L.-33004/99 सी.जी.-एच.आर.-अ.-28032023-244733 xxxGIDHxxx CG-HR-E-28032023-244733 xxxGIDExxx ऄसाधारण EXTRAORDINARY भाग II—खण् ड 3—ईप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 187] नइ कदल्ली, मगं लवार, माच च28, 2023/चत्रै 7, 1945 No. 187] NEW DELHI, TUESDAY, MARCH 28, 2023/CHAITRA 7, 1945 कृजि एव ंककसान कल्याण मत्रं ालय (कृजि एव ंककसान कल्याण जवभाग) ऄजधसचू ना नइ कदल्ली, 28 माच,च 2023 सा.का.जन. 229(ऄ).—पोहा श्रेणीकरण और जचहनांकन जनयम, 2023 का प्रारूप, कृजि ईपज (श्रेणीकरण और जचहनांकन) ऄजधजनयम, 1937 (1937 का 1) की धारा 3 की ईपधारा (1) के ऄंतगचत ऄजधसूचना सं.सा.का.जन. 825(ऄ) के तहत कदनांक 18 नवम्बर, 2022 को भारत के राजपत्र, ऄसाधारण, भाग ।।, खंड 3 ईप खंड (i) म ें प्रकाजित ककया गया था जजसमें ऐसे सभी व्यजियों स े जजनके आस ऄजधसूचना स े प्रभाजवत होने की संभावना थी, ईस तारीख स े जजस तारीख को भारत के राजपत्र की प्रजतयााँ जजसमें यह ऄजधसूचना ऄतं र्ववष्ट है, जनता को ईपलब्ध कराए जाने के पैंतालीस कदनों के भीतर अपेक्ष अमंजत्रत ककेए गए थे। और, ईि ऄजधसूचना की प्रजतयां जनता को 18 नवम्बर, 2022 को ईपलब्ध करा दी गइ थीं, और, ईि प्रारूप जनयमोाँ के संबंध म ेाँजहतधारकों से प्राप्त अपजियों और सुझावों पर जवजधवत रूप से जवचार ककया गया ह;ै ऄतः ऄब, केन्द्रीय सरकार कृजि ईपज (श्रेणीकरण और जचहनाकं न) ऄजधजनयम, 1937 (1937 का 1) की धारा 3 द्वारा प्रदि िजियों का प्रयोग करते हुए जनम्नजलजखत जनयम बनाती ह,ै ऄथाचत:- 1. संजक्षप्त नाम और प्रारंभ- (1) आन जनयमों का नाम पोहा श्रणे ीकरण और जचहनांकन जनयम, 2023 ह।ै (2) ये सरकारी राजपत्र में ईनके ऄंजतम प्रकािन की तारीख को प्रवृि होंगे। 2034 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. ऄनप्रु योग- ये जनयम धान (ओरयज़ा सैटटवा एल.) स े तैयार ककए गए पोहा पर लाग ू होंगे। आस े जचड़वा के नाम स े भी जाना जाता ह।ै 3. पटरभािाएं :- (1) आन जनयमों में जब तक संदभच म ेंऄन्द्यथा ऄपेजक्षत न हो- (क) ‘’ऄजधजनयम’’ से कृजि ईपज (श्रेणीकरण और जचहनांकन) ऄजधजनयम, 1937 (1937 का 1) ऄजभप्रते ह;ै (ख) ‘’कृजि जवपणन सलाहकार’’ से भारत सरकार का कृजि जवपणन सलाहकार ऄजभप्रते ह;ै (ग) ‘’प्राजधकृत पैकर’’ स े ऐसा व् यजि या व् यजियों का जनकाय ऄजभप्रेत ह ै जजसे आन जनयमों एवं साधारण श्रणे ीकरण और जचहनांकन जनयम, 1988 के ऄधीन जवजहत श्रेणी मानकों और प्रकिया के ऄनुसार पोहा का श्रेणीकरण करने और ईसे जचहनांककत करने के जलए प्राजधकार प्रमाण-पत्र ऄनुदत्त ककया गया हो; (घ) ‘’प्राजधकार प्रमाण पत्र’’ से साधारण श्रणे ीकरण और जचहनांकन जनयम, 1988 के ईपबंधों के ऄधीन जारी प्रमाण पत्र ऄजभप्रेत ह,ै जो ककसी व्यजि या व्यजियों के जनकाय को श्रेणी ऄजभधान जचहन द्वारा पोहा के श्रणे ीकरण और जचहनांकन का प्राजधकार दते ा ह;ै (ङ) “साधारण श्रणे ीकरण और जचहनांकन जनयम” से साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 ऄजभप्रेत ह;ै (च) “श्रेणी ऄजभधान जचहन’’ से जनयम 3 में जनर्ददष्ट “एगमाकच प्रतीक जचहन” ऄजभप्रेत ह;ै (छ) “जवजधक माप जवज्ञान (पकै ेज में रखी वस्ट्तुए)ं जनयम” स े जवजधक माप जवज्ञान (पैकेज में रखी वस्ट्तुए)ं जनयम, 2011 ऄजभप्रेत ह ैएवं ; (ज) “ऄनुसूची” से आन जनयमों के साथ संलग्न ऄनुसूची ऄजभप्रेत ह।ै (2) आन जनयमों में प्रयुक् त िब् द और पद, जो पटरभाजित नहीं ह ैं लेककन जजन्द्ह ें कृजि ईपज (श्रेणीकरण और जचहनांकन) ऄजधजनयम, 1937 (1937 का 1) या साधारण श्रणे ीकरण और जचहनांकन जनयम, 1988 में पटरभाजित ककया गया ह,ै के िमिः वही ऄथच होंग ेजो ईक्त ऄजधजनयम या जनयम म ेंह;ैं 4. श्रणे ी ऄजभधान जचहन :- श्रणे ी ऄजभधान जचहन म ें “एगमाकच प्रतीक जचहन” का जडज़ाआन होगा जो ऄनुसूची-। म ें जनधाचटरत जडजाआन के सदश्ृ य होगा जजसमें प्राजधकार प्रमाण-पत्र संखयांक, िब्द ‘एगमाकच’, वस्ट्तु का नाम और श्रणे ी िाजमल होंगे। 