L.-33004/99 xxxGIDHxxx सी.जी.-डी.एलxx.x-GअID.-E2x3xx0 72025-264900 CG-DL-E-23072025-264900 असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 440] नई किल्ली, सोमवार, िलु ाई 21, 2025/आिाढ़ 30, 1947 No. 440] NEW DELHI, MONDAY, JULY 21, 2025/ASHADHA 30, 1947 कृजि एव ं ककसान कल्य ाण मत्रं ालय (कृजि एव ं ककसान कल्य ाण जवभाग) अजधसचू ना नई किल् ली, 4 िुलाई, 2025 सा.का.जन. 483(अ).—केन्द्रीय सरकार के पूवव अनुमोिन से पौधा ककस्ट्म और कृिक अजधकार संरक्षण प्राजधकरण, पौधा ककस्ट्म और कृिक अजधकार सरं क्षण अजधजनयम, 2001 (2001 का 53) की धारा 95 की उपधारा (1) द्वारा प्रित्त िजियों का प्रयोग करत े हुए, पौधा ककस्ट्म और कृिक अजधकार सरं क्षण जवजनयम, 2006 को और संिोजधत करने के जलए जनम्नजलजखत जवजनयम बनाता ह,ै अर्ावत:् - 1. संजक्षप्त नाम और प्रारंभ.- (1) इन जवजनयमों का संजक्षप् त नाम पौधा ककस्ट्म और कृिक अजधकार संरक्षण (संिोधन) जवजनयम, 2025 ह।ै (2) य ेरािपत्र में इनके प्रकािन की तारीख को प्रवृत् त होंगे1 2. पौधा ककस्ट्म और कृिक अजधकार संरक्षण जवजनयम, 2006 (जिसे इसमे उि जवजनयम के रूप म ें जनर्िवष्ट ककया गया ह)ै , में जवजनयम 4 के स्ट्र्ान पर जनम्नजलजखत जवजनयम रखा िाएगा, अर्ावत:् - “4. अजधकाररता.- (1) रजिस्ट्रार की अजधकाररता वह होगी िो प्राजधकरण द्वारा समय-समय पर जनधावररत की िाए और जिसकी सहायता संयुि रजिस्ट्रार, उप रजिस्ट्रार, उप जनिेिक (प्रिासन), लेखाकार और अन्द्य तकनीकी, जवजधक सलाहकार, जवत्तीय और प्रिासजनक कमवचाररयों द्वारा की िाएगी।” 3. उि जवजनयम में, जवजनयम 5 के स्ट्र्ान पर जनम्नजलजखत जवजनयम रखा िाएगा।- “5. रजिस्ट्रारों की पिावजध और सेवा की ित ें ।- (1) रजिस्ट्रार, संयुि रजिस्ट्रार और उप रजिस्ट्रारों की पिावजध, अहतव ाएं, अनुभव और सेवा ित ें इन जवजनयमों स े उपाबद्ध अनुसूची में जवजनर्िष्टव उपबंधों के अनुरूप होंगी। 4881 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 5 क. प्रारंजभक गठन- (1) इन जवजनयमों के प्रारंभ होने से ठीक पूवव अनुसूची के स्ट्तंभ (1) म ें जवजनर्िवष्ट पिों को जनयजमत आधार पर धारण करन े वाल े कार्मवकों को इन जवजनयमों के उपबधं ों के अधीन जनयिु ककया गया समझा िाएगा। (2) इन जवजनयमों के प्रारंभ होने से ठीक पूवव संबंजधत श्रणे ी म ें उप-जवजनयम (1) में जवजनर्िवष्ट कार्मवकों की जनयजमत जनरंतर सेवा की, सेवा में पररवीक्षा अवजध और प्रोन्नजत, पुजष्ट और पेंिन के जलए अहकव सेवा और पेंिन के जलए गणना की िाएगी । ” 4. उि जवजनयम में, प्रारूप 1 क के पश्चात, जनम्नजलजखत अनुसूची अंत:स्ट्र्ाजपत की िाएगी, अर्ावत्:- “अनुसूची पि का पिों की वगीकरण वेतन मैररक्स चयन पि ह ैया सीधी भती ककए िाने वाल े नाम संख्या में स्ट्तर अचयन पि व्यजियों के जलए आयु सीमा (1) (2) (3) (4) (5) (6) रजिस्ट्रार 03 समूह ‘क’ स्ट्तर -13 लाग ूनहीं होता । पचास विव से अनजधक (2025) अरािपजत्रत (123100- 215900 रुपये) सीधी भती ककए िान े वाले व्यजियों सीधी भती