From the Director of Mines and Geology, Hyderabad, File No.37485/R6-1/2010, dated:31.01.2012. ***** ORDER:- In the reference first read above, while furnishing the proposals, the Director of Mines & Geology, Hyderabad has requested the Government to consider for grant of Mining Lease for Laterite over an extent of Ac.12.04 Gts (4.896 Hects.,) in Sy.No.2539/P to 2541/P, 2544/P, 2545/P, 2546, 2547, 2548, 2550/P & 2556/P to 2558/P (Patta Lands) of Ramachandrapuram (V), Mulugu (M), Warangal District for a period of 20 years in favour of M/s. Vinayaka Mines & Minerals, Prop. Sri Kusuma Ramesh subject to submission of consent for establishment from A.P. Pollution Control Board as per O.S.No.1533, dated:14-09-2006 and also subject to satisfaction of all terms and conditions laid down in Mineral Concession Rules, 1960 & Mine and Minerals (Development and Regulation) Act, 1957. The Director of Mines and Geology, Hyderabad has also requested to issue a notice to the applicant for submission of approved mining plan as requested under Rule 22(4) of Mineral Concession Rules, 1960. 2. In the reference second read above, it was informed that Government have proposed to grant of Mining Lease for Laterite over an extent of Ac.12.04 Gts. (4.896 Hects.,) in Sy.Nos.2539/P to 2541/P, 2544/P, 2545/P, 2546, 2547, 2548, 2550/P & 2556/P to 2558/P (Patta Lands) of Ramachandrapuram Village, Mulugu Mandal, Warangal District for a period of 20 years in favour of M/s.Vinayaka Mines & Minerals, Prop.Sri Kusuma Ramesh subject to submission of consent for Establishment from A.P.Pollution Control Board as per O.S.No.1533, dt:14-9-2006 and also subject to satisfaction of all terms and conditions laid down in Mineral Concession Rules, 1960 & Mines and Mineral (Development and Regulation) Act, 1957, and also a notice may be issued to the applicant for submission of approved mining plan under Rule 22(4) of Mineral Concession Rules, 1960. Sri Kusuma Ramesh, proprietor, M/s. Vinayaka Mines & Minerals was requested to submit the Mining Plan approved by the authorities concerned through the Director of Mines & Geology, Hyderabad for the area referred above within a period of six (6) months from the date of receipt of the memo for consideration of his Mining Lease Application and to submit the Consent for Establishment (C.F.E) from A.P. Pollution Control Board. 3. In the reference third read above, the Director of Mines & Geology, Hyderabad has stated that the applicant firm submitted the Mining Plan approved by the Zonal Joint Director of Mines & Geology, Hyderabad vide Letter No.5969/MP/WGL/2011, dated:12.10.2011 and also submitted a copy of clearance obtained from A.P.Pollution Control Board, Zonal Office, Hyderabad vide Order No.121-WGL/APPCB/ZOH/CFE/2011, dated:06.01.2012 and requested the Government to grant of Mining Lease for Laterite over an extent of Ac.12.04 Gts [P.T.O]:: 2 :: (4.896 Hects.,) in Sy.Nos.2539/P to 2541/P, 2544/P, 2545/P, 2546, 2547, 2548, 2550/P & 2556/P to 2558/P (Patta Lands) of Ramachandrapuram (V), Mulugu (M), Warangal District for a period of 20 years in favour of M/s.Vinayaka Mines & Minerals, Prop. Sri Kusuma Ramesh. 4. The Government after careful examination, hereby grant a Mining Lease for Laterite over an extent of Ac.12.04 Gts (4.896 Hects.,) in Sy.Nos.2539/P to 2541/P, 2544/P, 2545/P, 2546, 2547, 2548, 2550/P & 2556/P to 2558/P (Patta Lands) of Ramachandrapuram (V), Mulugu (M), Warangal District for a period of 20 years in favour of M/s.Vinayaka Mines & Minerals, Prop. Sri Kusuma Ramesh, subject to satisfaction of all other terms and conditions of Mines and Minerals (Development & Regulation) Act, 1957 and Mineral Concession Rules, 1960 and to the additional conditions specified in the Appendix to this order. 5. The rates of royalty, dead rent, surface rent and water charges shall be collectable as follows, or as revised by the Government from time to time. I. Rates of Royalty : LATERITE : (a) Zero point five zero percent of London Metal Exchange Aluminium metal price chargeable on the contained aluminium metal in ore produced for those dispatched for use in alumina and aluminium metal extraction. (b) Twenty five per cent of sale price on ad valorem basis for those dispatched for use other than alumina and aluminium metal extraction and for export. II. Dead rent : (Rates of Dead rent in Rupees per hectare per annum or as revised by the Government from time to time. ) From the second year 3rd year and 4th year 5th year onwards of lease 200/- 500/- 1000/- III. Surface rent and Water charges : As fixed by the Government from time to time. 6. The grantee should pay a deposit of Rs.10,000/- as prescribed under Rule 32 of the Mineral Concession Rules, 1960 before the lease is actually executed. 7. The grantee should execute the lease deed within the time limit specified in Rule 31 of Mineral Concession Rules, 1960. 8. The terms and conditions referred to at paras 4 to 7 of this order are subject to such further modifications, additions and alterations as may be ordered before the lease deed is executed. 9. The Director of Mines & Geology, Hyderabad is requested to take necessary further action for execution of the lease deed after satisfying himself that the grantee fulfills all the required conditions and other provisions of the Act and Rules applicable in this regard and as soon as the deed is executed, the date of such execution should be reported to the Government. [Contd.P.3]:: 3 :: Note: The grant is liable for cancellation should it be found that it was grossly inequitable or was made under a mistake of fact or owing to misrepresentation or fraud or in excess of authority.
