L.-33004/99 सी.जी.-एच.आर.-अ.-05072023-247067 xxxGIDHxxx CG-HR-E-05072023-247067 xxxGIDExxx ऄसाधारण EXTRAORDINARY भाग II—खण् ड 3—ईप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 387] नइ कदल्ली, बुधवार, जुलाइ 5, 2023/अिाढ़ 14, 1945 No. 387] NEW DELHI, WEDNESDAY, JULY 5, 2023/ASHADHA 14, 1945 कृजि एव ंककसान कल्याण मत्रं ालय (कृजि एव ं ककसान कल्याण जवभाग) ऄजधसचू ना नइ कदल्ली, 5 जुलाइ, 2023 सा.का.जन. 480(ऄ).—बहु-स्रोत खाद्य तेल श्रणे ीकरण और जचहनांकन जनयम, 2023 का प्रारूप, भारत के राजपत्र, ऄसाधारण, भाग-II, खंड-3, ईपखडं (i) म ें कदनांक 24 फरवरी 2023 को सा.का.जन. 132(ऄ), कदनाकं 24 फरवरी 2023 को प्रकाजित गया था, जजसमें ऐसे सभी व्यजियों जजनके ईनसे प्रभाजवत होने की संभावना थी, ईस तारीख से पैंतालीस कदन के भीतर अक्षेप एवं सुझाव अमंजत्रत ककये गए थ े । और ईि ऄजधसूचना की प्रजतयााँ अम जनता को 24 फरवरी 2023 को ईपलब्ध करा दी गयी थी; और, ईि प्रारूप जनयमों पर अम जनता द्वारा जवजनर्ददष्ट समय में प्राप्त अक्षेपों और सुझावो पर केंद्रीय सरकार द्वारा सम्यक रूप से जवचार कर जलया गया ह;ै ऄतः ऄब, केन्द्द्रीय सरकार कृजि ईपज (श्रेणीकरण और जचह्रनाकं न) ऄजधजनयम, 1937 (1937 का 1) की धारा 3 द्वारा प्रदत्त िजियों का प्रयोग करते हुए और जमजश्रत खाद्य वनस्ट्पजत तले (श्रेणीकरण और जचहनांकन जनयम), 1991 के ईन बातों के जसवाय ऄजधक्रमण करते हुए जजन्द्ह ें ऐसे ऄजधक्रमण स े पहल े ककया गया हो या ककए जाने का लोप ककया गया था, जनम्नजलजखत जनयम बनाती ह,ै ऄथाात.- 1. संजक्षप्त नाम और प्रारंभ.– (1) आन जनयमों का नाम बहु-स्रोत खाद्य तेल श्रेणीकरण और जचहनांकन जनयम, 2023 ह।ै (2) ये सरकारी राजपत्र म ेंईनके ऄंजतम प्रकािन की तारीख को प्रवृत् त होंग े। 4279 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. प्रयोज्यता.– य े जनयम ककन्द्हीं दो ऄनुमत खाद्य वनस्ट्पजत तेलों के जमश्रण द्वारा तैयार ककए गए बहु-स्रोत खाद्य तेलों पर लाग ू होंगे । 3. (1) पररभािाए:ं - आन जनयमों म ें जब तक संदभ ा म ेंऄन्द्यथा ऄपेजक्षत न हो- (क) “ऄजधजनयम” स े कृजि ईपज (श्रणे ीकरण और जचह्रनांकन) ऄजधजनयम, 1937 (1937 का 1) ऄजभप्रते ह;ैं (ख)‘’कृजि जवपणऩ सलाहकार’’ से भारत सरकार का कृजि जवपणन सलाहकार ऄजभप्रते ह;ै (ग) ‘’प्राजधकृत पैकर’’ से ऐसा व् यजि या व् यजियों का जनकाय ऄजभप्रेत ह ै जजसे आन जनयमों और साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 के ऄधीन जवजहत श्रेणी मानकों और प्रकक्रया के ऄनुसार बहु-स्रोत खाद्य तेलों का श्रेणीकरण और जचहनांकन करन े के जलए प्राजधकार प्रमाण-पत्र ऄनुदत् त ककया गया हो; (घ) ‘’प्राजधकार प्रमाण पत्र’’ से साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 के ईपबंधों के ऄधीन जारी प्रमाण पत्र ऄजभप्रेत ह,ै जो ककसी व्यजि या व्यजियों के जनकाय को श्रणे ी ऄजभधान जचहन द्वारा बहु-स्रोत खाद्य वनस्ट्पजत तले ों के श्रणे ीकरण और जचहनांकन का प्राजधकार देता ह;ै (ङ) “साधारण श्रणे ीकरण और जचहनांकन जनयम” से कृजि ईपज (श्रेणीकरण और जचहनाकं न) ऄजधजनयम 1937 (1937 का 1) की धारा 3 के ऄधीन बनाए गए साधारण श्रणे ीकरण और जचहनांकन जनयम, 1988 ऄजभप्रेत ह;ै (च) “श्रणे ी ऄजभधान जचहन” से जनयम 3 के ऄंतगात यथा प्रदत “एगमाका प्रतीक जचहन” ऄजभप्रेत ह;ै (छ) “जवजधक माप जवज्ञान (पैकेज में रखी वस्ट्तुएाँ) जनयम” स े जवजधक माप जवज्ञान ऄजधजनयम, 2009 (2010 का 1) के ऄंतगात बनाए गए जवजधक माप जवज्ञान (पैकेज म ेंरखी वस्ट्तुएाँ) जनयम, 2011 ऄजभप्रते ह,ै और (ज) “ऄनुसूची” से आन जनयमों के साथ संलग्न ऄनुसूची ऄजभप्रेत ह।