) of A.P.C.S. (CC&A) Rules, 1991 read with the instructions issued in the reference 7th read above with immediate effect for having convicted by the Hon’ble High Court of Andhra Pradesh, Hyderabad by setting aside the acquittal judgment dated 28.11.2003 of the Special Judge for SPE &ACB cases, Hyderabad. Accordingly, Government hereby impose the punishment of dismissal from service against Sri P.Somaraju, former Assistant Commissioner of Labour, Circle-I, Hyderabad Under Rule 9 (x) read with Rule 25 (i) of A.P.C.S. (CC&A) Rules, 1991 read with the instructions issued in G.O.Ms.No.2, General Administration (Ser.C) Department, dated 04.01 1999 with immediate effect. The Commissioner of Labour Hyderabad is requested to take further action in the matter immediately. The following notification shall be published in the Andhra Pradesh Gazette. NOTIFICATION In exercise of powers conferred Under Rule 9 (x) read with Rule 25 (i) of the A.P.C.S. (CCA) Rules, 1991 read with the instructions issued in G.O.Ms.No.2, General Administration (Ser.C) Department, dated: 04.01.1999, the Governor of Andhra Pradesh hereby dismiss Sri P.Somaraju, former Assistant Commissioner of Labour, Circle-I, Hyderabad from service with immediate effect.
