BACKLOG OF EXECUTION PETITIONS
5640. SHRI BAPI HALDAR:
Will the Minister of LAW AND JUSTICE be pleased to state:
(a) whether it is a fact that over 8.82 lakh execution petitions are pending in district courts and
about 39 per cent are in Maharashtra, if so, pendency of execution petitions, State/UT-wise;
(b) whether the Supreme Court has mandated all High Courts to establish a mechanism for
deciding execution petitions within six months;
(c) if so, the details of compliance with the Supreme Court’s 6 month timeline, High Court-wise;
and
(d) the average disposal time of execution petitions in the last five years, State/UT-wise?

(a): The Supreme Court of India, in its proceedings dated 16.10.2025 in M.A. Nos. 1889–
1891/2025 in CA No.3640-3642 of 2025, observed that as on that date, a total of 8,82,578
execution petitions were pending across the country. As on 18.03.2026, the pendency of execution
petitions State/UT-wise is at Annexure.
(b): Yes, the Supreme Court of India has mandated expeditious disposal of execution petitions; in
Para 42.12 of Rahul S. Shah v. Jinendra Kumar Gandhi, it directed that execution proceedings to
be completed within six months from the date of filing, which has been reiterated by the Apex
court in its subsequent orders including Bhoj Raj Garg v. Goyal Education and Welfare Society &
Ors., Special Leave Petition(C) Nos.19654 of 2022 as well as orders dated 06.03.2025 in Civil
Appeal Nos. 3640-3642 of 2025 (Periyammal (dead) through Lrs & Ors. V/s V. Rajamani & Anr.
Etc.
(c) & (d): The details regarding compliance with the Supreme Court’s 6 month timeline, High
Court-wise is not centrally maintained. However, as per the information provided by some High
Courts it is observed that pursuant to the Supreme Court’ directions, the Orissa High Court, the
Jharkhand High Court, the Gauhati High Court and the Bombay High court have issued
administrative instructions to subordinate courts for the disposal of execution petitions within six
months. Further, the data regarding average disposal time of execution petitions in the last five
years, State/UT-wise is not centrally maintained.
