COMPENSATION AND PROTECTION OF WORKERS FROM
WORKPLACE ACCIDENTS
†70. SHRI RAJKUMAR ROAT:
Will the Minister of LABOUR AND EMPLOYMENT be pleased to
state:
(a)the details of the accidental deaths of workers reported while
engaged in their jobs in the country during the last five years and
the current year, year and State/UT-wise;
(b)the details of actual quantum of compensation disbursed in such
cases by the respective employers, insurance schemes and State
Welfare Boards;
(c)the details of the total number of worker fatalities recorded during
the said period in the Udaipur, Dungarpur, Banswara, and
Pratapgarh districts of Rajasthan, along with the compensation
disbursed to their dependents as per the rules;
(d)whether the Government is aware that many dependents are
deprived of compensation due to destroying evidence by
employers/contractors making unfulfilled verbal announcements or
owing to administrative delays;
(e)if so, the number of such complaints received, First Information
Reports (FIRs) registered and the details of the action taken
thereon district and State/UT-wise; and
(f)whether the Government proposes to introduce any new legislation
or the amendments in the existing laws in order to make time-
bound and compulsory compensation mandatory, prescribe
stringent penalties for tampering with evidence, enforce
mandatory registration/insurance in high-risk zones and establish
fast-track settlement mechanisms and if so, the timeline thereof?
ANSWER

(a) to (f): The Central Government has enacted the Occupational
Safety, Health and Working Conditions (OSH&WC) Code, 2020, which

has come into force with effect from 21.11.2025 to regulate
occupational safety, health and working conditions of the persons
employed in an establishment and for matters connected therewith
or incidental thereto.
Directorate General Occupational Safety and Health (DGOSH), an
attached office of Ministry of Labour and Employment collects the
data of accidental deaths and injuries of workers from Chief
Inspector of Factories (CIF) / Directorate General of Industrial Safety
& Health (DISH) of the States / Union Territories (UTs) in case of
factories registered under Factories Act, 1948 [now subsumed under
OSH & WC Code 2020]. The details of accidental deaths, state-wise,
including in Rajasthan during calendar year 2020 to 2024 is annexed.
Further, the Government has also enacted Code on Social
Security (CoSS) 2020 which has come into effect from 21.11.2025. As
per CoSS 2020 the compensation related issues are dealt at State /
Union Territories level.