के जलए पररवीक्षा की भती की पद्धजत; भती सीधे के जलए अपेजक्षत िैजक्षक और अन्द्य जवजहत आय ु और अवजध, यकि होगी या प्रोन्द् नजत द्वारा या अहतव ाएं । िैजक्षक अहतव ाए ं कोई हो। प्रजतजनयुजि या स्ट्र्ानान्द्तरण प्रोन्नत व्यजियों या या आमले न द्वारा तर्ा जवजभन्न प्रजतजनयुजि की ििा पद्धजतयों द्वारा भरे िाने वाली में लागू होंगी। ररजियों की प्रजतितता । (7) (8) (9) (10) आवश्यक: स्ट्तंभ (11) के एक विव प्रोन्नजत न होन े पर प्रजतजनयुजि (i) आनुवंजिकी और पािप प्रिनन या अनुसार (अल्पकाजलक अनुबंध सजहत) आनुवंजिकी या कृजि वनस्ट्पजत जवज्ञान द्वारा। या बीि जवज्ञान और प्रौद्योजगकी या बीि प्रौद्योजगकी या पािप आनुवंजिकी संसाधन म ें जविेिज्ञता के सार् कृजि में मास्ट्टर जडग्री या पािप प्रिनन और आनुवंजिकी में जविेिज्ञता के सार् वाजनकी या बागवानी या पािप िैव प्रौद्योजगकी या पािप आणजवक िीव जवज्ञान और िैव प्रौद्योजगकी में मास्ट्टर जडग्री। (ii) कृजि जवज्ञान या बीि जवकास के कियाकलापों म ें पंरह विव का अनुभव, जिसमें से कम से कम 3 वि व का अनुभव ककस्ट्म सुधार या बौजद्धक संपिा अजधकार के क्षेत्र म ें आवश्यक ह।ै[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 वांछनीय: बीि जवकास कायविम या बौजद्धक संपिा अजधकार और पौध ककस्ट्म सुधार के कियाकलापों या वृक्ष सुधार में तीन विव के अनुसंधान अनभु व के सार् डॉक्टरेट की जडग्री। प्रोन्नजत या प्रजतजनयुजि या आमेलन द्वारा भती यकि जवभागीय प्रोन्नजत सजमजत या भती करने की ककन की ििा म,ें वे श्रणे ी जिनसे प्रोन्नजत या चयन सजमजत जवद्यमान ह,ै तो उसकी पररजस्ट्र्जतयों में संघ प्रजतजनयुजि या आमले न ककया िाएगा। संरचना लोक सेवा आयोग से परामिव ककया िाएगा (11) (12) (13) प्रोन्नजत: जवभागीय प्रोन्नजत सजमजत (प्रोन्नजत लाग ूनहीं होता । (i) संयुि रजिस्ट्रार जिसन े वेतन स्ट्तर-12 म ें पर जवचार करन े के जलए) म ें पांच विव की जनयजमत सेवा की हो; या जनम्नजलजखत िाजमल होंगे:- (ii) जिसने वेतन मैररक्स में वेतन स्ट्तर-12 म ें (1) महारजिस्ट्रार, पीपीवीएफआरए संयुि रजिस्ट्रार और वेतन स्ट्तर-11 में उप - अध्यक्ष; रजिस्ट्रार की श्रेणी म ें िस वि व की संयुि सेवा की (2) पीपीवीएफआरए के अध्यक्ष द्वारा हो, जिसम ें से संयिु रजिस्ट्रार की श्रणे ी म ें नाजमत ककया िान े वाला ऐसा न्द्यूनतम तीन वि व की जनयजमत सेवा की हो। अजधकारी िो भारत सरकार के प्रजतजनयुजि: संयुि सजचव के पि से नीचे के पि न हो - सिस्ट्य; (क) (i) िो मूल संवगव या जवभाग में जनयजमत आधार पर सििृ पि धारण ककए हुए हों; या (3) पीपीवीएफआरए के अध्यक्ष द्वारा नाजमत ककय े िान े वाल े ऐसे िो (ii) जिसने मूल संवगव या जवभाग में वेतन जविेिज्ञ, िो वेतन स्ट्तर-14 म ें संयुि मैररक्स में वेतन स्ट्तर-12 (78800-209200 सजचव के पि से नीचे पि पर न हो रुपये) या समतुल्य म ें जनयजमत आधार पर - सिस्ट्य जनयुजि के बाि उस श्रणे ी में पांच विव की जनयजमत सेवा की हो; या सजचव के पि से नीचे के पि न हो (ii) जिसने