ै (2) आन जनयमों म ें प्रयुक्त िब् द और पद, जो पररभाजित नहीं ह ैं लेककन जजन्द्ह ें कृजि ईपज (श्रेणीकरण और जचहनांकन) ऄजधजनयम, 1937 और साधारण श्रणे ीकरण और जचहनांकन जनयम, 1988 म ें पररभाजित ककया गया ह,ै के वही ऄथ ाहोंग ेजो क्रमिः ईक्त ऄजधजनयम ऄथवा जनयम में ह;ैं 4. श्रणे ी ऄजभधान जचहन.– श्रणे ी ऄजभधान जचहन में “एगमाका प्रतीक जचहन” का जडज़ाआन होगा जो, ऄनुसूची-I म ें जनधााररत जडजाआन के सद्रश्य होगा और प्राजधकरण प्रमाण-पत्र संख्याक, िब्द “एगमाका”, वस्ट्तु का नाम और श्रेणी िाजमल होंगे बित े रटन की पकै कग पर एगमाका प्रतीक वाली कागज की पची के प्रयोग की ऄनुमजत ऐसे प्राजधकृत पैकरों को दी जाएगी जजन्द्ह ें कृजि जवपणन सलाहकार द्वारा ऄथवा आस संबंध में ऄजधकृत ऄजधकारी द्वारा ऄथवा जवजनर्ददष्ट के ऄनुसार समय समय पर-ऐसा करन े की ऄनुमजत प्रदान की गइ हो। 5. श्रणे ी ऄजभधान .– बहु-स्रोत खाद्य तेल की गुणवत्ता ईपदर्शित करने के जलए श्रणे ी ऄजभधान ऄनुसूची-II म ें जवजनर्ददष्ट मापदंड के ऄनुसार होंगे। 6. गणु वत्ता .– आन जनयमों के प्रयोजनाथा ,बहु-स्रोत खाद्य तले की गुणवत्ता ऄनुसूची-II म ें जवजनर्ददष्ट के ऄनुसार होगी। 7. पकै कग करन े की जवजध.– (1) बहु-स्रोत खाद्य तेलों को खाद्य सुरक्षा और मानक (पैकेजजग) जवजनयम, 2018 और जवजधक माप जवज्ञान (पैकेज म ें रखी वस्ट्तुए)ाँ जनयम, 2011 के प्रावधानों के ऄनुसार ईजचत पकै ेजजग सामग्री म ें पैक ककया जाएगा। (2) समान लॉट ऄथवा बैच और ग्रडे के छोटे पैक अकारों की श्रणे ीकृत सामग्री की पैककग एक मास्ट्टर कंटेनर में की जाएगी और ईस पर श्रेणी ऄजभधान जचहन सजहत परू ा ब्यौरा ऄंककत ककया जाएगा। (3) प्रत् यके पैकेज में समान प्रकार का और समान श्रणे ी ऄजभधान का बहु-स्रोत खाद्य तले होगा । (4) प्रत् यके पैकेज को ईजचत और सुरजक्षत रूप से बंद और मुहरबंद ककया जाएगाता ,कक ईसकी सामग्री बाहर न फैल सके तथा ईस पर सक्षम प्राजधकारी द्वारा जारी प्रतीक नंबर ऄंककत ककए जाएंगे। 8. जचहनाकं न की जवजध.– (1) श्रेणी ऄजभधान जचहन प्रत् यके पैकेज पर कृजि जवपणन सलाहकार या आस जनजमत ईनके द्वारा ऄजधकृत ककसी ऄजधकारी द्वारा साधारण श्रणे ीकरण और जचहनांकन जनयम,1988 के जनयम 11 के ऄनुसार ऄनुमोकदत रीजत स े सुरजक्षत रूप स े जचपकाया या मुकद्रत ककया जाएगा और खाद्य सुरक्षा और मानक (लेबजलग और[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 प्रदिान) जवजनयम, 2020 के प्रावधानों के ऄनुसार पैकेजजग पर समुजचत रूप स े बहु-स्रोत खाद्य तले ऄंककत ककया जाएगा। (2) बहु-स्रोत खाद्य तेलों की पकै ेजजग पर समुजचत तरीके स े जनम्नजलजखत जववरण प्रदर्शित ककए जाने ह ैंनामत:- (क) वनस्ट्पजत खाद्य तले ों के जमश्रण वाले प्रत्येक पैकेज पर पैक के उपर ईसके ब्ांड नाम ऄथवा रेड नाम के ठीक नीचे जनम्नजलजखत लेबल घोिणा ऄंककत की जाएगी.– " बहु-स्रोत खाद्य तले (खाद्य वनस्ट्पजत तले का नाम और स्ट्वरूप*) ……………………..भार द्वारा % (खाद्य वनस्ट्पजत तले का नाम और स्ट्वरूप*) ……………………..भार द्वारा % (*ऄथाात भौजतक/रासायजनक रूप से पररष्कृत ऄथवा कच्चा स्ट्वरूप) " (ख) एक लीटर से कम पैक अकार के जलए, लेबल घोिणा “बहु-स्रोत खाद्य तले ” के फोंट का अकार तीन जमलीमीटर स े कम नहीं होगा तथा घोिणा जववरण की लम्बाइ न्द्यनू तम पेंतीस जमलीमीटर होगी और लेबल घोिणा “खाद्य तले का नाम और स्ट्वरूप ............भार द्वारा %” के जलए फोंट का अकार दो जमलीमीटर स े कम नहीं होगा; (ग) एक लीटर स े ऄजधक ककन्द्त ु पांच लीटर स े कम पैक अकार के जलए, लेबल घोिणा “बहु-स्रोत खाद्य तेल” के फोंट का अकार 4 जमलीमीटर से कम नहीं होगा तथा घोिणा जववरण की लम्बाइ न्द्यूनतम पतैं ालीस जमलीमीटर होगी और लेबल घोिणा “खाद्य तले का नाम और स्ट्वरूप ............