जिसे पंिीकरण सजमजत को भेि किया गया था। पंिीकरण सजमजत ने केंद्र सरकार को अपनी जसफाररिें प्रस्ट् तुत की ह;ैं और िबकक, जवभाग न े पंिीकरण सजमजत की जसफाररिों के कायावन्वयन से संबंजधत अनुमोिन की सूचना िते े हुए किनांक 14 अक्िूबर, 2016 को आििे िारी ककया था; और िबकक, उक्त जविेिज्ञ सजमजत न े इस अजधसूचना की अनुसूची म ें जवजनर्िष्टव सत्ताईस कीिनािकों के उपयोग को िारी रखन े की जसफाररि की थी और संस्ट् तुत अययययन परू ा होने के बाि उसकी समीक्षा की िानी थी तब ीसी जस्ट् थजत म ें पंिीकरण सजमजत द्वारा जवचार ककया गया और जसफाररिें सरकार को प्रस्ट्तुत कीं गईं ; और िबकक, केंद्र सरकार न े पंिीकरण सजमजत से परामि व करने और संस्ट्त ुत अययययन, डेिा और सुरक्षामिो को प्रस्ट्तुत करन े की जस्ट्थजत से संबजं धत में अपनी ररपोिव पर जवजधवत जवचार करने के बाि इस आिय के साथ संतोि व् यक्त 985 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ककया ह ै कक इस अजधसूचना की अनुसूची म ें जवजनर्िष्टव सत्ताईस कीिनािकों के उपयोग से मानवों और पिुओं म ें िोजखम उत् पन् न हो सकता ह।ै इसजलए इस संबंध में तत्काल कारववाई करने हते ु अपेजक्षत अथवा आवश् यक कायववाही की िाए; और िबकक, केंद्र सरकार, कीिनािक अजधजनयम, 1968 (1968 का 46) की धारा 27 की उप-धारा (2) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए भारत के रािपत्र, असाधारण, भाग-II, खंड-3, उपखंड (ii) में किनांक 18 मई, 2020 की अजधसूचना संख्या का.आ 1512(अ) के मायय यम से कीिनािकों पर प्रजतबंध लगाने संबंधी आिेि, 2020 का मसौिा आिेि प्रकाजित ककया और और उन सभी व्यजक्तयों से आपजत्तयां और सुझाव आमंजत्रत ककए जिनके प्रभाजवत होने की संभावना है, उस तारीख से पैंतालीस किनों की अवजध समाप्त होने से पहले, जिस पर आजधकाररक रािपत्र की प्रजतयां जिसमें उक्त अजधसूचना प्रकाजित की गई थी, िनता के जलए उपलब्ध कराई गई थी ; और िबकक, उक्त रािपत्र अजधसूचना की प्रजतयां िनता किनाकं 18 मई, 2020 को को उपलब्ध करा िी गई थीं; और उक्त प्रारूप आिेि के संबंध में प्राप्त आपजत्तयों या सुझावों को इस प्रयोिन के जलए गरठत एक जविेिज्ञ सजमजत को संिर्भवत ककया गया था जिस पर उक्त जविेिज्ञ सजमजत द्वारा जवजधवत जवचार ककया गया था; और िबकक, केंद्र सरकार न,े जविेिज्ञ सजमजत की ररपोिव पर जवचार करन े के बाि और कीिनािक अजधजनयम, 1968 (1968 का 46) के तहत गरठत पंिीकरण सजमजत के साथ परामि व के बाि संतोि व् यक्त ककया कक सुरक्षा और प्रभावकाररता पर डेिा की अनपु लब्धता के कारण तीन कीिनािकों के उपयोग म ें मानवों और पिओंु के स्ट्वास्ट््य के जलए खतरा और िोजखम िाजमल ह;ै और िबकक, कीिनािक जनजिद्ध आिेि, 2020 के जलए उक्त मसौिा आिेि किनांक 18 मई, 2020 की अजधसूचना संख्या का.आ. 1512(अ) द्वारा प्रकाजित, को िेि के जवजभन्न उच्च न्यायालयों में चनु ौती िी गई थी। माननीय उच्च न्यायालय, रािस्ट्थान न े मामल े म ें अगले आिेि तक कीिनािकों के जनिधे स े संबंजधत अंतररम आिेि किनांक 21.07.2020 द्वारा उक्त जनयमों के कायावन्वयन पर रोक लगा िी थी। और िबकक, तिपु रांत, रािस्ट्थान के माननीय उच्च न्यायालय ने नारायण ससंह राठौर द्वारा िायर जसजवल ररि याजचका संख्या 7474/2020 के मामले म ें किनांक 18.01.2023 के एक आिेि के मायययम से जनिेि िारी ककया ह ै कक किनांक 21.07.2020 का अंतररम आिेि जनष्‍पप्र भाव ककया िाता ह।ै अब, इसजलए, वह मसौिा आिेि जिस े केंद्र सरकार कीिनािक अजधजनयम 1968 की धारा 36 की उपधारा (1) और धारा 28 के साथ परठत धारा 27 की उपधारा-।। द्वारा प्रित्त िजक्तयों का, जिसे केंद्र सरकार द्वारा प्रस्ट्ताजवत ककया गया ह,ै का प्रयोग करत े हुए संभाजवत रूप से प्रभाजवत सभी व्यजक्तयों के सूचनाथ व इसे एतद्वारा प्रकाजित करन े के साथ-साथ तिनुरूप इस आिय का नोरिस किया िाता ह ैकक इस ताररख से जिस पर इस आिेि में जनजहत भारत के रािपत्र की प्रजतया ं सावविजनक रूप स े उपलब्ध कराई गईं ह,ैं 30 किनों की अवजध के समापन के बाि उक्त समौिा आिेि पर जवचार ककया िाएगा। 