(1) पररभािाए:ं - इन जनयमों में जब तक संदभ वमें अन्यथा अपेजक्षत न हो- (क) ‘’अजधजनयम’’ से कृजि उपज (श्रणे ीकरण और जचहनांकन) अजधजनयम, 1937 (1937 का 1) अजभप्रते ह;ै (ख) ‘’कृजि जवपणन सलाहकार’’ से भारत सरकार का कृजि जवपणन सलाहकार अजभप्रेत ह;ै (ग) ‘’प्राजधकृत पैकर’’ से ऐसा व् यजि या व् यजियों का जनकाय अजभप्रेत ह ै जजसे इन जनयमों एवं साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 के अधीन जवजहत श्रणे ी मानकों और प्रकक्रया के अनुसार घी का श्रेणीकरण करने और उसे जचहनांककत करने के जलए प्राजधकार प्रमाण-पत्र अनुदत्त ककया गया हो; (घ) ‘’प्राजधकार प्रमाण पत्र’’ से साधारण श्रणे ीकरण और जचहनांकन जनयम, 1988 के उपबंधों के अधीन जारी प्रमाण पत्र अजभप्रेत ह,ै जो ककसी व्यजि या व्यजियों के जनकाय को श्रेणी अजभधान जचहन द्वारा घी के श्रेणीकरण और जचहनांकन का प्राजधकार दते ा ह;ै (ङ) “साधारण श्रेणीकरण और जचहनांकन जनयम” से कृजि उपज (श्रेणीकरण और जचहनांकन) अजधजनयम, 1937 (1937 का 1) की धारा 3 के अधीन बनाए गए साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 अजभप्रेत ह;ै (च) “श्रेणी अजभधान जचहन’’ से जनयम 3 में जन्द्ट “एगमाकव प्रतीक जचहन” अजभप्रेत ह;ै (छ) “जवजधक माप जवज्ञान (पैकेज में रखी वस्ट्तुएं) जनयम” से जवजधक माप जवज्ञान अजधजनयम, 2009 (2010 का 1) के अंतगवत बनाए गए जवजधक माप जवज्ञान (पैकेज में रखी वस्ट्तएु ं) जनयम, 2011 अजभप्रेत ह ैएवं; (ज) “अनुसूची” से इन जनयमों के साथ संलग्न अनुसूची अजभप्रेत ह।ै (2) इन जनयमों म ें प्रयुक् त िब् द और पद, जो पररभाजित नहीं ह ैंलेककन जजन्ह ेंकृजि उपज (श्रेणीकरण और जचहनांकन) अजधजनयम, 1937 और साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 म ें पररभाजित ककया गया ह,ै के वही अथ व होंग े जो उक्त अजधजनयम अथवा जनयम में ह;ैं 3. श्रेणी अजभधान जचहन -: श्रेणी अजभधान जचहन म ें “एगमाकव प्रतीक जचहन” का जडज़ाइन होगा जो अनुसूची-I में जनधावररत जडज़ाइन के सदश्ृ य होगा जजसमें प्राजधकार प्रमाण पत्र संखयांक, िब्द ‘एगमाकव’, वस्ट्तु का नाम और श्रेणी िाजमल होंग े परंत ु रटन की पैककग पर एगमाकव प्रतीक वाली कागज की पची के प्रयोग की अनुमजत केवल ऐसे प्राजधकृत पैकरों को दी जाएगी जजन्ह ें कृजि जवपणन सलाहकार द्वारा अथवा इस संबंध म ें प्राजधकृत अजधकारी द्वारा अथवा जवजन्द्ट के अनुसार समय-समय पर ऐसा करने की अनुमजत प्रदान की गई हो। 4. श्रेणी अजभधान -: घी की गुणवत्ता उपदर्मित करन े के जलए श्रेणी अजभधान अनुसूची-II म ें जवजन्द्ट मापदडं के अनुसार होंगे।[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 5. गणु वत्ता :- इन जनयमों के प्रयोजनाथव, घी की गणु वत्ता अनुसूची-II में जवजन्द्ट के अनुसार होगी। 6. पैककग करने की जवजध: (1) घी को खाद्य सुरक्षा और मानक (पैकेजजग) जवजनयम, 2018 और जवजधक माप जवज्ञान (पैकेज म ेंरखी वस्ट्तुएाँ) जनयम, 2011 के प्रावधानों के अनुसार समुजचत पैंककग सामग्री में पैक ककया जाएगा। (2) समान लॉट अथवा बैच और ग्रडे के छोटे पैक आकारों की श्रेणीकृत सामग्री की पैककग एक मास्ट्टर कंटेनर में की जाएगी और उस पर श्रणे ी अजभधान जचहन सजहत परू ा ब्यौरा अंककत ककया जाएगा। (3) प्रत् यके पैकेज म ेंसमान प्रकार का और समान श्रणे ी अजभधान का घी होगा । (4) प्रत् यके पैकेज को उजचत और सुरजक्षत रूप से बंद और मुहरबंद ककया जाएगा, ताकक उसकी सामग्री बाहर न फैल सके तथा उस पर सक्षम प्राजधकारी द्वारा जारी प्रजतकृजत संखया अंककत की जाएगी। 