Executive Summary & Key Takeaways

**Executive Summary** The Ministry of Labour and Employment issued this notification on May 12, 2026, under Section 4 of the Code on Wages, 2019. It designates specific officers as authorities to adjudicate disputes regarding whether work is of the "same or similar nature" under Section 3 of the Code. This notification supersedes the previous order dated October 17, 2019, and applies to all establishments where the Central Government is the appropriate government. **Key Points / Main Content** **Legal Framework and Supersession** * The notification is issued in exercise of powers conferred by Section 4 of the Code on Wages, 2019 (29 of 2019). * It supersedes the earlier notification of the Government of India, S.O. No. 3729(E), dated October 17, 2019. * Actions taken or omitted before this supersession remain valid. **Mandate of Designated Authorities** * Designated officers are empowered to decide disputes regarding whether a specific work is of the same or similar nature for the purposes of Section 3 of the Code. * The authority applies to establishments for which the Central Government is the "appropriate government." **Jurisdictional Structure** * The notification defines 21 distinct jurisdictions across India, assigning a specific Deputy Chief Labour Commissioner (Central) to each. * The Chief Labour Commissioner (Central) and Deputy Chief Labour Commissioners (Central) in the New Delhi office hold jurisdiction over the "whole of India." * Regional authorities are assigned to specific states, groups of states, or Union Territories (e.g., the Ahmedabad office covers Gujarat, Dadra and Nagar Haveli, and Daman and Diu). * Certain jurisdictions are divided by civil districts; for instance, West Bengal is split between the Asansol and Kolkata offices, while Maharashtra is split between the Mumbai and Nagpur offices. **Impact Analysis** **Establishments (where the Central Government is the appropriate government)** **Impact** These organizations are now subject to the specific jurisdictional oversight of designated authorities for any disputes concerning the nature and classification of work under the Code on Wages. **Action Required** Identify the relevant Deputy Chief Labour Commissioner (Central) based on the geographical location of the establishment to ensure compliance and proper filing in the event of a dispute. **Employees and Labour Unions** **Impact** They are provided with a clarified legal recourse and a specific designated official to resolve disputes regarding work similarity, which is critical for wage-related claims. **Action Required** Direct any disputes regarding the "same or similar nature" of work to the specific regional authority outlined in the notification’s table. **Deputy Chief Labour Commissioners (Central)** **Impact** These officers are formally vested with the legal authority to adjudicate disputes under Section 3 of the Code on Wages within their specified geographical boundaries. **Action Required** Exercise the powers of the designated authority for their respective jurisdictions as defined in the 2026 notification table.