5. श्रणे ी ऄजभधान :- पोहा की गणु विा ईपदर्वित करन े के जलए श्रेणी ऄजभधान वह होगा जैसा कक ऄनुसूची-II के श्रणे ी ऄजभधान हते ु मापदंड में वर्वणत ककया गया ह।ै 6. गणु विा:- आन जनयमों के प्रयोजन के जलए पोहा की गणु विा ऄनुसूची-II में जनर्ददष्ट के ऄनुसार होगी। 7. पकै कग करन े की जवजध : -(1) पोहा को खाद्य सुरक्षा और मानक (पैकेजजग) जवजनयम, 2018, खाद्य सुरक्षा और मानक (लेबजलग और प्रदिनच ) जवजनयम, 2020 और जवजधक माप जवज्ञान (पैकेज में रखी वस्ट्तुएं) जनयम, 2011 के प्रावधानों के ऄनुसार ईजचत पकै ेजजग सामग्री म ेंपैक ककया जाएगा। (2) समान लॉट या बैच और ग्रडे के छोटे पैक अकारों की श्रणे ीकृत सामग्री की पैककग एक मास्ट्टर कंटेनर म ेंकी जाएगी और ईस पर श्रेणी ऄजभधान जचहन सजहत परू ा ब्यौरा ऄंककत ककया जाएगा; (3) प्रत् यके पैकेज म ेंसमान प्रकार का और समान श्रणे ी ऄजभधान का पोहा होगा; (4) प्रत् यके पैकेज ईजचत और सरु जक्षत रूप स ेबंद और मुहरबंद ककया जाएगा, ताकक ईसकी सामग्री बाहर न फैल सके; 8. जचहनाकं न की जवजध: - (1) श्रेणी ऄजभधान जचहन प्रत् येक पकै ेज पर कृजि जवपणन सलाहकार या ईनके द्वारा ऄजधकृत ककसी ऄजधकारी द्वारा साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 के जनयम 11 के ऄनुसार ऄनुमोकदत रीजत से सुरजक्षत रूप स ेजचपकाया या मुकरत ककया जाएगा;[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 (2) श्रेणी ऄजभधान जचहन के ऄजतटरक्त , प्रत्येक पैकेज पर जनम् नजलजखत जववरण स्ट्पष्ट और ऄजमट रूप से ऄंककत ककया जाएगा:- (क) वस्ट्तु का नाम; (ख) श्रेणी; (ग) ककस्ट्म या रेड का नाम (वैकजल्पक); (घ) लॉट ऄथवा बैच संखया; (ड़) पैककग की तारीख; (च) फसल वि च (वैकजल्पक) (छ) िुद्ध भार; (ज) प्राजधकृत पैकर का नाम और पता; (झ) ऄजधकतम खुदरा मल्ू य; (सभी कर सजहत) (ञ) ....माह....वि च के पूव चईपयोग हते ु सवोिम; (ट) जवजधक माप जवज्ञान (पैकेज में रखी वस्ट्तुए)ं जनयम, 2011 या खाद्य सुरक्षा और मानक (पैकेजजग) जवजनयम, 2018 ऄथवा खाद्य सुरक्षा और मानक (लेबजलग और प्रदिचन) जवजनयम, 2020 के तहत जनर्ददष्ट ऄथवा तत्समय लाग ू ककसी ऄन्द्य कानून के तहत जारी ऄजधसूचना ऄथवा आस ऄजधजनयम के प्रावधानों के तहत जारी ककन्द्हीं ऄनुदेिों के तहत जनर्ददष्ट कोइ ऄन्द्य जववरण, बिते कक पैकेजों पर ऄंकन के जलए सही गुणविा की स्ट्याही का ईपयोग ककया गया हो। (3) प्राजधकृत पैकर कृजि जवपणन सलाहकार ऄथवा ईनके द्वारा ऄजधकृत ककसी ऄजधकारी का पूवच ऄनुमोदन प्राप् त करने के पश् चात साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 के जनयम 11 के ऄतं गतच श्रणे ीकृत पैकेजों पर ऄपना प्राआवेट व् यापार जचहन या व् यापार रांांड जचहनांककत कर सकता है, परंतु वह आन जनयमों के ऄनुसार श्रेणीकृत पैकेजों पर लगाए गए श्रेणी ऄजभधान जचहन द्वारा ईपदर्वित गणु विा से जभन्द् न गुणविा ईपदर्वित नहीं करेगा। 