7. जचहनाकं न की जवजध : (1) श्रेणी अजभधान जचहन प्रत् येक पैकेज पर कृजि जवपणन सलाहकार या इस जनजमत उनके द्वारा अजधकृत ककसी अजधकारी द्वारा साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 के जनयम 11 के अनुसार अनुमोकदत रीजत से सुरजक्षत रूप से जचपकाया या मुकद्रत ककया जाएगा। खाद्य सुरक्षा और मानक (लेबजलग और प्रदिवन) जवजनयम, 2020 के प्रावधानों के अनुसार पैकेजजग पर उपयुि रूप स ेघी को जचहनांककत ककया जाएगा। (2) श्रेणी अजभधान जचहन के अजतररक्त प्रत्येक पैकेज पर जनम् नजलजखत जववरण स्ट्प्ट रूप से और अजमट रूप स े अंककत ककया जाएगा:- (क) वस्ट्तु का नाम; (ख) श्रेणी; (ग) रेड नाम (वैकजल्पक); (घ) लॉट अथवा बैच संखया; (ड़) पैककग की तारीख*; (च) पोिण संबंधी जानकारी; (छ) िुद्ध भार; (ज) प्राजधकृत पैकर का नाम और पता; (झ) अजधकतम खुदरा मल्ू य (सभी कर सजहत); (ञ) ....माह....वि व के पूवव उपयोग हते ु सवोत्तम; (ट) भंडारण की जस्ट्थजत, यकद कोई हो; (ठ) जवजधक माप जवज्ञान (पैकेज म ें रखी वस्ट्तुए)ं जनयम, 2011 या खाद्य सुरक्षा और मानक (पैकेजजग) जवजनयम, 2018 अथवा खाद्य सुरक्षा और मानक (लेबजलग और प्रदिवन) जवजनयम, 2020 के तहत जन्द्ट अथवा तत्समय लागू ककसी अन्य कानून के तहत जारी अजधसूचना अथवा इस अजधजनयम के प्रावधानों के तहत जारी ककन्हीं अनुदिे ों के तहत जन्द्ट कोई अन्य जववरण बित े पैकेजों पर जचहनाकंन करने के जलए सही गुणवत्ता की स्ट्याही का प्रयोग ककया जाए। *पैककग की तारीख नमनू े के जवश्लेिण के परू ा होने की तारीख होगी।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (3) प्राजधकृत पैकर कृजि जवपणन सलाहकार अथवा उनके द्वारा अजधकृत ककसी अजधकारी का पूवव अनुमोदन प्राप् त करने के पश् चात साधारण श्रणे ीकरण और जचहनांकन जनयम के जनयम 11 के अंतगवत श्रणे ीकृत पैकेजों पर अपना प्राइवेट व् यापार जचहन या व् यापार रांांड जचहनांककत कर सकता ह,ै परंतु वह इन जनयमों के अनुसार श्रणे ीकृत पैकेजों पर लगाए गए श्रणे ी अजभधान जचहन द्वारा उपदर्मित गणु वत्ता से जभन् न गणु वत्ता उपदर्मित नहीं करेगा। 8. प्राजधकार प्रमाण पत्र प्रदान करने की जविेि ितें: साधारण श्रणे ीकरण और जचहनांकन जनयम के जनयम 3 के उप-जनयम (8) में जवजन्द्ट ितों के अजतररि प्रत्येक प्राजधकृत पैकर इन जनयमों के अतं गतव जन्द्ट ितों का पालन करेगा । (1) कच्चे दधू के संपणू व जवश्लिे ण, दधू की गणु वत्ता जनधावररत करने तथा परररक्षकों, गन्ना चीनी, यूररया, काजस्ट्टक सोडा, स्ट्टाच,व वनस्ट्पजत तेल आकद जैसी संभाजवत जमलावट का पता लगान े के जलए पररसर में ही प्रयोगिाला होनी चाजहए। घी के जनधावररत मापदंडों के जवश्लेिण के जलए प्रयोगिाला पूरी तरह स ेसुसजित होनी चाजहए। घी की गुणवत्ता की जांच करने के जलए इस प्रयोगिाला का प्रबंधन साधारण श्रणे ीकरण और जचहनांकन जनयम के जनयम 9 के अंतगवत कृजि जवपणन सलाहकार अथवा उनके द्वारा अजधकृत ककसी अजधकारी द्वारा अनुमोकदत योग्य रसायनज्ञ द्वारा ककया जाएगा। (2) जनमावण की प्रकक्रया ऐसी होगी कक घी की आवश्यक जविेिताओं को बनाए रखा जा सके जजसे ककसी भी समय 110° सेजल्सयस से अजधक गमव नहीं ककया जाएगा। (3) प्राजधकृत पैकर द्वारा इन जनयमों के अंतगवत घी का श्रणे ीकरण और जचहनांकन करन े के जलए अनुमोकदत ककए गए रसायनज्ञ को सभी तरह की आवश्यक सुजवधाएं और सहायता दी जाएंगी । (4) प्राजधकृत पैकर दधू , दग्ु ध वसा और घी की जवश्लेिणात्मक ररपोटव का उजचत ररकॉड व रखगे ा। सभी ररपोटव जवपणन और जनरीक्षण जनदिे ालय द्वारा यथा जन्द्ट जनधावररत प्रोफामाव में समयसमय पर प्रस्ट्तुत की जाएंगी। (5) घी के प्रसंस्ट्करण और पैककग के जलए इस्ट्तेमाल ककए जान े वाले प्राजधकृत पैकर के पररसर को समुजचत संवातन और प्रकाि सजहत स्ट्वास्ट््यप्रद और स्ट्वच्छता की दिा म ें रखा जाएगा और इन कायों म ें लग े हुए कार्ममकों का अच्छा स्ट्वास्ट््य होगा और व े ककसी संचारी , संसगी या संक्रामक