भार द्वारा %” के जलए फोंट का अकार 2.5 जमलीमीटर से कम नहीं होगा; (घ) पांच लीटर से ऄजधक पैक अकार के जलए, लेबल घोिणा “बहु-स्रोत खाद्य तेल” के फोंट का अकार दस जमलीमीटर से कम नहीं होगा और लेबल घोिणा “खाद्य तले का नाम और स्ट्वरूप ............भार द्वारा %” के जलए फोंट का अकार तीन जमलीमीटर से कम नहीं होगा; (ङ) बहु-स्रोत खाद्य तेलों की जबक्री खुले रूप म ें नहीं की जाएगी। आसकी जबक्री सील ककए गए पैकेजों, जजनका वजन पंद्रह लीटर ऄथवा ककलोग्राम स े ऄजधक नहीं होगा, म ें की जाएगी। बहु-स्रोत खाद्य तले का कंटेनर टेंपर प्रूफ होगा; (च) फ्रंट/सेंरल पैनल पर ईत्पाद के नाम के साथ मोटे ऄक्षरों म ेंजनम्नजलजखत घोिणा भी ऄंककत की जाएगी.– " खुले रूप म ेंजबक्री के जलए नहीं " (छ) आसकी जबक्री जमश्रण में प्रयिु ररफाआंड तले ों के सामान्द्य ऄथवा जेनररक नाम से भी नहीं की जाएगी, बजल्क आसकी जबक्री “बहु-स्रोत खाद्य तेल” ऄथवा आसके जलए समय-समय पर खाद्य सुरक्षा और मानक जवजनयम (एफ एस एस अर) में ईजल्लजखत ककसी ऄन्द्य नाम से की जाएगी; और (ज) बहु-स्रोत खाद्य तले के पैकेजजग लेबल पर “ऄजत-पररष्कृत”, “ऄजतररि-पररष्कृत”, “सूक्ष्म- पररष्कृत”, “डबल-पररष्कृत”, “ऄल्रा-पररष्कृत” जैसी ककसी ऄजतरंजजत ऄजभव्यजि का ईपयोग नहीं ककया जाएगा। (3) श्रेणी ऄजभधान जचहन के ऄजतररक्त प्रत्येक पैकेज पर जनम् नजलजखत जववरण स्ट्पष्ट रूप स े और ऄजमट रूप स े ऄंककत ककया जाएगा नामत: .– (क) वस्ट् तु का नाम; (ख) श्रेणी;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ग) ककस्ट्म या रेड नाम (वैकजल्पक); (घ) लॉट ऄथवा बैच संख्या; (ङ) पैककग की तारीख; (च) िुद्ध भार; (छ) प्राजधकृत पैकर का नाम और पता; (ज) ऄजधकतम खुदरा मल्ू य (सभी करों सजहत); (झ) पैककग/जनमााण की तारीख से.............माह..............विा स े पूवा ईपयोग हते ु सवोत्तम; (ञ) जवजधक माप जवज्ञान (पकै ेज में रखी वस्ट्तुए)ं जनयम, 2011 या खाद्य सुरक्षा और मानक (पैकेजजग) जवजनयम, 2018 ऄथवा खाद्य सुरक्षा और मानक (लेबजलग और प्रदिना ) जवजनयम, 2020 के तहत जनर्ददष्ट ऄथवा तत्समय लाग ू ककसी ऄन्द्य कानून के तहत जारी ऄजधसचू ना ऄथवा आस ऄजधजनयम के प्रावधानों के तहत जारी ककन्द्हीं ऄनुदेिों के तहत जनर्ददष्ट कोइ ऄन्द्य जववरण: बिते कक पैकेजों पर ऄंकन के जलए सही गुणवत्ता की स्ट्याही का ईपयोग ककया जाएगा। (4) प्राजधकृत पैकर कृजि जवपणन सलाहकार ऄथवा ईनके द्वारा ऄजधकृत ककसी ऄजधकारी का पूवा ऄनुमोदन प्राप् त करने के पश् चात साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 के जनयम 11 के ऄंतगता श्रणे ीकृत पैकेजों पर ऄपना प्राआवेट व् यापार जचहन या व् यापार ब्ांड जचहनांककत कर सकता ह,ै परंत ु वह आन जनयमों के ऄनुसार श्रेणीकृत पैकेजों पर लगाए गए श्रेणी ऄजभधान जचहन द्वारा ईपदर्शित गुणवत्ता से जभन्द् न गुणवत्ता ईपदर्शित नहीं करेगा। 9. प्राजधकार प्रमाण पत्र की जवििे ित.ें–साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 के जनयम 3 के ईप-जनयम (8) म ें जवजनर्ददष्ट ितों के ऄजतररि प्राजधकृत पैकर आस जनयम के जनम्नजलजखत ितों का पालन करेगा नामत: .