(2) के खंड (क), (ख), (ग), (घ), (ङ), (च), (छ), (ज), (झ), (ञ) (ट), (ण) और (त) के साथ परठत उपधारा (1) द्वारा प्राप्त िजियों का प्रयोग करत ेहुए, जनम्नजलजखत जनयम बनाती ह,ै अथाचत ्:- 1. संजक्षप्त नाम और प्रारंभ- (1) इन जनयमों का संजक्षप्त नाम राष्ट्रीय दतं जचककत्सा आयोग जनयम, 2024 ह।ै (2) ये राजपत्र म ें उनके प्रकािन की तारीख से प्रवृत्त होंगे। 2. पररभाषाए-ं (1) इन जनयमों म,ें जब तक कक संदभच स ेअन्यथा अपेजक्षत न हो,- (क) "अजधजनयम" स ेराष्ट्रीय दतं जचककत्सा आयोग अजधजनयम, 2023 (2023 का 21) अजभप्रेत ह;ै (ख) "बोडच" स े इस अजधजनयम की धारा 16 के अधीन गरठत कोई स्ट्वायत्त बोड च अजभप्रेत ह;ै (ग) "आयोग" से अजधजनयम की धारा 3 के अधीन गरठत राष्ट्रीय दतं जचककत्सा आयोग अजभप्रेत ह ै 1903 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (घ) "सजचव" से अजधजनयम की धारा 8 की उपधारा (1) के अधीन जनयुि आयोग का सजचव अजभप्रेत ह।ै (ङ) धारा स े अजधजनयम की धारा अजभप्रेत ह।ै (2) इन जनयमों म ें प्रयुि िब्द और अजभव्यजिया ं और इसम ें पररभाजषत नहीं ककए गए ह ैंककतु अजधजनयम म ें पररभाजषत ह,ैं को क्रमि: वही अथ चहोगा जो उनका अजधजनयम म ें ह।ै 3. धारा 4 की उपधारा (4) के खडं (क) के अधीन अिं काजलक सदस्ट्यों की जनयजु ि की रीजत- (1) केंद्रीय सरकार उपधारा (4) के खंड के अधीन खोजबीन-सह-चयन सजमजत की जसफाररिों के आधार पर प्रबंध, जवजध, जचककत्सा आचार, स्ट्वास्ट््य अनुसंधान, उपभोिा या रोगी अजधकार समथचन, जवज्ञान और प्रौद्योजगकी या अथचिास्त्र के क्षेत्रों में बीस वषच स े अन्यून जविेष ज्ञान और व्यावसाजयक अनभु व वाले व्यजियों म ें स े चार वषच की अवजध के जलए तीन अंिकाजलक सदस्ट्यों को जनयुि करेगी। (2) यथािीघ्र अंिकाजलक सदस्ट्य की कोई ररजि होती ह,ै खोजबीन-सह-चयन सजमजत उपयुि अभ्यर्थथयों की जसफाररि करन े के प्रयोजन के जलए ऐसी ररजि होने के तीन महीने समाप्त होने स े पूवच इसकी िीघ्र बैठक बुलाएगी। (3) खोजबीन सह-चयन सजमजत इसे जनर्ददष्ट अंिकाजलक सदस्ट्य की प्रत्येक ररजि के जलए न्यनू तम तीन नामों के पैनल की जसफाररि करेगी और इस तरह स े जनयुि व्यजि, आयोग के सदस्ट्य के रुप म ेंपूरे चार वषों की अवजध के जलए काय च करेंगे। 4. धारा 4 की उपधारा (4) के खडं (ख) के अधीन अिं काजलक सदस्ट्यों की जनयजु ि की रीजत- (1) केंद्रीय सरकार, धारा 4 की उपधारा (4) के खंड (ख) के अधीन की धारा 11 की उप-धारा (2) के खंड (ग) और खंड (घ) के अधीन दतं जचककत्सा सलाहकार पररषद के नामजनर्ददष्ट सदस्ट्यों म ें स े चक्रानुक्रम आधार पर, प्रत्येक दो वषच के पश्चात ् ऐसी तारीख को जो केंद्रीय सरकार द्वारा जवजनजश्चत की जाए, पची के ड्रा द्वारा, दस अिं -काजलक सदस्ट्यों की जनयुि करेगी। (2) पची का ड्रा एक ही आकार, रंग और जडजाइन की कागज की पर्थचयों स े संचाजलत ककया जाएगा, जजनम ेंप्रत्येक राज्य और संघ राज्यों क्षेत्रों के व्यजष्टकों के नाम जलखे होंग,े जजन्ह ें इस तरह स े मोडा जाएगा, जजससे कक गोपनीयता बनाई रखी जा सके। (3) राज्यों और संघ राज्य क्षत्रे ों के जलए पृथक बक्से होंग,े जजनमें स े राज्यों के जलए ड्रा बक्से स े नौ जस्ट्लप जनकाली जाएगी और संघ राज्य क्षेत्रों के जलए ड्रा बक्से स े जस्ट्लप ली जाएगी। (4) पर्थचयों का ड्रा केंद्रीय स्ट्वास्ट््य सजचव की उपजस्ट्थजत म ेंसचं ाजलत ककया जाएगा। (5) पर्थचयों का ड्रा प्रत्येक पश्चातवती दो वषच के अन्तराल पर, केवल उन राज्यों या संघ राज्य क्षेत्रों तक ही जनबंजधत होगा जजनका इससे तुरंत पूवचवती कायचकाल म ें सदस्ट्य के रुप म ेंप्रजतजनजधत्व न हो। (6) ककसी भी राज्य या संघ राज्य क्षेत्र का आयोग म ें एक समय में एक स े अजधक नाम जनदेजिती नहीं होगा। (7) ककसी सदस्ट्य की ररजि होने की दिा म,ें जजसमें मृत्य,ु त्यागपत्र या हटाने का कारण सजममजलत ह,ै यथाजस्ट्थजत राज्य सरकार या गृह मंत्रालय, यथािीघ्र उसकी जगह, ऐसी ररजि होने के तीन माह के भीतर ककसी अन्य व्यजि को नामजनदेजित करेगा और इस प्रकार स े नामजनर्ददष्ट व्यजि केवल िेष बच े हुए दो वषच के कायचकाल के जलए ही सदस्ट्य होगा। 5. धारा 4 की उपधारा (4) के खडं (ग) के अधीन अिं काजलक सदस्ट्यों की जनयजु ि की रीजत- (1) धारा 11 की उपधारा (2) के खंड (ङ) के अधीन दतं जचककत्सा सलाहकार पररषद म ें नामजनर्ददष्ट सदस्ट्यों म ें स े चक्रानुक्रम आधार पर, प्रत्येक दो वषच पर ऐसी तारीख को जो केंद्रीय सरकार द्वारा जवजनजश्चत की जाए, पर्थचयों के ड्रा द्वारा नौ अंि-काजलक सदस्ट्य जनयुि करेगी। (2) पर्थचयों का ड्रा एक ही आकार, रंग और जडजाइन की कागज की पर्थचयों स े संचाजलत ककया जाएगा, जजनम ें प्रत्येक राज्य और संघ राज्य क्षेत्रों के व्यजष्टकों का नाम जलखा होगा, जजन्ह ें इस तरह स े मोडा जाएगा, जजससे गोपनीयता बनाई रखी जा सके। (3) राज्यों और संघ राज्य क्षेत्रों के जलए पृथक ड्रा बक्से होंग े जजनमें स े राज्यों के ड्रा बक्सों स े 8 पर्थचयां जनकाली जाएंगी तथा संघ राज्य क्षेत्रों के ड्रा बक्से स ेएक पची जनकाली जाएगी।