Shri Harish Chandra Meena: Will the Minister of RURAL DEVELOPMENT be pleased to state: (a) whether Section 25 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, is applicable for passing an award under Section 24(1)(a) of the said Act, if so, the details thereof; (b) whether the declaration made under Section 6(1) of the Land Acquisition Act, 1894 prior to 01.01.2014 (i.e., before the enactment of the Act 2013) but published in the Gazette of the State Government after 01.01.2014 is likely to be considered declared under Section 19 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013; and (c) if so, the details thereof and if not, the reasons therefor? ANSWER MINISTER OF STATE IN THE MINISTRY OF RURAL DEVELOPMENT (DR. CHANDRA SEKHAR PEMMASANI) (a) Section 24(1)(a) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (RFCTLARR Act, 2013) provides that where no award has been made under Section 11 of the Land Acquisition Act, 1894 (LA Act, 1894), the provisions of the RFCTLARR Act, 2013 relating to the determination of compensation shall apply. However, Section 25 of the RFCTLARR Act 2013 provides for the time period for making an award from the date of publication of declaration under Section 19 of the RFCTLARR Act 2013.The applicability of Section 25 of the RFCTLARR Act, 2013 to cases covered under Section 24(1)(a) of the RFCTLARR Act, 2013 is not expressly mentioned in the provisions referred to above. (b) & (c) The applicability of the RFCTLARR Act 2013 to any land acquisition initiated under LA Act 1894 depends on whether an award has been made under Section 11 of the LA Act 1894 or not. The RFCTLARR Act 2013 does not contain any provision to consider a declaration made under Section 6(1) of the LA Act 1894 as declared under Section 19 of RFCTLARR Act 2013. ****