30 किनों की उपरोक्त अवजध के समापन से पहल े उक्त मसौिे के संबंध म ें ककसी भी व्यजक्त से प्राप्त ककसी आपजत्त अथवा सुझाव पर केंद्र सरकार द्वारा जवचार ककया िाएगा। उक्त मसौिा आििे के संबंध में ककसी भी आपजत्त अथवा सझु ाव को संयुक्त सजचव (पािप संरक्षण), कृजि एवं ककसान कल्याण मंत्रालय, कृजि एवं ककसान कल्याण जवभाग, कृजि भवन नई किल्ली-110001 को या jspp-dac@gov.in पर ई-मेल के मायययम से अग्रेजित ककया िा सकता ह।ै ड्राफ्ि आििे 1. सजं क्षप्त िीिकव और प्रारंभ - (1) इस आििे को कीिनािक (जनिधे ) आििे , 2023 कहा िा सकता ह;ै (2) यह रािपत्र म ें अपन े अजं तम प्रकािन की तारीख स े लाग ू होगें। 2. कजतपय कीिनािकों पर जनिधे - क. कोई भी व्यजक्त अनसु चू ी में किए गए कीिनािकों का आयात, जनमाणव , जबिी, पररवहन, जवतरण और उपयोग नहीं करेगा। ख. पंिीकरण सजमजत उक्त अनसु ूची म ें जवजनर्िष्टव कीिनािकों के जलए प्रित्त्त पंिीकरण प्रमाणपत्र को वापस ल े लेगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 ग. यकि कोई व्यजक्त जिसके पास पंिीकरण प्रमाणन है, वह पंिीकरण सजमजत को प्रमाणपत्र वाजपस करने में असमथव रहता ह ै तो तीन माह की अवजध के भीतर खंड (2) में किए गए जववरण के अनसु ार उक्त अजधजनयम म ें जनजहत प्रावधानों के तहत कारववाई की िाएगी। घ. उक्त अजधजनयम की धारा 9 के तहत प्रित्त अनसु ूची म ें ककए गए जवजनििे के अनसु ार कीिनािकों स े सबं ंजधत पंिीकरण का प्रमाणपत्र को इस आििे की प्रकािन की तारीख स े जनरस्ट्त माना िाएगा। ङ. ड. राज्य सरकार उक्त अजधजनयम और उसस े संबजं धत जनयमावली के उपबंधों के तहत ीसे किम उठाएगी, िो सबं ंजधत राज्यों द्वारा इस आििे के जनष्‍पपािन के जलए आवश्यक समझे। अनसु चू ी [परै ाग्राफ 2 िखे ]ें प्रजतबजं धत कीिनािकों की सचू ी ि.स.ं कीिनािक का केंद्र सरकार का जनणवय नाम (1) (2) (3) 1. जडकोफोल इस आििे के प्रकािन की तारीख स े पंिीकरण, आयात, जवजनमाणव , जनमाणव , पररवहन, जबिी प्रजतबंजधत ह ै और इसके उपयोग पर पूरी तरह स े प्रजतबधं लगा किया गया है। 2. जडनोकैप इस आििे के प्रकािन की तारीख स े पिं ीकरण, आयात, जवजनमावण, जनमाणव , पररवहन, जबिी प्रजतबजं धत है और इसके उपयोग पर पूरी तरह से प्रजतबंध लगा किया गया है। 3. मेथोजमल इस आििे के प्रकािन की तारीख से पंिीकरण, आयात, जवजनमाणव , जनमाणव , पररवहन, जबिी प्रजतबंजधत ह ै और इसके उपयोग पर पूरी तरह स े प्रजतबधं लगा किया गया है। 3. इसके आग,े केंद्र सरकार न,े जविेिज्ञ सजमजत की जसफाररि पर, अजधजनयम की धारा 27 की उप-धारा (2) द्वारा प्रित्त िजक्त का प्रयोग करते हुए, नीचे िी गई ताजलका के कॉलम (2) में उजल्लजखत जनम्नजलजखत कीिनािकों के लेबल और पत्रक से नीचे िी गई ताजलका के कॉलम (3) म ेंउजल्लजखत फसलों को हिाने का जनणवय जलया है, नामत: (क) प्रत्येक कीिनािी के सामने उजल्लजखत फसलों के जलए जनम्नजलजखत कीिनािकों के लबे ल िावे को इस आििे के प्रकािन की जतजथ स े प्रभावी िैव-प्रभावकाररता और अवजिष्‍प ि डेिा की अनपु लब्धता के कारण अनुमोकित उपयोग स े हिा किया िाएगा: ताजलका ि.स.ं कीिनािक का अनमु ोकित उपयोग से हिाई िान े वाली फसलों के नाम नाम (1) (2) (3) 1 काबोफ्यरू ान िॉप लेबल के साथ काबोफ्यरू ान के तीन प्रजतित एनकैप्सुलिे ेड ग्रन्े युल (सीिी) को िोड़कर काबोफ्यरू ान के अन्य सभी फॉमलूव ेिन का उपयोग रोका िा सकता है। 2 मालाथयॉन ज्वार, मिर, सोयाबीन, अरंडी, सरू िमुखी, सभंडी, बगैं न, फूलगोभी, मूली, िलिम, िमािर, सेब, आम और अगं रू । 3 मोनोिोिोफोस मोनोिोिोफॉस पद्रं ह प्रजतित पानी में घुलनिील ग्रन्े युल (एसिी) को िोड़कर इस कीिनािक के अन्य सभी फॉमूवलिे न को सबं ंजधत लबे ल फसलों में उपयोग से रोका िा सकता है।