L.-33004/99 सी.जी.-एच.आर.-अ.-15032023-244415 xxxGIDHxxx CG-HR-E-15032023-244415 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 153] नई किल्ली, बुधवार, माच च15, 2023/फाल्ग नु 24, 1944 No. 153] NEW DELHI, WEDNESDAY, MARCH 15, 2023/PHALGUNA 24, 1944 कृजि एव ंककसान कल्याण मत्रं ालय (कृजि एव ंककसान कल्याण जवभाग) अजधसचू ना नई किल्ली, 15 माच,च 2023 सा.का.जन. 192(अ).—वनस्ट्पजत तेल श्रणे ीकरण और जचहनाकं न (संिोधन) जनयम, 2023 जिनको केंद्रीय सरकार 1986 तक यथासंिोजधत कृजि उपि (श्रेणीकरण और जचहनांकन) अजधजनयम, 1937 (1937 का 1) की धारा 3 द्वारा प्रित्त िजियों का प्रयोग करत े हुए, वनस्ट्पजत तेल श्रेणीकरण और जचहनांकन जनयम, 1955 के मलू जनयम और वनस्ट्पजत तले श्रेणीकरण और जचहनांकन (सिं ोधन) जनयम, 2009 म ें संिोधन करन े के जलए, उि धारा की अपक्षे ानुसार ऐस े सभी व्यजियों की िानकारी के जलए, जिनके उससे प्रभाजवत होने की संभावना ह,ै प्रकाजित ककया िाता ह ै और यह सूचना िी िाती ह ै कक उि प्रारूप जनयमों पर, उस तारीख से, जिस स े भारत के रािपत्र की प्रजतयााँ जिसम ें यह अजधसूचना जनजहत ह,ै िनता को उपलब्ध करा िी िाती ह,ैं पैंतालीस किन की अवजध की समाजि के पश्चात जवचार ककया िाएगा । 2. सभी आपजत्तयों अथवा सुझावों पर िो उक्त प्रारूप जनयमों की बाबत ककसी व् यजि स े ऊपर जवजनर्िष्टच अवजध की समाजि स े पूव च प्राि होत े ह,ैं केन्‍द द्रीय सरकार द्वारा जवचार ककया िाएगा। 1739 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 3. कोई भी व् यजि िो उक्त प्रारूप जनयमों के संबंध म ें कोई सझु ाव िेना चाहता ह,ै वह अपना सुझाव ऊपर जनर्िष्च ट अवजध के भीतर कृजि जवपणन सलाहकार, भारत सरकार, जवपणन एवं जनरीक्षण जनििे ालय, प्रधान कायाचलय,सी.िी.ओ. कॉम्प्लेक्स, एन.एच.-IV, फरीिाबाि (हररयाणा)-121001 को भेि सकता ह,ै िो इन सुझावों को केन्‍द द्रीय सरकार के पास जवचाराथच भेिेंगे । प्रारूप जनयम 1. सजं क्ष्त नाम, लाग ू होना और प्रारंभ- (1) इन जनयमों का नाम वनस्ट्पजत तेल श्रेणीकरण और जचहनांकन (संिोधन) जनयम, 2023 ह।ै (2) ये सरकारी रािपत्र म ेंउनके अंजतम प्रकािन की तारीख को प्रवृत् त होंग े । 2. जनयम 10 के जलए, जनम्नजलजखत प्रजतस्ट्थापन ककए िाएगं :े- 10(ए) वनस्ट्पजत तेल के घरेल ू व्यापार म ें धात ु संििू क, कीटनािक अविेि, सूक्ष्मिीव अपक्षे ाओं, फसल संििू कों, प्राकृजतक रूप स े पाए िान े वाल े जविैल े पिाथों के अवजिष्ट स्ट्तर स े सम्पबंजधत प्रजतबंधो तथा खाद्य सुरक्षा और मानक (संििू क, आजवि और अवजिष्ट) जवजनयम, 2011 तथा खाद्य सुरक्षा और मानक (खाद्य उत्पाि मानक और खाद्य सहयोज्य) जवजनयम, 2011 म ें यथा जवजनर्िष्टच अन्‍दय खाद्य सुरक्षा अपेक्षाओं अथवा घरेलू व्यापर के जलए खाद्य सुरक्षा और मानक अजधजनयम, 2006 (2006 का 34) के अधीन अजधसूजचत ककसी भी अन्‍दय जवजनयम का अनपु ालन ककया िाएगा। 10 (बी) वनस्ट्पजत तले के जनयाचत म ें कोडेक्स एजलमन्‍दे टेररयस आयोग द्वारा जनधाचररत भारी धातुओं, कीटनािको की अवजिष्ट सीमाओं और अन्‍दय खाद्य सुरक्षा मापिडं ों अथवा आयातकताच ििे की अपेक्षाओं का अनुपालन ककया िाएगा। 3. जनयम 11 के बाि जनम्नजलजखत को अतं ःस्ट्थाजपत ककया िाएगा :- 12. वनस्ट्पजत तले ों को खाद्य सुरक्षा और मानक (खाद्य पिाथो का फोर्टचकफकेिन) जवजनयम, 2018 म ें जनधाचररत पोिक तत्वों के स्ट्तर के अनुसार सूक्ष्मपोिक तत्व जवटाजमन ए और जवटाजमन डी स े समृद्ध (फोर्टचफाइड) ककया िा सकता ह।ै 13. वनस्ट्पजत तेल म ें खाद्य सरु क्षा और मानक (खाद्य उत्पाि मानक और खाद्य सहयोज्य) जवजनयम, 2011 के अंतगतच यथा जवजनर्िष्टच संकेंद्रण म ें अनुमेय एंटी-ओक्सीडेंट्स और खाद्य योिक हो सकत े ह।ैं 14. इन जनयमों के तहत सजम्पमजलत वनस्ट्पजत तेल, खाद्य सुरक्षा और मानक (खाद्य उत्पाि मानक और खाद्य सहयोज्य), जवजनयम 2011 के अनुसार तेलों की फैटी एजसड सरं चना का अनुपालन करेंगे। 4. मूल जनयम म ें सरसों के तले की अनुसूची-I को जनम्नजलजखत स े प्रजतस्ट्थाजपत ककया िाएगा:- " सरसों तेल का श्रणे ी अजभधान एव ं गणु वत्ता” 1. सरसों का तेल ब्राजसका कैंपेजस्ट्रस जलन (पीली और भूरी सरसों) या ब्रैजसका िुनेजिया जलन (लाही, राई या लाहा) या ब्रैजसका नैपस (रेपसीड या तोररया) के स्ट्वच्छ और ठोस बीिों या इन बीिों के जमश्रण स े जनष्किचण की प्रकिया द्वारा प्राि ककया िाएगा। जनष्कासन िवाब जवजध द्वारा प्राि तले , जवलायक जनष्कर्िचत तले ों और हक्े सेन अविेिों स े मुि होगा। 