9. प्राजधकार प्रमाण पत्र की जवििे ित:ें- (1) साधारण श्रणे ीकरण और जचहनांकन जनयम, 1988 के जनयम 3 के ईप-जनयम (8) में जवजनर्ददष्ट ितों के ऄजतटरि प्रत्येक प्राजधकृत पैकर आस जनयम में जनर्ददष्ट सभी ितों का पालन करेगा। (2) पोहा की गुणविा का परीक्षण करने के जलए प्राजधकृत पैकर साधारण श्रणे ीकरण और जचहनांकन जनयम, 1988 के जनयम 8 के तहत जारी मापदंडों के ऄनुसार या तो ऄपनी स्ट्वयं की प्रयोगिाला स्ट्थाजपत करेगा या ककसी ऄनुमोकदत राज्य श्रेणीकरण प्रयोगिाला या सहकारी ऄथवा एसोजसएिन प्रयोगिाला या ऐसी प्राआवेट वाजणजज्यक प्रयोगिाला के साथ संपकच करेगा जजसका प्रबंधन साधारण श्रणे ीकरण और जचहनांकन जनयम, 1988 के जनयम 9 के ऄतं गतच कृजि जवपणन सलाहकार या ईनके द्वारा ऄजधकृत ककसी ऄजधकारी द्वारा ऄनुमोकदत योग्य रसायनज्ञ द्वारा ककया जा रहा हो। (3) प्राजधकृत पैकर के पटरसर को समुजचत संवातन और प्रकाि सजहत स्ट्वास्ट््यप्रद और स्ट्वच्छता की दिा में रखा जाएगा। आन कायों में लग े हुए कार्वमकों का ऄच्छा स्ट्वास्ट््य होगा और वे ककसी संचारी, संसगी या संिामक रोग से मुि होंगे। (4) प्राजधकृत पैकर के पटरसर में पक्क े फिच सजहत पयाचप् त भंडारण सुजवधाएं होंगी और वह नमी, ककसी तरह की दरारों, कृंतकों और कीटों स ेमुक्त होगा। (5) प्राजधकृत पैकर और ऄनुमोकदत रसायनज्ञ परीक्षण, श्रेणीकरण, पैककग, जचहनांकन, सीजलग और ऄजभलेखों के ऄनुरक्षण से संबंजधत ऐसे सभी ऄनुदेिों का पालन करेंगे जो समय-समय पर साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 के ऄंतगचत कृजि जवपणन सलाहकार या आस जनजमि ईनके द्वारा ऄजधकृत ककसी ऄजधकारी द्वारा जारी ककए गए हो।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ऄनसु चू ी-I (जनयम 4 देख)ें (एगमाकच प्रतीक का जडजाआन) No. A C वस्ट्तु का नाम………………………………………… श्रेणी……………………………………………… ऄनसु चू ी –II (जनयम 5 और 6 देख)ें पोहा का श्रेणी ऄजभधान और ईसकी गुणविाः 1. धान (ओरयज़ा सैटटवा एल.) को हल्का ईबालकर या गमच पानी में जभगोने के बाद सुखाकर, भनू कर, रोलरों से चपटा करके फ्लेक बनाकर, भूसी जनकालकर तथा छलनी स ेसभी बारीक पाईडर को हटा कर पोहा तयै ार ककया जाता ह।ै 2. न्द् यनू तम ऄपेक्षाए.ं – (i) पोहा में जनम्नजलजखत जविेिताएं होंगी- (क) रूजचकर स्ट्वाद, गंध तथा ईस ककस्ट्म के एकसमान रंग की जविेिता होगी जजससे ईसे प्राप्त ककया गया ह;ै (ख) दाग रजहत होगा तथा ईिम धान से तैयार ककया जाएगा; (ग) बाहरी पदाथों जैस ेकक पत्थर, धलू , जमट्टी, धान, धान की भूसी, कृंतक ऄविेि और ऄवजिष्ट, गंदगी, भुकड़ी, फंफूद, जीजवत या मृत कीट, कीट ऄंि अकद से मुि होगा; (घ) ककसी जवजातीय स्ट्वाद, गंध, ऄप्रीजतकर गंध, खमीरीकरण से मिु होगा; और (ख) जजसे ऄपने गंतव्य स्ट्थान पर संतोिजनक ढंग से पहुचं ाया जा सके। (ii) पोहा का भंडारण ठंडे एवं िुष्क स्ट्थान पर ककया जाएगा तथा साफ और स्ट्वास्ट््यपरक दिा में रखा जाएगा। (iii) पोहा को ईसकी मोटाइ तथा 30 जडग्री सेजल्सयस पानी में पुनगचटठत होन े म ें लगने वाल े समय के अधार पर जनम्नजलजखत श्रेजणयों में वगीकृत ककया जा सकता ह।ै 30 जडग्री सेजल्सयस पानी में पुनगचठन के जलए पोहा और पानी का ऄनुपात 1: 4 रखा जाएगा बिते आस तरह पुनगचटठत पोहा जचपजचपा नहीं होगा और अकार में पृथक-पृथक रहगे ा। ताजलका श्रेणी पोहा की मोटाइ (एमएम) 30 जडग्री सेजल्सयस पानी म ेंपनु गचटठत होने में लगने वाला समय (जमनट) (ऄजधकतम) बारीक 0.5 5 मध्यम 0.7 10 मोटा 1.0 20 आस श्रेणी को पैकेजों पर ऄंककत ककया जा सकता ह।ै [फा. सं. क्य-ू 11047/08/पोहा/2020- मानक] डॉ. एन. जवजया लक्ष्मी, संयुि सजचव (जवपणन)6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture and Farmers Welfare) NOTIFICATION New Delhi, the 28th March, 2023 G.S.R. 229(E).