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 4 क्यनू लफोस िूि, इलायची और ज्वार. 5 मैनकोिबे अमरूि, ज्वार और िैजपओका। 6 अक्सीफलोरफे आलू और मगूं फली. न 7 जडमथे ोि कच्च े खाद्य पिाथों के रूप में उपयोग ककए िाने वाल े फलों और सजब्ियों को हिान े का लबे ल । 8 क् लोरप्य ररफोस बेर, साइरस और तंबाकू. (ख) उपरोक्त उजल्लजखत कीिनािकों के संबंध म ें पंिीकरण का प्रमाण पत्र प्राप्त करन े वाल े सभी पंिीयक इस आिेि के प्रकािन की तारीख स े िह महीने के भीतर, जिसके जवफल होने पर कीिनािक अजधजनयम, 1968 की धारा 14 के तहत लाइसेंस रद्द करने की कारववाई िरूु की िाएगी, सजचव, केंद्रीय कीिनािक बोडव और पिं ीकरण सजमजत, एनएच-IV फरीिाबाि,को उपयुवक्त फसलों पर लेबल िावों को हिाने के जलए लेबल और पत्रक के साथ अपना प्रमाण पत्र प्रस्ट्ततु करेंग े । (ग) पंिीकरण के प्रमाण पत्र में गरै -पृष्ांकन या सुधार को इस आििे के प्रावधानों के उल्लघं न म ें पंिीकरण के ीस े प्रमाणपत्रों पर संचालन की अनमु जत या अनुमोिन के रूप में नहीं जलया िाएगा। (घ) जनयत तारीख तक पंिीकरण का प्रमाण पत्र प्रस्ट्ततु नहीं ककया गया ह,ै इसे रद्द कर किया गया माना िाएगा। (ड़) राज्य सरकार अपने संबंजधत राज्यों में इस तरह के किम उठाएगी िो इस आिेि के प्रावधानों को पूरा करने के जलए उपयुक्त हो सकत े ह।ैं [फा. स.ं 13035-15/2019-पीपी-I (वॉल्यूम i)] आिीि कुमार श्रीवास्ट्तव सयं क्तु सजचव (पीपी) MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture and Farmers Welfare) NOTIFICATION New Delhi, the 2nd February, 2023 S.O. 701(E).—Whereas, the Central Government in the erstwhile Ministry of Agriculture, Department of Agriculture and Cooperation constituted an Expert Committee on 8th July, 2013 to examine the continued use or otherwise of neo-nicotinoid insecticides registered in India. The mandate of the Committee was further expanded on 19th August, 2013, to review sixty-six insecticides which were banned or restricted or withdrawn in other countries but continue to be registered for domestic use in India. The Committee after detailed examination submitted its report to the Central Government on the 9th December, 2015; which was referred to the Registration Committee. The Registration Committee submitted their recommendations to the Central Government; And whereas, the Department issued order dated 14th October 2016, conveying the approval for implementation of the recommendations of the Registration Committee; And whereas, the said Expert Committee had recommended continuing the use of the twenty seven insecticides as specified in the schedule to this notification and the same to be reviewed after completion of the recommended studies, this was considered by Registration Committee and submitted recommendations to the Government; And whereas, the Central Government, after consultation with the Registration Committee and duly considering their report with regard to status of submission of recommended studies, data and safety concerns, was satisfied that the use of twenty seven insecticides as specified in the schedule to this Notification are likely to involve risk to human beings and animals as to render it expedient or necessary to take immediate action; And whereas, the Central Government, in exercise of the powers conferred by sub-section (2) of section 27 of