Will the Minister of ROAD TRANSPORT AND HIGHWAYS be pleased to state:
(a) whether Government, through its implementing agency NHAI, requires contractors to sign written agreements specifying the maintenance responsibility and defect liability period after the construction of National Highways;
(b) if so, the details of the standard duration of maintenance or defect liability period provided in such contracts for newly constructed highways;
(c) whether contractors are legally bound to repair any damage or deterioration occurring within this stipulated period and the penalties imposed for failure to do so; and
(d) whether any contractor has been penalized, blacklisted or issued notices for failing to maintain highways during the specified maintenance period? ANSWER THE MINISTER OF ROAD TRANSPORT AND HIGHWAYS (SHRI NITIN JAIRAM GADKARI)
(a) & (b) There is provision of Defect Liability Period (DLP) in the Contract / Concession Agreement (CA) of the respective Contractors / Concessionaires to maintain the National Highways (NH) post construction / concession Period.
The Concession period of projects including maintenance in Build-Operate-Transfer (BOT) mode is 15 to 30 years and generally 15 years in case of Hybrid Annuity Model (HAM) projects.
Further, in case of Engineering Procurement & Construction (EPC) Projects, the provision of DLP is for 05 Years for bituminous pavement and 10 Years for concrete pavement.
For Toll-Operate-Transfer (TOT) and InvIT projects, concession period including maintenance is for 20 to 30 years. Concession period for projects on Operate, Maintain and Transfer (OMT) projects is generally 9 years.
For the remaining NHs stretches where DLP period had ended or is not under any concession period of BOT / HAM / TOT / Infrastructure Investment Trust (InvIT) project, maintenance works are being undertaken through Performance Based Maintenance Contract
(PBMC) mode for a period of 5 or 7 Years or Short-Term Maintenance Contract (STMC) mode for a period of 1-2 years.(c) & (d) Remedial work to repair or reconstruct damages during construction or in the DLP is the responsibility of the Contractor / Concessionaire at their own cost as per provisions of contract agreement except in those cases where the Contract Agreement has been terminated, in which case the securities provided are forfeited. Actions against defaulting agencies have been taken as per the provisions of the Contract / Concession Agreement in cases of deficiencies / damages, such as termination of contract agreement, levying of penalties / liquidated damages, debarment / blacklisting, declaring as non-performers, etc. The list of cases where the Contractors/Concessionaires, etc. against whom the actions are initiated in last 3 years is annexed.ANNEXURE ANNEXURE REFERED TO IN REPLY TO PART (c) and (d) OF RAJYA SABHA UNSTARRED QUESTION NO. 4257 TO BE ANSWERED ON 01ST APRIL, 2026 ASKED BY SHRI SANT BALBIR SINGH REGARDING AGREEMENTS ON MAINTENANCE AND DEFECT LIABILITY.