रोग स े मिु होंगे। (6) प्राजधकृत पैकर के पररसर म ें पक्क े फि व सजहत पयावप् त भंडारण सुजवधाएं होंगी और वह नमी, ककसी तरह की दरारों, कृतकों और कीटों स ेमिु होगा I (7) जजस पररसर में घी का जनमावण या प्रसंस्ट्करण ककया जाता है, वहां घी के अलावा कोई वसा या तेल नहीं होना चाजहए तथा कोई कृजत्रम स्ट्वाद या रंग भी नहीं होना चाजहए। (8) प्राजधकृत पैकर और अनुमोकदत रसायनज्ञ द्वारा परीक्षण, श्रेणीकरण, पैककग, जचहनांकन, सीजलग और अजभलेखों के अनरु क्षण स े संबंजधत ऐस े सभी अनुदेिों का पालन ककया जाएगा जो अजधजनयम के प्रावधानों के अंतगवत समय-समय पर जारी ककए गए हों । (i) आवश्यक न्यूनतम बुजनयादी ढाचं ा - घी के जलए प्राजधकार प्रमाणपत्र (सीए) केवल उन्हीं पार्टटयों को ही कदया जाएगा जो नीच े उजल्लजखत अपेजक्षत न्यूनतम बुजनयादी ढांच/े सुजवधाओं के साथ डेयरी संयंत्रों म ें दधू स ेघी का जनमावण करत े ह:ैं (ii) भवन/बुजनयादी ढांचा स्ट्थायी प्रकृजत का होगा जजसका उजचत रख-रखाव ककया जा रहा हो तथा जजसम ें सपाट, समतल, दरार रजहत फिव हो I (iii) पयावि जल आपूर्मत, जल जनकासी व्यवस्ट्था और जबजली का प्रावधान होना चाजहए। (iv) पैक्ड घी के भडं ारण के जलए अलग कमरे होंगे। (v) दधू से घी बनान ेके जलए डेयरी संयंत्रों के जलए भारत सरकार के कृजि जवपणन सलाहकार द्वारा जन्द्ट अन्य ढांचागत/तकनीकी आवश्यकताएाँ I[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 5 अनसु चू ी I (जनयम 3 देख)ें (एगमाकव प्रतीक जचहन का जडजाइन) C A No. वस्ट्तु का नाम…………………. श्रेणी…………………………………. अनसु चू ी II (जनयम 4 और 5 देख)ें घी का श्रणे ी अजभधान और गणु वत्ता 1. घी का जनमावण दधू या दग्ु ध वसा उत्पादों जैसे मक्खन या क्रीम या सजम्मश्रण से एक ऐसी प्रकक्रया के माध्यम से ककया जाएगा जजसके पररणामस्ट्वरूप पानी और दधू के वसारजहत ठोस पदाथव, लगभग पूरी तरह से जनकल जाएाँ। 2. न्यूनतम अपेक्षाए ं: (1) घी म ेंजनम्नजलजखत जविेिताएाँ होंगी - क. स्ट्प्ट दग्ु ध वसा होगा और 40 जडग्री सेजल्सयस पर साफ़ एवं पारदिी होगा; ख. प्राकृजतक, मधुर गंध और अच्छे स्ट्वाद से युि होगा; ग. बासीपन, अजप्रय गधं , गंदगी, जनलंजबत अथवा अघुलनिील पदाथव अथवा अन्य ककसी जवजातीय पदाथ व से मिु होगा; घ. पृथक्कृत जल, तलछट जमाव, योजजत रंजक पदाथव और ककसी भी तरह के अन्य गंधयिु पदाथ वसे मुि होगा; ङ. कृजत्रम तेल/वसा, खजनज तेल और पि ु वसा (दग्ु ध वसा के अलावा) से मिु होगा; च. फीनॉलफ्थेजलन परीक्षण नकारात्मक होगा। (2) घरेल ू व्यापार के मामले म ें यह धात ु संदिू क, कीटनािक अविेि, सूक्ष्मजीव अपक्षे ाओं, फसल संदिू कों, प्राकृजतक रूप स े पाए जाने वाल े जविलै े पदाथों के अवजि्ट स्ट्तर स े संबंजधत प्रजतबंधों तथा खाद्य सुरक्षा और मानक (संदिू क, आजवि और अवजि्ट ) जवजनयम, 2011 तथा खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) जवजनयम, 2011 म ें यथा जवजन्द्ट अन्य खाद्य सुरक्षा अपेक्षाओं अथवा घरेल ू व्यापार के जलए खाद्य सुरक्षा और मानक अजधजनयम, 2006 (2006 का 34) के अधीन अजधसूजचत ककसी भी अन्य जवजनयम का अनपु ालन करेगा। (3) जनयावत के मामल े में यह कोडेक्स एजलमेंटेररयस आयोग द्वारा जनधावररत भारी धातओंु और कीटनािकों की अवजि्ट सीमाओं तथा अन्य खाद्य सुरक्षा मापदंडों अथवा आयातकता वदिे की अपेक्षाओं का अनुपालन करेगा। 