द्वारा प्रित्त िजियों का प्रयोग करते हुए बनाने का जवचार ह,ै को उि धारा की अपेक्षानुसार ऐसे सभी व्यजियों
की िानकारी के जलए जिनके इस अजधसूचना से प्रभाजवत होने की सभं ावना ह,ै एतद्दवारा सूजचत ककया िाता ह ै
कक उि प्रारूप जनयमों पर उस तारीख स े जिस तारीख को भारत के रािपत्र की प्रजतयााँ जिसमें यह अजधसचू ना

सलाहकार, भारत सरकार, जवपणन एवं जनरीक्षण जनिेिालय, प्रधान कायािलय, सी.िी.ओ. काम्पलैक्स,
एन.एच.-IV, फरीिाबाि (हररयाणा)-121001 को अग्रेजित ककए िा सकते ह।ैं
प्रारूप जनयम
1.सजं क्षप्त नाम, लागू होना और प्रारंभ- (1) इन जनयमों का नाम पोहा श्रेणीकरण और जचहनाकं न जनयम, 2022
ह ै ।
(2) य े जनयम धान (ओरयज़ा सैरिवा एल.) से तैयार ककए गए पोहा पर लाग ू होंगे। इसे जचड़वा के नाम से भी
िाना िाता ह।ै
(3) य े सरकारी रािपत्र में उनके अंजतम प्रकािन की तारीख को प्रवृत्त होंगे।
2. पररभािाए ं :- (1) इन जनयमों में िब तक संिभ ि में अन्द्यथा अपेजक्षत न हो-
(क) ‘‘कृजि जवपणन सलाहकार’’ से भारत सरकार का कृजि जवपणन सलाहकार अजभप्रेत ह;ै
(ख) ‘‘प्राजधकृत पैकर’’ स े ऐसा व् यजि या व् यजियों का जनकाय अजभप्रेत ह ै जिसे इन जनयमों एवं साधारण
श्रेणीकरण और जचहनांकन जनयम, 1988 के अधीन जवजहत श्रेणी मानकों और प्रकक्रया के अनुसार पोहा का
श्रेणीकरण करने और उस े जचहनांककत करने के जलए प्राजधकार प्रमाण-पत्र अनुित् त ककया गया हो;
(ग) ‘‘प्राजधकार प्रमाण पत्र’’ स े साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 के उपबंधों के अधीन िारी
प्रमाण पत्र अजभप्रेत ह,ै िो ककसी व्यजि या व्यजियों के जनकाय को श्रेणी अजभधान जचहन द्वारा पोहा के
श्रेणीकरण और जचहनांकन का प्राजधकार िेता ह;ै
(घ) “साधारण श्रेणीकरण और जचहनांकन जनयम” स े कृजि उपि (श्रेणीकरण और जचहनांकन) अजधजनयम 1937
(1937 का 1) की धारा 3 के अधीन बनाए गए साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 अजभप्रेत ह;ै
(ङ) “श्रेणी अजभधान जचहन’’ से जनयम 3 म ें जनर्ििष्ट “एगमाकि प्रतीक जचहन” अजभप्रेत ह;ै
(च) “जवजधक माप जवज्ञान (पैकेि में रखी वस्ट्तुएं) जनयम” स े जवजधक माप जवज्ञान अजधजनयम, 2009 (2010 का
1) के अंतगति बनाए गए जवजधक माप जवज्ञान (पैकेि में रखी वस्ट्तुएं) संिोधन जनयम, 2022 अजभप्रेत ह ै एवं ;
(छ) “अनुसूची” से इन जनयमों के साथ संलग्न अनुसूची अजभप्रेत ह।ै
(2) इन जनयमों में प्रयुक् त िब् ि और पि, िो पररभाजित नहीं ह ैं लेककन जिन्द्ह ें कृजि उपि (श्रेणीकरण और
जचहनाकं न) अजधजनयम, 1937 (1937 का 1) या साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 म ें