the Insecticides Act, 1968 (46 of 1968) published a draft Order for Banning of Insecticides vide notification number S.O. 1512(E), dated 18th May, 2020, in the Gazette of India, Extraordinary, Part-II, section-3, sub-section (ii)[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 and invited objections and suggestions from all persons likely to be affected thereby, before the expiry of the period of forty-five days from the date on which the copies of the Official Gazette in which the said notification was published were made available to the public; And whereas, copies of the said Gazette notification were made available to the public on the 18th May, 2020; And whereas, the objections or suggestions received in respect of the said draft order were referred to an Expert Committee constituted for the purpose which were duly considered by the said Expert Committee; And whereas, the Central Government, after considering the report of the Expert Committee and after consultation with the Registration Committee, set up under the Insecticides Act, 1968 (46 of 1968), is satisfied that the use of three insecticides involves health hazards and risk to human beings and animals due to non-availability of data on safety and efficacy; And whereas, the said draft order for Banning of Insecticides Order, 2020 published vide notification number S.O. 1512(E), dated 18th May, 2020, was challenged in various High Courts of the country. The Hon’ble High court of Rajasthan had stayed the implementation of the said rules vide interim order dated 21.07.2020 relating to Prohibition of Insecticides till further order in the case. And whereas, thereafter, Hon’ble High Court of Rajasthan, has issued direction through an order dated 18.01.2023 in the matter of S.B. Civil Writ Petition No. 7474/2020 filed by Narayan Singh Rathore, that the interim order dated 21.07.2020 is vacated. Now therefore, the draft order, which the Central Government proposes to make, in exercise of the powers conferred by sub-section 2 of Section 27 read with section 28 and sub-section (1) of section 36 of the Insecticides Act, 1968 is hereby published for information of all persons likely to be affected thereby and notice is hereby given that the said draft order shall be taken into consideration after the expiry of a period of thirty days from the date on which the copies of the Gazette of India containing this order are made available to the public; Any objection or suggestion which may be received from any person in respect of the said draft Order before the expiry of the aforesaid period of thirty days will be considered by the Central Government. Any objection or suggestion in respect to the said draft order may be forwarded to the Joint Secretary (Plant Protection), Ministry of Agriculture and Farmers Welfare, Department of Agriculture and Farmers Welfare, Krishi Bhawan, New Delhi-110 001 or through email at jspp-dac@gov.in. DRAFT ORDER 1. Short title and commencement. - (1) This order may be called the Insecticides (Prohibition) Order, 2023; (2) It shall come into force on the date of its final publication in the Official Gazette. 