का 42) की धारा 3 के साथ परित सरोगेसी (जवजनयमन) ऄजधजनयम, 2021 (2021 का 47) की धारा 50 की ईप धारा
(2) के खंड (ण) और (थ) द्वारा प्रदत्त िजियों का प्रयोग करत ेहुए, जनम्नजलजखत जनयम बनाती ह,ै ऄथाात्:-
1. सजं िप्त नाम और प्रारंभ – (1) आन जनयमों का संजिप्त नाम राष्ट्रीय सहायताप्राप्त िननीय प्रौद्योजगकी और सरोगेसी
बोडा (नामांकन द्वारा जविेषज्ञ सदस्ट्यों की जनयुजि) जनयम, 2022 ह।ै
(2) ये रािपत्र म ेंईनके प्रकािन की तारीख से पवृ त्तृ होंगे।
2. धारा 17 की ईप-धारा (2) के खडं (च) के ऄतं गता जविषे ज्ञ सदस्ट्यों की जनयजु ि की रीजत– केंद्रीय सरकार सरोगेसी
(जवजनयमन) ऄजधजनयम 2021 धारा 17 की ईप-धारा (2) के खंड (च) म ें जनर्ददष्ट सदस्ट्यों को नामांकन द्वारा और
ऄंिकाजलक अधार पर जनयिु करेगी।
3. जविषे ज्ञ सदस्ट्यों के जलए ऄहता ा और ऄनभु व - सरोगेसी (जवजनयमन) ऄजधजनयम 2021 धारा 17 की ईपधारा (2)
के खंड (च) में जनर्ददष्ट सदस्ट्यों के पास जनम्नजलजखत ऄहता ा और ऄनुभव होगा, ऄथाात:् -
(i) जचदकत्सा अनुवंजिकीजवद के पास राष्ट्रीय जचदकत्सा अयोग ऄजधजनयम, 2019 (2019 का 30) द्वारा
मान्यता प्राप्त जचदकत्सा अनुवंजिकी में राष्ट्रीय बोड ा म ें डॉक्टरेट ऑफ मेजडजसन या जडप्लोमेट होना चाजहए, और
ऐसे िेत्र में कम से कम पंद्रह वषा का ऄनुभव होना चाजहए;

(ii) भ्रूणजवज्ञानी के पास दकसी मान्यता प्राप्त जवश्वजवद्यालय से भ्रणू जवज्ञान या नदै ाजनक भ्रूणजवज्ञान के िेत्र म ें
जचदकत्सा ऄहता ा स्नातकोत्तर या डॉक्टरेट की जडग्री होनी चाजहए, और ऐसे िेत्र में कम से कम पंद्रह वषा का ऄनुभव
होना चाजहए;
(iii) स्त्री रोग जविेषज्ञ और प्रसूजत जविेषज्ञ के पास राष्ट्रीय जचदकत्सा अयोग ऄजधजनयम, 2019 (2019 का
30) द्वारा मान्यता प्राप्त प्रसूजत और स्त्री रोग म ें जचदकत्सा ऄहता ा स्नातकोत्तर होनी चाजहए और ऐस े िेत्र म ें कम स े
कम पंद्रह वष ा का ऄनुभव होना चाजहए;
(iv) सामाजिक वैज्ञाजनक के पास दकसी मान्यता प्राप्त जवश्वजवद्यालय स े दकसी भी जवषय म ें स्नातक ऄहता ा या
सामाजिक जवज्ञान में ऄजधमानतः स्नातकोत्तर ऄहता ा होनी चाजहए और ऐसे िेत्र में कम से कम पंद्रह वषा का
ऄनुभव होना चाजहए;
(v) मजहला कल्याण सगं िनों का प्रजतजनजधत्व करन े वाल े व्यजि की दकसी मान्यता प्राप्त जवश्वजवद्यालय स े
दकसी भी जवषय में स्नातक ऄहता ा होनी चाजहए और मजहलाओं के जहत के जलए काम करने का कम से कम पंद्रह वषा
का ऄनुभव होना चाजहए।
(vi) मजहला स्ट्वास्ट््य और बालक मद्दु ों पर काया कर रह ेनागररक समाि का प्रजतजनजधत्व करन े वाल े व्यजि की
दकसी मान्यता प्राप्त जवश्वजवद्यालय स े दकसी भी जवषय म ें ऄहता ा स्नातक होनी चाजहए और मजहला स्ट्वास्ट््य और
बाल मुद्दों पर काम करन े का कम से कम पद्रं ह वष ा का ऄनुभव होना चाजहए।
4. अय ुसीमा - यदद कोइ व्यजि जनयुजि के समय पैंसि वष ा की अय ु प्राप्त कर चुका ह ैतो वह सदस्ट्य के रूप म ें जनयिु
होने के जलए पात्र नहीं होगा।
5. सदस्ट्यों की पनु र्ननयजु ि -जनयम 4 के ऄधीन रहत े हुए, सरोगेसी (जवजनयमन) ऄजधजनयम, 2021 की धारा 17 की
ईप-धारा (2) के खंड (च) में जनर्ददष्ट सदस्ट्य, दसू रे कायाकाल के जलए पुनर्ननयुजि के जलए पात्र होगा।

NOTIFICATION
New Delhi, the 16th June, 2022
G.S.R. 453(E).—In exercise of the powers conferred by clauses (o) and (q) of sub section (2) of