पररभाजित ककया गया ह,ै के वही अथि होंग े िो उक्त अजधजनयम या जनयम में ह;ैं
3. श्रेणी अजभधान जचहन :- श्रेणी अजभधान जचहन म ें “एगमाकि प्रतीक जचहन” का जडज़ाइन होगा िो
अनुसूची-। में जनधािररत जडिाइन के सिश्ृ य होगा जिसमें प्राजधकार प्रमाण-पत्र संखयांक, िब्ि ‘एगमाकि’,
वस्ट्तु का नाम और श्रेणी िाजमल होंगे।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3
4. श्रेणी अजभधान :- पोहा की गुणवत्ता उपिर्िित करने के जलए श्रेणी अजभधान वह होगा िैसा कक अनसु ूची-II के
श्रेणी अजभधान हते ु मापिंड में वर्णित ककया गया ह।ै
5. गुणवत्ता:- इन जनयमों के प्रयोिन के जलए पोहा की गुणवत्ता अनुसूची-II में जनर्ििष्ट के अनुसार होगी।
6. पैककंग करने की जवजध : -(1) पोहा को खाद्य सुरक्षा और मानक (पैकेजिंग) जवजनयम, 2018, खाद्य सरु क्षा और
मानक (लेबजलंग और प्रिििन) जवजनयम, 2020 और जवजधक माप जवज्ञान (पैकेि म ें रखी वस्ट्तुएं) संिोधन जनयम,
2022 के प्रावधानों के अनुसार उजचत पैकेजिंग सामग्री में पैक ककया िाएगा।
(2) समान लॉि या बैच और ग्रेड के छोिे पैक आकारों की श्रेणीकृत सामग्री की पैककंग एक मास्ट्िर कंिेनर में की
िाएगी और उस पर श्रेणी अजभधान जचहन सजहत पूरा ब्यौरा अंककत ककया िाएगा;
(3) प्रत् येक पैकेि म ें समान प्रकार का और समान श्रेणी अजभधान का पोहा होगा;
(4) प्रत् येक पैकेि उजचत और सुरजक्षत रूप स े बंि और मुहरबंि ककया िाएगा, ताकक उसकी सामग्री बाहर न फैल
सके;
7. जचहनाकं न की जवजध : - (1) श्रेणी अजभधान जचहन प्रत् येक पैकेि पर कृजि जवपणन सलाहकार या उनके द्वारा
अजधकृत ककसी अजधकारी द्वारा साधारण श्रेणीकरण और जचहनाकं न जनयम, 1988 के जनयम 11 के अनुसार
अनुमोकित रीजत स े सुरजक्षत रूप से जचपकाया या मुकरत ककया िाएगा;
(2) श्रेणी अजभधान जचहन के अजतररक् त, प्रत्येक पैकेि पर जनम्न जलजखत जववरण स्ट्पष्ट रूप से और अजमि रूप स े
अंककत ककया िाएगा:-
(क) वस्ट्तु का नाम;
(ख) श्रेणी;
(ग) ककस्ट्म या रेड का नाम (वैकजल्पक);
(घ) लॉि/बैच संखया;
(ड़) पैककंग की तारीख;
(च) फसल विि (वैकजल्पक)
(छ) िुद्ध भार;
(ि) प्राजधकृत पैकर का नाम और पता;
(झ) अजधकतम खुिरा मूल्य; (सभी कर सजहत)
(ञ) ....माह....विि के पूव ि उपयोग हते ु सवोत्तम;
(ि) जवजधक माप जवज्ञान (पैकेि में रखी वस्ट्तुएं) संिोधन जनयम, 2022 या खाद्य सुरक्षा और मानक (पैकेजिंग)

तत्समय लाग ू ककसी अन्द्य कानून के तहत िारी अजधसचू ना अथवा इस अजधजनयम के प्रावधानों के तहत िारी
ककन्द्हीं अनुिेिों के तहत जनर्ििष्ट कोई अन्द्य जववरण, बिते कक पैकेिों पर अंकन के जलए सही गुणवत्ता की स्ट्याही
का उपयोग ककया िाएगा।
