Read:- 1.From the CTE, Hyd., Lr.No.C1/576/2012, Dt.10-01-2012. 2.From the CTE, Hyd., Lr.No.C1/18371/2011, Dt.17-01-2012. *** ORDER:- In the references read above, the Commissioner of Technical Education, A.P., Hyderabad has furnished a Provisional Seniority List of Principals of Government Polytechnics who have completed two years of service as on 01-09-2011, prepared based on Special Rules for APTES issued in G.O.Ms.No.178, Higher Education (TE.2) Department, Dated: 09-12-2005, which was communicated to the individuals concerned with a request to submit their objections, if any. The Commissioner of Technical Education has examined the objections received from the incumbents and forwarded the same together with his remarks to Government with a request to examine the objections and to communicate the final seniority lists of Principals in Government Polytechnics as on 01-09-2011. 2. The Government, after careful examination of the objections raised on the provisional seniority list (with their Serial Numbers in the provisional seniority list given in brackets), and duly taking into consideration, the remarks offered by the Commissioner of Technical Education on each of them, have come to the conclusion as indicated below:- i) Sri P.Yellaiah (Sl.No.11) :- The incumbent represented that his seniority in the cadre of Principal is to be fixed duly effecting notional promotion from 12.10.2003 as per Govermment Memo. No.11371/TE-I-2/2003-1, Dated 28.9.2004 and in accordance with the G.O.Ms.No.354, General Administration (Services-A) Dept., Dated 11.5.1990 duly preponing the date of promotion as Principal from 30.9.2007 to 12.3.2003 on similar lines as effected to Sri R.V.Ramana Rao, Principal, G.M.R. Polytechnic, Paderu, since carry forward vacancies (3 Nos) for Scheduled Caste were existing in between the period after effecting the promotions to the post of Principal in August, 2003 and before effecting promotion to the post of Principals in September, 2007 vide G.O.Ms.No.63, Higher Education (TE-2) Dept., Dated 25.8.2003 and G.O.Ms.No.185, Higher Education (TE-I-2) Department, Dated 29.9.2007 respectively; that Dr. K. Raghunath was promoted to the post of Principal, AP Government Institute of Leather Technology, Hyderabad, i.e., category-I of class-C; that the Amendment to the Special Rules for APTES issued in G.O.Ms.No.147, H.E. (TE.1) Department, Dated:13.11.2009 providing for promotion of the Principals of AP Government Institute of Leather Technology, Hyderabad and Government Institute of Printing Technology, Secunderabad, i.e., category-I of class-C to the posts of Joint Directors cannot be enforced retrospectively and as such, his name should be deleted from the seniority list; that the Principals who are already promoted with their existing qualifications, i.e., Bachelor’s Degree for Engineering stream and Master’s Degree for Non-Engineering stream by virtue of Contd…2/p:: 2 :: qualifications relaxation as per G.O.Ms.No.72, H.E.(TE.2) Department, Dated 26.9.2002 are not eligible to be included in the seniority list and for further promotion to the posts of Joint Director including Regional Joint Directors; that the names of the Principals who do not possess the prescribed qualification of M.Tech. for Engineering stream and Ph.D. for Non-Engineering stream should be deleted from the seniority list and therefore, requested to consider the above objections before finalising the seniority list duly showing his name at the appropriate place for effecting further promotion. In pursuance of the orders issued in Govt. Memo. No.11371/TE-I-2/2003-1, Dated 28-9-2004 according permission to fill up the post of Principals in Government Polytechnics by promoting Sri P.Yellaiah, Head of Civil Engineering Section, SRRS Government Polytechnic, Sircilla purely on adhoc basis as per seniority under rule 10(a) of A.P. State and Subordinate Service Rules, 1996, necessary proposals have been submitted to the Government by the then Director of Technical Education to consider his promotion on adhoc basis to the post of Principal in Government Polytechnics through DPC. But his case could not be considered by the Government. His case was, however, considered along with the other eligible candidates for promotion to the post of Principals for the panel year 2006-07 against one of the SC carry forward vacancies. Accordingly, he was promoted as Principal vide G.O.Ms.No.185, H.E.