ORDER:
In the G.Os. 1st to 3rd read above, Government have issued orders
approving the schemes for providing financial assistance of Rs.2.00,000/- towards
accidental death relief and Rs.30,000 for natural death in respect of the Building
and Other Construction Workers who are registered as beneficiaries with the
Andhra Pradesh Building and Other Construction Workers Welfare Board.
U/s 16(1) of Building and Other Construction Workers Regulations of
Employment & Conditions of service Act, 1996, a building worker who has been
registered as a beneficiary under this Act shall, until he attains the age of sixty
years, contribute to the fund at such rate per mensem as may be specified by the
State Government, by notification in the Official Gazette and different rates of
contribution may be specified for different classes of building workers. Provided
that the Board may, if satisfied that a beneficiary is unable to pay his contribution
due to any financial hardship, waive the payment of contribution for a period not
exceeding three months at a time. Further u/s 17 of Act when a beneficiary has not
paid his contribution under sub-section (1) of Section 16 for a continuous period of
not less than one year, he shall cease to be a beneficiary. Provided that if the
Secretary of the Board is satisfied that the non-payment of contribution was for a
reasonable ground and that the building worker is willing to deposit the arrears, he
may allow the building worker to deposit the contribution in arrears and on such
deposit being made, the registration of building worker shall stand restored.
The Secretary, Andhra Pradesh Building and Other Construction Workers’
Welfare Board in his letters 4th read above has stated that several representations
have been received from the Building and Other Construction Workers Unions that
their members were registered under Building and Other Construction workers Act
and their member ship period of one year is over. Due to lack of knowledge/
poverty and ignorance, the members could not renewed the membership for
subsequent years. Meanwhile certain construction workers met with accidents and
when the workers / their dependents approached, the Building and Other

Construction workers Welfare Board did not entertain the claims on the ground
that their membership has lapsed. He has, therefore, requested the Government
to permit the Board to extend accidental death relief and natural death relief to
these workers, as a special case, to avoid hardship to them.
The Government after careful examination hereby accord permission to the
Secretary, Andhra Pradesh Building and Other Construction Workers Welfare
Board to sanction the claims to the workers / their dependents who could not
renewed the membership subsequent years due to lack of knowledge and
ignorance as per the orders issued in the GOs first and second read above, an
humanitarian grounds as a special case to avoid hardship to the construction
workers and dependents of the deceased workers.
The Commissioner of Labour & Secretary, Andhra Pradesh Building &
Other Construction Workers Welfare Board shall take action accordingly.
