The Director of Mines & Geology, Hyd., File No.19723/R4-1/06 dated 20.12.2011. *** ORDER: In the G.O.1st read above, Government have granted a Mining Lease for Limestone and Serpentine over an extent of 4.113 Hectares in Sy.No.12/B and 13/C,E,F of Nagarur (V), Yadiki Mandal, Anantapur District in favour of Sri G.Peddi Reddy for a period of 20 years with a condition that the grantee should execute the lease deed within a period of six months from the date of issue of the order, as per rule 31 (1) of M.C. Rules,1960. 2. In his letter 2nd read above, the Director, Mines & Geology has stated that the Asst.Director of Mines and Geology, Tadipatri vide his Lr.No.754/M2/2004, dated 27.3.2008 has reported that the grantee i.e., Sri G.Peddi Reddy has failed to execute the lease deed within the stipulated time under rule 31(1) of M.C. Rules,1960 and recommended for revocation of the grant order. 3. Based on the proposals of the Director of Mines and Geology, a Show Casuse Notice was issued on 20.11.2010 to Sri G.Peddi Reddy, proposing for revocation of the Mining Lease granted vide G.O.Ms.No.304,dt.10-11-206, on the ground that, the applicant has failed to execute the lease deed within the stipulated time under rule 31 of MC Rules, 1960. 4. In the reference 4th read above, the grantee Sri G.Peddi Reddy has stated that due to his prolonged ill health he could not execute the lease deed within the period stipulated under Rule 31 of Mineral Concession Rules, 1960 and enclosed medical certificate and requested the Government to drop the action proposed against him vide Govt. Memo.No.7220/M.III(1)/2008-1,dated 27.11.2010 and to permit him to execute the lease deed. 5. In the reference 5th read above, Government has requested the Director of Mines and Geology, Hyderabad to furnish his remarks on request of the grantee. 6. In the reference 6th read above, the Director of Mines and Geology has stated that the grantee Sri G.Peddi Reddy has stated that due to his prolonged ill health he could not execute the lease deed within the period stipulated under Rule 31 of M.C.Rules 1960 and (P.T.O)::2:: enclosed medical certificate. As seen from the Medical Certificate, Sri G. Peddi Reddy was under Medical treatment from 01.5.2007 onwards. The Director of Mines and Geology, Hyderabad also stated that Government issued orders granting Mining Lease vide G.O.Ms.No.304, Ind.& Com.(M.III) Dept., dt.10.11.2006 and lease deed is to be executed with in 6 months from the date of issue of orders i.e. on or before 09.4.2007. As seen from the Medical Certificate, Sri G. Peddi Reddy was under Medical treatment from 01.5.2007 onwards only. After grant of lease Sri G.Peddi Reddy is in good health condition for 7 months. The explanation given by Sri G.Peddi Reddy that due to prolonged illness he could not able to execute the lease is not correct and not satisfactory also. 7. Finally, the Director of Mines and Geology has requested the Government to revoke the grant order, issued vide G.O.Ms.No.304 Inds. & Com (M.III) Dept., dated 10.11.2006 in favour of Sri G.Peddi Reddy for Lime stone and Serpentine over an extent of 4.113 Hectares in S.No.12/B and 13/C,E,F of Nagarur (V), Yadiki Mandal, Anantapur District under rule 31(1) of M.C.Rules,1960. 8. Government, after careful examination of the matter, hereby revoke the orders issued in the G.O. 1st read above granting Mining Lease for Limestone and Serpentine over an extent of 4.113 Hectares in S.No.12/B and 13/C,E,F of Nagarur (V), Yadiki Mandal, Anantapur District in favour of Sri G.Peddi Reddy, under Rule 31 of M.C. Rules, 1960. 9. The Director of Mines and Geology shall take necessary further action accordingly.