(TE.1) Department, Dated 29.9.2007 and he assumed charge of the post of Principal on 30-9- 2007. In this connection, it is noticed that the notional promotion of Sri R.V.Ramana Rao, Principal, GMR Polytechnic, Paderu was considered as a sequel to consideration for his notional promotion to the post of Senior Lecturer in Metallurgy in Zone-I through Departmental Promotional Committee. Therefore, the case of Sri R.V.Ramana Rao is different from that of the case of Sri P.Yellaiah and as such, the latter is not entitled for advancement of his date of promotion from 30-9-2007 to 12-10-2003 as was considered in respect of Sri R.V.Ramana Rao, Principal, GMR Polytechnic, Paderu. In the light of the Special Rules for APTES issued in G.O.Ms.No.178, H.E. (TE.2) Department, Dated:.9-12-2005 read with the ad-hoc rules issued in G.O. Ms.No.292, LE & TE (TE.2) Department, Dated:.8.12.1987, Dr. K.Raghunath, Head of Leather Chemistry was considered through DPC for promotion to the post of Principal of A.P. Government Institute of Leather Technology, Hyderabad (Category-I of class-C in APTES) vide G.O.Ms.No.99, H.E.(TE.2) Department, Dated: 27.6.2006 and accordingly, he assumed charge of the post on 27.7.2006. Later, an amendment to Rule 3 of the above Special Rules for APTES was issued in G.O.Ms.No.147, H.E.(TE.1) Department., Dated 13.11.2009 providing a channel of promotion to the Principals of Special Polytechnics, viz., A.P. Government Institute of Leather Technology and Government Institute of Printing Technology to the post of Joint Director including the posts of Regional Joint Directors. To say in other words, on and from 13.11.2009, the Principals of A.P. Government Institute of Leather Technology and the Principal of Govt Institute of Printing Technology are eligible for promotion to the post of Joint Director along with the Principals of Polytechnics, i.e., category-I of class-B in APTES and an inter se seniority list of Principals of Polytechnics and the Principals of Special Polytechnics is to be prepared and issued and based on their seniority in the seniority list so issued, promotions to the posts of Joint Director are to be considered. Keeping in view the above position, the provisional seniority list of Principals was prepared duly showing the name of Dr. K.Raghunath at Sl.No.(10) and communicated. Contd….3/p:: 3 :: In the Special Rules for APTES issued in G.O.Ms.No.178, H.E. (TE.2) Dept., dt.9.12.2005, no qualifications are prescribed for the posts of Joint Director including Regional Joint Directors as was prescribed for the posts of Principals, Heads of Sections, etc. As per Rule 3 of the said Special Rules, the post of Joint Director is to be filled by promotion from category-I of class-B and category-I of class-C. Therefore, the question of insisting on M.Tech. qualification or Ph.D. for promotion to the posts of Joint Director does not arise. In the above circumstances, the plea of Sri P.Yellaiah to delete the name of Dr. K.Ragunath from the seniority list and also for deletion of the names of the Principals who do not possess the qualifications of M.Tech. or Ph.D. from the seniority list cannot be considered and the same is therefore rejected. ii) Sri J.Satyanarayana Murthy (Sl.No.5):- 1) He has represented that he was selected as Head of Section in Government Polytechnics by APPSC in the year 1991 and Sri R.V.Ramana Rao was promoted as Head of Section through DPC in the year 1994. Hence, R.V. Ramana Rao is junior to him in the cadre of Head of Section; (2) That Sri R.V. Ramana Rao was promoted as Principal based on the vertical seniority which is not applicable to him as per Rule 33 of AP State and Subordinate Service Rules and there is no ratio application for promotion between APPSC direct recruitees and DPC promotees Heads of Sections in the Department vide G.O.Ms.No.607, GA (Services) Department, Dated 6.11.1992, which was supported by APAT in O.A. No.5236/2007 and the same was ascertained by Government in G.O.Ms.No.31, HE (TE.1) Department, Dated 8-4-2011. Hence, inclusion