Memo. No.319/M-III(1)/2009-1,Ind. & Com.(M.III) Dept., Dated 01-09-2009. 2) From Director of Mines and Geology, F.No.34543/R5-2/2008, Dated 09-01-2012. ***** O R D E R: In the Memo. 1st read above, Government have proposed to grant a Mining Lease for Pyrophillite over an extent of 334.40 Acres (135.330 Hectares) in Sy. No.2865 of Nooliveedu Village, Galiveedu Mandal, Kadapa District in favour of Sri K.John Karunakar for a period of 20 years, subject to submission of Approved Mining Plan under rule 22(4) of M.C. Rules, 1960 and subject to consent for Establishment (CFE) from the A.P.P.C.B, and Environmental clearance as per the Notification No.S.O.1533, dated 14-9-2006. 2. In the reference 2nd read above, the Director of Mines and Geology, Hyderabad has stated that Sri K.John Karunakar has submitted a Notarized affidavit on 30.11.2009 wherein he has stated that, he has applied for grant of Mining Lease for Pyrophillite in Sy.No.2865 of Nooliveedu Village, Galiveedu Mandal, Kadapa District over an extent of 334.40 Acs / 135.330 hects. Further he requested to reduce the recommended area for Mining Lease from 334.40 Acs to 59.05 Acs as shown in the mining plan, surveyed and recommended by R.Q.P stating that it has been noticed during the survey and preparation of Mining Plan that 59.05 Acs confined to Mineral bearing area. As such the applicant has requested to delete 275.35 Acs, which is non Mineral bearing area and to accept 59.05 Acs as Mineral bearing area for Mining Lease as proposed by R.Q.P. 3. The Director of Mines & Geology stated that the Asst.Director of Mines and Geology, Kadapa has reported that the applied area has been re-surveyed by the surveyor on 01.12.2009 and reported that the applied area comes to 59.05 Acrs or 23.900 hectares, as against the originally recommended area 385.40 Acres or 135.330 hects, for which the applicant has accepted to take the re-surveyed area of 59.05 Acrs or 23.900 hectares in Sy.No.2865 of Nooliveedu Village, Galiveedu Mandal, Kadapa District. The Asst.Director of Mines and Geology also submitted re-inspection report in the matter and submitted revised proposals for the reduced area. 4. The Director of Mines and Geology, Hyderabad has submitted proposals along with the Approved Mining Plan duly approved by the Zonal Joint Director of Mines and Geology, Kadapa; Consent Order for Establishment (CFE) issued by AP Pollution Control Board vide Order No.CDP-185/PCB/ZOK/CFE/2011-312,dated 1.07.2011; Environmental Clearance Order No.SEIAA/AP/KDP-24/2011, Dt.20.05.2011 of SEIAA of Government of India Ministry of Environment & Forests, Hyderabad; Re-Survey Report along with Sketch duly signed by the signatures of Tahsildar, Galiveedu, ADMG, Kadapa and the applicant; and Notarized affidavit submitted by the applicant for the reduced area i.e. 59.05 Acres instead of 334.40 Acres in Sy.No.2865 of Nooliveedu Village, Galiveedu Mandal. 5. The Director of Mines and Geology, Hyderabad has requested the Government to grant the Mining Lease for Pyrophillite over an extent of 59.05 Acres or 23.906 Hectares (instead of 385.40 Acres as proposed earlier) in Sy.No.2865 of Nooliveedu Village, Galiveedu Mandal, Kadapa District for a period of 20 years in favour of Sri K.John Karunakar. 6. Government, after careful examination, hereby grant a Mining Lease for Pyrophillite over an extent of 59.05 Acres or 23.906 Hectares (instead of 385.40 Acres as proposed in the reference 1st read above) in Sy.No.2865 of Nooliveedu Village, Galiveedu Mandal, Y.S.R.District for a period of 20 years in favour of Sri K.John Karunakar, subject to (P.T.O)::2:: satisfaction of MM(D&R) Act, 1957 and rules made there under in general, also subject to the conditions in Form-K prescribed under the M.C. Rules, 1960 and to the additional conditions specified in the Appendix to this order. 7. The rates of royalty, dead rent, surface rent and water charges shall be collectable as follows: I. Rates of Royalty: Pyrophillite Twenty percent of sale price on ad valorem basis. II. Dead Rent Rates of dead rent in rupees per hectare per annum or as revised by the Government from time to time From second year of Third year and fourth year Fifth year lease onwards 200 500 1000 III.Surface rent and water As fixed by the Government from time charges to time. 8. The grantee should execute the lease deed within the time limit specified in Rule 31 of Mineral Concession Rules, 1960. 9. The grantee should pay a deposit of Rs.10,000/- as prescribed under Rule 32 of the Mineral Concession Rules, 1960 before the lease is actually executed. 10. The terms and conditions referred to in paras 6 to 8 of this order are subject to such further modifications, additions and alterations as may be ordered before the lease deed is executed. 11. The Director of Mines and Geology, shall take necessary further action for the execution of the lease deed after satisfying himself that the grantee fulfils all the required provisions of the amended Act and Rules. As soon as the deed is executed, the date of such execution should be reported to the Government. Note:-The grant is liable for cancellation, should it be found at a later date that it was grossly inequitable or was made under a mistake of fact or owing to misrepresentation or fraud or in excess of authority.