– (1) घटक वनस्ट्पजत खाद्य तले ों के जनष्किाण और पररष्करण के जलए या तो ऄपनी मिीनरी और ईपकरण होंग े या ईसके पास जनधााररत गणु वत्ता के प्राजधकृत ररफाआनररयों स े खरीदे गए खाद्य वनस्ट्पजत तले ों के जमश्रण एव ं भडं ारण की ईपयुि व्यवस्ट्था होगी। (2) जमश्रण-पूवा और जमश्रण-पश्चात वनस्ट्पजत तेलों की गणु वत्ता की जांच करने के जलए ऄपने पररसर पर स्ट्वय ं की सुसजित तले प्रयोगिाला स्ट्थाजपत करेगा। जमश्रण के जलए प्रयिु ककए जाने वाले घटक तले ों और बहु-स्रोत खाद्य तेलों की गणु वत्ता की जांच करने के जलए आस प्रयोगिाला का प्रबंधन कृजि जवपणन सलाहकार ऄथवा साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 के जनयम 9 के ऄतं गात ईनके द्वारा ऄजधकृत ककसी ऄजधकारी द्वारा ऄनुमोकदत योग्य रसायनज्ञ द्वारा ककया जाएगा। (3) आन जनयमों के ऄंतगात बहु-स्रोत खाद्य तेल का श्रेणीकरण और जचहनांकन करने के जलए ऄनुमोकदत ककए गए रसायनज्ञ को सभी तरह की अवश्यक सुजवधाएं और सहायता दी जाएंगी । (4) जमश्रण तैयार करन े के जलए प्रयोग ककए गए ऄलग-ऄलग तरह के घटक तले ों की मात्रा एव ं जमश्रण के ईत्पादन की मात्रा और ईनकी जवश्लेिणात्मक ररपोटों का ईजचत ररकॉड ा रखा जाएगा और आस े एक जनधााररत प्रोफॉमा ा म ें अवजधक अधार पर जवपणन एव ं जनरीक्षण जनदेिालय को जवजनर्ददष्ट ऄनुसार प्रस्ट्ततु ककया जाएगा । (5) खाद्य तेलों की प्रोसेजसग, जमश्रण और पैककग के जलए आस्ट्तेमाल ककए जाने वाले पररसरों को समुजचत संवातन और प्रकाि सजहत स्ट्वास्ट््यप्रद और स्ट्वच्छता की दिा म ें रखा जाएगा और आन कायों म ें लगे हुए कार्शमकों का ऄच्छा स्ट्वास्ट््य होगा और वे ककसी संचारी, संसगी या संक्रामक रोग स े मुि होंगे।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 5 (6) पररसर म ें पक्क े फिा सजहत पयााप् त भंडारण सुजवधाएं होंगी, फिा म ें दरारें नहीं होंगी और वह नमी, ककसी तरह के कृंतकों और कीटों के ईत् पीड़न स ेमुक् त होगा । (7) ऄनुमोकदत रसायनज्ञ द्वारा परीक्षण, श्रेणीकरण, पैककग, जचहनांकन, सीजलग और ऄजभलेखों के ऄनुरक्षण स े संबंजधत ऐसे सभी ऄनुदेिों का पालन ककया जाएगा जो ऄजधजनयम के प्रावधानों के ऄंतगात समय-समय पर जारी ककए गए हों । ऄनसु चू ी I (जनयम 4 देख)ें (एगमाका प्रतीक जचहन का जडजाआन) N o. C A वस्ट्तु का नाम…………………. श्रेणी…………………………………. ऄनसु चू ी II (जनयम 5 और 6 देख)ें 1. बहुस्रोत- खाद्य तले का श्रेणी ऄजभधान और गुणवत्ता: (1) बहु-स्रोत खाद्य तेल ककन्द्हीं दो ऄनुमत खाद्य वनस्ट्पजत तले ों (सरसों के तले को छोड़कर) का सजम्मश्रण होगा, जहा ं जमश्रण म ें प्रयोग ककए गए ककसी भी खाद्य वनस्ट्पजत तेल का ऄनपु ात वजन के ऄनुसार बीस प्रजतित से कम नहीं होगा और जमश्रण म ें प्रयोग ककए गए ऄलग घटक तले की गणु वत्ता ऐसी होगी जो एगमाका ऄथवा खाद्य सुरक्षा और मानक जवजनयम में जनधााररत प्राकृजतक जविेिताओं और गुणवत्ता के ऄनरूु प होगी। (2) न्द्यूनतम ऄपेक्षाए.ं – बहु-स्रोत खाद्य तेल - (क) साफ होगा; (ख) बासीपन, दगु ंध, गंदगी, जनलंजबत ऄथवा ऄघलु निील पदाथ ा ऄथवा ऄन्द्य ककसी जवजातीय पदाथ ा से मिु होगा; (ग) पृथक्कृत जल; तलछट जमाव, योजजत रंजक पदाथ ा और ककसी भी तरह के ऄन्द्य गंधयुि पदाथ ा से मिु होगा; And, whereas, copies of the said Gazette were made available to the public on the 24th February, 2023; And, whereas, the objections and suggestions received from the public in respect of the said draft rules within the specified period have been considered by the Central Government; Now, therefore, in the exercise of the powers conferred by Section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937), and in supersession of the Blended Edible Vegetable Oils (Grading and Marking) Rules, 1991, except in respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules, namely:- 1. Short title and commencement.