ORDER:
In the Memo. 1st read above, Government have proposed to grant the Mining
Lease for Limestone(C.G) over an extent of 660.00 Acres in Sy.Nos. 679, 682 etc., of
Chilamakur, Sy.No.470-3, 470-4 etc., of Nidizuvvi Village, Yerraguntla Mandal,
Y.S.R. District, in favour of M/s Teja Cement Limited for a period of 30 years, subject
to submission of Approved Mining Plan under rule 22(4) of M.C.Rules 1960 and
subject to obtaining the Consent for Establishment from A.P. Pollution Control Board
and Environmental impact Assessment Reports from Ministry of Environmental and
Forests, Govt. of India as per S.O.1533, dt.14.9.2006 and further subject to condition
to establish Cement Unit within three years from the date of grant of Mining Lease as
per G.O.Ms.No.32, Ind.& Com Dept., dt. 19.02.1997.
2. The Director of Mines and Geology in the reference 2nd read above, has sent
proposals along with the Mining Plan approved by the Indian Bureau of Mines,
Bangalore vide Lr.No.MP/AP/CDP/LST-234-SZ, dt.29.11.2011; Consent for
Establishment from A.P. Pollution Control Board, Hyderabad Order
No.183/PCB/CFE/RO-TPT/HO/2011,dt.15-10-2011 and Environmental Clearance from
Ministry of Environment and Forests, Government of India, F.No.J-11011/234/2010-
IA-II(I),dt.13-5-2011 and recommended for grant of Mining Lease for Limestone
(C.G) over an extent of 660.00 Acres in Sy.Nos. 679, 682 etc., of Chilamakur,
Sy.No.470-3, 470-4 etc., of Nidizuvvi Village, Yerraguntla Mandal, Y.S.R. District, in
favour of M/s Teja Cement Limited for a period of 30 years, subject to satisfaction of
M.C.Rules,1960 and MM (D&R) Act, 1957, and with a condition to establish Cement
Unit within 3 years from the date of grant of Mining Lease as per G.O.Ms.No.32,
Ind & Com Dept., dt.19.02.1997.
3. After careful examination of the matter, Government, hereby grant Mining
Lease for Limestone (C.G) over an extent of 660.00 Acres in Sy.Nos. 679, 682 etc.,
of Chilamakur, Sy.No.470-3, 470-4 etc., of Nidizuvvi Village, Yerraguntla Mandal,
Y.S.R. District, in favour of M/s Teja Cement Limited for a period of 30 years, subject
to satisfaction of M.C.Rules,1960 and MM (D&R) Act, 1957 and with a condition to
establish Cement Unit within 3 years from the date of grant of Mining Lease as per
G.O.Ms.No.32, Ind & Com Dept., dt.19.02.1997 and also subject to the conditions in
Form-K prescribed under the Mineral Concession Rules, 1960 and to the additional
conditions specified in the Appendix to this order.
4. The rates of Royalty, Dead Rent, Surface Rent and water charges and also
Cess shall be collectable as follows or as revised by the Government from time to
time:
(P.T.O)::2::
Limestone : Seventy two Rupees per tonne.
(a) L.D.Grade (Less than one and
Half percent silica content)
(b) Others : Sixty two Rupees per tonne
II. Dead Rent:
[Rates of dead rent in rupees per hectare per annum or as revised from time to time]
From 2nd year of Lease 3rd & 4th year onwards 5th Year onwards
Rs.200/- Rs.500/- Rs.1000/-
III. Surface rent and : As fixed by the Government
water charges and from time to time
also Cess
5. The grantee should pay a deposit of Rs.10,000/- as prescribed under rule 32
of the Mineral Concession Rules,1960 before the Lease is actually executed.
6. The grantee should execute the lease deed within the time limit specified in
Rule 31 of Mineral Concession Rules,1960.
7. The terms and conditions referred to in paras 3 to 6 of this order are subject to
such further modifications, additions and alterations as may be ordered before the
lease deed is executed.
8. The Director of Mines and Geology shall take necessary further action for the
execution of the lease deed after satisfying himself that the grantee fulfils all the
required provisions of the amended Act and Rules. As soon as the deed is executed,
the date of such execution should be reported to the Government.
Note: The grant is liable for cancellation, should it be found
that it was grossly inequitable or was made under a
mistake of fact or owing to misrepresentation or fraud or
in excess of authority.
