1. सजं िप्त नाम और प्रारंभ – (1) इन जनयमों का संजिप्त नाम जविेष आर्थिक िोन (चौथा संिोधन) जनयम, 2026 ह।ै

(2) य ेरािपत्र में प्रकािन की जतजथ को प्रवृत्त होंगे।

2. जविेष आर्थिक िोन जनयम, 2006 (जिसे इसके बाि उि जनयम कहा गया ह)ै में जनयम 18 के उप-जनयम (2) में खंड (ii) के बाि जनम्नजलजखत खडं अंत: स्ट्थाजपत दकए िाएगं े, अथाित्:- “(ii क) दकसी अंतरािष्ट्रीय जवत्तीय सेवा केंद्र में स्ट्थाजपत कोष के प्रयोिन से जवकासकताि द्वारा जनजध प्रबंधन इकाई के जलए जलजखत रूप म ेंपुजि दकए गए स्ट्थान के अनंजतम प्रस्ट्ताव को स्ट्थान का अनंजतम प्रस्ट्ताव माना िाएगा। स्ट्पिीकरण 1. - इस खंड, (ii ख) और जनयम 22 के उप-जनयम (3) के परंतुक के प्रयोिन के जलए अजभव्यजि "जनजध प्रबंधन इकाई (एफएमई)" और "कोष" के क्रमि: वही अथ िहोंग ेंिो उन्ह ेंअतं रािष्ट्रीय जवत्तीय सेवा केंद्र प्राजधकरण जवजनयम, 2025 के जवजनयम 2 के खंड (ढ) और (छछ) में प्रित्त ह।ैं 7949 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] स्ट्पिीकरण 2.- इस खंड (ii ख) और जनयम 19 के उप-जनयम (4) और उप-जनयम (6 ख) के परंतुक, जनयम 21 ख के उप-जनयम (1) और जनयम 22 के उप-जनयम (3) के परंतुक के प्रयोिन के जलए, अजभव्यजि "अंतराष्ट्रि ीय जवत्तीय सेवा केंद्र" का वही अथ ि होगा िो अतं रािष्ट्रीय जवत्तीय सेवा केंद्र प्राजधकरण अजधजनयम, 2019 (2019 का 50) की धारा 3 के खडं (छ) और उसके अधीन बनाए गए जनयमों या जवजनयमों में प्रित्त ह।ै (ii ख) दकसी अंतरािष्ट्रीय जवत्तीय सेवा केंद्र में स्ट्थाजपत कोष के जलए, उि कोष की जनजध प्रबंधन इकाई द्वारा जनष्पादित पट्टा जवलेख को उि कोष का पट्टा जवलेख माना िाएगा।

3. उि जनयमावली म,ें जनयम 19 म,ें -

(i) उप-जनयम (4) में तीसरे परंतुक के बाि, जनम्नजलजखत परंतुक अतं : स्ट्थाजपत दकया िाएगा, अथाित्:- “परंत,ु यह और भी दक अंतराष्ट्रि ीय जवत्तीय सेवा केंद्र में स्ट्थाजपत दकसी इकाई के जलए, अंतरािष्ट्रीय जवत्तीय सेवा केंद्र प्राजधकरण द्वारा अंजतम रूप में पहली बार िी गई मान्यता, पिं ीकरण, लाइसेंस या प्राजधकार (चाह े दकसी भी नाम से ज्ञात हो) को सेवा गजतजवजध का प्रारंभ माना िाएगा और प्रारंभ की तारीख वही होगी जिस तारीख को ऐसी मान्यता, पंिीकरण, लाइसेंस या प्राजधकार दिया गया ह।ै परंत ु यह भी दक चौथ े परंतुक के तहत जनधािररत प्रारंभ जतजथ वही रहगे ी, भल े ही अंतरािष्ट्रीय जवत्तीय सेवा केंद्र प्राजधकरण द्वारा िारी मान्यता, पंिीकरण, लाइसेंस या प्राजधकार, जिसके आधार पर इकाई की िुरुआत अवधाररत की गई थी, वह अब मान्य नहीं रही।”