[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 (4) पर्थचयों का प्रथम ड्रा उन राज्यों और संघ राज्य क्षेत्रों तक जनबंजधत होंगा, जजनका जनयम 4 के अधीन अंिकाजलक सदस्ट्यों के रूप म ें प्रजतजनजधत्व नहीं ह ै और प्रत्येक पश्चातवती दो वषच के अंतराल पर पर्थचयों का ड्रा उन राज्यों और संघ राज्य क्षेत्रों तक जनबंजधत होगा, जजनका तत्काल पूवचवती कायचकाल म ें सदस्ट्यों के रूप म ेंप्रजतजनजधत्व नहीं था। (5) पर्थचयों का ड्रा केंद्रीय स्ट्वास्ट््य सजचव की उपजस्ट्थजत म ेंसचं ाजलत ककया जाएगा। (6) आयोग म ेंककसी भी राज्य या संघ राज्य क्षत्रे का प्रजतजनजधत्व एक बार म ें एक से अजधक नामजनदेजिती नहीं होगा। (7) ककसी सदस्ट्य की ररजि होने की दिा म ें जजसम ें मृत्य,ु त्याग पत्र या हटाना यथाजस्ट्थजत राज्य सरकार या गृह मंत्रालय, यथा िीघ्र और ऐसी ररजि होने की तारीख स े तीन मास की अवजध के भीतर उसके स्ट्थान पर ककसी अन्य व्यजि को नामजनदेजित करेगा और इस प्रकार नामजनदेजित व्यजि केवल िेष बच े हुए दो वषच की अवजध के जलए सदस्ट्य होगा। 6. अजधजनयम की धारा 4 की उप-धारा (4) के खडं (घ) के अधीन अिं काजलक सदस्ट्यों की जनयजु ि की रीजत- (1) केंद्रीय सरकार, एसोजसएट प्रोफेसर या इससे ऊपर के स्ट्तर के दतं -जचककत्सा संकाय म ें से दो अंिकाजलक सदस्ट्यों को चार वषच की अवजध के जलए जनयुि करेगी। (2) सदस्ट्यों की जनयुजि, केंद्रीय या राज्य या स्ट्वायत्त सरकारी संस्ट्थानों स े आमंजत्रत नामजनदेिन के आधार पर की जाएगी। (3) ककसी सदस्ट्य की मृत्यु, त्याग पत्र या हटाने सजहत अन्य कारणों स े ररजि यथाजस्ट्थजत, केंद्रीय या राज्य या स्ट्वायत्त सरकारी संस्ट्थान, िीघ्र और ररजि होने की तारीख स े तीन मास की अवजध के भीतर उसके स्ट्थान पर ककसी अन्य व्यजि को नामजनदेजित करेगी और इस प्रकार नामजनदेजित व्यजि चार वषच की पूण च कायचकाल के जलए सदस्ट्य के रूप म ें काय च करेगा। 7. खोजबीन-सह-चयन सजमजत के सदस्ट्यों के रूप म ें जविषे ज्ञों का नामजनदेिन- (1) केंद्रीय सरकार, धारा 5 की उपधारा (1) के खंड (ख) और खंड (ग) के अधीन खोजबीन-सह-चयन सजमजत के सदस्ट्यों के रूप म ें जनम्नजलजखत व्यजियों को नामजनदेजित करेगी, अथाचत:- (क) तीन जविेषज्ञ जजन्ह ें सरकारी संस्ट्थानों स े दतं -जचककत्सा जिक्षा, जन स्ट्वास्ट््य जिक्षा और स्ट्वास्ट््य अनुसंधान के क्षत्रे म ें उत्कृष्ट अहतच ा प्राप्त हो और कम-स-े कम पच्चीस वषच का अनुभव हो; (ख) एक जविेषज्ञ, जजसे प्रबंध या जवजध या अथचिास्त्र या जवज्ञान और प्रौद्योजगकी के क्षत्रे म ें उत्कृष्ट अहतच ाए ं प्राप्त हों और कम-स-े कम पच्चीस वषच का अनुभव हो। (2) उप-जनयम (1) के अधीन नामजनदेजित व्यजि दो वषच के कायचकाल के जलए खोजबीन-सह-चयन सजमजत के सदस्ट्यों के रूप म ेंकायच करेंगे। (3) खोजबीन-सह-चयन सजमजत के ककसी सदस्ट्य की यथाजस्ट्थजत मृत्य,ु त्याग पत्र या हटाने सजहत अन्य कारणों से ररजि होने पर, केंद्रीय सरकार उप-जनयम (1) के अधीन िीघ्र और ऐसी ररजि होने की तारीख स े तीन मास की अवजध के भीतर उसके स्ट्थान पर ककसी अन्य व्यजि को नामजनदेजित करेगी और इस प्रकार नामजनदेजित व्यजि दो वषच के पूण च कायचकाल के जलए खोजबीन-सह-चयन सजमजत में सदस्ट्य बना रहगे ा। 8. आयोग के अध्यक्ष को सदं ेय वते न और भत्त े तथा सदस्ट्यों को संदेय भत्त-े (1) अध्यक्ष को संदेय वेतन भारत सरकार के अपर सजचव को अनुज्ञेय वेतन के समतुल्य होगा। परंतु यह कक जहां अध्यक्ष सरकारी, अर्द्-च सरकारी अजभकरण, पजब्लक सेक्टर उपक्रम या मान्यता प्राप्त अनुसंधान संस्ट्थान स े सेवा जनवृत्त व्यजि ह,ै ऐस े अध्यक्ष द्वारा प्राप्त वते न के साथ उसके द्वारा प्राप्त पेंिन या आवजधक फायदों के पेंिनरी मूल्य या दोनों, अंजतम आहररत वेतन स े अजधक नहीं होंगे। (2) अध्यक्ष केंद्रीय सरकार या राज्य सरकार या संघ राज्य क्षत्रे प्रिासन की सेवा म ें ह,ै उसके वेतन और भत्त े उसके मूल संवगच या जवभाग म ें ऐसे अध्यक्ष पर लाग ू जनयमों या उप-जनयम (1), जो भी अजधक हो, के अनुसार जवजनयजमत होंग े और आयोग में उसकी जनयुजि को प्रजतजनयुजि पर हुई जनयुजि माना जाएगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (3) आयोग का अध्यक्ष और प्रत्येक अन्य सदस्ट्य, केंद्रीय सरकार म ें समतुल्य स्ट्तर के अजधकाररयों को अनुज्ञेय दरों पर उनके वेतन के समुजचत महगं ाई भत्ते, यात्रा भत्तों और दैजनक भत्तों के हकदार होंगे। परंत ुयह कक पदेन सदस्ट्यों का मंहगाई भत्ता और यात्रा भत्ता मूल जवभाग या संगठन द्वारा वहन ककया जाएगा। (4) अध्यक्ष और प्रत्येक सदस्ट्य, यात्रा भत्तों और दैजनक भत्तों स ेसंबंजधत उनके जबलों का स्ट्वय ंजनयंत्रण अजधकारी होगा। 9. आयोग के सजचव- (1) केंद्रीय सरकार आयोग के सजचव के रूप में ऐसे व्यजि को जनयुि करेगी जो उत्कृष्ट योग्यता, जसर्द् प्रिासजनक क्षमता प्राप्त और सत्यजनष्ठ हो तथा जजसके पास जनम्नजलजखत अहतच ाए ंऔर अनुभव हो, अथाचत:- (i) ककसी जवश्वजवद्यालय या संस्ट्थान स े अजधमानत: दतं -जचककत्सा या जन स्ट्वास्ट््य या स्ट्वास्ट््य प्रिासन स े संबंजधत ककसी जवषय म ें स्नातकोत्तर जडग्री; और (ii) मूल संवगच या जवभाग में जनयजमत आधार पर सदिृ पद धाररत ककया हो; या (iii) वेतन मैररक्स म ेंस्ट्तर 13 या इसके समतुल्य पर न्यूनतम तीन वषच की जनयजमत सेवा की हो; या (iv) वेतन मैररक्स म ेंस्ट्तर 12 या इसके समतुल्य पर न्यूनतम सात वषच की जनयजमत सेवा की हो; और (v) केंद्रीय सरकार या राज्य सरकार या ककसी कानूनी जनकाय या मान्यता प्राप्त संगठन या संस्ट्था म ें अपनी संबंजधत सेवा या वृजत्त म ें कम स े कम बारह वषच का अनुभव और साथ ही कम स े कम पांच वषच का प्रिासजनक अनुभव हो। (2) आवेदन की जतजथ तक पचपन वषच की आय ु पूरी कर चुका व्यजि सजचव पद के जलए पात्र नहीं होगा। (3) सजचव को संदेय वेतन, भारत सरकार के संयुि सजचव के वेतन के समतुल्य होगा। (4) सजचव, भारत सरकार के संयुि सजचव को अनज्ञु ेय दरों पर उसके वेतन के समुजचत महं गाई भत्ता, यात्रा भत्ता और दैजनक भत्ता का हकदार होगा। (5) सजचव चार वषच के कायचकाल के जलए या साठ वषच की आय ुप्राप्त करन े तक, जो भी पहल े हो, पद पर रहगे ा। 