of Sri R.V.Ramana Rao above me in the final seniority list is objectionable; (3) He was promoted as Principal in the panel year 2002-03 from Direct Recruitment Heads of Sections in the Reservation category at Sl.No.15 and he must be placed below Sri Ch. Ravindra who was also selected as Head of Section by APPSC in 1991 along with him; (4) Sri D. Venkateswarlu, Additional Secretary, SBTET who was also selected as Head of Section by APPSC in 1991 was promoted as Principal in 1998 and RJD in 2006. Whereas he was not promoted along with him; (5) On his objection on the provisional seniority list of Principals, it was mentioned in G.O.Ms.No.47, HE (TE-1) Department, Dated 1-6-2011 that no qualifications are prescribed for the posts of Joint Directors as were prescribed for the post of Principal, Heads of Sections, etc. He contended that when AICTE Scale of Pay is being implemented for the promotion of JD/RJD, the qualification is also to be implemented along with AICTE Scale as per G.O.Ms. No.178, HE(TE-1) Dept., dated 9- 12-2005. He has requested for review of his case by considering APPSC merit as his juniors became seniors in promotions. The posts of Heads of Sections are subject-wise. The Senior Lecturers of a subject is promoted to the post of Head of Section in that subject only. Sri R.V. Ramana Rao belongs to Metallurgy subject and Sri J.Satyanarayana Murthy to Architecture subject. As there was a provision in the then Special Rules for APTES issued in G.O.Ms.No.1146, GAD (Rules), dated 13.9.1961 governing the posts of Heads of Sections in Polytechnics, among others, for appointment by direct recruitment to the posts of Head of Sections Sri J. Satyanarayana Murthy was appointed through APPSC by direct recruitment to the post of Head of Architecture in the year 1991 along with Sri D. Venkateswarlu and Sri Ch. Ravindra whom he referred to in his representation. As seen from the list of candidates selected for appointment to the posts Contd…4/p:: 4 :: of Heads of Sections, while Sri D.Venkateswarlu and Sri Ch.Ravindra were selected against SC carry forward vacancy and Roster point (4) BC-A vacancy respectively, Sri J. Satyanarayana Murthy against Roster point (7). On representation from Service Associations and individuals working in conventional branches like Civil, Mechanical, EEE, complaining that persons working in diversified branches like ECE, Metallurgy etc., the Special Rules were examined and vertical seniority was introduced for promotions to the posts of Principals by way of Amendment to the then Special Rules for APTES vide G.O.Ms.No.273, Education (TE-I) Department, Dated 20.8.1998. As per the Amendment issued in G.O.Ms.No.273, Education (TE-I) Department, Dated 20.8.1998 for the purpose of promotion to the posts of Principals, a common seniority list of Heads of Section shall be prepared based on their service reckoned from the date of regular appointment to the initial gazetted post, i.e., Lecturers (now called Sr. Lecturer) and the direct recruits to the posts of Heads of Section in Engineering shall be considered for promotions to the post of Principals by following a Roster against every 25th vacancy. This Amendment was upheld both by the Hon’ble APAT and the Hon’ble High Court of AP in O.A. No.8934/1998 and WP No.3360/2001 respectively. Accordingly, Sri J.Satyanarayana Murthy was considered for promotion to the post of Principal against Roster Point (16) vide G.O.Ms.No.55, HE (TE-2) Dept., dated 26.7.2003. (As a matter of fact, he ought to have been considered against Roster Point (26) which is meant for the direct recruitee Head of Section, after the direct recruitment Head of Section Sri Ch.Ravinder against Roster Point (1) in the list). The G.O.Ms.No.607, GA (Services) Department, Dated: 6.11.1992 is applicable where the seniority is taken in the feeder category. In the case of Principal, the vertical seniority is followed in the next below feeder category of Head of Section. Therefore, his seniority cannot be refixed in terms of the said G.O. The same provision as in G.O.Ms.No.273, Education (TE-2) Department, Dated: 20.8.1998 in so far as it relates to direct recruit Heads of Sections, is reflected at Note (6) under Rule (3) of the Special Rules issued in G.O.Ms.No.178, H.E.