—Whereas, the draft of the Poha Grading and Marking Rules, 2023, was published under sub- section (1) of section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937) in the Gazette of India, Extraordinary, Part II, Section 3, sub-Section (i), vide number G.S.R.825 (E), dated the 18th November, 2022, inviting objections and suggestions from all persons likely to be affected thereby within forty-five days from the date on which copies of the said notification published in the Gazette of India, were made available to the public; And whereas, the copies of the said notification were made available to the public on 18th November, 2022, and whereas, the objections and suggestions received from the stakeholders in respect of the said draft rules have been duly considered; Now, therefore, in exercise of the powers conferred by section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937), the Central Government hereby makes the following rules, namely:- 1. Short title and commencement. - (1) These rules may be called the Poha Grading and Marking Rules, 2023. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. Application.- They shall apply to Poha prepared from paddy (Oryza sativa L.), also known as flattened rice, rice flakes, beaten rice or chiwda. 3. Definitions. -(1) In these rules, unless the context otherwise requires,- (a) “Act” means the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937); (b) "Agricultural Marketing Adviser" means the Agricultural Marketing Adviser to the Government of India; (c) "authorised packer" means a person or a body of persons who has been granted a certificate of authorisation to grade and mark poha in accordance with the grade standards and procedure provided under these rules and the General Grading and Marking Rules, 1988; (d) "certificate of authorisation" means a certificate issued under the provisions of the General Grading and Marking Rules, 1988, authorising a person or a body of persons to grade and mark poha with the grade designation mark; (e) "General Grading and Marking Rules" means the General Grading and Marking Rules, 1988; (f) "Grade Designation Mark" means „‟AGMARK Insignia‟‟ referred to in rule 3; (g) “Legal Metrology (Packaged Commodities) Rules" means the Legal Metrology (Packaged Commodities) Rules, 2011; and (h) "schedule" means a schedule appended to these rules. (2) The words and expressions used and not defined in these rules but defined in the Agricultural Produce (Grading and Marking) Act, 1937 or the General Grading and Marking Rules, 1988, shall have the meanings respectively assigned to them in the said act and the rules. 4. Grade Designation Mark. - The Grade Designation Mark shall consist of the design of "AGMARK Insignia", as set out in Schedule-I and incorporating the certificate of authorisation number, the word “AGMARK", the name of commodity and its grade. 5. Grade designations. - The grade designations to indicate the quality of poha including the criteria for grade designation shall be as set out in Schedule-II. 6. Quality. -For the purpose of these rules, the quality of poha shall be as provided in Schedule-II. 7. Method of packing. - (1) The poha shall be packed in suitable packaging material in accordance with the provisions of the Food Safety and Standards (Packaging) Regulations, 2018 and the Food Safety and Standards (Labeling and Display) Regulations, 2020 and Legal Metrology (Packaged Commodities) Rules, 2011.