10. धारा 11 की उपधारा (2) के खंड (घ) के दसू रे उपबंध के अधीन दतं जचककत्सा सलाहकार पररषद के सदस्ट्य का नामजनदेिन- जहां ककसी राज्य या संघ राज्य क्षत्रे म ें कोई सरकारी दतं जचककत्सा कॉलेज नहीं ह,ै राज्य सरकार या संघ राज्य क्षत्रे की दिा म,ें गृह मंत्रालय जनम्नजलजखत दतं अहतच ाएं और अनुभव रखन े वाले व्यजि को धारा 11 की उपधारा (2) के खंड (घ) के दसू रे उपबंध के अधीन दतं जचककत्सा सलाहकार पररषद के सदस्ट्य के रूप म ें नामजनदेजित करेगा अथाचत:् - (क) ककसी मान्यता प्राप्त जवश्वजवद्यालय या संस्ट्थान स े दतं जचककत्सा जवज्ञान के ककसी भी जवषय म ें स्नातकोत्तर जडग्री (ख) राष्ट्रीय रजजस्ट्टर या राज्य रजजस्ट्रर म ेंरजजस्ट्रीकृत; और (ग) दतं जचककत्सा जवज्ञान के क्षत्रे म ेंपंद्रह वषच स े अन्यनू का अनभु व हो। 11. धारा 17 की उपधारा (5) के अधीन बोडच के दसू रे अिं काजलक सदस्ट्य की जनयजु ि की रीजत- केंद्रीय सरकार धारा 17 की उपधारा (5) के अधीन प्रत्येक बोडच के जलए लॉटरी जनकालकर दसू रे अंिकाजलक सदस्ट्य की जनयुजि धारा 4 की उपधारा (4) के खंड (ग) के अधीन आयोग के सदस्ट्यों म ें से जनयुि करेगी, जजन्होंने स्ट्वायत्त बोडच के दसू रे अंिकाजलक सदस्ट्य के रूप म ें सेवा करने के जलए अपनी सहमजत दी ह ैऔर ककसी भी अजनच्छुक सदस्ट्य का नाम ड्रा बक्से म ें िाजमल नहीं ककया जाएगा। (2) ड्रा बक्से म ेंनौ राज्यों के नाम वाली नौ पर्थचयों म ें स े तीन पर्थचयां जनकाली जाएंगी। (3) पहली पची म ें आने वाला नाम स्नातक और स्नातकोत्तर दतं जचककत्सा जिक्षा बोडच के दसू रे अंिकाजलक सदस्ट्य का प्रजतजनजधत्व करेगा, दसू री पची म ें आन े वाला नाम दतं जचककत्सा मूल्यांकन और रेटटग बोड च के दसू रे अिं काजलक सदस्ट्य का प्रजतजनजधत्व करेगा और तीसरी पची म ें आने वाला नाम आचार और दतं जचककत्सा रजजस्ट्रीकरण बोड च के दसू रे अंिकाजलक सदस्ट्य का प्रजतजनजधत्व करेगा। (4) लॉट का ड्रा संघ स्ट्वास्ट््य सजचव की उपजस्ट्थजत म ेंसंचाजलत ककया जाएगा। (5) दसू रे अंिकाजलक सदस्ट्यों का कायचकाल, धारा 4 की उपधारा (4) के खंड (ग) के अधीन आयोग म ेंउनकी सदस्ट्यता के साथ सहजवस्ट्तारी होगा।[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 5 (6) ककसी भी समय ररजि होने की जस्ट्थजत म,ें केंद्रीय सरकार इस जनयम म ें उपबंजधत रीजत म ें अन्य दसू रे अंिकाजलक सदस्ट्य की जनयुजि करेगी। 12. बोडों के अध्यक्ष और पणू कच ाजलक सदस्ट्यों को सदं ेय वते न और भत्त े और अिं काजलक सदस्ट्यों को सदं ेय भत्त-े (1) बोड च के अध्यक्ष और पणू चकाजलक सदस्ट्यों का वेतन, भारत सरकार के संयुि सजचव स्ट्तर अजधकारी के अजधकारी के वते न के समतुल्य होगा: परंत ु यह कक जहां ककसी बोडच का अध्यक्ष या पूणचकाजलक सदस्ट्य, सरकारी, अध-च सरकारी अजभकरण, पजब्लक सेक्टर उपक्रम या मान्यता प्राप्त अनुसंधान संस्ट्थान स े सेवाजनवृत्त व्यजि ह,ै ऐसे अध्यक्ष या पूणचकाजलक सदस्ट्य द्वारा प्राप्त वेतन के साथ संदेय पेंिन या आवजधक फायदों के पेंिनरी मूल्य, या दोनों अंजतम आहररत वेतन से अजधक नहीं होंगे। (2) जहां ककसी बोडच का अध्यक्ष या पणू चकाजलक सदस्ट्य केंद्रीय सरकार या राज्य सरकार या सघं राज्य क्षत्रे प्रिासन की सेवा में ह,ै उसका वेतन और भत्त े ऐसे अध्यक्ष या उसके मलू संवग च या जवभाग म ें पूणचकाजलक सदस्ट्य पर लाग ू जनयमों के अनुसार जवजनयजमत होंग े या उपजनयम (1) के अनुसार, जो भी अजधक हो, तथा आयोग म ें उसकी जनयुजि प्रजतजनयजु ि पर मानी जायेगी। (3) प्रत्येक बोड च का अध्यक्ष और पूणचकाजलक सदस्ट्य, केंद्रीय सरकार म ें समतल्ु य स्ट्तर के अजधकाररयों को अनुज्ञेय दरों पर उनके वेतन के समुजचत महगं ाई भत्ते होंगे। (4) प्रत्येक बोड च का अध्यक्ष और प्रत्येक अन्य सदस्ट्य अपन े वेतन के समुजचत दरों पर यात्रा भत्ता और दैजनक भत्त े के हकदार होंगे जो केंद्रीय सरकार म ेंउनके समतुल्य अजधकाररयों को अनज्ञु ेय ह।ैं 13. बठै क िल्ु क- यथाजस्ट्थजत आयोग या बोडच म,ें आयोग के पदेन और अंिकाजलक सदस्ट्य और प्रत्येक बोडच के अंिकाजलक सदस्ट्य, प्रत्येक कदन की बैठक के जलए पांच हजार रुपय ेबैठक िुल्क के हकदार होंगे। 14. छुट्टी- धारा 4 की उपधारा 4 के खंड (क) स े (घ) के अधीन जनयुि अध्यक्ष और आयोग के सदस्ट्य, आयोग के सजचव और प्रत्येक बोडच के अध्यक्ष और पूणचकाजलक सदस्ट्य जनम्नजलजखत के हकदार होंगे— (क) समय-समय पर यथा संिोजधत केंद्रीय जसजवल सेवा (अवकाि) जनयम, 1972 के अनुसार केंद्रीय सरकार के सेवकों के जलए अनुज्ञेय अर्थजत अवकाि, अध च वेतन अवकाि और पररवर्थतत अवकाि; और (ख) समय-समय पर यथा संिोजधत केंद्रीय जसजवल सेवा (छुट्टी) जनयम, 1972 के अधीन अस्ट्थायी केंद्रीय सरकार के सेवकों के जलए अनुज्ञेय असाधारण छुट्टी। 