(3) प्राजधकृत पैकर कृजि जवपणन सलाहकार अथवा उनके द्वारा अजधकृत ककसी अजधकारी का पूव ि अनुमोिन प्राप्त
करने के पश् चात साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 के जनयम 11 के अंतगित श्रेणीकृत पैकेिों पर
अपना प्राइवेि व् यापार जचहन या व् यापार ब्ांड जचहनांककत कर सकता ह,ै परंत ु वह इन जनयमों के अनुसार
श्रेणीकृत पैकेिों पर लगाए गए श्रेणी अजभधान जचहन द्वारा उपिर्िित गुणवत्ता स े जभन्द् न गुणवत्ता उपिर्िित नहीं
करेगा।
8. प्राजधकार प्रमाण पत्र की जविेि ितें:- (1) साधारण श्रेणीकरण और जचहनाकं न जनयम, 1988 के जनयम 3 के
उप-जनयम (8) में जवजनर्ििष्ट ितों के अजतररि प्रत्येक प्राजधकृत पैकर इस जनयम में जनर्ििष्ट सभी ितों का पालन
करेगा।
(2) पोहा की गुणवत्ता का परीक्षण करने के जलए प्राजधकृत पैकर साधारण श्रेणीकरण और जचहनाकं न जनयम,
1988 के जनयम 8 के तहत िारी मापिंडों के अनुसार या तो अपनी स्ट्वयं की प्रयोगिाला स्ट्थाजपत करेगा या
ककसी अनुमोकित राज्य श्रेणीकरण प्रयोगिाला या सहकारी अथवा एसोजसएिन प्रयोगिाला या ऐसी प्राइवेि
वाजणजज्यक प्रयोगिाला के साथ संपकि करेगा जिसका प्रबंधन साधारण श्रेणीकरण और जचहनाकं न जनयम, 1988
के जनयम 9 के अंतगित कृजि जवपणन सलाहकार या उनके द्वारा अजधकृत ककसी अजधकारी द्वारा अनुमोकित योग्य
रसायनज्ञ द्वारा ककया िा रहा हो।
(3) प्राजधकृत पैकर के पररसर को समुजचत संवातन और प्रकाि सजहत स्ट्वास्ट््यप्रि और स्ट्वच्छता की ििा में रखा
िाएगा। इन कायों म ें लग े हुए कार्मिकों का अच्छा स्ट्वास्ट््य होगा और वे ककसी संचारी, संसगी या संक्रामक रोग
से मुि होंगे।
(4) प्राजधकृत पैकर के पररसर में पक् के फिि सजहत पयािप्त भंडारण सुजवधाएं होंगी और वह नमी, ककसी तरह की
िरारों, कृंतकों और कीिों से मुक् त होगा।
(5) प्राजधकृत पैकर और अनमु ोकित रसायनज्ञ परीक्षण, श्रेणीकरण, पैककंग, जचहनांकन, सीजलंग और अजभलेखों के
अनुरक्षण से संबंजधत ऐसे सभी अनुिेिों का पालन करेंगे िो समय-समय पर साधारण श्रेणीकरण और जचहनांकन
जनयम, 1988 के अंतगित कृजि जवपणन सलाहकार या इस जनजमत्त उनके द्वारा अजधकृत ककसी अजधकारी द्वारा

पोहा का श्रेणी अजभधान और उसकी गुणवत्तााः
1. धान (ओरयज़ा सैरिवा एल.) को हल्का उबालकर या गमि पानी में जभगोने के बाि सुखाकर, भूनकर, रोलरों
से चपिा करके फ्लके बनाकर, भूसी जनकालकर तथा छलनी से सभी बारीक पाउडर को हिा कर पोहा
तैयार ककया िाता ह।ै
2. न्द् यूनतम अपेक्षाएं :
(i) पोहा म ें जनम्नजलजखत जविेिताएं होंगी –
(क) रूजचकर स्ट्वाि, गंध तथा उस ककस्ट्म के एकसमान रंग की जविेिता होगी जिससे उसे प्राि
ककया गया ह;ै
(ख) िाग रजहत होगा तथा उत्तम धान स े तैयार ककया िाएगा;