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 7 (2) The graded material of small pack sizes of the same lot or batch and grade may be packed in a master container with complete details thereon along with the Grade Designation Mark. (3) Each package shall contain poha of the same type and of the same grade designation. (4) Each package shall be properly and securely closed and sealed so as to disallow spilling. 8. Method of marking.- (1) The Grade Designation Mark shall be securely affixed to or printed on each package in the manner approved by the Agricultural Marketing Adviser or an officer authorised by him under rule 11 of the General Grading and Marking Rules, 1988. (2) In addition to the Grade Designation Mark, the following particulars shall be clearly and indelibly marked on each package, namely:- (a) name of the commodity; (b) grade; (c) variety or trade name (optional); (d) lot or batch number; (e) date of packing; (f) crop year (optional); (g) net weight; (h) name and address of the authorised packer; (i) maximum retail price (inclusive of all taxes); (j) BEST BEFORE ___________MONTH ______YEAR; and (k) any other particulars as provided under the Legal Metrology (Packaged Commodities) Rules, 2011 or specified under the Food Safety and Standards (Packaging) Regulations, 2018 and the Food Safety and Standards (Labeling and Display) Regulations, 2020 or any notification issued under any other law for the time being in force or any instructions issued under the provisions of the Act: provided that right quality of ink is used for marking on packages. (3) The authorised packer shall after obtaining prior approval of the Agricultural Marketing Adviser or an officer authorised by him under rule 11 of the General Grading and Marking Rules, 1988 mark his private trade mark or trade brand on the graded packages provided the same do not indicate quality other than that indicated by the Grade Designation Mark affixed to the graded packages in accordance with these rules. 9. Special conditions of certificate of authorisation.–(1) In addition to the conditions specified in sub-rule (8) of rule 3 of the General Grading and Marking Rules, 1988, every authorised packer shall comply the conditions specified under these rules. (2) The authorised packer shall either set up his own laboratory as per norms issued under rule 8 of the General Grading and Marking Rules, 1988 or have access to an approved State grading laboratory or cooperative or association laboratory or a private commercial laboratory manned by a qualified chemist approved by the Agricultural Marketing Adviser or an officer authorised by him under rule 9 of the General Grading and Marking Rules, 1988 for testing the quality of poha. (3) The premises of the authorised packer shall be maintained in hygienic and sanitary conditions with proper ventilations and well lighted arrangement and the personnel engaged in these operations shall be in sound