15. छुट्टी मंजरू ी प्राजधकारी- (1) आयोग के अध्यक्ष को छुट्टी मंजूर करन े के जलए केंद्रीय सरकार सक्षम प्राजधकारी होगी। (2) आयोग के अध्यक्ष जनम्नजलजखत को छुट्टी मंजूर करने के जलए सक्षम प्राजधकारी होंग-े (क) सदस्ट्य, आयोग के पदेन सदस्ट्यों से जभन्न और सजचव; और (ख) बोडच के अध्यक्ष। (3) बोड च का अध्यक्ष, बोडच के पूणचकाजलक सदस्ट्य को छुट्टी मंजूर करने का प्राजधकार होगा। 16. अजभदायी भजवष्य जनजध- चेयरपसचन और बोडच के अध्यक्ष और पूणचकाजलक सदस्ट्य, (क) अजभदायी भजवष्य जनजध जनयम (भारत), 1962 के उपबंधों द्वारा िाजसत होंगे और सामान्य भजवष्य जनजध (केंद्रीय सेवाएं) जनयम, 1960 के अधीन अजभदान लेन ेका कोई जवकल्प नहीं ह;ै (ख) बोडच म ें उनके द्वारा प्रदान की गई सेवा के जलए अजतररि पेंिन और उपदान के हकदार नहीं होंगे। 17. केन्द्रीय जसजवल सेवा जनयमों का लाग ू होना- यथाजस्ट्थजत आयोग के अध्यक्ष, सजचव और बोडच के अध्यक्ष तथा पूणचकाजलक सदस्ट्य, केन्द्रीय जसजवल सेवा (आचरण) जनयमों के उपबन्धों द्वारा उनके कायचकाल के दौरान िाजसत होंगे।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. और इस े अजधक सुगम बनाने की दजृ ष्ट से अन्य के बीच, आधुजनक प्रौद्योजगकी को अपनान,े अवसंरचना का गहन उपयोग, संकाय साझा करना और वैजश्वक सवोत्तम प्रथाओं के पालन का परामि चदेगा: (ग) बोडों के जवजनश्चयों के जवरुर्द् अपील की सुनवाई की रीजत जवजनजश्चत करेगा: परंतु यह कक जहां बोडच के जवजनश्चय के जवरूर्द् अपील फाइल की जाती ह,ै ऐसे बोडच के अध्यक्ष अपील की कायचवाही म ें भाग नहीं लगें े (घ) जवजनयम (i) सभी राज्य सरकारों, संघ राज्य क्षत्रे प्रिासनों और अन्य पणधाररयों जैसे कक दतं जचककत्सक व्यवसाजयक संगम, रेजजडेंट दतं जचककत्सक संगम और रोगी अजधकार जनकायों स ेपरामि च के पश्चात बनाए; (ii) प्रारूप जवजनयमों को तीस कदनों की अवजध के जलए आयोग की वेबसाइट पर उपलब्ध कर व्यापक प्रचार करन े के पश्चात बनाए: (iii) आम जनता स ेप्राप्त सभी आपजत्तयों या सुझावों पर जवचार करने के पश्चात बनाए; (iv) स्ट्वास्ट््य और पररवार कल्याण मंत्रालय के माध्यम स े जवजनयमों के अंजतम प्रारुप पर जवजध और न्याय मंत्रालय के जवधायी जवभाग स े परामि चकरने के पश्चात बनाए; (ङ) आयोग द्वारा जलए गए प्रत्येक प्रमुख जवजनश्चय की एक प्रजत को अपने सजचव के माध्यम स े स्ट्वास्ट््य और पररवार कल्याण मंत्रालय को पष्ठृ ांककत करना और इस ेआयोग की वेबसाइट पर प्रकाजित करेगा; (च) केंद्रीय सरकार को समय समय पर ऐसी सूचना या ररपोट च उपलब्ध करवाऐगा जो केंद्रीय सरकार द्वारा यथा अपेजक्षत हो। 20. भारतीय दतं जचककत्सा पररषद के तत्कालीन कमचच ाररयों को दये प्रजतकर- (1) धारा 58 की उप-धारा (5) म ें उपबंजधत अनुसार आयोग एक वष च की अवजध के भीतर तत्कालीन भारतीय दतं जचककत्सा पररषद के जनयजमत कमचचाररयों को समय स े पहल ेसमाजप्त और संदेय प्रजतकर पर जवजनश्चय करेगा। (2) तत्कालीन भारतीय दतं जचककत्सा पररषद के कमचचारी को, जब तक कक वह संजवदा के आधार पर आयोग के साथ जारी नहीं रखता Short title and commencement.–– (1) These rules may be called the National Dental Commission Rules, 2024. (2) They shall come into force from the date of their publication in the Official Gazette. 2. Definitions.––(1) In these rules, unless the context otherwise requires,–– (a) ―Act‖ means the National Dental Commission Act, 2023 (21 of 2023); (b) ―Board‖ means any of the Autonomous Board constituted under section 16 of the Act; (c) ―Commission‖ means the National Dental Commission constituted under section 3 of the Act; (d) ―Secretary‖ means Secretary of the Commission appointed under sub-section (1) of section 8 of the Act; (e) ―section‖ means section of the Act. (2) Words and expressions used in these rules and not defined herein but defined in the Act, shall have the respective meanings assigned to them in the Act. 3. Manner of appointment of part-time Members under clause (a) of sub-section (4) of section 4.–– (1) The Central Government shall appoint three part-time Members under clause (a) of sub-section (4) of section 4 on the recommendations of the Search-cum-Selection Committee for a term of four years, from amongst persons having special knowledge and professional experience of not less than twenty years in areas of management, law, medical ethics, health research, consumer or patient rights advocacy, science and technology or economics. (2) As soon as any vacancy of a part-time Member arises, the Search-cum-Selection Committee shall, for the purpose of recommending suitable candidates, convene its meeting at the earliest but not later than three months from the occurrence of such vacancy. (3) The Search-cum-Selection Committee shall recommend a panel of at least three names for each vacancy of a part- time Member referred to it and the persons so appointed shall serve as a Member of the Commission for a full term of four years. 