(ii) उप जनयम (6ख) में जनम्नजलजखत परंतुक अंतःस्ट्थाजपत दकया िाएगा, अथाित:् - “परंत ु यह दकसी अंतरािष्ट्रीय जवत्तीय सेवा केंद्र में स्ट्थाजपत दकसी इकाई के जलए, अनुमोिन पत्र के नवीनीकरण का जनणिय अंतराष्ट्रि ीय जवत्तीय सेवा केंद्र प्राजधकरण की जसफाररिों के आधार पर जनम्नजलजखत मानिंडों पर दकया िाएगा, अथाित:् -

(i) सृजित रोिगार;

(ii) इकाई के कामकाि से िुड ेलाग ूकानूनों के उल्लंघन का मामला; और

(iii) वैधाजनक भुगतानों में चूक के मामले, यदि कोई हो।"

4. उि जनयमों म,ें जनयम 21ख के स्ट्थान पर जनम्नजलजखत जनयम प्रजतस्ट्थाजपत दकया िाएगा, अथाति ्: – " 21ख. वाययु ान या पोत पट्टे पर िेन ेसबं धं ी दक्रयाकलापों स ेिडु ी इकाइयां– (1) अंतरािष्ट्रीय जवत्तीय सेवा केंद्र में एक इकाई, िो वायुयान या िहाि पट्टे पर िेने का कायि करने के जलए अजधकृत ह ैअथवा कोई व्यजि िो वायुयान या िहाि पट्टे पर िेने का कायि करने के जलए एक अतं रािष्ट्रीय जवत्तीय सेवा केंद्र में एक इकाई स्ट्थाजपत करने का प्रयोिन रखता है, यदि अंतराष्ट्रि ीय जवत्तीय सेवा केंद्र प्राजधकरण द्वारा अनुमजत िी िाती ह ैतो उसे एक अलग कायािलय बनाए रखने की आव‍यकता नहीं होगी,वह कायािलय स्ट्थान या िनिजि अथवा िोनों का उपयोग दकसी अन्य इकाई का कर सकता है, िो वायुयान या िहाि पट्टे पर िेने के दक्रयाकलाप या रस्ट्ट और कंपनी सेवा प्रिाता कायिकलाप करने के जलए अजधकृत हो, िैसा दक अंतरािष्ट्रीय जवत्तीय सेवा केंद्र प्राजधकरण द्वारा अनुमोदित दकया गया हो:

परंतु कायािलय स्ट्थान या िनिजि या िोनों का उपयोग केवल रस्ट्ट और कंपनी सेवा प्रिाता के साथ ही अनुमत होगा, िो इस उप-जनयम के तहत अनुमत व्यजि को अपनी सेवाएं प्रिान कर रहा ह ैया प्रिान करन े का प्रयोिन रखता ह।ै

(2) उप-जनयम (1) के तहत अनुमत व्यजि को स्ट्थान और पट्टा जवलेख के एक अलग अनंजतम प्रस्ट्ताव की आव‍यकता नहीं होगी, और इस तरह उस इकाई के स्ट्थान और पट्टा जवलेख का अनंजतम प्रस्ट्ताव जिसके साथ कायािलय स्ट्थान साझा दकया िा रहा ह,ै जनयम 18 के प्रयोिनों के जलए पयािप्त होगा।”

5. उि जनयमों के जनयम 22 म,ें उप-जनयम (3) के पश्चात् जनम्नजलजखत परंतुक अतं ःस्ट्थाजपत दकया िाएगा, अथाित्:- “परंत ुइस उप-जनयम में जनजहत कुछ भी अंतरराष्ट्रीय जवत्तीय सेवा केंद्र में स्ट्थाजपत दकसी कोष पर लागू नहीं होगा।” [फा. सं. .के-43022/73/2023-एसईिेड] जवमल आनंि, संयुि सजचव[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 नोट: – मलू जनयम भारत के रािपत्र, असाधारण, भाग-II, खंड 3, उप-खडं (i) म ेंअजधसूचना संख्या सा.का. जन.54 (अ), दिनांक 10 फरवरी, 2006, के द्वारा माध्यम से प्रकाजित दकए गए थे और अंजतम बार अजधसचू ना संख्या सा.का.जन……..