3. श्रेणी अजभधान के जलए मापदडं : ताजलका-1 श्रेणी वजन के दग्ुध वसा, ब्यूरटरो- रीचटव पोलेंस्ट्के ओजलक बोदोईं आयोडीन साबुनीकरण β- अजभधान अनुसार नमी ररफ्रैक्टोमीटर मीसल मान एजसड के परीक्षण मान मान न्यूनतम % जसटोस्ट्टेरॉल का प्रजतित (द्रव्यमान रीजडग मान, रूप म ें की (से अजधक अनुसार) 40˚सजेल्सयस न्यूनतम एफएफए, उपजस्ट्थजत नहीं) पर अजधकतम, % (1) (2) (3) (4) (5) (6) (7) (8) (9) (10) (11) जविेि 0.30 99.70 40.0 से 28 1.0-2.0 1.0 नकारात्मक 25-38 205-235 नकारात्मक 43.06 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] मानक 0.30 99.70 40.0 से 26 1.0-2.0 1.5 नकारात्मक 25-38 205-235 नकारात्मक 43.0 सामान्य 0.50 99.50 40.0 से 24 0.5-2.0 2.0 नकारात्मक 25-38 205-235 नकारात्मक 44.0 4. जविेि ितव - घी को गाय का घी घोजित ककया जा सकता ह,ै यकद इसे गाय के दधू से प्राि दग्ु ध वसा, मक्खन या क्रीम स े जनर्ममत ककया गया हो। इस प्रयोजन के जलए प्राजधकृत पैकर दधू की खरीद का उजचत ररकॉड वरखेगा। 5. इन जनयमों के अंतगवत आन े वाला घी खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य), जवजनयम 2011 के अनुसार फैटी एजसड संरचना का अनुपालन करेगा। 6. अजतररि अपेक्षाए-ं (i) घी की पैककग ऐसी होगी कक वह – (क) यातायात और हडैं जलग की जस्ट्थजत का सामना कर सके; (ख) जजसे अपने गंतव्य स्ट्थान पर संतोिजनक ढंग से पहुचं ाया जा सके। (ii) घी का भंडारण ठंडे और िुष्क स्ट्थान पर ककया जाएगा तथा इसे उजचत स्ट्वच्छ और स्ट्वास्ट््यकर जस्ट्थजत में रखा जाएगा। [फा. स.ं क्य1ू 1047/03/घी/2022-मानक] फ़ैज़ अहमद ककदवई, अपर सजचव (जवपणन) MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture and Farmers Welfare) NOTIFICATION New Delhi, the 13th December, 2023 G.S.R. 893(E).—the following draft of the Ghee Grading and Marking Rules, 2023 which the Central Government proposes to make in exercise of the powers conferred by section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937) in supersession of the principal rule of Ghee Grading and Marking Rules, 1938, amended upto1991 except as respect things done or omitted to be done before such supersession is hereby published as required by the said section for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of forty-five days from the date on which the copies of the Gazette of India containing this notification are made available to the public. Objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the above said period shall be taken into consideration by the Central Government. Objections or suggestions, if any, in respect of the said draft rules, may be forwarded to the Agricultural Marketing Adviser to the Government of India, Directorate of Marketing and Inspection, Head Office, CGO Complex, NH - IV, Faridabad (Haryana) 121001. DRAFT RULES 1. Short title, application and commencement.-(1) These rules shall be called the Ghee Grading and Marking Rules, 2023. (2) They shall apply to Ghee manufactured from milk or milk fat products like butter or cream or combination. (3) They shall come into force on the date of their final publication in the Official Gazette. 2. Definitions.-(1) In these rules, unless the context otherwise requires,- (a) “Act” means the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937); (b) "Agricultural Marketing Adviser" means the Agricultural Marketing Adviser to the Government of India; (c) "authorised packer" means a person or a body of persons who has been granted a certificate of authorization to grade and mark Ghee in accordance with the grade standards and procedure provided under these rules and the General Grading and Marking Rules, 