(TE-2) Department, Dated: 9.12.2005. The Hon’ble APAT set aside the said Note (6) in their Judgement in OA No.5236 of 2007 filed by Sri A.Pullaiah, Head of Mining Engineering Section challenging the said Note. In the light of the said Judgement, the case of Sri A.Pullaiah was considered for promotion to the post of Principal vide G.O.Ms.No.31, H.E.(TE-2) Department, Dated 8.4.2011. His promotion was considered to the post of Principal with reference to Note (4) under Rule 3 of the Special Rules or APTES issued in G.O.Ms.No.1146, GA (Rules), dt. 13.09.1961 as amended in G.O.Ms.No.273, Edn.(TE-2) Dept., dt.20.8.1998. Further, it is submitted that there is no AICTE Scale for the post of JD and the JD/RJD promotees are continuing in the AICTE Scale attached to the post of Principals only. As already mentioned in the reply to his objection in G.O.Ms.No.47, HE (TE-2) Department, Dated.1.6.2011, there are no qualifications prescribed, for the post of Joint Director including RJD were prescribed for the posts of Principals, Heads of Sections, etc. It was prescribed for the posts of Principals, Head of Sections etc., in the Special Rules for APTES issued in G.O.Ms.No.178, HE (TE-2) Department, Dated 9.12.2005. In the connection, it is further submitted that when objections have been called for in this Office Show-cause Memo. No.C1/14480/2009, dated 11.8.2011 on the proposal to place the name of Sri R.V. Ramana Rao, Principal, GMR Polytechnic, Paderu in Contd…5/p:: 5 :: between Sri Ch.Ravindra Sl.No.(1) and Sri B.Suryudu, Sl.No.(2) in the final seniority list of Principals in Govt. Polytechnics communicated vide G.O.Ms.No.47, HE (TE.1) Dept., dated 1.6.2011 for promotion to the post of JD/RJD of Technical Education for the panel year 2010-11, the incumbent, viz., Sri J. Satyanarayana Murthy, Principal raised the same objections vide his representation dated 16.8.2011. The objections raised by the incumbent have been over ruled by the Government as unsustainable vide their Memo. No.14706/TE.1/A2/11-1, dated 10.10.2011. In the above circumstances, the objections raised by the incumbent Sri J.Satyanarayana Murthy, Principal, Government Polytechnic, Narsapur is not sustainable and the same is over ruled this time also. iii) Sri A.Ravindra Babu (Sl.No.12):- The incumbent represented that his seniority in the cadre of Principal is to be fixed duly effecting notional promotion from 12.11.2004 as per Government Memo.No.9726/TE-I-2/2004-1, Dated 3.12.2004 and in accordance with the G.O.Ms.No.354, General Administration (Services-A) Department, Dated 11.5.1990 duly preponing the date of promotion as Principal from 30.9.2007 to 12.11.2004 on similar lines as effected to Sri R.V.Ramana Rao, Principal, G.M.R. Polytechnic, Paderu since carry forward vacancies (3 Nos) for Scheduled Caste were existing in the panel year 2004. The incumbent represented that as per the Special Rules for APTES issued in G.O.Ms.No.178, H.E.(TE.2) Dept., dt.9-12-2005, the posts of Principals of Polytechnics and the posts of Principals of Special Polytechnics, i.e., AP Government Institute of Leather Technology and Government Institute of Printing Technology are two different and distinct categories and the promotional channels of these posts are also different; that based on the said rules, he has been promoted to the post of Principal of Government Polytechnic against an SC carry forward vacancy and that Dr. K. Raghunath was promoted to the post of Principal, AP Government Institute of Leather Technology, Hyderabad, i.e., category-I of class-C; that an amendment to the Special Rules for APTES was issued in G.O.Ms.No.147, H.E. (TE.1) Department, Dated 13.11.2009 providing for promotion of the Principals of AP Government Institute of Leather Technology, Hyderabad and Government Institute of Printing Technology, Secunderabad, i.e., category-I of class-C to the posts of Joint Directors and as such, two separate seniority lists are required to be prepared and the name of Dr. K. Raghunath is to be deleted from the list of Principals of Government Polytechnics; that even assuming that the combined and common seniority list is required to be prepared, the Principals of Special