CENTRAL MOTOR VEHICLES (SECOND AMENDMENT) RULES, 2026
2187. SHRI BABUBHAI JESANGBHAI DESAI:
Will the Minister of ROAD TRANSPORT AND HIGHWAYS be pleased to state:
(a) the manner in which the Central Motor Vehicles (Second Amendment) Rules, 2026 are being
implemented to strengthen compliance of National Highway user fee payments;
(b) the definition and mechanism for identification and recovery of 'unpaid user fee' through the
Electronic Toll Collection system;
(c) how clearance of unpaid user fee has been linked with vehicle-related services such as grant
of No Objection Certificate, renewal of Certificate of Fitness and issuance of National Permits;
(d) the changes made to Form 28 and integration with designated online portals; and
(e) the expected impact on toll compliance, digital enforcement and Multi-Lane Free Flow
tolling?
ANSWER

(a) to (d). Government vide GSR 28(E) dated 13.01.2026 has notified Central Motor Vehicles
(Second Amendment) Rules, 2026.
i. Under rule 2, the following definition of “unpaid user fee” has been inserted:
“‘(ze) "unpaid user fee" means the user fee payable by a motor vehicle for use of a
section of a National Highway, where the Electronic Toll Collection Infrastructure has
recorded the passage of such vehicle but has not received the applicable user fee levied
under the provisions of section 7 of the National Highways Act, 1956 (48 of 1956) and
rules made thereunder.’.”ii. Under Form 28 (application and grant of no objection certificate) an additional requirement is
inserted for providing particulars of unpaid user fee. Therefore, any details of unpaid user fee is
to be provided to the Registering Authority while seeking NOC.
iii. Under rule 55 (transfer of ownership) a requirement has been inserted to provide a No
Objection Certificate (under Form 28) in the list of documents required to be accompanied with
the application for transfer of ownership of a motor vehicle.
iv. Under rule 58 (no objection certificate), a condition has been inserted whereby it is provided
that the registering authority shall not grant the no-objection certificate until unpaid user fee is
paid by the applicant.
v. Rule 62 (validity of certificate of fitness) has been amended to provide that certificate of
fitness shall not be renewed or generated until unpaid user fee is paid by the applicant.
vi. Under rule 90 (additional conditions for national permit) has been amended to provide that
national permit shall be issued subject to payment of unpaid user fee.
e. The measures introduced through the Central Motor Vehicles (Second Amendment) Rules,
2026 are expected to enhance compliance in payment of user fee on National Highways,
strengthen digital enforcement through integration of tolling and vehicle registration databases,
reduce toll evasion and improve operational efficiency of Electronic Toll Collection systems.
The initiative is also expected to support the progressive adoption of advanced tolling
technologies including Multi-Lane Free Flow (MLFF) tolling on National Highways.