– (1) These rules may be called the Multi-Source Edible Oils Grading and Marking Rules, 2023. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. Application.– They shall apply to Multi-Source Edible Oils prepared by blending of any two permitted edible vegetable oils. 3. Definitions.– (1) In these rules, unless the context otherwise requires,- (a) ―Act‖ means the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937); (b) "Agricultural Marketing Adviser" means the Agricultural Marketing Adviser to the Government of India; (c) "authorised packer" means a person or a body of persons who has been granted a certificate of authorisation to grade and mark Multi-Source Edible Oil in accordance with the grade standards and procedure provided under these rules and the General Grading and Marking Rules, 1988;[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 9 (d) "Certificate of Authorisation" means a certificate issued under the provisions of the General Grading and Marking Rules, 1988 authorising a person or a body of persons to grade and mark Multi Source Edible Oils with the Grade Designation Mark; (e) "General Grading and Marking Rules" means the General Grading and Marking Rules, 1988 made under section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937); (f) "Grade Designation Mark" means ‗‘AGMARK Insignia‘‘ as provided under rule 3; (g) ―Legal Metrology (Packaged Commodities) Rules" means the Legal Metrology (Packaged Commodities) Rules, 2011, made under the Legal Metrology Act, 2009 (1 of 2010); and (h) "Schedule" means a Schedule appended to these rules. (2) Words and expressions used in these rules and not defined but defined in the Agricultural Produce (Grading and Marking) Act, 1937 and General Grading and Marking Rules, 1988 shall have the meanings respectively assigned to them under the said Act or rules. 4. Grade designation mark.–The grade designation mark shall consist of the design of "AGMARK Insignia" as set out in the Schedule-I and incorporating the certificate of authorisation number, the word "AGMARK", name of the commodity and its grade provided that the use of Agmark Replica paper slip shall be allowed for tin packing, for such authorised packers, who have been granted the permission by the Agricultural Marketing Adviser or an officer authorised in this regard or as may be specified from time to time. 5. Grade designations.– The grade designations to indicate the quality of Multi-Source Edible Oils including the criteria for grade designation shall be as set out in Schedule-II. 6. Quality.– For the purposes of these rules, the quality of Multi-Source Edible Oils shall be as provided in Schedule-II. 7. Method of packing.– (1) Multi-Source Edible Oils shall be packed in suitable packaging material in accordance with the provisions of the Food Safety and Standards (Packaging) Regulations, 2018 and Legal Metrology (Packaged Commodities) Rules, 2011. (2) The graded material of small pack sizes of the same lot or batch and grade shall be packed in a master container with complete details thereon along with the Grade Designation Mark. (3) Each package shall contain Multi-Source Edible Oil of the same type and of the same grade designation. (4) Each package shall be properly and securely closed and sealed so as to disallow spilling and marked with replica numbers issued by the competent authority. 