4. Manner of appointment of part-time Members under clause (b) of sub-section (4) of section 4.–– (1) The Central Government shall appoint ten part-time Members under clause (b) of sub-section (4) of section 4 from amongst the members of the Dental Advisory Council nominated under clauses (c) and (d) of sub-section (2) of section 11, on rotation basis, after every two years, by draw of lots on such date as may be decided by the Central Government. (2) The draw of lots shall be conducted with paper slips of uniform size, colour and design bearing individual names of each State and Union territories, which shall be folded in such manner so as to preserve the confidentiality. (3) There shall be separate draw boxes for the States and the Union territories out of which nine slips shall be picked up from the draw box for the States and one slip shall be picked up from the draw box of the Union territories. (4) The draw of lots shall be conducted in the presence of the Union Health Secretary. (5) The draw of lots at every subsequent two year interval, shall be restricted to those States or Union territories not represented as Members in the immediately preceding term. (6) No State or Union territory shall be represented by more than one nominee in the Commission at a time. (7) In the event of occurrence of vacancy of a Member, including by reason of death, resignation or removal, the State Government or the Ministry of Home Affairs, as the case may be, shall nominate another person in his place at the[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 9 earliest and within three months from the occurence of such vacancy, and the person so nominated, shall be a Member only for the remaining term of two years. 5. Manner of appointment of part-time Members under clause (c) of sub-section (4) of section 4.–– (1) Nine part-time Members from amongst the members of the Dental Advisory Council nominated under clause (e) of sub- section (2) of section 11, on rotation basis, after every two years, by draw of lots on such date as may be decided by the Central Government (2) The draw of lots shall be conducted with paper slips of uniform size, colour and design bearing individual names of each State and Union territories, which shall be folded in such manner so as to preserve the confidentiality. (3) There shall be separate draw boxes for the States and the Union territories out of which eight slips shall be picked up from the draw box for the States and one slip shall be picked up from the draw box of the Union territories. (4) The first draw of lots shall be restricted to those States and Union territories which are not represented as part-time Members under rule 4 and the draw of lots at every subsequent two-year interval, shall be restricted to those States and Union territories not represented as Members in the immediately preceding term. (5) The draw of lots shall be conducted in the presence of the Union Health Secretary. (6) No State or Union territory shall be represented by more than one nominee in the Commission at a time. (7) In the event of occurrence of vacancy of a Member, including by reason of death, resignation or removal, the State Government or the Ministry of Home Affairs, as the case may be, shall nominate another person in his place at the earliest and within three months from the date of occurence of such vacancy and the person so nominated shall be a Member only for the remaining term of two years. 6. Manner of appointment of part-time Members under clause (d) of sub-section (4) of section 4.–– (1) The Central Government shall appoint two part-time Members from amongst dental faculty of the level of Associate Professor or above, for a period of four years. (2) The members shall be appointed on the basis of nominations invited from the Central or State or Autonomous Government Institutes. (3) In the event of occurrence of vacancy of a Member, including by reason of death, resignation or removal, the Central or State or Autonomous Government Institute, as the case may be, shall nominate another person in his place at the earliest and within three months from the date of occurence of such vacancy and the person so nominated shall serve as a Member for a full term of four years. 