1988; (d) "Certificate of Authorisation" means a certificate issued under the provisions of the General Grading and Marking Rules, 1988 authorising a person or a body of persons to grade and mark Ghee with the Grade Designation Mark;[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 7 (e) "General Grading and Marking Rules" means the General Grading and Marking Rules, 1988 made under section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937); (f) "Grade Designation Mark" means „‟AGMARK Insignia‟‟ referred to in rule 3; (g) “Legal Metrology (Packaged Commodities) Rules" means the Legal Metrology (Packaged Commodities) Rules, 2011, made under the Legal Metrology Act, 2009 (1 of 2010); and (h) "Schedule" means a Schedule appended to these rules. (2) Words and expressions used in these rules and not defined but defined in the Agricultural Produce (Grading and Marking) Act, 1937 and General Grading and Marking Rules, 1988 shall have the same meaning as are assigned to them under the said Act or rules. 3. Grade designation mark.-The grade designation mark shall consist of the design of "AGMARK Insignia" as set out in Schedule-I, incorporating the certificate of authorisation number, the word "AGMARK", name of the commodity and its grade provided that the use of Agmark Replica paper slip shall be allowed only for tin packing for such authorised packers who have been granted the permission by the Agricultural Marketing Adviser or an officer authorised in this regard or as may be specified from time to time. 4. Grade designations.- The grade designations to indicate the quality of Ghee including the criteria for grade designation shall be as set out in Schedule-II. 5. Quality.- For the purpose of these rules, the quality of Ghee shall be as provided in Schedule-II. 6. Method of packing. -(1) Ghee shall be packed in suitable packaging material in accordance with the provisions of the Food Safety and Standards (Packaging) Regulations, 2018 and Legal Metrology (Packaged Commodities) Rules, 2011. (2) The graded material of small pack sizes of the same lot or batch and grade may be packed in a master container with complete details thereon along with the Grade Designation Mark. (3) Each package shall contain Ghee of the same type and of the same grade designation. (4) Each package shall be properly and securely closed and sealed so as to disallow spilling and marked with replica numbers issued by the competent authority. 7. Method of Marking.-(1) The Grade Designation Mark shall be securely affixed to or printed on each package in the manner approved by the Agricultural Marketing Adviser or an officer authorised by him under rule 11 of the General Grading and Marking Rules. Ghee shall be marked suitably on packaging in accordance with the provisions of the Food Safety and Standards (Labeling and Display) Regulations, 2020. (2) In addition to the Grade Designation Mark, following particulars shall be clearly and indelibly marked on each package, namely- (a) name of the commodity; (b) grade; (c) trade name(optional); (d) lot/batch number; (e) date of packing*; (f) nutritional