Polytechnics should be given placement taking the date of amendment issued in G.O.Ms. No.147, H.E. (TE.1) Department, Dated 13.11.2009 or subsequent date into consideration and place below the names of the Principals of Government Polytechnics, i.e., category-I of class-B who have been promoted prior to the said amendment and requested to place the name of Dr. K. Raghunath below his name and other Principals of category-I of class-B irrespective of his date of promotion as Principal of Special Polytechnic; that as per the orders issued by Government in Memo No.9726/ TE-1-2/2004-1, dt.3.12.2004 of H.E. Department, he was to be promoted as Principal for the panel year 2004-05 and his services were required to be regularised from the said panel year of 2004-05, but he was given promotion on 30.9.2007 in violation of the said orders; that the provisional seniority list was issued taking into account his actual date of promotion and placed him at Sl.No.(12) instead of at Sl.No.(11) and finally requested to place his name at the appropriate place in the seniority list to be finalised for effecting further promotions. Contd..6/p:: 6 :: In the light of the Special Rules for APTES issued in G.O.Ms.No.178, H.E. (TE.2) Department, Dated: 9-12-2005 read with the ad-hoc rules issued in G.O.Ms.No.292, LE & TE (TE.2) Department, Dated:.8.12.1987, Dr.K.Raghunath, Head of Leather Chemistry was considered through DPC for promotion to the post of Principal of A.P. Govt Institute of Leather Technology, Hyderabad (category-I of class-C in APTES) vide G.O. Ms.No.99, H.E.(TE.2) Department, Dated:.27.7.2006 and accordingly, he assumed charge of the post on 27.7.2006. Later, an amendment to Rule 3 of the above Special Rules for APTES was issued in G.O.Ms.No.147, H.E.(TE.1) Department, Dated 13.11.2009 providing a channel of promotion to the Principals of Special Polytechnics, viz., A.P. Government Institute of Leather Technology and Government Institute of Printing Technology to the post of Joint Director including the posts of Regional Joint Directors. To say in other words, on and from 13.11.2009, the Principals of A.P. Government Institute of Leather Technology and the Principal of Government Institute of Printing Technology are eligible for promotion to the post of Joint Director along with the principals of Polytechnics, i.e., category-I of class-B in APTES and an inter se seniority list of Principals of Polytechnics and the Principals of Special Polytechnics is to be prepared and issued and based on their seniority in the seniority list so issued, promotions to the posts of Joint Director are to be considered. Keeping in view the above position, the provisional seniority list of Principals was prepared duly showing the name of Dr. K.Raghunath at Sl.No.(10) and communicated. In pursuance of the orders issued in Government Memo. No.9726/TE-1-2/2004- 1, H.E.(TE.1-2) Department, Dated:.3.12.2004 according to permission to fill up the posts of Principals in Government Polytechnics by promoting Sri A. Ravindra Babu, the then Head of Mechanical Engineering Section on ad-hoc basis as per seniority under Rule 10(a) of A.P. State & Subordinate Services Rules, necessary proposals have been submitted to Government by the then Director of Technical Education to consider his promotion on ad-hoc basis to the post of Principal in Government Polytechnics through DPC. But his case could not be considered by the Government. His case was, however, considered along with the other eligible candidates for promotion to the posts of Principals for the panel year 2006-07. Accordingly, he was promoted to the post of Principal vide G.O.Ms.No.185, H.E.(TE.1) Dept., dt.29.9.2007 and assumed charge of the post of the Principal on 30.9.2007. In this connection, it is further submitted that on the provisional seniority list of Principals communicated vide CTE Memo. No.C1/ 1354/2010, dated 4.1.2011, the incumbent, i.e., Sri A.Ravindra Babu raised the same objections and the objections have been over ruled vide G.O.Ms.No.47, HE (TE.1) Department, Dated 1.6.2011. In the above circumstances, the request of Sri A.Ravindra Babu to place the name of Sri P. Yellaiah and his name above Dr. K.Ragunath cannot be considered and the same therefore, is rejected this time also. iv) Sri V.V.L.N.Murthy (Sl.No.4):- He has represented that his name was mentioned at Sl.No.