7. Nomination of experts as members of Search-cum-Selection Committee.– (1) The Central Government shall nominate the following persons as members of the Search-cum-Selection Committee under clauses (b) and (c) of sub- section (1) of section 5, namely :–– (a) three experts, possessing outstanding qualification and experience of not less than twenty-five years in the field of dental education, public health education and health research from Government Institutes; (b) one expert, having outstanding qualifications and experience of not less than twenty-five years in the field of management or law or economics or science and technology. (2) The persons nominated under sub-rule (1) shall serve as members of the Search-cum-Selection Committee for a term of two years. (3) In the event of occurrence of vacancy, including by reason of death, resignation or removal, as the case may be, of any member of the Search-cum-Selection Committee under sub-rule (1), the Central Government shall nominate another person as a member at the earliest and within three months from the date of occurence of such vacancy and the person so nominated shall remain a member in the Search Cum Selection Committee for a full term of two years. 8. Salaries and allowances payable to Chairperson and allowances payable to Members of Commission.–– (1) The salary payable to the Chairperson shall be equivalent to the salary admissible to an Additional Secretary to the Government of India: Provided that where the Chairperson is a retired person from the Government, semi-Government agency, public sector undertaking or recognised research institution, the salary payable together with the pension or pensionery value of the terminal benefits, or both, received by such Chairperson shall not exceed the last pay drawn. (2) Where the Chairperson is in the service of the Central Government or a State Government or a Union territory Administration, his salary and allowances shall be regulated in accordance with the rules applicable to such10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Chairperson in his parent cadre or department, or as per sub-rule (1), whichever is higher, and his appointment in the Commission shall be treated as being on deputation. (3) The Chairperson and every other Member of the Commission shall be entitled to dearness allowance, travelling allowances and daily allowances appropriate to their pay at the rates admissible to officers of equivalent level in the Central Government: Provided that dearness allowance and travelling allowance of ex officio Members shall be borne by the parent department or organisation. (4) The Chairperson and every Member shall be his own controlling officer in respect of his bills relating to travelling allowances and daily allowances. 9. Secretary of Commission.–– (1) The Central Government shall appoint a Secretary to the Commission who shall be a person of of outstanding ability, proven administrative capacity and integrity and possessing the following qualifications and experience, namely:–– (i) a post-graduate degree in any discipline preferably related to Dental or Public Health or Health Administration from any University or Institute; and (ii) holding analogous post on regular basis in the parent cadre or department; or (iii) with minimum three years’ regular service in Level 13 in the pay matrix or equivalent thereto; or (iv) with minimum seven years’ regular service in Level 12 in the pay matrix or equivalent thereto; and (v) having experience in the Central Government or a State Government or any statutory body or recognised organisation or institution of not less than twelve years in his related service or profession along with administrative experience of not less than five years. (2) A person who has completed the age of fifty-five years on the date of application shall not be eligible for the post of Secretary. (3) The salary payable to the Secretary shall be equivalent to the salary of Joint Secretary to the Government of India. (4) The Secretary shall be entitled for dearness allowance, travelling allowances and daily allowances appropriate to his pay at the rates admissible to Joint Secretary to the Government of India. (5) The Secretary shall hold office for a term of four years or till he attain the age of sixty years, whichever is earlier. 