information; (g) net weight; (h) name and address of the authorised packer; (i) maximum retail price (inclusive of all taxes); (j) BEST BEFORE _______MONTH ______YEAR; (k) storage condition, if any (l) any other particulars as provided under the Legal Metrology (Packaged Commodities) Rules, 2011 or specified under the Food Safety and Standards (Packaging) Regulations, 2018 and the Food Safety and Standards (Labeling and Display) Regulations, 2020 or any notification issued under any other law for the time being in force or any instructions issued under the provisions of the Act, provided that right quality of ink is used for marking on packages. * The date of packing shall be the date of completion of the analysis of the sample. (3) The authorised packer may after obtaining prior approval of the Agricultural Marketing Adviser or an officer authorised by him under rule 11 of the General Grading and Marking Rules, mark his private trade mark or trade brand on the graded packages provided the same do not indicate quality other than that indicated by the Grade Designation Mark affixed to the graded packages in accordance with these rules.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 8. Special conditions for grant of Certificate of Authorisation. - In addition to the conditions specified in sub-rule (8) of rule 3 of the General Grading and Marking Rules, every authorised packer shall comply the conditions specified under these rules. (1) The premises should have in house laboratory for complete analysis of raw milk, for determining quality of milk and detecting possible adulterants such as preservatives, cane sugar, urea, caustic soda, starch, vegetable oil, etc. The laboratory should also be fully equipped for the analysis of ghee for prescribed parameters. The laboratory shall be manned by a qualified chemist approved by the Agricultural Marketing Adviser or an officer authorised by him under rule 9 of the General Grading and Marking Rules for testing the quality of Ghee. (2)The process of manufacture shall be such as to retain the essential characteristics of the ghee which shall not be heated at any time over 110°C. (3) The authorised packer shall provide all necessary facilities and assistance to the approved chemist for carrying out the grading and marking of Ghee under these rules. (4) The authorised packer shall maintain proper record of analytical reports of milk, milk fat and ghee. All the reports shall be submitted periodically in prescribed proforma as specified by Directorate of Marketing and Inspection. (5) The premises of the authorized packer used for processing and packing of Ghee shall be maintained in hygienic and sanitary conditions with proper ventilation and well lighted arrangement and the personnel engaged in these operations shall be in sound health and free from any infectious, contagious or communicable diseases. (6) The premises of the authorized packer shall have adequate storage facilities with pucca floor, free from dampness, any kind of cracks and crevices, rodent and insect infestation. (7) There shall be no fat or oil other