Technical glitches in MCA21 V3 Portal
1966 Dr. Ashok Kumar Mittal:
Will the Minister of Corporate Affairs be pleased to state:
(a) whether the MCA21 V3 portal continues to face outages, technical glitches and filing
failures causing significant burden on companies, if so, the details thereof;
(b) whether lack of timely scrutiny has weakened detection of shell companies and financial
misconduct, if so, the details thereof and if not, the reasons therefor;
(c) whether inadequate enforcement has led to rising auditor negligence and undisclosed
beneficial ownership, if so, the details thereof and if not, the reasons therefor; and
(d) whether Government will undertake a complete review of systemic failures that
undermine corporate transparency, if so, the details thereof and if not, the reasons therefor?

(a) Version-3 of MCA21 (MCA21 V3) has been launched to promote Ease of Doing Business,
strengthen compliance and enhance transparency. Through MCA21 V3, functionalities like
Web filings, LLP Module, Company module, e-Enforcement, e-Adjudication, e-
Consultation, e-Book Learning Management System have already been implemented. All
filings are now being made through V3. During the last three years the number of forms
which have been filed on the MCA21 V3 portal are as under:

(b) There is no definition of Shell Company under the Companies Act, 2013. However, the
Ministry initiates special drives from time to time to strike off the companies which fall under
the provisions of Section 248(1) of the Companies Act, 2013. Any complaint or reference of
financial misconduct is addressed by taking suitable enforcement action as provided under
the Companies Act 2013.
Page 1 of 2(c) No, Sir. The existing provisions of the Companies Act regarding duties of the Auditors,
Auditing Standards, disclosure of Significant Beneficial Ownership are aimed at enhancing
corporate governance & transparency. Appropriate enforcement action is taken by the
Ministry on the basis of complaints received from the stakeholders, other enforcement
authorities and organisations.
(d) No sir. There is no such systemic failure which undermines corporate transparency.