health and free from any infectious, contagious or communicable diseases. (4) The premises of the authorised packer shall have adequate storage facilities with pucca floor and free from dampness, any kind of cracks and crevices, rodent and insect infestation. (5) The authorised packer and the approved chemist shall observe all instructions regarding testing, grading, packing, marking, sealing and maintenance of records which may be issued by the Agricultural Marketing Adviser or an officer authorised by him in this behalf in accordance with the General Grading and Marking Rules, 1988 from time to time.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] SCHEDULE-I (See rule 4) (Design of AGMARK Insignia) C A No. Name of the Commodity------------------ Grade------------------------------------ SCHEDULE-II (See rules 5 and 6) Grade designation and quality of Poha 1. Poha is produced from paddy (Oryza sativa L.) by parboiling or soaking in hot water followed by drying, roasting, flaking or flattening with rollers, dehusking and sieving to remove all fine powder. 2. Minimum requirements.- (i) Poha shall - (a) have pleasant taste, flavor and uniform color characteristic of the variety from which obtained; (b) be unstained and prepared from wholesome, sound paddy grains; (c) be free from extraneous matter such as stones ,dirt, clay, paddy, paddy husk, rodent hair and excreta, filth, moulds, fungus, live and dead insects and insect fragments and the like; (d) be free from any foreign taste, odour, obnoxious smell and evidence of fermentation; and (e) be free from artificial coloring, polishing agents, artificial fragrances and any other chemicals. (ii) For domestic trade, it shall comply with the restrictions in regard to residual levels of metal contaminants, pesticide residues, microbial requirements, crop contaminants, naturally occurring toxic substances and other food safety requirements as provided under the Food Safety and Standards (Contaminants, Toxins and Residues) Regulations, 2011, the Food Safety and Standards (Food Product Standards and Food Additives) Regulations, 2011 and other regulations made for domestic trade under the Food Safety and Standards Act, 2006 (34 of 2006). (iii) For export trade, it shall comply with the residual limits of heavy metals, pesticides and other food safety requirements as laid down by the Codex Alimentarius Commission or importing countries requirement for exports. 3. Other requirements.- (i). The condition of poha shall be so as to enable it to- (a) withstand transport and handling; and (b) arrive in satisfactory condition at the place of destination. (ii). Poha shall be stored in a cool and dry place and properly maintained in a clean and hygienic condition. (iii). Poha may be classified to be of following categories based on the thickness of flakes and time taken to reconstitute in water at 30°C and for reconstitution in water at 30°C, the ratio maintained shall be 1:4 poha:water provided that the reconstituted poha shall not be pasty and shall be discrete in shape.
