ABSTRACT
Mines and Minerals – Transfer of Mining Lease held by M/s. Vishwamber
Cements for Limestone over an extent of Ac.322.06 gts. or 130.37 Hectares
in Sy. No.170 (P) of Gundlapally Village, Mattampally Mandal, Nalgonda
District in favour of M/s. Vishwamber Cements Ltd. for the unexpired portion
of the lease period upto 15.11.2018 under Rule 37 of MC Rules, 1960 –
Permission – Accorded.

O R D E R:
In the reference 1st read above, a Mining Lease was granted for
Limestone over an extent of 322.06 Acres in Sy. No.170 (P) of Gundlapally
(V), Mattampally (M), Nalgonda District for a period of 20 years in favour of
M/s. Vishwamber Cements, subject to establishment a cement plant within a
period of 36 months. Further, Government have given extension of time for
a period of 2 years vide reference 2nd read above and for another period of
two years vide reference 3rd read above.
2. In the reference 4th read above, M/s. Vishwamber Cements Limited
has informed that, they were granted the above Mining Lease in the name of
M/s. Vishwamber Cements. They further stated that, considering the large
financial outlay, required for the project, professional setup required and
experience in handling large projects, Vishwamber Cements has been
converted to Vishwamber Cements Limited under companies Act, 1956. They
have requested to transfer the Mining Lease for Limestone over an extent of
322.06 Acres in Sy. No.170 (P) of Gundlapally (V), Mattampally (M),
Nalgonda District which is presently in the name of M/s. Vishwamber
Cements (Proprietary concern) to M/s. Vishwamber Cements Limited (Public
Limed Company with Mr. T.N Vishwamber, Mr. V.V Balakrishnan and Mr. V.B
Manoj as Directors). They further stated that, they have made all payments
with regard to Mineral revenue to the Department in respect of the above
Mining Lease.
3. In the reference 5th read above, the Director of Mines & Geology has
informed that, the transferor i.e. M/s. Vishwamber Cements has acquired
the land over an extent of 128.14 gts. in Peddaveedu Village, Mattampally
Mandal, Nalgonda District and the same was certified by the Tahsildar,
Mattampally vide Certificate No. B/AR No/6/2008, dated 31-1-2008. The
MOEF, Government of India vide F.No. J-11011/978/2007-IA-II(I), dated 12-
2-2009 have accorded environmental clearance to the project under the
provisions of EIA Notification dated: 14-9-2006. The lessee has submitted
the approved mining plan, transfer application and the steps taken on the
progress of the cement plant. The lessee has also submitted the Mineral
Revenue Clearance Certificate (MRCC) issued by the DDM&G., Hyderabad
which is valid upto 31-3-2012.

4. The DM&G has further informed that, the transferee had submitted an
affidavit stating that, they will abide by the conditions of the lease originally
made Government orders and the original lease deed conditions. The
Transferee Company has submitted the details of financial requirement for
establishment of the cement plant and their plans to meet the same. The
DM&G has therefore requested the Government to consider the transfer of
the mining lease for Limestone held by M/s. Vishwamber Cements in
favour of M/s. Vishwamber Cements Limited over an extent of Acres
322.06 gts. or 130.37 hectares in Sy.No.170(P) of Gundlapally Village,
Mattampally Mandal, Nalgonda District for unexpired period of lease i.e. upto
15-11-2018 under Rule 37 of M.C. Rules, 1960.
5. In the above circumstances and after careful examination of the
proposal, Government under Rule 37 of M.C. Rules, 1960, hereby accord
permission for transfer of Mining Lease held by M/s. Vishwamber Cements
for Limestone over an extent of 322.06 Acres in Sy. No.170 (P) of
Gundlapally (V), Mattampally (M), Nalgonda District in favour of M/s.
Vishwamber Cements Limited for the un-expired portion of the mining
lease period i.e., upto 15.11.2018 subject to satisfaction of MM(D&R) Act,
1957 and the rules made thereunder.
6. The transfer of lease deed should be executed, within three months
from the date of this order and both the transferor and transferee, should
pay all mineral revenue dues to the Government till the date of transfer,
before execution of the transfer lease deed.
7. The Director of Mines and Geology shall take further necessary action in
the matter accordingly.
