ORDER:
Whereas in the reference 1st read above, it has been brought to
the notice of the Government that Sri A. Rajaiah, Assistant Labour
Officer, Bhongir was trapped by Anti Corruption Bureau officials on
22.10.1997 when he demanded and accepted the bribe amount of
Rs.2,200/- from the complainant for showing official favour in the cases
booked against their companies and not to cause further harassment.
Accordingly, in the reference 2nd read above, the Accused officer was
placed under suspension. Later on, he was reinstated into service vide
reference 3rd read above.
And whereas in the reference 2nd read above, the Director
General, Anti Corruption Bureau, Hyderabad in his final report has
recommended the Government to prosecute Sri V. Rajaiah, Assistant
Labour Officer, Bhongir in court of law as he is liable for offences
punishable under section 7 and 13 (2) read with 13(1) (d) of prevention
of corruption Act, 1988.
And whereas in the reference 3rd read above, Government have
examined the matter in detail have accorded sanction for the
prosecution of Sri V. Rajaiah, Formerly Assistant Labour Officer, Bhongir
for the offences punishable U/s 7 and 13(2) r/w 13 (1) (d) of the P.C
Act, 1988 by a competent jurisdiction.

And whereas in the reference 4th read above the Additional
Special Judge for SPE and ACB cases, Hyderabad has pronounced the
Judgment against Sri V. Rajaiah, formerly Assistant Labour Officer,
Bhongir finding him not guilty of the changes against him and acquitted
him.
And whereas in the reference 5th read above the Director General,
Anti Corruption Bureau, Hyderabad has requested the Government to
give permission to proper an appeal in High Court of Andhra Pradesh
against the acquittal Judgment as the Additional Special Judge for SPE
and ACB cases, Hyderabad.
And whereas in the reference 6th read above, Government
accorded permission to the Director General, Anti Corruption Bureau,
Hyderabad for preferring an appeal in High Court of Andhra Pradesh
against the acquittal of the accused officer Sri V. Rajaiah, former
Assistant Labour Officer, Nalgonda.
And whereas in the reference 7th read above, the High Court of
Andhra Pradesh has pronounced Judgment in Criminal Appeal
No.651/2004 dismissing the Criminal Appeal filed by the Director
General, Anti Corruption Bureau, Hyderabad and confirmed the
Judgment of the Lower Court in acquitting the Accused Officer, Sri
Rajaiah, Assistant Labour Officer, Bhongir.
And whereas in the reference 8th read above the Director General,
Anti Corruption Bureau, has requested to permit him to prefer an
appeal in Supreme Court of India against the Judgment of High Court of
Andhra Pradesh in Criminal Appeal No.651/2004.
Government after careful examination of the matter hereby direct
that further action against Sri V. Rajaiah, formerly Assistant Labour
Officer, Bhongir be dropped.
The Commissioner of Labour, Andhra Pradesh, Hyderabad is
requested to take action accordingly.
