(M.I) Dept., dated 05-02-2001. 2) From the Director of Mines & Geology, Hyderabad F.No.5581/R7-1/2009, dated 25.03.2009. 3) Government Show Cause Notice Memo.No.4596/M.I(2)/2009, dated 14.10.2010. 4) Reply from the General Manager, M/s. Trimex Indsutries Ltd, dt. 29.10.2010. 5) From the Director of Mines & Geology, Hyderabad F.No.5581/R7-1/2009, dated 02.01.2012. *** ORDER:- In the reference 1st read above, Government have granted the Mining lease for Quartz and Feldspar over an extent of 3.00 Acres in Sy.No.392/1 of Mallareddypalli Village, Chintapalli Mandal, Nalgonda District, in favour of M/s. Trimex Industries Limited for a period of 20 years. The Mining Lease was executed on 21-07-2001 and it will be in force up to 20-07-2021. 2. In the reference 2nd read above, the Director of Mines & Geology has requested the Government to declare the Mining lease for Quartz and Feldspar over an extent of 3.00 Acres in Sy.No.392/1 of Mallareddypalli Village, Chintapalli Mandal, Nalgonda District, granted in favour of M/s. Trimex Industries Limited as lapsed under Rule 28(1) of M.C. Rules, 1960 on the ground that the Mine is not working for the last three years and the lessee is not erected the boundary pillars 3. Therefore, Government have proposed to declare the Mining lease for Quartz and Feldspar over an extent of 3.00 Acres in Sy.No.392/1 of Mallareddypalli Village, Chintapalli Mandal, Nalgonda District, held by M/s. Trimex Industries Limited as lapsed under Rule 28 (1) of M.C. Rules, 1960 for the reasons stated in para (2) above. Accordingly a Show Cause Notice vide reference 3rd read above was issued to the lessee company to submit their explanation, as to why action as proposed in para-2 above shall not be taken within 15 days, failing which, further action will be taken on the basis of the material available with the Government. 4. In their reply vide reference 4th read above, the General Manager (Operations) of M/s. Trimex Industries Limited have submitted their explanation stating that, they have operating the mine continuously, the details of which can be verified from the Royalty Permits taken, Dead Rent paid and the monthly returns submitted till date. They have requested the Government to kindly give necessary instructions to the concerned officials for visiting their operating mine so that the discriminations pointed in the show cause notice can be verified at the Mine itself. 5. In the reference 5th read above, the Director of Mines & Geology, Hyderabad has stated that, the above mine worked for a period of 4 years after execution of lease deed and subsequently the mine was kept under non working for more than 3 years period. As per the recent inspection report and observations of the Royalty Inspector of the ADM&G office, Nalgonda, it appears that the mine is again started working during the year 2011. As per the ADM&G., Nalgonda records the last dispatch permit was obtained on 7-4-2005 for a quantity of 206 MT of Feldspar. He further stated that, as per his records the lessee company is furnishing monthly returns regularly by showing the mine is working continuously since execution of lease deed, even in the non working period also. It clearly shows that the monthly returns furnished by M/s. Trimex Industries Ltd., for the non-working period are fabricated one. The DM&G has therefore requested the Government to pass necessary deemed fit orders on the application filed by M/s Trimex Industries Limited in connection with mining lease lapsed under Rule 28 (1) of MC Rules, 1960. (P.T.O.)-2- 6. Government after careful examination of the reply furnished by the Director of M/s. Trimex Industries Limited and further remarks of the Director of Mines & Geology, Hyderabad, have decided to determine the Mining Lease for Quartz and Feldspar over an extent of 3.00 Acres in Sy.No.392/1 of Mallareddypalli Village, Chintapalli Mandal, Nalgonda District, held by M/s. Trimex Industries Limited as lapsed under Rule 28(1) of M.C. Rules, 1960. 7. Therefore, Government, hereby declare the Mining lease for Quartz and Feldspar over an extent of 3.00 Acres in Sy.No.392/1 of Mallareddypalli Village, Chintapalli Mandal, Nalgonda District, held by M/s. Trimex Industries Limited as lapsed under Rule 28(1) of M.C. Rules, 1960. 8. The Director of Mines and Geology, Hyderabad is requested to take necessary further action in the matter accordingly.
