Parliament Question: Reducing no construction/repair zone ground monuments

GOVERNMENT OF INDIA MINISTRY OF CULTURE RAJYA SABHA UNSTARRED QUESTION NO.1441 ANSWERED ON 12.02.2026 REDUCING NO CONSTRUCTION/REPAIR ZONE GROUND MONUMENTS 1441# SHRI DEEPAK PRAKASH: Will the Minister of CULTURE be pleased to state? (a) whether Government is aware of pitiable conditions of families living in clustered houses near the 100 meters vicinity of monuments, burial grounds and tombs who are unable to repair or construct houses under the AMASR Act; (b) whether it has been recommended to reduce this no construction/repair zone of 100- meters; (c) if so, the reason for not doing so; and (d) whether Government would filter the essential monuments so that existing insignificant structures are freed from 100-meters ban and if not, the reasons therefor? ANSWER THE MINISTER OF CULTURE AND TOURISM (SHRI GAJENDRA SINGH SHEKHAWAT) (a) There are certain regulations to repair or renovate a building or house located in the prohibited area as per the provisions of Ancient Monuments and Archaeological sites and remains Act, 1958 (AMASR Act,1958). However, any person desires to carry out any repair or renovation of a building or structure situated in prohibited area can carry out such repair or renovation after obtaining prior permission from Competent Authority. (b)& No recommendation for reducing the 100-metre prohibited area for construction or repair (c) is under consideration at present. As such the question of reasons for not doing so does not arise. (d) At present; there is no such proposal to filter or categorize monuments of national importance for relaxing the 100-metre prohibited area restrictions. As per the existing provisions of the AMASR Act, 1958, all protected monuments are accorded equal legal status and protection under the Act. Accordingly, the prescribed restrictions are uniformly applicable to all protected monuments to ensure their effective preservation and protection. *****
