Executive Summary & Key Takeaways

## Report on Amendment to the National Company Law Appellate Tribunal Recruitment Rules **1. Executive Summary:** This report analyzes an amendment to the National Company Law Appellate Tribunal (NCLAT) Recruitment, Salary and other Terms and Conditions of Service of Officers and other Employees Rules, 2020. The amendment, enacted on May 6, 2025, focuses on changes related to the post of Stenographer Grade III within the NCLAT, specifically renaming the post to Stenographer Grade II, increasing the allowable age range for applicants, modifying age relaxation rules for government servants, clarifying the age limit determination date, and changing transcription time on computers. The key impact is on recruitment and qualification standards for Stenographer positions within the NCLAT. **2. Introduction:** This report aims to provide a detailed analysis of the amendment to the National Company Law Appellate Tribunal Recruitment, Salary and other Terms and Conditions of Service of Officers and other Employees Rules, 2020, as published in the Gazette of India on May 7, 2025. The analysis is based solely on the provided text of the amendment. **3. Policy Overview:** This report concerns an *amendment* to an existing policy. The original policy is the "National Company Law Appellate Tribunal Recruitment, Salary and other Terms and Conditions of Service of Officers and other Employees Rules, 2020." The core objective of *this amendment*, as inferred from the provided text, is to modify the recruitment criteria and job title for Stenographer positions within the NCLAT. **4. Background and Rationale:** This amendment addresses potential issues related to recruitment and qualification for Stenographer Grade III positions. The changes suggest a need to broaden the pool of eligible candidates and align the position's responsibilities and qualifications more accurately. Specifically, increasing the age limit and modifying the age relaxation rules may be aimed at attracting a wider range of applicants, possibly including more experienced candidates. Renaming the post from Stenographer Grade III to Stenographer Grade II indicates a possible change in the role's responsibilities or grading within the organization. Furthermore, increasing the alloted time for transcription may mean that there is an expectation for more difficult transcriptions, or that previous transcription times were inadequate. **5. Key Provisions / Changes:** This amendment introduces the following specific changes to the original 2020 rules, concerning Schedule I, serial number 18, pertaining to the post of Stenographer: * **Change 1:** The title "Stenographer Grade III" is *substituted* with "Stenographer Grade II." * **Effect:** This changes the official designation of the position, potentially impacting its associated responsibilities, pay scale, and internal hierarchy. * **Change 2:** The age range "Between 18 and 25 years of age" is *substituted* with "Between 18 and 27 years of age." * **Effect:** This expands the eligibility criteria, allowing candidates up to 27 years old to apply, widening the applicant pool. * **Change 3:** Note 1 (concerning age relaxation) is *substituted* with "Note 1 : Relaxable for Government Servants upto forty years in accordance with the instructions or orders issued by the Central Government." * **Effect:** This clarifies and potentially broadens the age relaxation for government servants, allowing them to be up to 40 years old, aligning with Central Government guidelines. * **Change 4:** Note 2 (concerning the crucial date for determining age) is *substituted* with "Note 2 : The crucial date for determining the age limit shall be as advertised by the Staff Selection Commission." * **Effect:** This clarifies that the Staff Selection Commission will define the key age-determining date. * **Change 5:** The transcription time "Transcription : 40 minutes on computer" is *substituted* with "Transcription : 50 minutes on computer." * **Effect:** This increases the time allotted for transcription tasks, likely in response to the type of content that needs to be transcribed, or as a general acknowledgement that the time needed for a transcription is higher. **6. Target Audience and Stakeholders:** The primary target audience includes: * Individuals seeking Stenographer positions within the National Company Law Appellate Tribunal (NCLAT). * Government servants interested in applying for these positions. * The Staff Selection Commission (SSC), which will be involved in the recruitment process and determining the crucial age limit date. * The NCLAT itself, particularly its HR department, as the changes affect their recruitment procedures. **7. Implementation Aspects (Inferred):** * **Responsible Agency:** The Ministry of Corporate Affairs is the issuing authority of this amendment. The Staff Selection Commission (SSC) is implicated in this policy and will play a role in implementing the changed recruitment. * **Timelines:** The amendment came into force on the date of its publication in the Official Gazette (May 7, 2025). * **Procedures:** NCLAT's recruitment process for Stenographer positions will need to be updated to reflect the new job title, age limits, age relaxation rules, and transcription time. **8. Expected Outcomes / Impact of Changes:** The anticipated outcomes of these changes include: * A potentially larger and more diverse pool of applicants for Stenographer positions within the NCLAT. * Increased opportunities for government servants to apply for these positions due to the revised age relaxation rules. * More flexibility for candidates to demonstrate their transcription skills with the extended time. * A possible change in the responsibilities for the Stenographer position. * Streamlined recruitment process if SSC procedures are clear. **9. Conclusion:** The amendment to the National Company Law Appellate Tribunal Recruitment Rules represents a targeted effort to refine the recruitment process for Stenographer positions within the NCLAT. By modifying the job title, age limits, age relaxation rules, age determination procedures, and transcription time, the amendment aims to attract a wider range of qualified candidates and ensure efficient recruitment and operation of the tribunal.