(ग) बाहरी पिाथों िसै े कक पत्थर, धूल, जमट्टी, धान, धान की भसू ी, कृंतक अविेि और अवजिष्ट,
गंिगी, भुकड़ी, फंफूि, िीजवत या मृत कीि, कीि अिं आकि से मुि होगा;
(घ) ककसी जविातीय स्ट्वाि, गंध, अप्रीजतकर गंध, खमीरीकरण से मुि होगा ;
(ङ) कृजत्रम रंग, पॉजलि पिाथि, कृजत्रम सुवास और अन्द्य ककसी रसायन से मुि होगा ;
(ii) घरेलू व्यापार के मामले में यह धातु संििू क, कीिनािक अविेि, सूक्ष्मिीव अपेक्षाओं, फसल संििू कों,
प्राकृजतक रूप स े पाए िान े वाल े जविैले पिाथों के अवजिष्ट स्ट्तर से संबंजधत प्रजतबधं ों तथा खाद्य सरु क्षा और
मानक (संििू क, आजवि और अवजिष्ट) जवजनयम, 2011 और खाद्य सुरक्षा और मानक (खाद्य उत्पाि मानक और
खाद्य सहयोज्य) जवजनयम, 2011 म ें यथा जवजनर्ििष्ट अन्द्य खाद्य सुरक्षा अपेक्षाओं अथवा घरेल ू व्यापार के जलए
खाद्य सरु क्षा और मानक अजधजनयम, 2006 (2006 का 34) के अधीन अजधसूजचत ककसी भी अन्द्य जवजनयम का

(iii) जनयाित के मामल े में यह कोडेक्स एजलमेंिेररयस आयोग द्वारा जनधािररत भारी धातुओं और कीिनािकों की
अवजिष्ट सीमाओं तथा अन्द्य खाद्य सुरक्षा मापिंडों अथवा आयातकताि िेि की अपेक्षाओं का अनुपालन करेगा।

4. अन्द्य अपेक्षाए:ाँ
(i) पोहा की जस्ट्थजत ऐसी होगी कक वह -
(क) यातायात और हडैं जलगं की जस्ट्थजत का सामना कर सके; और
(ख) जिसे अपने गंतव्य स्ट्थान पर सतं ोििनक ढंग से पहुचं ाया िा सके ।
(ii) पोहा का भंडारण ठंडे एवं िुष्क स्ट्थान पर ककया िाएगा तथा साफ और स्ट्वास्ट््यपरक ििा में रखा
िाएगा।
(iii) पोहा को उसकी मोिाई तथा 30 जडग्री सेजल्सयस पानी में पुनगिरठत होने में लगने वाल े समय के आधार पर
जनम्नजलजखत श्रेजणयों में वगीकृत ककया िा सकता ह।ै 30 जडग्री सेजल्सयस पानी में पुनगिठन के जलए पोहा और
पानी का अनुपात 1: 4 रखा िाएगा। इस तरह पुनगिरठत पोहा जचपजचपा नहीं होगा और आकार में पृथक-पृथक
रहगे ा।

NOTIFICATION
New Delhi, the 17th November, 2022
G.S.R 825(E).—the following draft of the Poha Grading and Marking Rules, 2022 which the Central
Government proposes to make in exercise of the powers conferred by section 3 of the Agricultural Produce (Grading
and Marking) Act, 1937 (1 of 1937) is hereby published as required by the said section for information of all persons
likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after
the expiry of a period of forty-five days from the date on which the copies of the Gazette of India containing this
notification are made available to the public.