than ghee or any artificial flavoring or coloring matter in the premises where ghee is manufactured or processed. (8) The authorised packer and the approved chemist shall observe all instructions regarding testing, grading, packing, marking, sealing, maintenance of records, which may be issued from time to time under the provisions of the Act. 9. Minimum infrastructure requirement - Certificate of Authorization (CA) for ghee shall be granted only to the parties who manufacture ghee from milk in dairy plants with requisite minimum infrastructure/facilities like: (i) The building/infrastructure shall be permanent in nature and maintained properly with smooth, plain, cracks and crevices free flooring. (ii) There should be provision for adequate water supply, drainage system and power. (iii) There shall be separate rooms for storing packed ghee. (iv) Other infrastructural/technological requirements as specified by the Agricultural Marketing Adviser to the Government of India for dairy plants to manufacture ghee from milk. Ghee shall be manufactured from milk or milk fat products like butter or cream or combination by means of a process which results in almost total removal of water and milk solids-not-fat. 2. Minimum requirement: (1) Ghee shall- (a) be clarified milk fat and clear and transparent at 40°C; (b) have natural, pleasant odor and agreeable taste; (c) be free from rancidity, obnoxious smell, turbidity, suspended or insoluble matter or any other foreign matter; (d) be free from separated water, sedimentations, added coloring matter and any other flavoring substances; (e) be free from synthetic oil/fat, mineral oil and animal fat (other than milk fat); (f) the phenolphthalein test shall be negative. (2) for domestic trade, it shall comply with the restrictions in regard to residual levels of metal contaminants, pesticides residues, microbial requirements, crop contaminants, naturally occurring toxic substances and other food safety requirements as specified under the Food Safety and Standards (Contaminants, Toxins and Residues) Regulations, 2011, Food Safety and Standards (Food Product Standards and Food Additives) Regulations, 2011, and other regulations made for domestic trade under the Food Safety and Standards Act, 2006 (34 of 2006). (3) For export trade, it shall comply with the residual limits of heavy metals, pesticides and other food safety requirements as laid down by the Codex Alimentarius Commission or importing countries requirement for export. 3. Special Condition - The ghee may be declared as Cow Ghee, if it is manufactured from milk fat or butter or cream derived from cow milk. For this purpose the authorised packer shall maintain proper record of milk procurement. 5. The ghee covered under these rules shall comply with the fatty acid composition as per Food Safety and Standards (Food Products Standards and Food Additives), Regulations 2011. 6. Additional requirements - (i) The packing condition of the Ghee shall be such as to enable it- (a) to withstand transport and handling; (b) to arrive in satisfactory condition at the place of destination.
