[G.O. Ms. No. 51, Home, Prohibition and Excise (III), 7th September 2023, ஆவணி 21, ச�ோபகிருது, திருவள்ளுவர் ஆண்டு-2054.] No. II(1)/HOPE/30/2023.—In exercise of the powers conferred by rule 41 of the Tamil Nadu Brewery Rules, 1983, the Governor of Tamil Nadu, hereby exempts Thiruvalargal Mohan Breweries and Distilleries Limited, Chennai from the operation of rule 5(2) of the said Rules, to the extent it restricts the transferability of the licence and to accord prior approval to the Commissioner of Prohibition and Excise to transfer of privilege and endorsement of beer manufacturing Licence Number.1/1984-85 granted to Tvl.Mohan Breweries and Distilleries Limited under the said Rules in the name of Tvl.Transworld Breweries and Distilleries Private Limited (Transferee Company), in the same premises, subject to the condition that to furnish a licence obtained from the Food Safety and Standards Authority of India and Goods and Services Tax Number within a month from the date of receipt of the order of transfer of licence and also any other requirements ordered to be fulfilled by the Commissioner of Prohibition and Excise. PUBLIC DEPARTMENT (SC) Declaration of Premises of Gas Collecting Station and Sectionalising Value Station of Gas Authority of India Limited (GAIL), Kuthalam Village (Narimanam) and Thittacherry Village (Maraikkanchavadi), Nagapattinam District as “Prohibited Place’’ under the Official Secrets Act. [G.O. No. SS.II / 311-2/2022, Public (S.C.), 16th August 2023, ஆடி 31, ச�ோபகிருது, திருவள்ளுவர் ஆண்டு-2054.] No. II(1)/PU/31/2023.—WHEREAS, the Manager (F&S), Gas Authority of India Limited (GAIL) in his letter No. GAIL / CB / PDY /SEC / 15 / 2011, dated 17-02-2014, addressed to the Collector, Nagapattinam District, among other things has informed that the Gas Collecting Station located at Kuthalam Village (Narimanam), Survey No.26/2 to an extent of 0.70.0 Hectare and Sectionalising Valve station installed at Thittacherry Village (Maraikkanchavadi), Survey No.160/1B to an extent of 0.04.0 Hectare are Vital Installations for Gas Authority of India Limited and has requested to declare the above premises as "Prohibited Places" under the Official Secrets Act, 1923 (Central Act XIX of 1923); AND WHEREAS, based on the reports and recommendations of the District Revenue Officer and other Revenue officials, the Collector, Nagapattinam District in the letters Rc.No.13764/C3/2016, dated 13-05-2019, R.C.No. 13764/ C3/2016, dated 20.09.2019. has requested to issue necessary orders, for declaring the premises of Gas Collecting Station located at Kuthalam Village (Narimanam - Survey No.26/2) to an extent of 0.71.0 Hectare and Sectionalising Valve station installed at Thittacherry Village (Maraikkanchavadi SV Station - Survey No.160/1B2) to an extent of 0.04.0 Hectare, as prohibited places under the Official Secrets Act, 1923 (Central Act XIX of 1923); AND WHEREAS, the Inspector General of Police, Intelligence, Chennai in his letter SCA.3 No. 11766/C/2019, dated 23-11-2019 has also recommended to include the above premises as a Vital Installation and to declare the above installation as 'Prohibited Place'; AND WHEREAS, the Additional Director General of Police/Intelligence, Chennai, in his letter SCA.3 No. 11766-1/C/2019/C, dated 04-06-2022, has stated that the Superintendent of Police, Nagapattinam District has informed that the Gas Authority of India Limited (GAIL) has not initiated/taken up any new project for installation of Gas Pipelines in Kuthalam (Narimanam) and Thittacherry (Maraikkanchavadi) Villages of Nagapattinam District; AND WHEREAS, the Collector, Nagapattinam District, in his letter Rc.No.13764/2016/E3, dated 24-06-2022 has stated that the Joint Director of Agriculture and District Environmental Engineer (a/c), TN Pollution Control Board, Nagapattinam has informed that the above units of M/s.Gas Authority of India Limited located in Kuthalam and Thittachery are not involved in any manufacturing activity and only receiving the Natural gas from M/s.Oil and Natural Gas Corporation Limited and distributing to the various consumers and that the above said activity of the M/s.Gas Authority of India Limited and its installations will not come under theSep. 27, 2023] TAMIL NADU GOVERNMENT GAZETTE 105 purview of Tamil Nadu Protected Agricultural Zone Development Act, 2020 (Tamil Nadu Act 11 of 2020) and as per the Central Pollution Control Board Notification, 2016, the transportation of Oil and Gas pipeline falls under GREEN category. He has finally informed that no project mentioned in the second schedule of Tamil Nadu Protected Agricultural Zone Development Act, 2020 has been initiated in the over ground Minor Installations of gas pipelines of GAIL (India) Limited at Survey No.26/2 (0.71.0 Hectare at Kuthalam Village-Narimanam) and at Survey No.160/1B2 (0.04.0 Hectare at Thittacherry Village-Maraikkanchavadi), Nagapattinam district; AND WHEREAS, the reports/recommendations of the Collector, Nagapattinam District and Additional Director General of Police, Intelligence, Chennai were examined carefully and this Government has come to a conclusion that it is necessary to declare the premises of Gas Collecting Station and Sectionalising Valve Station of Gas Authority of India Limited (GAIL) at Kuthalam Village (Narimanam) and Thittacherry Village (Maraikkanchavadi), Nagapattinam District, as specified in the Schedule below, to be a "Prohibited Place" under sub-clauses (c) and (d) of clause (8) of section 2 of the Official Secrets Act, 1923 (Central Act XIX of 1923), on the ground that information with respect thereto, or the destruction or obstruction thereof, or interference therewith, would be useful to an enemy; AND WHEREAS, in pursuance of clause (1) of Article 258 of the Constitution of India, the Government of India, Ministry of Home Affairs, New Delhi, have, in its Notification No.S.O.1285, dated the 4th May 1963, published in the Gazette of India, dated the 11th May 1963, entrusted to the Government of Tamil Nadu the functions of the Central Government in relation to any matter specified in sub-clauses (c) and (d) of clause (8) of section 2 of the Official Secrets Act, 1923 (Central Act XIX of 1923).