Objections or suggestions which may be received from any person with respect to the said draft rules before
the expiry of the above said period shall be taken into consideration by the Central Government.
Objections or suggestions, if any, in respect of the said draft rules may be forwarded to the Agricultural
Marketing Adviser to the Government of India, Directorate of Marketing and Inspection, Head Office, CGO Complex,
NH - IV, Faridabad (Haryana) 121001.
DRAFT RULES
1. Short title, application and commencement. - (1) These rules may be called the Poha Grading and Marking
Rules, 2022.
(2) They shall apply to Poha prepared from paddy (Oryza sativa L.). It is also known as flattened rice, rice
flakes, beaten rice or chiwda.
(3) They shall come into force on the date of their final publication in the Official Gazette.
2. Definitions. -(1) In these rules, unless the context otherwise requires-
(a) "Agricultural Marketing Adviser" means the Agricultural Marketing Adviser to the Government of
India;
(b) "authorised packer" means a person or a body of persons who has been granted a certificate of
authorization to grade and mark Poha in accordance with the grade standards and procedure provided
under these rules and the General Grading and Marking Rules, 1988;
(c) "Certificate of Authorisation" means a certificate issued under the provisions of the General Grading
and Marking Rules, 1988 authorising a person or a body of persons to grade and mark Poha with the
Grade Designation Mark;
(d) "General Grading and Marking Rules" means the General Grading and Marking Rules, 1988 made
under section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937);
(e) "Grade Designation Mark" means ‘’AGMARK Insignia’’ referred to in rule 3;
(f) “Legal Metrology (Packaged Commodities) Rules" means the Legal Metrology (Packaged
Commodities) Amendment Rules, 2022, made under the Legal Metrology Act, 2009 (1 of 2010); and
(g) "Schedule" means a Schedule appended to these rules.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(2) The words and expressions used in these rules and not defined but defined in the Agricultural Produce (Grading
and Marking) Act, 1937 or the General Grading and Marking Rules, 1988, shall have the same meaning as are
assigned to them under the said Act or the Rules.
3. Grade Designation Mark. - The Grade Designation Mark shall consist of the design of "AGMARK
Insignia" as set out in Schedule-I, incorporating the certificate of authorisation number, the word
“AGMARK", the name of commodity and its grade.
4. Grade designations. - The grade designations to indicate the quality of Poha including the criteria for grade
designation shall be as set out in Schedule-II.
5. Quality. -For the purpose of these rules, the quality of Poha shall be as provided in Schedule-II.
6. Method of packing. -(1)Poha shall be packed in suitable packaging material in accordance with the
provisions of the Food Safety and Standards (Packaging) Regulations, 2018, the Food Safety and Standards
(Labeling and Display) Regulations, 2020 and Legal Metrology (Packaged Commodities) Amendment Rules,
2022.
(2) The graded material of small pack sizes of the same lot or batch and grade may be packed in a master
container with complete details thereon along with the Grade Designation Mark.
(3) Each package shall contain Poha of the same type and of the same grade designation.
(4) Each package shall be properly and securely closed and sealed so as to disallow spilling.
7. Method of Marking.- (1) The Grade Designation Mark shall be securely affixed to or printed on each
package in the manner approved by the Agricultural Marketing Adviser or an officer authorised by him
under rule 11 of the General Grading and Marking Rules, 1988.
(2) In addition to the Grade Designation Mark, following particulars shall be clearly and indelibly marked
on each package, namely-
(a) name of the commodity;
(b) grade;
(c) variety or trade name(optional);
(d) lot/batch number;
(e) date of packing;
(f) crop year (optional);
(g) net weight;
(h) name and address of the authorised packer;
(i) maximum retail price (inclusive of all taxes);
(j) BEST BEFORE ___________MONTH ______YEAR; and
(k) any other particulars as provided under the Legal Metrology (Packaged Commodities) Amendment
Rules, 2022 or specified under the Food Safety and Standards (Packaging) Regulations, 2018 and the
Food Safety and Standards (Labeling and Display) Regulations, 2020 or any notification issued under
any other law for the time being in force or any instructions issued under the provisions of the Act,
provided that right quality of ink shall be used for marking on packages.