8. Method of Marking.– (1) The Grade Designation Mark shall be securely affixed to or printed on each package in the manner approved by the Agricultural Marketing Adviser or an officer authorised by him under rule 11 of the General Grading and Marking Rules, 1988 and the Multi-Source Edible Oils shall be marked suitably on packaging in accordance with the provisions of the Food Safety and Standards (Labeling and Display) Regulations, 2020. (2) The following particulars are to be displayed in proper manner on packaging of Multi-Source Edible Oils namely: – (a) every package containing an admixture of vegetable edible oils shall carry the following label declaration immediately below its brand name or trade name on front of pack, namely:- ― Multi-Source Edible Oil (Name and nature* of edible vegetable oil) ……………………..% by weight (Name and nature* of edible vegetable oil)………………………% by weight; (*i.e. Physically/Chemically Refined or Raw form) ‖ (b) for pack size less than one litre, the font size of the label declaration ―MULTI-SOURCE EDIBLE OIL‖, shall not be less than three millimeter with the length of declaration statement as thirty five millimeter minimum and for label declaration ―Name and Nature of edible oil......percent by weight‖, font size shall not be less than two millimeter; (c) for pack size one litre to below five litre, the font size of the label declaration ―MULTI-SOURCE EDIBLE OIL‖ shall not be less than four millimeter with the length of declaration statement as forty five millimeter minimum and for label declaration ―Name and Nature of edible oil......per cent. by weight‖ font size shall not be less than 2.5 millimeter;10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (d) for pack size five litre and above, the font size of the label declaration ―MULTI-SOURCE EDIBLE OIL‖ shall not be less than ten millimeter and for label declaration ―Name and Nature of edible oil......percent by weight‖ font size shall not be less than three millimeter. (e) the Multi-Source Edible Oil shall not be sold in loose form and it shall be sold in sealed package weighing not more than fifteen liter or Kilogram. The container having Multi Source Edible Oil shall be tamper proof; (f) there shall also be the following declaration in bold capital letters along with the name of product on front/central panel: – ― ―NOT TO BE SOLD LOOSE‖; ‖ (g) it shall also not be sold under the common or generic name of the refined oils used in the blend, but shall be sold as ―Multi-Source Edible Oil‖ or any other nomenclature as referred in Food Safety and Standards Regulations (FSSR) for the same time to time; and (h) Multi-Source Edible Oil packaging label shall not use any exaggerated expressions like ―Super- Refined‖, ―Extra-Refined‖, ―Micro-Refined‖, ―Double refined‖, ―Ultra-Refined‖. (3) In addition to the Grade Designation Mark, following particulars shall be clearly and indelibly marked on each package, namely: – (a) name of the commodity; (b) grade; (c) variety or trade name(optional); (d) lot or batch number; (e) date of packing; (f) net weight; (g) name and address of the authorised packer; (h) maximum retail price (inclusive of all taxes); (i) best before _______month from Date of Packing/ Manufacture; and (j) any other particulars as provided under the Legal Metrology (Packaged Commodities) Rules, 2011 or specified under the Food Safety and Standards (Packaging) Regulations, 2018 and the Food Safety and Standards (Labeling and Display) Regulations, 2020 or any notification issued under any other law for the time being in force or any instructions issued under the provisions of the Act: provided that right quality of ink shall be used for marking on packages. (4) The authorised packer may after obtaining prior approval of the Agricultural Marketing Adviser or an officer authorised by him under rule 11 of the General Grading and Marking Rules, 1988, mark his private trade mark or trade brand on the graded packages provided the same does not indicate quality other than that indicated by the Grade Designation Mark affixed to the graded packages in accordance with these rules. 9. Special conditions of Certificate of Authorisation.– In addition to the conditions specified in sub-rule (8) of rule 3 of the General Grading and Marking Rules, 1988, the authorised packer shall comply the following conditions namely: – (1) either own proper machinery and equipment for expression and refining of the constituent edible vegetable oils or shall have appropriate arrangements for blending and storage of constituent‘s edible vegetable oils procured from authorised refineries of the prescribed quality. (2) set up well equipped oil laboratory in his own premise, for testing quality of vegetable oils prior to blending and after blending, The laboratory shall be manned by a qualified chemist approved by the Agricultural Marketing Adviser or an officer authorised by him under rule 9 of the General Grading and Marking Rules, 1988 for testing the quality of constituent oils to be used in blending of Multi-Source Edible Oil. (3) provide all necessary facilities and assistance to the approved chemist for carrying out the grading and marking of the Multi-Source Edible Oil under these rules.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 11 (4) maintain proper record of analytical reports and quantity of the individual constituent oils used for blending and the production of blends and shall submit periodical returns in the prescribed proforma as specified to Directorate of Marketing and Inspection. (5) the premises used for processing, blending and packing of edible oils shall be maintained in hygienic and sanitary conditions with proper ventilation and well lighted arrangement and the personnel engaged