10. Nomination of member of Dental Advisory Council under the second proviso to clause (d) of sub-section (2) of section 11.– Where there is no Government Dental College in any State or Union territory, the State Government or in case of a Union territory, the Ministry of Home Affairs shall, nominate a person possessing the following dental qualifications and experience, as a member of the Dental Advisory Council under the second proviso to clause (d) of sub-section (2) of section 11, namely:– (a) a post-graduate degree in any discipline of dental sciences from a recognised University or institute; (b) registered with the National Register or State Register; and (c) having experience of not less than fifteen years in the field of dental sciences. 11. Manner of appointment of second part-time Members of Boards under sub-section (5) of section 17 .– (1) The Central Government shall appoint under sub-section (5) of section 17, a second part-time Member for each of the Boards by draw of lots from amongst the Members of the Commission appointed under clause (c) of the sub-section (4) of section 4 who have given their consent to serve as second part time Member of Autonomous Board and the name of any unwilling Member shall not be included in the draw box. (2) Three slips shall be picked from out of the nine slips in the draw box containing the names of the nine States. (3) The name appearing in the first slip shall represent the second part-time Member of the Undergraduate and Postgraduate Dental Education Board, the name appearing in the second slip shall represent the second part-time Member of the Dental Assessment and Rating Board and the name appearing in the third slip shall represent the second part-time Member of the Ethics and Dental Registration Board. (4) The draw of lots shall be conducted in the presence of the Union Health Secretary.[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 11 (5) The term of the second part-time Members shall be co-terminus with their membership in the Commission under clause (c) of sub-section (4) of section 4. (6) In the event of occurrence of vacancy at any time, the Central Government shall appoint another second part-time Member in the manner provided in this rule. 12. Salaries and allowances payable to President and whole-time Members, and allowances payable to part- time Members, of Boards.– (1) The salary of the President and whole-time Members of a Board shall be equivalent to the salary of an officer of the level of Joint Secretary to the Government of India: Provided that where the President or a whole-time Member of a Board, is a retired person from the Government, semi-Government agency, public sector undertaking or recognised research institution, the salary payable together with the pension or pensionery value of the terminal benefits, or both, received by such President or whole-time Member shall not exceed the last pay drawn. (2) Where the President or a whole-time Member of a Board is in the service of the Central Government or a State Government or a Union territory Administration, his salary and allowances shall be regulated in accordance with the rules applicable to such President or a whole-time Member in his parent cadre or department, or as per sub-rule (1), whichever is higher, and his appointment in the Commission shall be treated as being on deputation. (3) The President and whole-time Members of each Board shall be entitled for dearness allowance appropriate to their pay at the rates admissible to officers of equivalent level in the Central Government. (4) The President and every other Member of each of the Boards shall be entitled to travelling allowance and daily allowances at the rates appropriate to their pay admissible to officers of equal rank in the Central Government. 13. Sitting fee.––The ex-officio and part time Members of the Commission and the part-time Members of each Board, shall be entitled to a sitting fee of five thousand rupees for each day of sitting of the Commission or the Board as the case may be. 14. Leave.– The Chairperson and Members of the Commission appointed under clauses (a) to (d) of sub-section (4) of section 4, the Secretary to the Commission and the President and whole-time Members of each Board shall be entitled to–– (a) earned leave, half pay leave and commuted leave as admissible to Central Government servants in accordance with the Central Civil Services (Leave) Rules,1972, as amended from time to time; and (b) extraordinary leave as admissible to the temporary Central Government servants under the Central Civil Services (Leave) Rules, 1972, as amended from time to time. 15. Leave sanctioning authority.