**Policy Analysis Report: Fertiliser Inorganic, Organic or Mixed Control Amendment Order, 2021**
**1. Executive Summary:**
This report analyzes the Fertiliser Inorganic, Organic or Mixed Control Amendment Order, 2021, which amends the Fertiliser Inorganic, Organic or Mixed Control Order, 1985. The amendment modifies deadlines related to compliance and application processes. The key changes involve extending the deadline for compliance mentioned in clause 20 c, subclause 5, and modifying the deadline for submitting applications in Form G3. These changes likely aim to provide stakeholders with additional time to meet regulatory requirements.
**2. Introduction:**
This report aims to provide an informative analysis of the Fertiliser Inorganic, Organic or Mixed Control Amendment Order, 2021, based solely on the text of the order as published in the Gazette of India. It identifies key changes and potential implications for affected parties in the fertilizer industry.
**3. Policy Overview:**
* This is an amendment to the Fertiliser Inorganic, Organic or Mixed Control Order, 1985.
* The core objective of the *amendment*, as inferred from the text, is to modify specific deadlines related to compliance and application processes within the existing regulatory framework for fertilizers.
**4. Background and Rationale:**
This amendment likely addresses concerns or requests from stakeholders regarding the feasibility of meeting the original deadlines. The extension of deadlines suggests that the initial timelines may have been perceived as too restrictive, potentially hindering compliance or creating administrative bottlenecks. The changes seem designed to allow businesses more time to comply with existing regulations or complete application procedures.
**5. Key Provisions / Changes:**
This section details the specific changes introduced by the amendment:
* **Change 1:** Amendment of Clause 20 c, subclause 5, of the Fertiliser Inorganic, Organic or Mixed Control Order, 1985.
* **Original Provision:** The original text in clause 20 c, subclause 5 stipulated a deadline of "within a period of six months from the date of publication of this order".
* **New Provision:** The amendment substitutes this with a specific date: "within 31st March, 2022".
* **Effect of Change:** This change replaces a relative deadline (six months from publication) with a fixed deadline (March 31, 2022), providing a clear and specific timeframe for compliance.
* **Change 2:** Amendment of Form G3.
* **Original Provision:** The original text in Form G3 contained the placeholder "upto ........day of August, 2022".
* **New Provision:** The amendment substitutes this with "upto 22nd day of February, 2023".
* **Effect of Change:** This change extends the application submission deadline in Form G3 from August 2022 to February 2023.
**6. Target Audience and Stakeholders:**
Based on the text, the primary target audience includes:
* Fertilizer manufacturers and distributors, who must comply with the regulations outlined in the Fertiliser Inorganic, Organic or Mixed Control Order, 1985.
* Entities submitting applications using Form G3, likely related to permits, licenses, or other regulatory approvals within the fertilizer sector.
* The Department of Agriculture, Cooperation and Farmers Welfare, responsible for administering and enforcing the order.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency:** The Department of Agriculture, Cooperation and Farmers Welfare is the responsible agency, as evidenced by the order being issued by the Ministry of Agriculture and Farmers Welfare.
* **Timelines:** The amendment specifies two key timelines:
* Compliance with clause 20 c, subclause 5, must be achieved by March 31, 2022.
* Applications using Form G3 must be submitted by February 22, 2023.
* The amendment comes into force on the date of its publication in the Official Gazette (June 15, 2021).
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcomes of these changes include:
* Increased compliance rates due to the extended deadline for meeting the requirements of clause 20 c, subclause 5.
* Reduced administrative burden on both regulators and regulated entities by providing more realistic timeframes for compliance and application processing.
* Smoother operation of the regulatory framework governing the fertilizer industry.
* The amendment provides more time, potentially to overcome supply chain difficulties and other such issues that might affect the manufacturers and distributors.
**9. Conclusion:**
The Fertiliser Inorganic, Organic or Mixed Control Amendment Order, 2021, introduces targeted modifications to deadlines within the existing regulatory framework for fertilizers. By extending the compliance deadline in clause 20 c, subclause 5, and the application deadline in Form G3, the amendment likely aims to facilitate smoother implementation and improve compliance rates within the fertilizer industry. These changes demonstrate an adaptive approach to regulation, responding to the practical challenges faced by stakeholders.