2. न्‍दयूनतम अपेक्षाए:ं (1) सरसों के तले म ेंजनम्नजलजखत जविेिताए ाँ होंगी - (क) जवजिष्ट और स्ट्वीकाय च स्ट्वाि एव ं गधं होगा; (ख) िब किल्टर ककए गए तेल का नमूना 30 जडग्री सेजल्सयस तापमान पर 24 घंटे के जलए रखा िाता ह ै तो यह साफ और गंिलापन स ेमुि होगा;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (ग) बासीपन, िगु ंध, जनलंजबत अथवा अघलु निील पिाथच अथवा अन्‍दय ककसी जविातीय पिाथ च स े मुि होगा; All objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period so specified will be taken into consideration by the Central Government. 3. Any person desirous of making any suggestion in respect of the said draft rules, may forward the same, within the period specified above, to the Agricultural Marketing Adviser to the Government of India, Directorate of Marketing and Inspection, Head Office, CGO Complex, NH - IV, Faridabad (Haryana) 121001, who shall forward the same to the Central Government for consideration. Draft Rules 1. Short title, application and commencement. - (1) These rules shall be called the Vegetable Oils Grading and Marking (amendment) Rules, 2023. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. For Rule 10 following shall be substituted.- “10 (A) Vegetable Oils for domestic trade, shall comply with the restrictions in regard to residual levels of metal contaminants, pesticides residues, microbial requirements, crop contaminants, naturally occurring toxic substances and other food safety requirements as specified under the Food Safety and Standards (Contaminants, Toxins and Residues) Regulations, 2011, Food Safety and Standards (Food Product Standards and Food Additives) Regulations, 2011, and other regulations made for domestic trade under the Food Safety and Standards Act, 2006 (34 of 2006). 10 (B) Vegetable Oils for export trade, shall comply with the residual limits of heavy metals, pesticides and other food safety requirements as laid down by the Codex Alimentarius Commission or importing countries requirement for export.”[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 3. After Rule 11 following shall be inserted.- “12. Vegetable Oils may be fortified with the micronutrients Vitamin A and Vitamin D at the level of nutrients prescribed in Food Safety and Standards (Fortification of Foods) Regulations, 2018. 13. Vegetable Oils may contain permitted anti-oxidants, food additives, in the concentration as specified under Food Safety and Standards (Food Products Standards and Food Additives), Regulations 2011. 14. The vegetable oils covered under these rules shall comply with the fatty acid composition of the oils as per Food Safety and Standards (Food Products Standards and Food Additives), Regulations 2011. 4. In Principal Rule the Schedule I of Mustard Oil, shall be replaced with the following.- “Grade designation and Quality of Mustard Oil 1. Mustard Oil shall be obtained by a process of expression of clean and sound mustard seed of Brassica campestris Linn (yellow and Brown sarson) or Brassica junecea Linn (Lahi, Rai or laha) or Brassica napus (rapeseed or toria) or admixture of these seeds. The oil obtained by expelled pressed method shall be free from solvent extracted oils and hexane residues. 2. Minimum Requirement: (1) Mustard Oil shall ,- (a) have characteristic and acceptable taste and flavor; (b) be clear and free from turbidity when a filtered sample of oil is kept for 24 hours at 30C ; (c) be free from rancidity, obnoxious smell, suspended or insoluble matter or any other foreign matter, (d) be free from separated water, sedimentations, added colouring matter and any other flavouring substances ; (e) be free from synthetic oil. (2). Mustard oil, if produced by solvent extraction shall be refined before it is supplied for human consumption and shall conform to the standards as laid down or made under Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011 and Hexane should be not more than 5 ppm. 3.