(3) The authorised packer may after obtaining prior approval of the Agricultural Marketing Adviser or an officer
authorised by him under rule 11 of the General Grading and Marking Rules, 1988, mark his private trade
mark or trade brand on the graded packages provided the same do not indicate quality other than that
indicated by the Grade Designation Mark affixed to the graded packages in accordance with these rules.
8. Special conditions of Certificate of Authorisation.–(1) In addition to the conditions specified in sub-rule (8)
of rule 3 of the General Grading and Marking Rules,1988, every authorised packer shall comply the
conditions specified under these rules.
(2) The authorised packer shall either set up his own laboratory as per norms issued under rule 8 of the
General Grading and Marking Rules, 1988, or have access to an approved State Grading Laboratory or
cooperative or association laboratory or a private commercial laboratory manned by a qualified chemist
approved by the Agricultural Marketing Adviser or the officer authorised by him under rule 9 of the
General Grading and Marking Rules, 1988, for testing the quality of Poha.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9
(3) The premises of the authorised packer shall be maintained in hygienic and sanitary conditions with
proper ventilations and well lighted arrangement and the personnel engaged in these operations shall be
in sound health and free from any infectious, contagious or communicable diseases.
(4) The premises of the authorised packer shall have adequate storage facilities with pucca floor and free
from dampness, any kind of cracks and crevices, rodent and insect infestation.
(5) The authorised packer and the approved chemist shall observe all instructions regarding testing,
grading, packing, marking, sealing and maintenance of records which may be issued by the Agricultural
Marketing Adviser or an officer authorised by him in this behalf in accordance with the General
Grading and Marking Rules, 1988 from time to time.

Grade designation and quality of Poha
1. Poha is produced from paddy (Oryza sativa L.) by parboiling or soaking in hot water followed by drying,
roasting, flaking/flattening with rollers, dehusking and sieving to remove all fine powder.
2. Minimum requirements:
(i). Poha shall-
(a) have pleasant taste, flavor and uniform color characteristic of the variety from which obtained;
(b) be unstained and prepared from wholesome, sound paddy grains;
(c) be free from extraneous matter such as stones ,dirt, clay, paddy, paddy husk, rodent hair and excreta,
filth, moulds, fungus, live and dead insects and insect fragments etc.;
(d) be free from any foreign taste, odour, obnoxious smell and evidence of fermentation;
(e) be free from artificial coloring, polishing agents, artificial fragrances and any other chemicals;
(ii) For domestic trade, it shall comply with the restrictions in regard to residual levels of metal contaminants,
pesticide residues, microbial requirements, crop contaminants, naturally occurring toxic substances and other
food safety requirements as specified under the Food Safety and Standards (Contaminants, Toxins and Residues)
Regulations, 2011,the Food Safety and Standards (Food Product Standards and Food Additives) Regulations,
2011 and other regulations made for domestic trade under the Food Safety and Standards Act,2006 (34 of 2006).
(iii) For export trade, it shall comply with the residual limits of heavy metals, pesticides and other food safety
requirements as laid down by the Codex Alimentarius Commission or importing countries requirement for
exports.

4. Other requirements:
(i) The condition of Poha shall be so as to enable it to-
(a) withstand transport and handling; and
(b) arrive in satisfactory condition at the place of destination.
(ii) Poha shall be stored in a cool and dry place and properly maintained in a clean and hygienic condition.
(iii) Poha may be classified to be of following categories based on the thickness of flakes and time taken to
reconstitute in water at 30°C. For reconstitution in water at 30°C, the ratio maintained shall be 1:4
Poha:water. The reconstituted Poha shall not be pasty and shall be discrete in shape.
