Proc.No.C4/11020/2008 dated.25.03.2011 of Director of Treasuries and Accounts, A.P. Hyderabad 2.Appeal petition of Smt G.Vasundhara, Asst. Treasury Officer, Treasury & Accounts Services(discharged from service) dated.19.04.2011 addressed to Principal Secretary to Govt. (FP) 3. Govt. Memo No. 933/90/A2/Admn.I/2011, Dated:12 -05-2011. 4. Lr.No.C4/11020/2008 dated.04.11.2011 of DTA. *** ORDER: In the reference 1st read above, the Director of Treasuries and Accounts, A.P. Hyderabad has stated that Smt G.Vasundhara, Asst. Accounts Officer, Treasuries and Accounts Department has failed to fulfill the conditions required for successful completion of probation in the category of Asst. Accounts Officer/Asst. Treasury Officer of Treasuries and Accounts (Gaz.) Services and the individual has been issued a notice proposing to discharge form service in terms of sub rule (c) and (e) of Rules 16 read with clause (ii) of Sub Rule (a) of Rule 17 of A.P. State and Subordinate Services Rule 1996 vide Proc. No. No.C4/11020/2007 dated.12.10.2010. Finally the Director of Treasuries and Accounts, A.P. Hyderabad has decided to terminate the services of the individual and discharged her with immediate effect. 2. In the reference 2nd read above, the individual has furnished grounds for her plea as sub Rule (c) and (e) under Rule 16 of General rules for the State and Subordinate Services is not relevant to the issue for the simple reason that she passed all the Departmental tests within the period of two years and proceeded on leave with prior permission to leave the country and with prior sanction of leave. Sub rule (ii) under Rule 17 of A.P. State and Sub-ordinate service Rues, 1996 is also not relevant as she was not served with any notice for unsatisfactory service. There is no need to extend the probation also as she passed the departmental tests on time. As she did not complete the period of probation within a continuous period of three years from the date of commencement of her probation , she is required to complete the period of her probation in second spell i.e. from the date of joining into service after expiry of leave or from the date of joining duty before the expiry of her leave. She would not be considered for promotion till she completes her probation and till she puts in three years of service as per the Rule 8 of State and Subordinate service Rules. Finally, the individual has requested to set aside the orders of Director of Treasuries and Accounts, A.P. Hyderabad and reinstate her as she furnished certain grounds for her request to reinstate her into service i.e. she has passed all the Departmental tests within the probation period, she has been exempted from passing of Telugu Language Test as she completed her academic studies in Telugu Medium and she has not received any notice for unsatisfactory service. 3. In the reference 3rd read above, the Director of Treasuries and Accounts, A.P. Hyderabad has been requested to furnish his detailed remarks in the matter. In the reference 4th read above, the Director of Treasuries and Accounts, A.P. Hyderabad has stated that there are genuine reasons for her staying away from the country due to ill health. She has submitted the medical certificate vide her letter dated:21-10-2010 in which the Doctor has indicated that the individual is currently under his intermittent medical care and will remain so, by June, 2011 and the individual has not completed two years of service within a continuous period of three years. Finally the DTA has requested to consider the appeal petition favourably based on the circumstances explained above, under Rule 17 (e) (1) of A.P. State and Subordinate Service Rules 1996.-2- 4. When the matter was referred to G.A.(Ser.C) Department , it was advised that as per Rule 17 (e) (ii) , the authority competent to entertain an appeal under clause (i) may, either of its own motion or otherwise, revise any order discharging a probationer under any of the provisions referred to in the said clause within one year of the date of such order. 5. After careful examination of the matter Government hereby order to reinstate Smt G.Vasundhara, Asst. Treasury Officer, Treasuries and Accounts Department into service duly regularizing her leave period and treating the period i.e. the discharged period from service as EOL. 6. The Director of Treasuries and Accounts, A.P. Hyderabad shall take necessary action to post the individual accordingly.