2. Prohibition of Certain Insecticides- A. No person shall import, manufacture, sell, transport, distribute and use insecticides as provided in the Schedule. B. The Registration Committee shall call back the certificate of registration granted for the insecticides as provided in the said Schedule. C. If any person who holds the certificate of registration fails to return the certificate to the Registration Committee, referred to in clause (2), within a period of three months, action shall be taken under the provisions contained in the said Act. D. The certificate of registration for the insecticides as provided in the Schedule granted under section 9 of the said Act shall be deemed to be cancelled from the date of publication of this order. E. The State Government shall take all such steps under the provisions of the said Act and the rules framed thereunder, as it considers necessary for the execution of this order by the respective states. Further, the Central Government, on recommendations of the Expert Committee, in exercise of the power conferred by sub-section (2) of section 27 of the Act, has decided for omitting crops as mentioned in column (3) of the table below from the label and leaflets of the following insecticides mentioned in column (2) of the table below, namely: (A) Label claim of the following insecticides for the crops mentioned against each insecticide shall be omitted from the approved use due to non-availability of bio-efficacy and residue data with effect from the date of publication of this order: TABLE S. No. Name of Names of crops to be omitted from approved usage Insecticide (1) (2) (3) 1 Carbofuran All other formulations of Carbofuran except Carbofuran three percent Encapsulated granule (CG) along with the crop labels may be stopped from use. 2 Malathion Sorghum, Pea, Soybean, Castor, Sunflower, Bhindi, Brinjal, Cauliflower, Radish, Turnip, Tomato, Apple, Mango and Grape. 3 Monocrotophos All other formulations of this pesticide except Monocrotophos fifteen percent Water soluble granules (SG) may be stopped from use in respective label crops. 4 Quinalphos Jute, Cardamom and Sorghum. 5 Mancozeb Guava, Jowar and Tapioca. 6 Oxyfluorfen Potato and Groundnut. 7 Dimethoate Label deletion of fruits and vegetables that are consumed as raw food items. 8 Chlorpyriphos Ber, Citrus and Tobacco. (B) All registrants granted certificate of registration in respect of the above mentioned insecticides shall submit their certificate along with label and leaflet for deletion of label claims on the above mentioned crops to the Secretary, Central Insecticides Board and registration Committee, NH-IV, Faridabad, within six months from date of publication of this Order, failing which action to revoke licenses under section 14 of the Insecticides Act, 1968 shall be initiated. (C) Non-endorsement or correction in the certificate of registration will not be taken as permission or approval to operate upon such certificates of registration in contravention of the provisions of this Order. (D) Certificate of registration not submitted by the due date shall be deemed to have been cancelled. (E) The State Government shall take such steps in their respective States as they may deem fit for carrying out the provisions of this order. [F.