section 50 of the Surrogacy (Regulation) Act, 2021 (47 of 2021) read with section 3 of the Assisted
Reproductive Technology (Regulation) Act, 2021 (42 of 2021), the Central Government hereby makes the
following rules, namely: -
1. Short title and commencement. – (1) These rules may be called the National Assisted
Reproductive Technology and Surrogacy Board (Appointment of Expert Members by Nominating) Rules,
2022.
(2) They shall come into force from the date of their publication in the official Gazette.
2. Manner of appointment of Expert Members under clause (f) of sub-section (2) of section 17. –
The Central Government shall appoint the Members referred to in clause (f) of sub-section (2) of section 17
of the Surrogacy (Regulation) Act, 2021 by nomination and on part-time basis.
3. Qualification and experience for Expert Members. - The Members referred to in clause (f) of
sub-section (2) of section 17 of the Surrogacy (Regulation) Act, 2021 shall possess the following
qualification and experience, namely: -
(i) the Medical Geneticist shall possess Doctorate of Medicine or Diplomate in National
Board in Medical Genetics recognized by the National Medical Commission Act, 2019 (30 of
2019), having experience of not less than fifteen years in such field;[भाग II—खण् ड 3(i)] भारत का रािपत्र : ऄसाधारण 3
(ii) the Embryologist shall possess post-graduate medical qualification or doctoral degree in
the field of Embryology or Clinical Embryology from a recognized University, having experience
of not less than fifteen years in such field;
(iii) the Gynaecologist and Obstetrician shall possess post-graduate medical qualification in
Obstetrics and Gynaecology recognized by the National Medical Commission Act, 2019 (30 of
2019), having experience of not less than fifteen years in such field;
(iv) the Social Scientist shall possess graduate qualification in any discipline or preferably a
post-graduate qualification in social science from a recognized University, having experience of not
less than fifteen years in such field;
(v) the person representing women welfare organisations shall possess graduate qualification
in any discipline from a recognized University and working for the welfare of women for not less
than fifteen years.
(vi) the person representing civil society working on women’s health and child issues shall
possess graduate qualification in any discipline from a recognized University and working on
women’s health and child issues for not less than fifteen years.
4. Age limit. - A person shall not be eligible to be appointed as a member, if he or she has attained the
age of sixty-five years at the time of appointment.
5. Re-appointment of Members. -Subject to rule 4 a Member referred to in clause (f) of sub-section
(2) of section 17 of the Surrogacy (Regulation) Act, 2021, shall be eligible for re-appointment for another
term.