in these operations shall be in sound health and free from any infectious, contagious or communicable diseases. (6) the premises shall have adequate storage facilities with pucca floor, free from dampness, any kind of cracks and crevices, rodent and insect infestation. (7) the approved chemist shall observe all instructions regarding testing, grading, packing, marking, sealing, maintenance of records, which may be issued time to time under the provisions of the Act. Grade designation and quality of Multi-Source Edible Oil.– (1) Multi Source Edible Oil shall be the admixture of any two permitted edible vegetable oils (except mustard oil) where the proportion by weight of any edible vegetable oil used in the admixture is not less than twenty per cent and the individual constituent oil used in the blend shall be of such quality which conforms to the natural characteristics and the quality as prescribed either in the Agmark or the Food Safety and Standards Regulations. (2) Minimum requirement:- Multi-Source Edible Oil shall , – (a). be clear; (b). be free from rancidity, obnoxious smell, turbidity, suspended or insoluble matter or any other foreign matter; (c). be free from separated water, sedimentations, added colouring matter and any other flavouring substances ; (d). be free from mineral oil, argemone oil, castor oil, neem oil, Karanj oil, Kusum oil or any other animal fat and non edible oils or fats, hydrocyanic acid, and tricresyl phosphate; and (e). be free from synthetic oil. (3) Multi-Source Edible Oils may be fortified with the micronutrients Vitamin ‗A‘ and Vitamin ‗D‘ at the level of nutrients specified in the Food Safety and Standards (Fortification of Foods) Regulations, 2018. (4) Multi-Source Edible Oil may contain permitted anti-oxidants, food additives, in the concentration as specified under the Food Safety and Standards Regulations. (5) Refined edible vegetable oils used for Multi-Source Edible Oil, if produced by solvent extraction shall be refined before it is supplied for human consumption and shall conform to the standards as laid down or made12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] under the Food Safety and Standards Regulations and the Hexane limit should not exceed five parts per million. (6) for domestic trade, it shall comply with the restrictions in regard to residual levels of metal contaminants, pesticides residues, microbial requirements, crop contaminants, naturally occurring toxic substances and other food safety requirements as specified under the Food Safety and Standards (Contaminants, Toxins and Residues) Regulations, 2011, the Food Safety and Standards (Food Product Standards and Food Additives) Regulations, 2011, and other regulations made for domestic trade under the Food Safety and Standards Act, 2006 (34 of 2006). (7) For export trade, it shall comply with the residual limits of heavy metals, pesticides and other food safety requirements as laid down by the Codex Alimentarius Commission or importing countries requirement for export. 2.
