3981. SHRI CAPTAIN BRIJESH CHOWTA:
Will the Minister of CORPORATE AFFAIRS be pleased to state:
(a) the total funds allocated by companies for CSR activities in Karnataka during the last five years, sector-wise and district-wise, especially in Dakshina Kannada district;
(b) whether the Government has taken any steps to ensure equitable distribution of CSR funds across districts and if so, the details thereof;
(c) the amount of unspent CSR funds of companies operating in Dakshina Kannada district;
(d) whether the Government has ensured that CSR spending is in line with the local developmental needs of Dakshina Kannada district, if so, the details thereof and if not, the reasons therefor;
(e) the number of CSR run projects in Dakshina Kannada which are related to climate change mitigation and coastal infrastructure resilience; and
(f) the number of companies that failed to meet their CSR obligations in Dakshina Kannada and the subsequent penalties imposed? ANSWER MINISTER OF STATE IN THE MINISTRY OF CORPORATE AFFAIRS AND MINISTER OF STATE IN THE MINISTRY OF ROAD TRANSPORT AND HIGHWAYS [SHRI HARSH MALHOTRA]
(a): The CSR framework is disclosure based and companies are required to file details of CSR activities annually in the MCA21 registry. All data related to CSR filed by companies in MCA21 registry is available in public domain and can be accessed at www.csr.gov.in. On the basis of annual filings made by companies in the MCA21 registry, CSR expenditure of Development Sector-wise of Karnataka, District-wise including Dakshina Kannada district and Development Sector-wise in Dakshina Kannada district for the last five Financial Years from FY 2019-20 to FY 2023- 24 are attached at Annexure-I, Annexure-II and Annexure-III respectively.

(b) to (d) : CSR is a Board driven process and the Board of the company is empowered to plan, decide, execute and monitor CSR activities of the company based on the recommendation of its CSR Committee. The Board has to ensure that the approved amount has been spent on the assigned activity(ies). In case any amount remains unspent then such amount shall be transferred in the designated fund(s) in Schedule VII in the prescribed time limit. Under CSR framework, companies need to balance local area preferences with national priorities. The Government does not issue any directions to the companies to spend in a particular area or activity.
(e): Project-wise CSR expenditure is not specifically maintained by the Ministry.
(f): Penal action is initiated as per provisions of the Act, following due process of law after examination of records and /or receipt of complaint against the companies and officers-in-default. During the period of last 5 years, one company Mukka Proteins Limited registered in Dakshina Kannada district failed to meet CSR obligation and Rs.2,57,000/- (Two Lakh Fifty Seven Thousand Rupees only) was imposed as penalty, in 2023.
