From the Commissioner of Handlooms, Textiles & Apparel Export Parks, Hyderabad, Letter Rc.No.5264/2011-F2, dated 17-06-2011. *** O R D E R : And whereas, in the reference 6th read above, the Commissioner of Handlooms, Textiles and Apparel Export Parks, Hyderabad has stated that the Assistant Director (Handlooms and Textiles), Ongole has informed that the Elections to the Chowdeswari Handloom Weavers Co-operative Society Limited., Vagupalli were conducted on 08-06-2007 and the Managing Committee of the Society was elected on 11-06-2007. Some of the members of the Society have approached the Hon’ble Andhra Pradesh Co-operative Tribunal, Vijayawada on the Elections held on 08-06-2007 to the society in O.P.44/2007. The Honourable Andhra Pradesh Co-operative Tribunal, Vijayawada has issued orders on 25-11-2008 in the said O.P. and set-aside the election of the said Society and directed to conduct fresh Elections within 90 days and also directed the Assistant Director (Handlooms and Textiles), Ongole to make necessary arrangements for running day to day administration of the Society, as per the Andhra Pradesh Co-operative Societies Act, 1964 and Rules, till the election is held until new Managing Committee take charge. Aggrieved by the Andhra Pradesh Co-operative Tribunal orders, the elected Managing Committee filed Writ Petition before Honourable Andhra Pradesh High Court. The Honorable Andhra Pradesh High Court in their orders dated 27-01-2009 in W.P.M.P.No.997/2009 in W.P.No.791 of 2009 have issued the Stay Orders, on the orders passed by the Honourable Andhra Pradesh Co-operative Tribunal, Vijayawada to “the effect that the Person-in-Charge had already taken over the charge and running the Society. In view of the same there shall be status-quo, existing as on today pending further orders”. The Commissioner of Handlooms, Textiles & Apparel Export Parks, Andhra Pradesh, Hyderabad has further informed that the Assistant Director (Handlooms and Textiles), Ongole has appointed Person-in-Charge to the Society and extended the term from 05-01-2010 till 04-07-2011. 2. And whereas, the Commissioner of Handlooms, Textiles & Apparel Export Parks, Andhra Pradesh, Hyderabad requested the Government to ratify the action taken by Assistant Director (Handlooms and Textiles), Ongole, for appointment of Assistant Development Officer as Person-in- Charge to Chowdeswari Handloom Weavers Co-operative Society, Vagupalli beyond 4-1-2010 with effect from 05-01-2010 to 04-07-2011 and also accord permission to extend the term of the official Person-in-Charge for another six months from 05-07-2011, which is within the aggregate period of three years including the extended period. And whereas, the Government, after careful examination of the matter have decided to ratify the action taken by the Assistant Director (Handlooms and Textiles), Ongole, in having appointed the Assistant Development Officer as Person-in-Charge to Chowdeswari Handloom Weavers Co-operative Society, Vagupalli beyond period from 05-01-2010 to 04-07-2011 and also accorded permission to extend the term of the official Person-in-Charge for another six months from 05-07-2011. 4. In exercise of the powers conferred under section 32 (7) (a) of the Andhra Pradesh Co-operative Societies Act, 1964 (Act 7 of 1964), the Government hereby ratify the action taken by the Assistant Director (Handlooms and Textiles), Ongole, in having appointed the Assistant Development Officer as Person-in-Charge to Chowdeswari Handloom Weavers Co-operative Society, Vagupalli for the period from 05-01-2010 to 04-07-2011 and also accorded permission to extend the term of the official Person-in-Charge for another six months i.e., from 05-07-2011. 5. The Director, Handlooms & Textiles and Apparel Export Parks, Andhra Pradesh, Hyderabad shall take necessary action accordingly in the matter.