NOTIFICATION New Delhi, the 15th October, 2026 G.S.R. 895(E).— In exercise of the powers conferred by section 55 of the Special Economic Zones Act, 2005 (28 of 2005), the Central Government hereby makes the following rules further to amend the Special Economic Zones Rules, 2006, namely: –

1. Short title and commencement. – (1) These rules may be called the Special Economic Zones (Fourth Amendment) Rules, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Special Economic Zones Rules, 2006 (hereinafter referred to as the said rules), in rule 18, in sub-rule (2), after clause (ii), the following clauses shall be inserted, namely: - “(ii a) For the purpose of a fund setup in any International Financial Service Centre, the provisional offer of space confirmed by the Developer in writing for the fund management entity shall be considered as the provisional offer of space.

Explanation 1.– For the purpose of this clause, (ii b) and proviso to sub-rule (3) of rule 22, the expressions “fund management entity (FME)” and "fund" shall have the same meanings as respectively assigned to them in clauses (n) and (gg) of regulation 2 of the International Financial Services Centres Authority Regulations, 2025.

Explanation 2.– For the purpose of this clause, (ii b) and proviso to sub-rule (4) and sub-rule (6B) of rule 19, sub-rule (1) of rule 21B and proviso to sub-rule (3) of rule 22, the expression “International Financial Service Centre” shall have the same meaning as assigned to it in clause (g) of section 3 of the International Financial Services Centres Authority Act, 2019 (50 of 2019) and rules or regulations made thereunder.

(ii b) For a fund setup in any International Financial Service Centre, the Lease Deed executed by the fund management entity of the said fund shall be considered as Lease Deed of the said fund.”.

3. In the said rules, in rule 19, –

(i) in sub-rule (4) after third proviso, the following proviso shall be inserted, namely: – “Provided also that for a Unit set up in an International Financial Service Centre, grant of the first recognition, registration, license or authorisation, by whatever name called, in its final form, by the International Financial Services Centres Authority, shall be considered as commencement of service activity and the date of commencement shall be the date of grant of such recognition, registration, license or authorisation:

Provided also that the date of commencement determined under the fourth proviso shall be the same even if the recognition, registration, license or authorisation issued by the International4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Financial Services Centres Authority based on which the commencement of the Unit was so determined, ceases to be valid.”;

(ii) in sub-rule (6B), the following proviso shall be inserted, namely: – “Provided that for a Unit set up in an International Financial Service Centre, the renewal of Letter of Approval shall be decided based on the recommendations of the International Financial Services Centres Authority on the following criteria, namely: –

(i) employment generated;

(ii) instance of violation of applicable statutes related to the functioning of the Unit; and

(iii) cases of default, if any, of statutory payments.”.

4. In the said rules, for rule 21B, the following rule shall be substituted, namely: – "21B. Units dealing with aircraft or ship leasing activities. – (1) A Unit in an International Financial Services Centre, authorised to undertake aircraft or ship leasing or a person intending to setup a Unit in an International Financial Services Centre to undertake aircraft or ship leasing activity, if allowed by the International Financial Services Centre Authority not to maintain separate office, may utilize office space or manpower or both, of another Unit authorised to undertake aircraft or ship leasing activity or Trust and Company Service Provider activity, as may be approved by the

International Financial Services Centre Authority:

Provided that utilisation of office space or manpower or both shall be allowed only with Trust and Company Service Provider, which is providing or intending to provide their services to the person allowed under this sub-rule.

(2) A person allowed under the sub-rule (1) shall not require a separate provisional offer of space and lease deed, and as such the provisional offer of space and lease deed of the Unit with which office space is being shared shall suffice for the purposes of rule 18.".

5. In the said rules, in rule 22 after sub-rule (3), the following proviso shall be inserted, namely: – “Provided that nothing contained in this sub-rule shall apply to a fund setup in an International Financial Service Centre.’’.