वेतन मैररक्स के वेतन स्ट्तर-11 (67700- - सिस्ट्य; 208700 रुपये) या समकक्ष में जनयजमत आधार पर जनयुजि (3) पीपीवीएफआरए के अध्यक्ष द्वारा के बाि सुसंगत क्षेत्र म ें प्रिान की गई श्रेणी में पांच वि व की नाजमत ककये िाने वाले ऐसे िो सेवा की हो; या जविेिज्ञ, िो वते न स्ट्तर-14 में संयुि (iii) सुसंगत वेतन मैररक्स के वेतन स्ट्तर-10 (56100- सजचव के पि से नीच े पि पर न हो 177500 रुपय)े म ें जनयजमत आधार पर जनयुजि के बाि - सिस्ट्य सुसंगत क्षेत्र म ें प्रिान की गई श्रेणी म ें िस वि व की सेवा की हो; पर सििृ पि धारण ककए हुए हों; या (3) अध्यक्ष, पीपीवीएफआरए द्वारा नाजमत (ii) जिसन े वेतन मैररक्स के वेतन स्ट्तर-10 (56100- ककये िाने वाला ऐसे िो जवििे ज्ञ, िो वते न 177500 रुपये) में जनयजमत आधार पर जनयुजि के स्ट्तर-14 म ें संयुि सजचव के पि से नीचे न हो पश्चात सुसंगत क्षेत्र में श्रणे ी म ें पांच विव की सेवा की - सिस्ट्य। हो; Short title and commencement.- (1) These regulations may be called the Protection of Plant Varieties and Farmers’ Rights (Amendment) Regulations, 2025. (2) They shall come into force on the date of their publication in the Official Gazette.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 2. In the Protection of Plant Varieties and Farmers’ Rights Regulations, 2006 (herein referred as said regulation), for regulation 4, the following regulation shall be substituted, namely:- “4. Jurisdiction.- (1) The jurisdiction of the Registrar shall be such as may be determined by the Authority from time to time and shall be assisted by the Joint Registrar, Deputy Registrar, Deputy Director (Administration), Accountant and other technical, legal advisor, financial and administrative staff.”. 3. In the said regulation, for regulation 5, the following regulations shall be substituted.- “5. The term of office and the conditions of service of the Registrars.- (1) The term of office, qualifications, experience and conditions of service of the Registrars, Joint Registrars and Deputy Registrars shall be as per provisions specified in the Schedule annexed to these regulations. 5A. Initial constitution.- (1) Personnel holding the posts specified in column (1) of the Schedule, immediately before the commencement of these regulations on a regular basis, shall be deemed to have been appointed under the provisions of these regulations. (2) The regular continuous service of personnel referred to in sub-regulation (1) in the respective grade immediately before the commencement of these regulations, shall count for the probation period and qualifying service for promotion, confirmation, and pension in the service.”. 4.