– (1) The Central Government shall be the authority competent to sanction leave to the Chairperson of the Commission. (2) The Chairperson of the Commission shall be the authority competent to sanction leave to,– (a) the Members, other than ex officio Members of Commission and the Secretary; and (b) the President of a Board. (3) The President of a Board shall be the authority to sanction leave to the whole-time Member of that Board. 16. Contributory Provident Fund.– The Chairperson and the President and whole-time Members of Board, – (a) shall be governed by the provisions of the Contributory Provident Fund Rules (India), 1962 and there shall be no option to subscribe under the General Provident Fund (Central Services) Rules, 1960; (b) shall not be entitled to additional pension and gratuity for the service rendered by them in the Board 17. Application of Central Civil Services Rules.– The Chairperson, Secretary, President and whole-time Members of the Commission and the Boards, as the case may be, shall be governed by the provisions of the Central Civil Service (Conduct) Rules during their tenure. 18. Declaration of assets, professional and commercial engagement or involvement.–– The Chairperson, Secretary, President, and Members of the Commission and Boards shall– (a) file a return of their assets and liabilities in Form A annexed to these rules;12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (b) declare their professional and commercial engagement or involvement at the time of appointment, and at the time of demitting office as such Chairperson or Secretary or Member, in Form B annexed to these rules. 19. Other powers and functions of Commission. –– In addition to the powers and functions of the Commission specified in section 10 , the Commission shall–– (a) undertake study to reduce the cost of dental education in the country; (b) suggest, among others, adoption of modern technology, intensive use of infrastructure, faculty sharing, and global best practices with a view to reduce the cost of education and make it more accessible; (c) decide the manner of hearing appeals against the decisions of Boards: Provided that where an appeal is filed against the decision of a Board, the President of such Board shall not participate in the appeal proceedings; (d) make regulations after (i) consulting all State Governments, Union territory Administrations and other stakeholders, such as, association of dental professionals, association of resident dentists and patient rights bodies; (ii) giving wide publicity by placing draft regulations on the website of the Commission for a period of thirty days; (iii) taking into consideration all objections or suggestions received from the general public; (iv) Consulting the Legislative Department in the Ministry of Law and Justice on the final draft of the regulations through the Ministry of Health and Family Welfare; (e) endorse a copy of each major decision taken by the Commission to the Ministry of Health and Family Welfare through its Secretary and publish it on the website of the Commission; (f) furnish such information or report to the Central Government as may be required by the Central Government from time to time 20. Compensation payable to erstwhile employees of Dental Council of India.– (1) The Commission shall decide on the premature termination and compensation payable to the regular employees of the erstwhile Dental Council of India within a period of one year as provided in sub-section (5) of Section 58. (2) An employee of the erstwhile Dental Council of India, unless continued with the Commission on contract basis, shall be paid an advance amount equivalent to three months’ salary at the time of termination of his service which shall be deducted from the total compensation package. (3) An employee of the erstwhile Dental Council of India who is not continued with the Commission, shall be paid compensation package including pensionary benefits applicable to such employee as per the terms and conditions of his service at the time of his appointment in the erstwhile Dental Council of India.
