Implementation of DoPT Reservation Rules for SC/ST/OBC
3558. SHRI MANOJ KUMAR:
Will the Minister of YOUTH AFFAIRS AND SPORTS be pleased to state:
(a) whether the Department of Personnel and Training (DoPT)
Office Memorandum (OM) No. 41034/4/2022-Estt.(Res-I) dated 21st
November 2022 provides for compliance with reservation rules for
SCs, STs, and OBCs in temporary positions lasting 45 days or longer;
(b) if so, whether the said provisions are applicable to the selection
of National Youth Volunteers (NYVs) serving for extended periods of
one to two years under Nehru Yuva Kendra Sangthan (NYKS) and if
so, the details thereof and if not, the reasons therefor, State, district
and category-wise;
(c) the details of SC, ST and OBC volunteers selected as NYVs
during the last three selection cycles;
(d) whether any Member of Parliament have any roles in the said
programmes runs under Mera Yuva Bharat erstwhile Nehru Yuva
Kendra (NYK) and if so, the details thereof; and
(e) the administrative mechanisms or monitoring frameworks in
place to ensure District Selection Committees headed by District
Magistrates comply with the said statutory reservation directives?
ANSWER

(a) Yes Sir, as per the DoPT instructions dated 24.09.1968,
reiterated vide OM dated 15.05.2018 and 21.11.2022, in respect of
Page 1 of 2appointments to Central Government posts and services, there shall
be reservation for Scheduled Caste, Scheduled Tribe and Other
Backward Classes candidates in temporary appointments which are
to last for 45 days or more.
(b) The provisions of the instructions of the DoPT as referred to in
part (a) above, are applicable to appointments to temporary posts
under the Government. The MY Bharat Volunteers are not appointed
against any post in Government and therefore not paid any salary.
Hence, the reservation policy is not applicable to the MY Bharat
Youth Volunteers under the National Youth Corps Scheme (NYC) as
the NYC Scheme envisages engagement of youths on a voluntary
basis for one year (extendable for one more year) and are paid
honorarium for their volunteering services. However, endeavour is
made to include youth from all sections of the society.
(c) The details of SC, ST and OBC volunteers selected as MY Bharat
Youth Volunteers during the last 3 years are as follows:

(d) The implementation of the National Youth Corps Scheme,
including the selection and engagement of MY Bharat Youth
Volunteers, is carried out through MY Bharat and its field-level
institutional mechanism. The Members of Parliament do not have any
role in the day-to-day implementation and administration of the
Scheme. However, the Members of Parliament may participate in and
support youth-related programmes and activities organised under MY
Bharat.
(e) Does not arise in view of the reply at Part (b) above.
