Executive Summary & Key Takeaways

**Executive Summary** This notification, issued by the Ministry of Civil Aviation on May 6, 2026, appoints designated officers from the Directorate General of Civil Aviation (DGCA) to adjudge penalties for violations related to the carriage of dangerous goods by air. Pursuant to the Bharatiya Vayuyan Adhiniyam, 2024, the order establishes a formal hierarchy for adjudication based on ten specific severity levels of non-compliance. These provisions ensure administrative continuity and clarify jurisdictional authority for enforcement actions. **Key Points / Main Content** **Legal Framework and Appointment** * The appointments are made under sub-sections (2) and (3) of section 32 of the Bharatiya Vayuyan Adhiniyam, 2024. * Designated officers are authorized to adjudge penalties as specified under Rule 24 of the Aircraft (Carriage of Dangerous Goods) Rules, 2026. * All appointed officers must hold a rank not below Deputy Secretary to the Government of India or its equivalent. **Adjudication Hierarchy by Severity Level** * **Levels 1 to 3:** Adjudged by the Deputy Director or Senior Dangerous Goods Inspector. * **Levels 4 to 6:** Adjudged by the Director. * **Levels 7 and 8:** Adjudged by the Deputy Director General. * **Levels 9 and 10:** Adjudged by the Joint Director General. **Administrative Rules for Enforcement** * **Multiple Violations:** If a single act or omission results in contraventions across multiple severity levels, the penalty will be adjudged by the officer corresponding to the highest severity level involved. * **Vacancy Protocol:** In the event of a vacancy due to leave, superannuation, or any other reason, the officer next higher in rank will assume the role of the designated officer for that jurisdiction until the vacancy is filled. **Impact Analysis** **Stakeholder: Directorate General of Civil Aviation (DGCA) Officers** **Impact** Senior officers within the DGCA (from Senior Inspectors to Joint Director Generals) are granted statutory authority to act as "designated officers" for penalty adjudication. Their specific legal responsibilities are now tied directly to the severity of the violation. **Action Required** Appointed officers must exercise their adjudicatory powers in alignment with the severity levels defined in the Aircraft (Carriage of Dangerous Goods) Rules, 2026. Higher-ranking officers must be prepared to assume the duties of subordinates in case of vacancies. **Stakeholder: Aircraft Operators and Cargo Entities** **Impact** Parties involved in the carriage of dangerous goods are subject to a structured enforcement regime. The severity of a violation will determine which level of the DGCA hierarchy will preside over the penalty proceedings. **Action Required** Entities must ensure strict compliance with dangerous goods regulations. In the event of a violation, they must interact with the specific designated officer assigned to the corresponding severity level of the contravention.