(4) in the provisional seniority list, that the incumbents at Sl.Nos.(2) and (3) were promoted and they joined as Principals after him, but their names are placed above him for the reasons not known to him and he, therefore, requested to verify the same and adjust accordingly. It is observed that based on the recommendations of the Review Screening Committee, Government issued orders in G.O.Rt.No.63, H.E (TE.1) Department, Dated 2.2.2011 approving the name of Sri R.V.Ramana Rao, at Sl.No.(4a) between the names Contd…7/p:: 7 :: of Sri M.Gal Reddy, Sl.No.(4) and Sri O.Prakash Reddy, Sl.No.(5) in the panel of Head of Section in Non-Engineering and Engineering in Government Polytechnics for the panel year 2002-03 for notional promotion in the category of Principal in Government Polytechnics on par with his junior and accordingly, Sri R.V.Ramana Rao was notionally promoted as Principal in Government Polytechnics w.e.f. 5.9.2003, i.e., the date on which his junior Sri O.Prakash Reddy was promoted as Principal of Government Polytechnic vide G.O.Ms.No.46, HE (TE.I) Department, Dated 30.5.2011. The name of Sri B. Suryudu, Government Polytechnic for Women, Kadapa was approved and shown at Sl.No.(7) against the Roster point (7) in the panel of Heads of Sections in Engineering & Non-Engineering for promotion to the posts of Principals in Government Polytechnics for the panel year 2002-03 vide G.O.Ms.No.55, HE (TE.2) Department, dated 26.7.2003. Accordingly, he was promoted to the post of Principal and he assumed charge of the post of Principal on 9.9.2003. Whereas, the name of V.V.L.N. Murthy was approved and shown at Sl.No.(9) against Roster point 9 in the panel of Heads of Sections in Engineering & Non-Engineering for promotion to the post of Principals in Government Polytechnics for the panel year 2002-2003 vide G.O.Ms. No.55, HE (TE.2) Department, Dated 26-7-2003. Accordingly, he was promoted to the post of Principal. He assumed charge of the post of Principal on 28-8-2003. Therefore, though Sri R.V. Ramana Rao and Sri Suryudu assumed the charge of the posts of Principal later to the date of his assuming the charge of the post of Principal, their names have been placed above his name, as in the panel of names of Heads of Sections for promotion to the post of Principals in Government Polytechnics for the panel year 2002-03. In the above circumstances, the claim of Sri VVLN Murthy to show his name above the names of Sri R.V.Ramana Rao and Sri B. Suryudu cannot be considered and the same may therefore be rejected. iv) Sri N.Narayana Reddy (Sl.No.31):- He has represented that he is a Physically handicapped person and presently working as Principal from 30.09.2007 and he, therefore, requested to propose his name under PH category Roster Point in view of the orders issued in G.O.Ms.No.42, Department for Women, Children, Disabled & Senior Citizens, Dated: 19.10.2011 while preparing final seniority list and sent to Government for consideration at the time of promotions to the post of Joint Director of Technical Education. The request of the incumbent to consider his case for promotion to the post of Joint Director under Physically Handicapped Quota Roster Point in view of G.O.Ms.No.42, Department for Women, Children, Disabled & Senior Citizens, Dated 19.10.2011, has nothing to do with the finalization of the seniority list of Principals. He did not raise any objection on the provisional seniority list. The question of considering his request does not arise at this stage and the same is therefore rejected as pre- matured. 3. In view of the facts mentioned above, the Government, after careful examination of the provisional seniority list of Principals in Government Polytechnics submitted by the Commissioner of Technical Education, while disposing the objection raised by certain Principals as mentioned above, hereby finalize and communicate the final seniority list, as annexed to the G.O., in the cadre of Principal to the Commissioner of Technical Education, with a direction to communicate the same to all the Principals concerned. Contd..8/p:: 8 :: 4.
