Sri Vishwajith Minerals, Warangal for the unexpired period of lease up to 11-06-2029 under Rule 37(1) of Mineral Concession Rules, 1960 - Permission Accorded - Orders – Issued. ---------------------------------------------------------------------------------- INDUSTRIES AND COMMERCE (MINES.II) DEPARTMENT G.O.Ms.No. 63 Dated:29-02-2012 Read the following:- 1) G.O.Ms.No.72, Industries & Commerce (M.II) Department, dated:13-03-2008. 2) From the Director of Mines & Geology, Hyderabad File No.16794/R6-1/2011, Dated:19.09.2011, 24-10-2011 & 11.11.2011. ***** ORDER:- In the reference 1st read above, orders were issued granting Mining Lease for Quartz over an extent of 11.07 Hect., in Sy.No.1616 of Velair Village, Dharmasagar Mandal, Warangal District for a period of 20 years in favour of Sri P.Sampath Kumar, subject to obtaining prior environmental Clearance as per the notification No.S.O.1533, dated:14.09.2006 under Sub Section 2 of Section 3 of Environment (Protection) Act, 1986, read with clause (d) of Sub-Rule (3) of Rule 5 of Environment (Protection) Rules, 1986 before execution of lease deed and subject to satisfaction of terms and conditions of MM(D&R) Act, 1957 and rules made thereunder in general and also subject to the conditions in Form-K prescribed under MC Rules 1960 and to the additional conditions specified in the Appendix to the order and subject to satisfying other applicable Acts and Rules. 2. In the reference 2nd read above, the Director of Mines & Geology, Hyderabad has stated that the lease was executed vide Procds.No.252/Q/2006, dated:12.06.2009, it will be inforce upto 11.06.2029. The lessee Sri P.Sampath Kumar through the letter dated:Nil have filed transfer application before the Assistant Director of Mines and Geology, Warangal on 27.01.2011 held by him infavour of M/s Vishwajith Minerals, Hanumakonda, Warangal. The Assistant Director of Mines & Geology, Warangal vide Letter No.513/M/2011, dated:20.05.2011 submitted proposals on the transfer of Mining Lease filed by Sri P.Sampath kumar for Quartz over an extent of 11.07 Hec in S.No.1616 of Velair Village, Dharmasagar Mandal, Warangal District in favour of M/s Vishwajith Minerals for the un expired portion of the lease period upto 11.06.2029 and also stated that the lessee i.e., Sri P.Sampath Kumar through Notarized Affidavit informed that he has decided to transfer the mining lease held by him in favour of M/s.Sri Vishwajith Minerals, Hanumakonda, Warangal for the unexpired portion of the lease period upto 11.06.2029 due to personal and financial problems and there is no speculation involved in the proposed transfer of mining lease and he has taken an amount of Rs.70,000/- spent towards actual development of the mining lease and the transferee firm i.e., M/s Vishwajith Minerals through Notarized Affidavit [P.T.O]-2- informed that they have no objection to undertake the mining lease held by Sri P.Sampath Kumar and they have financially capable to do mining operations through engaging heavy machinery and also develop the mining lease systematically and they will accept the transfer of mining lease held by Sri P.Sampath Kumar. There is no speculation involved in the transaction, they have paid Rs.70,000/- to the transferor towards the expenditure incurred in the development of the mine. Further they will pay the mineral revenue dues if any arises in the future in respect of the said mining lease. 3. The Director of Mines & Geology, Hyderabad has also stated that, the transferor has submitted the Mineral Revenue Clearance Certificate issued by the Deputy Director of Mines and Geology, Warangal which is valid upto 30.09.2011 and also submitted Xerox copy of the Approved Mining Plan approved by the Zonal Joint Director of Mines and Geology, Hyderabad on 30.10.2008 and the Assistant Director of Mines and Geology, Warangal (vide Memo.no.16794/R6-1/2011, dated:10.08.2011) was requested to furnish the information with regard to production and dispatch particulars of the transferor i.e., Sri P.Sampath Kumar from 2009 to 2011 (upto July 2011). The Assistant Director of Mines and Geology, Warangal vide Lr.No.513/M/2011, dated:24.08.2011 submitted production and dispatch particulars as detailed below: Year Production in MT Dispatches in MP 2009-10 3740 3740 2010-11 5520 5520 Upto July’11) 1000 1000 4. The Director of Mines & Geology, Hyderabad has requested the Government to accord permission for transfer of Mining Lease held by Sri P.Sampath Kumar for Quartz over an extent of 11.07 Hect in Sy.Nos.1616 of Velair Village, Dharmasagar Mandal, Warangal District in favour of M/s. Sri Vishwajith Minerals, Warangal for the unexpired period of lease up to 11-06-2029 under Rule 37(1) of Mineral Concession Rules, 1960. 5. Government after careful examination have decided to accord permission for transfer of Mining Lease held by Sri P.Sampath Kumar for Quartz over an extent of 11.07 Hect in Sy.Nos.1616 of Velair Village, Dharmasagar Mandal, Warangal District in favour of M/s. Sri Vishwajith Minerals, Warangal for the unexpired period of lease up to 11-06-2029 under Rule 37(1) of Mineral Concession Rules 1960. 6. Accordingly, Government hereby accord permission for transfer of Mining Lease held by Sri P.Sampath Kumar for Quartz over an extent of 11.07 Hect in Sy.Nos.1616 of Velair Village, Dharmasagar Mandal, Warangal District in favour of M/s. Sri Vishwajith Minerals, Warangal for the unexpired period of lease up to 11-06-2029 under Rule 37(1) of M.C.Rules, 1960, subject to the satisfaction of Mineral Concession Rules, 1960 and Mines & Minerals (Development &Regulations) Act, 1957 and also subject to the condition that the transferee should abide by the terms and conditions laid down in original grant orders issued in the reference 1st read above and other relevant rules and regulations and subsequent amendments issued from time to time, there under, and also all other applicable Acts & Rules in this regard. The transfer lease deed should be executed within three months from the date of receipt of this order and both the transferor and transferee should pay all mineral revenue dues, if any, to the Government till the date of transfer, and fulfill all the conditions required, before execution of transfer lease deed. 8. The Director of Mines & Geology, Hyderabad is requested to take further necessary action in the matter after satisfying himself that all the provisions of the Rules/Acts are fulfilled by both the parties as required under applicable Rules/Acts.
